A BILL
To amend sections 101.531, 111.12, 149.09, and 149.0911
of the Revised Code to authorize the Secretary of2
State to distribute certain documents in an3
electronic format subject to certain conditions.4


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That sections 101.531, 111.12, 149.09, and 149.0915
of the Revised Code be amended to read as follows:6

       Sec. 101.531.  The material used in printingproducing bills7
shall be held and used to printproduce pamphlet laws and the8
session laws. The lines of each bill shall be numbered.9

       Sec. 111.12. The(A) Subject to division (B) of this10
section, the secretary of state shall compile and publish11
biennially in a paper, book, or other nonelectronic format12
twenty-five hundred copies of the election statistics of Ohio,13
four thousand copies of the official roster of federal, state, and14
county officers, and twenty-five hundred copies of the official15
roster of township and municipal officers.16

       (B)(1) The secretary of state may compile and publish17
biennially the election statistics of Ohio, the official roster of18
federal, state, and county officers, and the official roster of19
township and municipal officers in an electronic format under20
section 1306.20 of the Revised Code. Subject to division (B)(2)21
of this section, the secretary of state may do so instead of22
compiling and publishing these documents biennially in a paper,23
book, or other nonelectronic format in the numbers specified in24
division (A) of this section. If the secretary of state publishes25
these documents in an electronic format, any rules that the26
secretary of state adopts under section 1306.20 of the Revised27
Code relative to these documents in electronic format are not28
required to be consistent with the rules adopted by the department29
of administrative services under division (A) of section 1306.2130
of the Revised Code.31

       (2) Notwithstanding anything to the contrary in division (B)32
of section 1306.20 of the Revised Code, the secretary of state33
shall maintain the ability to compile and publish, and shall34
compile and publish, biennially in a paper, book, or other35
nonelectronic format copies of the election statistics of Ohio,36
the official roster of federal, state, and county officers, and37
the official roster of township and municipal officers for38
purposes of requests made under section 149.43 of the Revised Code39
for copies of those documents in such format. Subject to the40
applicable maximum number of copies required to be published under41
division (A) of this section, the secretary of state shall provide42
a copy of any of these documents in their paper, book, or other43
nonelectronic format to a party making such a request under44
section 149.43 of the Revised Code.45

       Sec. 149.09. (A) The secretary of state shall distribute46
the pamphlet laws in the following manner: one copy of each47
pamphlet law shall be forwarded to each county law library, one48
copy of each pamphlet law shall be forwarded to each county49
auditor, and one hundred copies of each pamphlet law shall be50
forwarded to the state library board, which shall forward to each51
library that receives publications under section 149.12 of the52
Revised Code one copy of each pamphlet law received. AnyThe53
secretary of state shall distribute any remaining copies of each54
pamphlet law received by the secretary of state shall be55
distributed by the secretary of state on the request of interested56
persons.57

       (B)(1) The secretary of state may produce and distribute the58
pamphlet laws in an electronic format under section 1306.20 of the59
Revised Code. If the secretary of state produces and distributes60
the pamphlet laws in an electronic format, any rules that the61
secretary of state adopts under section 1306.20 of the Revised62
Code relative to the pamphlet laws in electronic format are not63
required to be consistent with the rules adopted by the department64
of administrative services under division (A) of section 1306.2165
of the Revised Code. In those rules, the secretary of state shall66
establish a schedule for the electronic distribution of the67
pamphlet laws to county law libraries, county auditors, and the68
state library board in accordance with division (A) of this69
section and may authorize the compiling of one or more pamphlet70
laws in the same electronic distribution. 71

       (2) Notwithstanding anything to the contrary in division (B)72
of section 1306.20 of the Revised Code, the secretary of state73
shall maintain the ability to produce and distribute, and shall74
produce and distribute, in a nonelectronic format copies of the75
pamphlet laws for purposes of requests made under section 149.4376
of the Revised Code for copies in that format. The secretary of77
state shall provide a copy of a pamphlet law in its nonelectronic78
format to a party making such a request under section 149.43 of79
the Revised Code.80

       Sec. 149.091. The(A) Subject to division (B) of this81
section, the secretary of state shall compile, publish, and82
distribute either annually or biennially in a paper format a83
maximum of nine hundred copies of the session laws in permanently84
bound form, either annually or biennially. The permanently bound85
volumesannual or biennial publication shall contain copies of all86
enrolled acts and joint resolutions, and. The secretary of state87
shall containcause to be printed with each compilation of88
enrolled acts and joint resolutions distributed a subject index89
and, a table indicating Revised Code sections affected. The90
secretary of state shall cause to be printed in each volume, and91
the secretary of state's certificate that the laws, as assembled92
thereinso compiled and distributed, are true copies of the93
original enrolled billsacts or joint resolutions in the secretary94
of state's office.95

       The secretary of state shall distribute the permanently bound96
volumescompilations of the session laws in the following manner:97

       (A)(1) One hundred nine copies shall be forwarded to the98
clerk of the house of representatives.99

       (B)(2) Forty-three copies shall be forwarded to the clerk of100
the senate.101

       (C)(3) One copy shall be forwarded to each county auditor.102

       (D)(4) One copy shall be forwarded to each county law103
library.104

       (E)(5) Seventy-five copies shall be forwarded to the Ohio105
supreme court.106

       (F)(6) Two copies shall be forwarded to the division of the107
library of congress.108

       (G)(7) Two copies shall be forwarded to the state library.109

       (H)(8) Two copies shall be forwarded to the Ohio historical110
society.111

       (I)(9) Thirteen copies shall be forwarded to the legislative112
service commission.113

       (J)(10) Two hundred copies may be distributed, free of114
charge, to public officials.115

       (K)(11) Remaining copiescompilations may be sold by the116
secretary of state at a price to be determined by the department117
of administrative services, but suchthat selling price shall not118
exceed by ten per cent the cost of publication and distribution.119

       (B) The secretary of state annually or biennially may120
compile, publish, and distribute the session laws in an electronic121
format under section 1306.20 of the Revised Code. The secretary122
of state may do so instead of compiling and publishing the session123
laws as provided in division (A) of this section. If the124
secretary of state compiles and publishes the session laws in an125
electronic format, the following apply:126

       (1) Any rules that the secretary of state adopts under127
section 1306.20 of the Revised Code relative to the session laws128
in electronic format are not required to be consistent with the129
rules adopted by the department of administrative services under130
division (A) of section 1306.21 of the Revised Code.131

       (2) The session laws in electronic format shall include132
copies of all enrolled acts and joint resolutions and shall133
contain a subject index and a table indicating Revised Code134
sections affected.135

       (3) Each compilation of the session laws in electronic136
format shall include the secretary of state's certificate that the137
laws as so compiled and published are true copies of the original138
enrolled acts and joint resolutions in the secretary of state's139
office.140

       (4) The session laws may be distributed in an electronic141
format to an individual or entity listed in divisions (A)(1) to142
(9) of this section in a lesser number than that prescribed in the143
applicable division if the individual or entity consents to the144
lesser distribution.145

       (5) Notwithstanding the maximum number of compilations146
permitted to be distributed under division (A)(10) of this147
section, the session laws may be distributed in an electronic148
format to public officials free of charge.149

       (6) Subject to the selling price limitation of division150
(A)(11) of this section, the session laws may be sold in an151
electronic format to individuals or entities not covered by152
divisions (A)(1) to (10) of this section.153

       Section 2. That existing sections 101.531, 111.12, 149.09,154
and 149.091 of the Revised Code are hereby repealed.155
