To amend sections 4501.31, 4506.11, 4507.13, and | 1 |
4507.52 and to enact section 4507.062 of the | 2 |
Revised Code to establish that any applicant for a | 3 |
driver's license, permit, or identification card | 4 |
under twenty-six years of age who is required to | 5 |
register with the Selective Service System is | 6 |
deemed to have given consent for the Bureau of | 7 |
Motor Vehicles to forward the necessary | 8 |
registration information to the Selective Service | 9 |
System, to require the Bureau to submit the | 10 |
applicable information to the Selective Service | 11 |
System, and to prohibit the display of a person's | 12 |
social security number on the person's driver's | 13 |
license, commercial driver's license, temporary | 14 |
instruction permit, or identification card unless | 15 |
the person requests that the number be displayed on | 16 |
the license or card. | 17 |
Section 1. That sections 4501.31, 4506.11, 4507.13, and | 18 |
4507.52 be amended and section 4507.062 of the Revised Code be | 19 |
enacted to read as follows: | 20 |
Sec. 4501.31. (A)

driver's license, temporary instruction permit, and identification | 22 |
card issued by the registrar of motor vehicles or a deputy | 23 |
registrar
| 24 |
after the effective date of this amendment shall display the | 25 |
social security number of the person to whom the license, permit, | 26 |
or card is issued unless the person to whom the license, permit, | 27 |
or card is to be issued specifically requests that the person's | 28 |
social security number
| 29 |
card. If federal law requires the person's social security number | 30 |
to be displayed on the license, permit, or card, the social | 31 |
security number shall be displayed on the license, permit, or card | 32 |
notwithstanding
| 33 |
this division. | 34 |
(B) For purposes of compliance with subparagraph (b)(1)(B) | 35 |
of section 656 of Public Law No. 104-208, as statutorily noted | 36 |
under 5 U.S.C.A. 301, the registrar shall do both of the | 37 |
following: | 38 |
(1) Require every applicant for a driver's license, | 39 |
temporary instruction permit, commercial driver's license, or | 40 |
identification card to submit the applicant's social security | 41 |
number, if one has been assigned; | 42 |
(2) Verify that the number is valid. | 43 |
Sec. 4506.11. (A) Every commercial driver's license shall | 44 |
be marked "commercial driver's license" or "CDL" and shall be of | 45 |
such material and so designed as to prevent its reproduction or | 46 |
alteration without ready detection, and, to this end, shall be | 47 |
laminated with a transparent plastic material. The commercial | 48 |
driver's license for licensees under twenty-one years of age shall | 49 |
have characteristics prescribed by the registrar of motor vehicles | 50 |
distinguishing it from that issued to a licensee who is twenty-one | 51 |
years of age or older. Every commercial driver's license shall | 52 |
display all of the following information: | 53 |
(1) The name and residence address of the licensee; | 54 |
(2) A color photograph of the licensee; | 55 |
(3) A physical description of the licensee, including sex, | 56 |
height, weight, and color of eyes and hair; | 57 |
(4) The licensee's date of birth; | 58 |
(5) The licensee's social security number if the person has | 59 |
requested that the number be displayed in accordance with section | 60 |
4501.31 of the Revised Code or if federal law requires the social | 61 |
security number to be displayed and any number or other identifier | 62 |
the director of public safety considers appropriate and | 63 |
establishes by rules adopted under Chapter 119. of the Revised | 64 |
Code and in compliance with federal law.

(6) The licensee's signature; | 70 |
(7) The classes of commercial motor vehicles the licensee is | 71 |
authorized to drive and any endorsements or restrictions relating | 72 |
to the licensee's driving of those vehicles; | 73 |
(8) A space marked "blood type" in which the licensee may | 74 |
specify the licensee's blood type; | 75 |
(9) The name of this state; | 76 |
(10) The dates of issuance and of expiration of the license; | 77 |
(11) If the licensee has certified willingness to make an | 78 |
anatomical donation under section 2108.04 of the Revised Code, any | 79 |
symbol chosen by the registrar of motor vehicles to indicate that | 80 |
the licensee has certified that willingness; | 81 |
(12) If the licensee has executed a durable power of | 82 |
attorney for health care or a declaration governing the use or | 83 |
continuation, or the withholding or withdrawal, of life-sustaining | 84 |
treatment and has specified that the licensee wishes the license | 85 |
to indicate that the licensee has executed either type of | 86 |
instrument, any symbol chosen by the registrar to indicate that | 87 |
the licensee has executed either type of instrument; | 88 |
(13) Any other information the registrar considers advisable | 89 |
and requires by rule. | 90 |
(B) The registrar may establish and maintain a file of | 91 |
negatives of photographs taken for the purposes of this section. | 92 |
(C) Neither the registrar nor any deputy registrar shall | 93 |
issue a commercial driver's license to anyone under twenty-one | 94 |
years of age that does not have the characteristics prescribed by | 95 |
the registrar distinguishing it from the commercial driver's | 96 |
license issued to persons who are twenty-one years of age or | 97 |
older. | 98 |
Sec. 4507.062. (A)As used in this section, "license" | 99 |
includes a driver's license, commercial driver's license, | 100 |
temporary instruction permit, or identification card. | 101 |
(B)Any person under twenty-six years of age who is required | 102 |
to register with the selective service system in accordance with | 103 |
the "Military Selective Service Act of 1967," 81 Stat. 100, 50 | 104 |
U.S.C. App. 451 et seq., as amended, upon submission of an | 105 |
application for issuance or renewal of a license is deemed to have | 106 |
given consent for the bureau of motor vehicles to forward to the | 107 |
selective service system the necessary information for such | 108 |
registration. | 109 |
(C)Upon receipt of an application for issuance or renewal of | 110 |
a license from any person under twenty-six years of age who is | 111 |
required to register with the selective service system, the bureau | 112 |
shall forward to the selective service system in an electronic | 113 |
format the personal information necessary for such registration. | 114 |
(D) Every application for a license shall state that | 115 |
submission of the application will serve as the applicant's | 116 |
consent to registration with the selective service system, if so | 117 |
required by federal law. | 118 |
(E) The bureau may accept money from the selective service | 119 |
system to pay any costs that the bureau incurs in implementing | 120 |
this section. | 121 |
Sec. 4507.13. (A) The registrar of motor vehicles shall | 122 |
issue a driver's license to every person licensed as an operator | 123 |
of motor vehicles other than commercial motor vehicles. No person | 124 |
licensed as a commercial motor vehicle driver under Chapter 4506. | 125 |
of the Revised Code need procure a driver's license, but no person | 126 |
shall drive any commercial motor vehicle unless licensed as a | 127 |
commercial motor vehicle driver. | 128 |
Every driver's license shall display on it the distinguishing | 129 |
number assigned to the licensee and shall display the licensee's | 130 |
name | 131 |

residence; a color photograph of the licensee; a brief description | 134 |
of the licensee for the purpose of identification; a facsimile of | 135 |
the signature of the licensee as it appears on the application for | 136 |
the license; a space marked "blood type" in which a licensee may | 137 |
specify the licensee's blood type; a notation, in a manner | 138 |
prescribed by the registrar, indicating any condition described in | 139 |
division (D)(3) of section 4507.08 of the Revised Code to which | 140 |
the licensee is subject; if the licensee has executed a durable | 141 |
power of attorney for health care or a declaration governing the | 142 |
use or continuation, or the withholding or withdrawal, of | 143 |
life-sustaining treatment and has specified that the licensee | 144 |
wishes the license to indicate that the licensee has executed | 145 |
either type of instrument, any symbol chosen by the registrar to | 146 |
indicate that the licensee has executed either type of instrument; | 147 |
and any additional information that the registrar requires by | 148 |
rule.

The driver's license issued to a temporary resident shall | 163 |
contain the word "nonrenewable" and shall have any additional | 164 |
characteristics prescribed by the registrar distinguishing it from | 165 |
a license issued to a resident. | 166 |
Every driver's or commercial driver's license displaying a | 167 |
motorcycle operator's endorsement and every restricted license to | 168 |
operate a motor vehicle also shall display the designation | 169 |
"novice," if the endorsement or license is issued to a person who | 170 |
is eighteen years of age or older and previously has not been | 171 |
licensed to operate a motorcycle by this state or another | 172 |
jurisdiction recognized by this state. The "novice" designation | 173 |
shall be effective for one year after the date of issuance of the | 174 |
motorcycle operator's endorsement or license. | 175 |
Each license issued under this section shall be of such | 176 |
material and so designed as to prevent its reproduction or | 177 |
alteration without ready detection and, to this end, shall be | 178 |
laminated with a transparent plastic material. | 179 |
(B) Except in regard to a driver's license issued to a | 180 |
person who applies no more than thirty days before the applicant's | 181 |
twenty-first birthday, neither the registrar nor any deputy | 182 |
registrar shall issue a driver's license to anyone under | 183 |
twenty-one years of age that does not have the characteristics | 184 |
prescribed by the registrar distinguishing it from the driver's | 185 |
license issued to persons who are twenty-one years of age or | 186 |
older. | 187 |
Sec. 4507.52. Each identification card issued by the | 188 |
registrar of motor vehicles or a deputy registrar shall display a | 189 |
distinguishing number assigned to the cardholder, and shall | 190 |
display the following inscription: | 191 |

This card is not valid for the purpose of operating a motor | 193 |
vehicle. It is provided solely for the purpose of establishing | 194 |
the identity of the bearer described on the card, who currently is | 195 |
not licensed to operate a motor vehicle in the state of Ohio." | 196 |
The identification card shall display substantially the same | 197 |
information as contained in the application and as described in | 198 |
division (A)(1) of section 4507.51 of the Revised Code,

but shall not display the cardholder's social security number | 200 |
unless the cardholder specifically requests that the cardholder's | 201 |
social security number

indicate that the cardholder has executed either type of | 212 |
instrument, the card also shall display any symbol chosen by the | 213 |
registrar to indicate that the cardholder has executed either type | 214 |
of instrument. The card shall be sealed in transparent plastic or | 215 |
similar material and shall be so designed as to prevent its | 216 |
reproduction or alteration without ready detection. | 217 |
The identification card for persons under twenty-one years of | 218 |
age shall have characteristics prescribed by the registrar | 219 |
distinguishing it from that issued to a person who is twenty-one | 220 |
years of age or older, except that an identification card issued | 221 |
to a person who applies no more than thirty days before the | 222 |
applicant's twenty-first birthday shall have the characteristics | 223 |
of an identification card issued to a person who is twenty-one | 224 |
years of age or older. | 225 |
Every identification card issued to a resident of this state | 226 |
shall expire, unless canceled or surrendered earlier, on the | 227 |
birthday of the cardholder in the fourth year after the date on | 228 |
which it is issued. Every identification card issued to a | 229 |
temporary resident shall expire in accordance with rules adopted | 230 |
by the registrar and is nonrenewable, but may be replaced with a | 231 |
new identification card upon the applicant's compliance with all | 232 |
applicable requirements. A cardholder may renew the cardholder's | 233 |
identification card within ninety days prior to the day on which | 234 |
it expires by filing an application and paying the prescribed fee | 235 |
in accordance with section 4507.50 of the Revised Code. | 236 |
If a cardholder applies for a driver's or commercial driver's | 237 |
license in this state or another licensing jurisdiction, the | 238 |
cardholder shall surrender the cardholder's identification card to | 239 |
the registrar or any deputy registrar before the license is | 240 |
issued. | 241 |
If a card is lost, destroyed, or mutilated, the person to | 242 |
whom the card was issued may obtain a duplicate by doing both of | 243 |
the following: | 244 |
(A) Furnishing suitable proof of the loss, destruction, or | 245 |
mutilation to the registrar or a deputy registrar; | 246 |
(B) Filing an application and presenting documentary | 247 |
evidence under section 4507.51 of the Revised Code. | 248 |
Any person who loses a card and, after obtaining a duplicate, | 249 |
finds the original, immediately shall surrender the original to | 250 |
the registrar or a deputy registrar. | 251 |
A cardholder may obtain a replacement identification card | 252 |
that reflects any change of the cardholder's name by furnishing | 253 |
suitable proof of the change to the registrar or a deputy | 254 |
registrar and surrendering the cardholder's existing card. | 255 |
When a cardholder applies for a duplicate or obtains a | 256 |
replacement identification card, the cardholder shall pay a fee of | 257 |
two dollars and fifty cents. A deputy registrar shall be allowed | 258 |
an additional fee of two dollars and seventy-five cents | 259 |
commencing on July 1, 2001, three dollars and twenty-five cents | 260 |
commencing on January 1, 2003, and three dollars and fifty cents | 261 |
commencing on January 1, 2004, for issuing a duplicate or | 262 |
replacement identification card. A disabled veteran who is a | 263 |
cardholder and has a service-connected disability rated at one | 264 |
hundred per cent by the veterans' administration may apply to the | 265 |
registrar or a deputy registrar for the issuance of a duplicate or | 266 |
replacement identification card without payment of any fee | 267 |
prescribed in this section, and without payment of any lamination | 268 |
fee if the disabled veteran would not be required to pay a | 269 |
lamination fee in connection with the issuance of an | 270 |
identification card or temporary identification card as provided | 271 |
in division (B) of section 4507.50 of the Revised Code. | 272 |
A duplicate or replacement identification card shall expire | 273 |
on the same date as the card it replaces. | 274 |
The registrar shall cancel any card upon determining that the | 275 |
card was obtained unlawfully, issued in error, or was altered. The | 276 |
registrar also shall cancel any card that is surrendered to the | 277 |
registrar or to a deputy registrar after the holder has obtained a | 278 |
duplicate, replacement, or driver's or commercial driver's | 279 |
license. | 280 |
No agent of the state or its political subdivisions shall | 281 |
condition the granting of any benefit, service, right, or | 282 |
privilege upon the possession by any person of an identification | 283 |
card. Nothing in this section shall preclude any publicly | 284 |
operated or franchised transit system from using an identification | 285 |
card for the purpose of granting benefits or services of the | 286 |
system. | 287 |
No person shall be required to apply for, carry, or possess | 288 |
an identification card. | 289 |
(C) Except in regard to an identification card issued to a | 290 |
person who applies no more than thirty days before the applicant's | 291 |
twenty-first birthday, neither the registrar nor any deputy | 292 |
registrar shall issue an identification card to a person under | 293 |
twenty-one years of age that does not have the characteristics | 294 |
prescribed by the registrar distinguishing it from the | 295 |
identification card issued to persons who are twenty-one years of | 296 |
age or older. | 297 |
Section 2. That existing sections 4501.31, 4506.11, 4507.13, | 298 |
and 4507.52 of the Revised Code are hereby repealed. | 299 |
Section 3. Section 4507.062 of the Revised Code, as enacted | 300 |
by this act, shall take effect six months after the effective date | 301 |
