A BILL
To amend sections 4501.31, 4506.11, 4507.13, and1
4507.52 and to enact section 4507.062 of the2
Revised Code to establish that any applicant for a3
driver's license, permit, or identification card4
under twenty-six years of age who is required to5
register with the Selective Service System is6
deemed to have given consent for the Bureau of7
Motor Vehicles to forward the necessary8
registration information to the Selective Service9
System, to require the Bureau to submit the10
applicable information to the Selective Service11
System, and to prohibit the display of a person's12
social security number on the person's driver's13
license, commercial driver's license, temporary14
instruction permit, or identification card unless15
the person requests that the number be displayed on16
the license or card.17


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1.  That sections 4501.31, 4506.11, 4507.13, and18
4507.52 be amended and section 4507.062 of the Revised Code be19
enacted to read as follows:20

       Sec. 4501.31.  (A) EveryNo driver's license, commercial21
driver's license, temporary instruction permit, and identification22
card issued by the registrar of motor vehicles or a deputy23
registrar on or after the effective date of this sectionon or24
after the effective date of this amendment shall display the25
social security number of the person to whom the license, permit,26
or card is issued unless the person to whom the license, permit,27
or card is to be issued specifically requests that the person's28
social security number not be displayed on the license, permit, or29
card. If federal law requires the person's social security number30
to be displayed on the license, permit, or card, the social31
security number shall be displayed on the license, permit, or card32
notwithstanding a request to not display the number pursuant to33
this division.34

       (B) For purposes of compliance with subparagraph (b)(1)(B)35
of section 656 of Public Law No. 104-208, as statutorily noted36
under 5 U.S.C.A. 301, the registrar shall do both of the37
following:38

       (1) Require every applicant for a driver's license,39
temporary instruction permit, commercial driver's license, or40
identification card to submit the applicant's social security41
number, if one has been assigned;42

       (2) Verify that the number is valid.43

       Sec. 4506.11.  (A) Every commercial driver's license shall44
be marked "commercial driver's license" or "CDL" and shall be of45
such material and so designed as to prevent its reproduction or46
alteration without ready detection, and, to this end, shall be47
laminated with a transparent plastic material. The commercial48
driver's license for licensees under twenty-one years of age shall49
have characteristics prescribed by the registrar of motor vehicles50
distinguishing it from that issued to a licensee who is twenty-one51
years of age or older. Every commercial driver's license shall52
display all of the following information:53

       (1) The name and residence address of the licensee;54

       (2) A color photograph of the licensee;55

       (3) A physical description of the licensee, including sex,56
height, weight, and color of eyes and hair;57

       (4) The licensee's date of birth;58

       (5) The licensee's social security number if the person has59
requested that the number be displayed in accordance with section60
4501.31 of the Revised Code or if federal law requires the social61
security number to be displayed and any number or other identifier62
the director of public safety considers appropriate and63
establishes by rules adopted under Chapter 119. of the Revised64
Code and in compliance with federal law. If the licensee requests65
that the licensee's commercial driver's license not display the66
licensee's social security number, the license shall not display67
the number unless display of the number is required by federal68
law.69

       (6) The licensee's signature;70

       (7) The classes of commercial motor vehicles the licensee is71
authorized to drive and any endorsements or restrictions relating72
to the licensee's driving of those vehicles;73

       (8) A space marked "blood type" in which the licensee may74
specify the licensee's blood type;75

       (9) The name of this state;76

       (10) The dates of issuance and of expiration of the license;77

       (11) If the licensee has certified willingness to make an78
anatomical donation under section 2108.04 of the Revised Code, any79
symbol chosen by the registrar of motor vehicles to indicate that80
the licensee has certified that willingness;81

       (12) If the licensee has executed a durable power of82
attorney for health care or a declaration governing the use or83
continuation, or the withholding or withdrawal, of life-sustaining84
treatment and has specified that the licensee wishes the license85
to indicate that the licensee has executed either type of86
instrument, any symbol chosen by the registrar to indicate that87
the licensee has executed either type of instrument;88

       (13) Any other information the registrar considers advisable89
and requires by rule.90

       (B) The registrar may establish and maintain a file of91
negatives of photographs taken for the purposes of this section.92

       (C) Neither the registrar nor any deputy registrar shall93
issue a commercial driver's license to anyone under twenty-one94
years of age that does not have the characteristics prescribed by95
the registrar distinguishing it from the commercial driver's96
license issued to persons who are twenty-one years of age or97
older.98

       Sec. 4507.062. (A)As used in this section, "license"99
includes a driver's license, commercial driver's license,100
temporary instruction permit, or identification card.101

       (B)Any person under twenty-six years of age who is required102
to register with the selective service system in accordance with103
the "Military Selective Service Act of 1967," 81 Stat. 100, 50104
U.S.C. App. 451 et seq., as amended, upon submission of an105
application for issuance or renewal of a license is deemed to have106
given consent for the bureau of motor vehicles to forward to the107
selective service system the necessary information for such108
registration.109

       (C)Upon receipt of an application for issuance or renewal of110
a license from any person under twenty-six years of age who is111
required to register with the selective service system, the bureau112
shall forward to the selective service system in an electronic113
format the personal information necessary for such registration.114

       (D) Every application for a license shall state that115
submission of the application will serve as the applicant's116
consent to registration with the selective service system, if so117
required by federal law.118

       (E) The bureau may accept money from the selective service119
system to pay any costs that the bureau incurs in implementing120
this section.121

       Sec. 4507.13.  (A) The registrar of motor vehicles shall122
issue a driver's license to every person licensed as an operator123
of motor vehicles other than commercial motor vehicles. No person124
licensed as a commercial motor vehicle driver under Chapter 4506.125
of the Revised Code need procure a driver's license, but no person126
shall drive any commercial motor vehicle unless licensed as a127
commercial motor vehicle driver.128

       Every driver's license shall display on it the distinguishing129
number assigned to the licensee and shall display the licensee's130
name,and date of birth, and, except as otherwise provided in this131
section, the licensee's social security number if such number has132
been assigned; the licensee's residence address and county of133
residence; a color photograph of the licensee; a brief description134
of the licensee for the purpose of identification; a facsimile of135
the signature of the licensee as it appears on the application for136
the license; a space marked "blood type" in which a licensee may137
specify the licensee's blood type; a notation, in a manner138
prescribed by the registrar, indicating any condition described in139
division (D)(3) of section 4507.08 of the Revised Code to which140
the licensee is subject; if the licensee has executed a durable141
power of attorney for health care or a declaration governing the142
use or continuation, or the withholding or withdrawal, of143
life-sustaining treatment and has specified that the licensee144
wishes the license to indicate that the licensee has executed145
either type of instrument, any symbol chosen by the registrar to146
indicate that the licensee has executed either type of instrument;147
and any additional information that the registrar requires by148
rule. ANo license shall display the licensee's social security149
number unless the licensee specifically requests that the150
licensee's social security number not be displayed on the license. 151
If federal law requires the licensee's social security number to152
be displayed on the license, the social security number shall be153
displayed on the license notwithstanding a request to not display154
the number pursuant to this section.155

       The driver's license for licensees under twenty-one years of156
age shall have characteristics prescribed by the registrar157
distinguishing it from that issued to a licensee who is twenty-one158
years of age or older, except that a driver's license issued to a159
person who applies no more than thirty days before the applicant's160
twenty-first birthday shall have the characteristics of a license161
issued to a person who is twenty-one years of age or older.162

       The driver's license issued to a temporary resident shall163
contain the word "nonrenewable" and shall have any additional164
characteristics prescribed by the registrar distinguishing it from165
a license issued to a resident.166

       Every driver's or commercial driver's license displaying a167
motorcycle operator's endorsement and every restricted license to168
operate a motor vehicle also shall display the designation169
"novice," if the endorsement or license is issued to a person who170
is eighteen years of age or older and previously has not been171
licensed to operate a motorcycle by this state or another172
jurisdiction recognized by this state. The "novice" designation173
shall be effective for one year after the date of issuance of the174
motorcycle operator's endorsement or license.175

       Each license issued under this section shall be of such176
material and so designed as to prevent its reproduction or177
alteration without ready detection and, to this end, shall be178
laminated with a transparent plastic material.179

       (B) Except in regard to a driver's license issued to a180
person who applies no more than thirty days before the applicant's181
twenty-first birthday, neither the registrar nor any deputy182
registrar shall issue a driver's license to anyone under183
twenty-one years of age that does not have the characteristics184
prescribed by the registrar distinguishing it from the driver's185
license issued to persons who are twenty-one years of age or186
older.187

       Sec. 4507.52.  Each identification card issued by the188
registrar of motor vehicles or a deputy registrar shall display a189
distinguishing number assigned to the cardholder, and shall190
display the following inscription:191

"STATE OF OHIO IDENTIFICATION CARD
192

       This card is not valid for the purpose of operating a motor193
vehicle. It is provided solely for the purpose of establishing194
the identity of the bearer described on the card, who currently is195
not licensed to operate a motor vehicle in the state of Ohio."196

       The identification card shall display substantially the same197
information as contained in the application and as described in198
division (A)(1) of section 4507.51 of the Revised Code, including199
but shall not display the cardholder's social security number200
unless the cardholder specifically requests that the cardholder's201
social security number not be displayed on the card. If federal202
law requires the cardholder's social security number to be203
displayed on the identification card, the social security number204
shall be displayed on the card notwithstanding a request to not205
display the number pursuant to this section. The identification206
card also shall display the color photograph of the cardholder. If207
the cardholder has executed a durable power of attorney for health208
care or a declaration governing the use or continuation, or the209
withholding or withdrawal, of life-sustaining treatment and has210
specified that the cardholder wishes the identification card to211
indicate that the cardholder has executed either type of212
instrument, the card also shall display any symbol chosen by the213
registrar to indicate that the cardholder has executed either type214
of instrument. The card shall be sealed in transparent plastic or215
similar material and shall be so designed as to prevent its216
reproduction or alteration without ready detection.217

       The identification card for persons under twenty-one years of218
age shall have characteristics prescribed by the registrar219
distinguishing it from that issued to a person who is twenty-one220
years of age or older, except that an identification card issued221
to a person who applies no more than thirty days before the222
applicant's twenty-first birthday shall have the characteristics223
of an identification card issued to a person who is twenty-one224
years of age or older.225

       Every identification card issued to a resident of this state226
shall expire, unless canceled or surrendered earlier, on the227
birthday of the cardholder in the fourth year after the date on228
which it is issued. Every identification card issued to a229
temporary resident shall expire in accordance with rules adopted230
by the registrar and is nonrenewable, but may be replaced with a231
new identification card upon the applicant's compliance with all232
applicable requirements. A cardholder may renew the cardholder's233
identification card within ninety days prior to the day on which234
it expires by filing an application and paying the prescribed fee235
in accordance with section 4507.50 of the Revised Code.236

       If a cardholder applies for a driver's or commercial driver's237
license in this state or another licensing jurisdiction, the238
cardholder shall surrender the cardholder's identification card to239
the registrar or any deputy registrar before the license is240
issued.241

       If a card is lost, destroyed, or mutilated, the person to242
whom the card was issued may obtain a duplicate by doing both of243
the following:244

       (A) Furnishing suitable proof of the loss, destruction, or245
mutilation to the registrar or a deputy registrar;246

       (B) Filing an application and presenting documentary247
evidence under section 4507.51 of the Revised Code.248

       Any person who loses a card and, after obtaining a duplicate,249
finds the original, immediately shall surrender the original to250
the registrar or a deputy registrar.251

       A cardholder may obtain a replacement identification card252
that reflects any change of the cardholder's name by furnishing253
suitable proof of the change to the registrar or a deputy254
registrar and surrendering the cardholder's existing card.255

       When a cardholder applies for a duplicate or obtains a256
replacement identification card, the cardholder shall pay a fee of257
two dollars and fifty cents. A deputy registrar shall be allowed258
an additional fee of two dollars and seventy-five cents259
commencing on July 1, 2001, three dollars and twenty-five cents260
commencing on January 1, 2003, and three dollars and fifty cents261
commencing on January 1, 2004, for issuing a duplicate or262
replacement identification card. A disabled veteran who is a263
cardholder and has a service-connected disability rated at one264
hundred per cent by the veterans' administration may apply to the265
registrar or a deputy registrar for the issuance of a duplicate or266
replacement identification card without payment of any fee267
prescribed in this section, and without payment of any lamination268
fee if the disabled veteran would not be required to pay a269
lamination fee in connection with the issuance of an270
identification card or temporary identification card as provided271
in division (B) of section 4507.50 of the Revised Code.272

       A duplicate or replacement identification card shall expire273
on the same date as the card it replaces.274

       The registrar shall cancel any card upon determining that the275
card was obtained unlawfully, issued in error, or was altered. The276
registrar also shall cancel any card that is surrendered to the277
registrar or to a deputy registrar after the holder has obtained a278
duplicate, replacement, or driver's or commercial driver's279
license.280

       No agent of the state or its political subdivisions shall281
condition the granting of any benefit, service, right, or282
privilege upon the possession by any person of an identification283
card. Nothing in this section shall preclude any publicly284
operated or franchised transit system from using an identification285
card for the purpose of granting benefits or services of the286
system.287

       No person shall be required to apply for, carry, or possess288
an identification card.289

       (C) Except in regard to an identification card issued to a290
person who applies no more than thirty days before the applicant's291
twenty-first birthday, neither the registrar nor any deputy292
registrar shall issue an identification card to a person under293
twenty-one years of age that does not have the characteristics294
prescribed by the registrar distinguishing it from the295
identification card issued to persons who are twenty-one years of296
age or older.297

       Section 2.  That existing sections 4501.31, 4506.11, 4507.13,298
and 4507.52 of the Revised Code are hereby repealed.299

       Section 3. Section 4507.062 of the Revised Code, as enacted300
by this act, shall take effect six months after the effective date301
of this act.302
