To enact section 3704.12 of the Revised Code to

prohibit the sale of gasoline blended with methyl

tertiary butyl ether (MTBE).

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

Section 1. That section 3704.12 of the Revised Code be	4
enacted to read as follows:	5

Sec. 3704.12. (A) Gasoline blended with methyl tertiary	6
butyl ether (MTBE) shall not be sold or offered for sale in this	7
state.	8

(B) The attorney general, upon the request of the	9
director of environmental protection, shall bring an action for	10
injunction in any court of competent jurisdiction against any	11
person violating or threatening to violate division (A) of this	12
section. The court has jurisdiction to grant prohibitory and	13
mandatory injunctive relief.	14
