A BILL
To amend sections 2313.13 and 2313.24 of the Revised1
Code to modify the small county exception to the2
drawing, summoning, and service of jurors for a3
term or part of a term of a court of common pleas.4


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That sections 2313.13 and 2313.24 of the Revised5
Code be amended to read as follows:6

       Sec. 2313.13. (A) The court of common pleas may postpone the7
whole or a part of the time of service of a juror, after notice8
for service, to a later date during the same term or part of a9
term or to a subsequent term or part of a term of the same jury10
year or may excuse a juror, after notice for service, from service11
at that term for not more than three days at a time, where the12
exigencies of his business require his temporary excuse. The13
courtof a county or the judge of the court of common pleas of a14
county may also discharge, for the term of a court or for part of15
a term of a court, or excuse until a day certain, one or more16
jurors so notifiedsummoned for jury duty whose attendance is not17
required for the trial of issues at that term or part of a term,18
or until that day. Each19

       (B)(1) The court of common pleas of a county or a judge of20
the court of common pleas of a county may postpone the whole or a21
part of a juror's time of service on jury duty, after summoning22
the juror for jury duty, to either of the following:23

       (a) To a later date during the same term of court or part of24
a term of court;25

       (b) To a subsequent term of court or part of a term of court26
of the same jury year.27

       (2) Each juror so excused or whose time of service on jury28
duty is postponed until a day certainspecified date may be29
required to attend at the opening of court on that day, and30
thereafter on each day after that day until the juror is31
discharged, without further noticeadditional summons from the32
court.33

       (C) The court of common pleas of a county, or a judge of the34
court of common pleas of a county, may excuse until a specified35
date one or more jurors summoned for jury duty whose attendance is36
not required for the trial of issues until that day. Each juror37
excused until a specified date may be required to attend the38
opening of court on that day and on each day after that day until39
the juror is discharged, without additional summons from the40
court.41

       (D) The court of common pleas of a county or a judge of the42
court of common pleas of a county may excuse a juror, after43
summoning the juror for jury duty, from service on jury duty at44
that term of court for not more than three days at a time, if the45
exigencies of the juror's business require the juror's temporary46
excuse.47

       Sec. 2313.24. (A) The court of common pleas of a county, or48
a judge thereofof the court of common pleas of a county, shall49
specify by written order the number of jurors to be drawn for each50
term of that court, or part of a term,of that court when the term51
is divided into parts, to comply with sections 2313.01 to 2313.4652
of the Revised Code. A proportionate53

       (B) A portion of the number of jurors ordered for a term or54
part of a termto be drawn pursuant to division (A) of this55
section shall be first drawn and shall be summoned to be present56
for duty during the first three consecutive calendar weeks of the57
term or part of a term, and the. The same number of jurors shall58
next be drawn and shall be summoned to be presentfor duty during59
the next three consecutive calendar weeks, and in like manner60
jurors. Jurors shall be drawn and summoned for each succeeding61
three weeks of the term of court. This section as to the division62
of terms and as to the service of jurors for three weeks63

       (C) Divisions (A) and (B) of this section shall not apply to64
counties with a population of less than onetwo hundred fifty65
thousand population in which cases the. If divisions (A) and (B)66
of this section do not apply to a county, the court of common67
pleas of that county or a judge of the court of common pleas of68
that county shall make rules in his ownthat apply to that county69
applicable to such mattersfor the drawing and summons of jurors.70

       (D) The commissioners of jurors may send by mail or otherwise71
to a juror whose name is drawn, a printed notice, informing him72
the juror that hethe juror has been drawn for jury duty and will73
be notifiedsummoned by the sheriff, and such. The notice may74
contain copies of suchthe portions of sections 2313.01 to 2313.4675
of the Revised Code, asthat the commissioners deemconsider76
advisable.77

       Section 2. That existing sections 2313.13 and 2313.24 of the78
Revised Code are hereby repealed.79
