A BILL
To amend sections 101.531, 111.12, 149.09, 149.091,1
and 149.11 of the Revised Code to authorize the2
Secretary of State to distribute certain documents3
in an electronic format.4


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That sections 101.531, 111.12, 149.09, 149.091,5
and 149.11 of the Revised Code be amended to read as follows:6

       Sec. 101.531.  The material used in printing or producing7
bills shall be held and used to print or produce pamphlet laws and8
the session laws. The lines of each bill shall be numbered.9

       Sec. 111.12. The(A) Except as otherwise provided in10
division (B) of this section, the secretary of state shall compile11
and publish biennially in a paper, book, or other nonelectronic12
format twenty-five hundred copies of the election statistics of13
Ohio, four thousand copies of the official roster of federal,14
state, and county officers, and twenty-five hundred copies of the15
official roster of township and municipal officers.16

       (B) The secretary of state may compile and publish17
biennially the election statistics of Ohio, the official roster of18
federal, state, and county officers, and the official roster of19
township and municipal officers in an electronic format instead of20
compiling and publishing these documents biennially in a paper,21
book, or other nonelectronic format in the numbers specified in22
division (A) of this section. If the secretary of state does so,23
the secretary of state shall maintain the ability to provide24
copies of the election statistics of Ohio, the official roster of25
federal, state, and county officers, and the official roster of26
township and municipal officers in accordance with section 149.4327
of the Revised Code.28

       Sec. 149.09. The(A) Except as otherwise provided in division29
(B) of this section, the secretary of state shall distribute the30
pamphlet laws in the following manner: one copy of each pamphlet31
law shall be forwarded to each county law library, one copy of32
each pamphlet law shall be forwarded to each county auditor, and33
one hundred copies of each pamphlet law shall be forwarded to the34
state library board, which shall forward to each library that35
receives publications under section 149.12 of the Revised Code one36
copy of each pamphlet law received. AnyThe secretary of state37
shall distribute any remaining copies of each pamphlet law38
received by the secretary of state shall be distributed by the39
secretary of state on the request of interested persons.40

       (B)(1) If the secretary of state chooses to distribute the41
pamphlet laws in an electronic format instead of distributing42
copies as provided in division (A) of this section in a paper43
format, the secretary of state shall notify the clerk of the house44
of representatives and the clerk of the senate that the printing45
of paper copies for purposes of this section is no longer46
necessary and that the secretary of state intends to produce and47
distribute the pamphlet laws in an electronic format. The48
secretary of state shall be responsible for paying for the cost of49
producing and distributing the pamphlet laws in an electronic50
format.51

        (2) The secretary of state shall establish, by rule, a52
schedule for the distribution of pamphlet laws in an electronic53
format to county law libraries, county auditors, and the state54
library board.55

        (3) The secretary of state may compile one or more pamphlet56
laws in the same electronic distribution.57

        (4) The secretary of state shall maintain the ability to58
provide copies of the pamphlet laws in accordance with section59
149.43 of the Revised Code.60

       Sec. 149.091. The(A) Except as otherwise provided in61
division (C) of this section, the secretary of state shall62
compile, publish, and distribute either annually or biennially in63
a paper format a maximum of nine hundred copies of the session64
laws in permanently bound form, either annually or biennially. The65
permanently bound volumesannual or biennial publication shall66
contain copies of all enrolled acts and joint resolutions, and.67
The secretary of state shall containcause to be printed with each68
compilation of enrolled acts and joint resolutions distributed a69
subject index and, a table indicating Revised Code sections70
affected. The secretary of state shall cause to be printed in71
each volume, and the secretary of state's certificate that the72
laws, as assembled thereincompiled and distributed, are true73
copies of the original enrolled billsacts or joint resolutions in74
the secretary of state's office.75

       The secretary of state shall distribute the permanently bound76
volumescompilations of the session laws in the following manner:77

       (A) One hundred nine copies shall be forwarded to the clerk78
of the house of representatives.79

       (B) Forty-three copies shall be forwarded to the clerk of80
the senate.81

       (C)(1) One copy shall be forwarded to each county auditor.82

       (D)(2) One copy shall be forwarded to each county law83
library.84

       (E) Seventy-five copies shall be forwarded to the Ohio85
supreme court.86

       (F) Two copies shall be forwarded to the division of the87
library of congress.88

       (G) Two copies shall be forwarded to the state library.89

       (H) Two copies shall be forwarded to the Ohio historical90
society.91

       (I) Thirteen copies shall be forwarded to the legislative92
service commission.93

       (J)(3) Two hundred copies may be distributed, free of94
charge, to public officials.95

       (K)(4) Remaining copiescompilations may be sold by the96
secretary of state at a price to be determined by the department97
of administrative services, but such selling pricethat shall not98
exceed by ten per cent the actual cost of publication and99
distribution.100

       (B) Notwithstanding division (C) of this section, the 101
secretary of state shall compile, publish, and distribute, either 102
annually or biennially, in permanently bound volumes, a minimum of 103
twenty-five copies of the session laws. The annual or biennial 104
volumes shall contain copies of all enrolled acts and joint 105
resolutions. The secretary of state shall cause to be printed 106
with each volume of enrolled acts and joint resolutions107
distributed a subject index, a table indicating Revised Code108
sections affected, and the secretary of state's certificate that109
the laws so assembled are true copies of the original enrolled110
acts or joint resolutions in the secretary of state's office.111

        The secretary of state shall distribute the permanently112
bound volumes of the session laws in the following manner:113

        (1) Five copies shall be forwarded to the clerk of the114
house of representatives.115

        (2) Five copies shall be forwarded to the clerk of the116
senate.117

        (3) Five copies shall be forwarded to the legislative118
service commission.119

        (4) Two copies shall be forwarded to the Ohio supreme120
court.121

        (5) Two copies shall be forwarded to the division of the122
library of congress.123

        (6) Two copies shall be forwarded to the state library.124

        (7) Two copies shall be forwarded to the Ohio historical125
society.126

        (8) Two copies shall be retained by the secretary of state.127

       (C) The secretary of state annually or biennially may128
compile, publish, and distribute the session laws in an electronic129
format instead of compiling and publishing the session laws as130
provided in division (A) of this section. If the secretary of131
state compiles and publishes the session laws in an electronic132
format, the following apply:133

       (1) The session laws in electronic format shall include134
copies of all enrolled acts and joint resolutions and shall135
contain a subject index and a table indicating Revised Code136
sections affected.137

       (2) Each compilation of the session laws in electronic138
format shall include the secretary of state's certificate that the139
laws so compiled and published are true copies of the original140
enrolled acts and joint resolutions in the secretary of state's141
office.142

       (3) The session laws may be distributed in an electronic143
format to public officials free of charge.144

       (4) The session laws may be sold in an electronic format to145
individuals or entities not specified in division (A) or (B) of146
this section. The price shall not exceed the actual cost of147
producing and distributing the session laws in an electronic148
format.149

       Sec. 149.11.  Any department, division, bureau, board, or150
commission of the state government issuing a report, pamphlet,151
document, or other publication intended for general public use and152
distribution, which publication is reproduced by duplicating153
processes such as mimeograph, multigraph, planograph, rotaprint,154
or multilith, or printed internally or through a contract awarded155
to any person, company, or the state printing division of the156
department of administrative services, shall cause to be delivered157
to the state library one hundred copies of suchthe publication,158
subject to the provisions of section 125.42 of the Revised Code.159

       The state library board shall distribute the publications so160
received as follows:161

       (A) Retain two copies in the state library;162

       (B) Send two copies to the document division of the library163
of congress;164

       (C) Send one copy to the Ohio historical society and to each165
public or college library in the state designated by the state166
library board to be a depository for state publications. In167
designating which libraries shall be depositories, the board shall168
select those libraries whichthat can best preserve suchthose169
publications and whichthat are so located geographically as will170
make the publications conveniently accessible to residents in all171
areas of the state;.172

       (D) Send one copy to each state in exchange for like173
publications of suchthat state.174

       The provisions of this section shall not apply to any175
publication of the general assembly or to the publications176
described in sections 149.07, 149.08, 149.09149.091, and 149.17177
of the Revised Code, except that the secretary of state shall178
forward to the document division of the library of congress two179
copies of all journals, seventwo copies of the session laws in180
bound form as provided for in section 149.09149.091 of the181
Revised Code, and seventwo copies of all appropriation laws in182
separate form.183

       Section 2. That existing sections 101.531, 111.12, 149.09,184
149.091, and 149.11 of the Revised Code are hereby repealed.185
