A BILL
To amend sections 101.531, 111.12, 149.09, and 149.0911
of the Revised Code to authorize the Secretary of2
State to distribute certain documents in an3
electronic format subject to certain conditions.4


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That sections 101.531, 111.12, 149.09, and 149.0915
of the Revised Code be amended to read as follows:6

       Sec. 101.531.  The material used in printingproducing bills7
shall be held and used to printproduce pamphlet laws and the8
session laws. The lines of each bill shall be numbered.9

       Sec. 111.12. The(A) Subject to division (B) of this10
section, the secretary of state shall compile and publish11
biennially in a paper, book, or other nonelectronic format12
twenty-five hundred copies of the election statistics of Ohio,13
four thousand copies of the official roster of federal, state, and14
county officers, and twenty-five hundred copies of the official15
roster of township and municipal officers.16

       (B)(1) The secretary of state may compile and publish17
biennially the election statistics of Ohio, the official roster of18
federal, state, and county officers, and the official roster of19
township and municipal officers in an electronic format under20
section 1306.20 of the Revised Code. Subject to division (B)(2)21
of this section, the secretary of state may do so instead of22
compiling and publishing these documents biennially in a paper,23
book, or other nonelectronic format in the numbers specified in24
division (A) of this section. 25

       (2) Notwithstanding anything to the contrary in division (B)26
of section 1306.20 of the Revised Code, the secretary of state27
shall maintain the ability to compile and publish, and shall28
compile and publish, biennially in a paper, book, or other29
nonelectronic format copies of the election statistics of Ohio,30
the official roster of federal, state, and county officers, and31
the official roster of township and municipal officers for32
purposes of requests made under section 149.43 of the Revised Code33
for copies of those documents in such format. Subject to the34
applicable maximum number of copies required to be published under35
division (A) of this section, the secretary of state shall provide36
a copy of any of these documents in their paper, book, or other37
nonelectronic format to a party making such a request under38
section 149.43 of the Revised Code.39

       Sec. 149.09. (A) The secretary of state shall distribute40
the pamphlet laws in the following manner: one copy of each41
pamphlet law shall be forwarded to each county law library, one42
copy of each pamphlet law shall be forwarded to each county43
auditor, and one hundred copies of each pamphlet law shall be44
forwarded to the state library board, which shall forward to each45
library that receives publications under section 149.12 of the46
Revised Code one copy of each pamphlet law received. AnyThe47
secretary of state shall distribute any remaining copies of each48
pamphlet law received by the secretary of state shall be49
distributed by the secretary of state on the request of interested50
persons.51

       (B)(1) The secretary of state may produce and distribute the52
pamphlet laws in an electronic format under section 1306.20 of the53
Revised Code. If the secretary of state produces and distributes54
the pamphlet laws in an electronic format, any rules that the55
secretary of state adopts under section 1306.20 of the Revised56
Code relative to the pamphlet laws in electronic format shall57
establish a schedule for the electronic distribution of the58
pamphlet laws to county law libraries, county auditors, and the59
state library board in accordance with division (A) of this60
section and may authorize the compiling of one or more pamphlet61
laws in the same electronic distribution. 62

       (2) Notwithstanding anything to the contrary in division (B)63
of section 1306.20 of the Revised Code, the secretary of state64
shall maintain the ability to produce and distribute, and shall65
produce and distribute, in a nonelectronic format copies of the66
pamphlet laws for purposes of requests made under section 149.4367
of the Revised Code for copies in that format. The secretary of68
state shall provide a copy of a pamphlet law in its nonelectronic69
format to a party making such a request under section 149.43 of70
the Revised Code.71

       Sec. 149.091. The(A) Subject to division (B) of this72
section, the secretary of state shall compile, publish, and73
distribute either annually or biennially in a paper format a74
maximum of nine hundred copies of the session laws in permanently75
bound form, either annually or biennially. The permanently bound76
volumesannual or biennial publication shall contain copies of all77
enrolled acts and joint resolutions, and. The secretary of state78
shall containcause to be printed with each compilation of79
enrolled acts and joint resolutions distributed a subject index80
and, a table indicating Revised Code sections affected. The81
secretary of state shall cause to be printed in each volume, and82
the secretary of state's certificate that the laws, as assembled83
thereinso compiled and distributed, are true copies of the84
original enrolled billsacts or joint resolutions in the secretary85
of state's office.86

       The secretary of state shall distribute the permanently bound87
volumescompilations of the session laws in the following manner:88

       (A)(1) One hundred nine copies shall be forwarded to the89
clerk of the house of representatives.90

       (B)(2) Forty-three copies shall be forwarded to the clerk of91
the senate.92

       (C)(3) One copy shall be forwarded to each county auditor.93

       (D)(4) One copy shall be forwarded to each county law94
library.95

       (E)(5) Seventy-five copies shall be forwarded to the Ohio96
supreme court.97

       (F)(6) Two copies shall be forwarded to the division of the98
library of congress.99

       (G)(7) Two copies shall be forwarded to the state library.100

       (H)(8) Two copies shall be forwarded to the Ohio historical101
society.102

       (I)(9) Thirteen copies shall be forwarded to the legislative103
service commission.104

       (J)(10) Two hundred copies may be distributed, free of105
charge, to public officials.106

       (K)(11) Remaining copiescompilations may be sold by the107
secretary of state at a price to be determined by the department108
of administrative services, but suchthat selling price shall not109
exceed by ten per cent the cost of publication and distribution.110

       (B) The secretary of state annually or biennially may111
compile, publish, and distribute the session laws in an electronic112
format under section 1306.20 of the Revised Code. The secretary113
of state may do so instead of compiling and publishing the session114
laws as provided in division (A) of this section. If the115
secretary of state compiles and publishes the session laws in an116
electronic format, the following apply:117

       (1) The session laws in electronic format shall include118
copies of all enrolled acts and joint resolutions and shall119
contain a subject index and a table indicating Revised Code120
sections affected.121

       (2) Each compilation of the session laws in electronic122
format shall include the secretary of state's certificate that the123
laws as so compiled and published are true copies of the original124
enrolled acts and joint resolutions in the secretary of state's125
office.126

       (3) The session laws may be distributed in an electronic127
format to an individual or entity listed in divisions (A)(1) to128
(9) of this section in a lesser number than that prescribed in the129
applicable division if the individual or entity consents to the130
lesser distribution.131

       (4) Notwithstanding the maximum number of compilations132
permitted to be distributed under division (A)(10) of this133
section, the session laws may be distributed in an electronic134
format to public officials free of charge.135

       (5) Subject to the selling price limitation of division136
(A)(11) of this section, the session laws may be sold in an137
electronic format to individuals or entities not covered by138
divisions (A)(1) to (10) of this section.139

       Section 2. That existing sections 101.531, 111.12, 149.09,140
and 149.091 of the Revised Code are hereby repealed.141
