A BILL
To amend sections 145.295, 742.21, 742.371, 742.375,1
3307.761, 3309.73, 5505.201, and 5505.40 and to2
enact sections 109.761, 145.2913, 742.214,3
3307.765, 3309.731, and 5505.41 of the Revised Code4
to permit multiple transfers of service credit and5
contributions between Ohio's state retirement6
systems and to require employers of peace officers7
to make reports to the Ohio Peace Officer Training8
Commission.9


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That sections 145.295, 742.21, 742.371, 742.375,10
3307.761, 3309.73, 5505.201, and 5505.40 be amended and sections11
109.761, 145.2913, 742.214, 3307.765, 3309.731, and 5505.41 of the12
Revised Code be enacted to read as follows:13

       Sec. 109.761. (A)(1) Each agency or entity that appoints or14
employs one or more peace officers shall report to the Ohio peace15
officer training commission all of the following that occur on or16
after the effective date of this section:17

       (a) The appointment or employment of any person to serve the18
agency or entity as a peace officer in any full-time, part-time,19
reserve, auxiliary, or other capacity;20

       (b) The termination, resignation, felony conviction, or death21
of any person who has been appointed to or employed by the agency22
or entity as a peace officer in any full-time, part-time, reserve,23
auxiliary, or other capacity and is serving the agency or entity24
in any of those peace officer capacities.25

       (2) An agency or entity shall make each report required by26
this division not later than ten days after the occurrence of the27
event being reported. The agency or entity shall make the report28
in the manner and format prescribed by the executive director of29
the Ohio peace officer training commission.30

       (B) Each agency or entity that appoints or employs one or31
more peace officers shall annually provide to the Ohio peace32
officer training commission a roster of all persons who have been33
appointed to or employed by the agency or entity as peace officers34
in any full-time, part-time, reserve, auxiliary, or other capacity35
and are serving, or during the year covered by the report have36
served, the agency or entity in any of those peace officer37
capacities. The agency or entity shall provide the roster in the38
manner and format, and by the date, prescribed by the executive39
director of the Ohio peace officer training commission.40

       (C) The Ohio peace officer training commission shall41
prescribe the manner and format of making reports under division42
(A) of this section and providing annual rosters under division43
(B) of this section and shall prescribe the date by which the44
annual rosters must be provided.45

       Sec. 145.295.  (A) As used in this section, "militaryand46
section 145.2913 of the Revised Code:47

       (1) "Uniform retirement system" or "uniform system" means48
the Ohio police and fire pension fund or state highway patrol49
retirement system.50

       (2) "Military service credit" means credit purchased or51
obtained under this chapter or Chapter 742. or 5505. of the52
Revised Code for service in the armed forces of the United States.53

       (B) A member of the public employees retirement system who54
has contributions on deposit with, but is no longer contributing55
to, the Ohio police and fire pension fund or state highway patrol56
a uniform retirement system shall, in computing years of service,57
be given full credit for service credit earned under Chapter 742.58
or 5505. of the Revised Code or for military service credit if a59
transfer to the public employees retirement system is made under60
this division. At the request of the member, the Ohio police and61
fire pension fund or the state highway patrol retirementuniform62
system shall transfer to the public employees retirement system,63
for each year of service, the sum of the following:64

       (1) An amount equal to the member's accumulated65
contributions to the fund oruniform system making the transfer,66
and any payments by the member for military service credit, and67
any amounts paid under section 742.375 or 5505.201 of the Revised68
Code to purchase service credit;69

       (2) An amount equal to the lesser of the employer's70
contributions to the Ohio police and fire pension fund or state71
highway patrol retirementuniform system or the amount that would72
have been contributed by the employer for the service had the73
member been employed by the member's current employer as a member74
of the public employees retirement system at the time the credit75
was earned;76

       (3) Interest, determined as provided in division (H) of this77
section, on the amounts specified in divisions (B)(1) and (2) of78
this section for the period from the last day of the year for79
which the service credit in the transferring fund oruniform80
system was earned or in which payment was made forthe military81
service credit or credit under section 742.375 or 5505.201 of the82
Revised Code was purchased or obtained to the date the transfer is83
made.84

       (C) A member of the public employees retirement system who85
has at least eighteen months of contributing service credit with86
the public employees retirement system, who is a former member of87
the Ohio police and fire pension fund or state highway patrola88
uniform retirement system, and who has received a refund of the89
member's accumulated contributions to that fund oruniform system90
shall, in computing years of service, be given full credit for91
service credit earned under Chapter 742. or 5505. of the Revised92
Code or for military service credit if, for each year of service,93
the public employees retirement system receives the sum of the94
following:95

       (1) An amount, which shall be paid by the member, equal to96
the amount refunded by the Ohio police and fire pension fund or97
the state highway patrol retirementuniform system to the member98
for that year for accumulated contributions and payments for99
military service credit, with interest at a rate established by100
the public employees retirement board on that amount from the date101
of the refund to the date of the payment;102

       (2) Interest, which shall be transferred by the Ohio police103
and fire pension fund or state highway patrol retirementuniform104
system, on the amount refunded to the member that is attributable105
to the year of service from the last day of the year for which the106
service credit was earned or in which payment was made for107
military service credit to the date the refund was made;108

       (3) An amount, which shall be transferred by the Ohio police109
and fire pension fund or state highway patrol retirementuniform110
system, equal to the lesser of the employer's contributions to the111
Ohio police and fire pension fund or state highway patrol112
retirementuniform system or the amount that would have been113
contributed by the employer for the service had the member been114
employed by the member's current employer as a member of the115
public employees retirement system at the time the credit was116
earned, with interest on that amount from the last day of the year117
for which the service credit was earned or in which payment was118
made for military service credit to the date of the transfer.119

       On receipt of payment from the member, the public employees120
retirement system shall notify the Ohio police and fire pension121
fund or the state highway patrol retirementuniform system, which,122
on receipt of the notice, shall make the transfer required by this123
division. Interest shall be determined as provided in division124
(H) of this section.125

       (D) A member of the public employees retirement system who126
purchased credit under former division (A)(1) of this section, as127
it existed before August 25, 1995, for service as a member of the128
Ohio police and fire pension fund or state highway patrola129
uniform retirement system may elect to have the amount the member130
paid for this service credit refunded to the member under this131
division if the member agrees to repurchase this service credit132
pursuant to division (C) of this section.133

       (E) Service credit purchased or otherwise obtained under134
this section shall be considered the equivalent of Ohio service135
credit.136

       A member may choose to purchase only part of the credit the137
member is eligible to purchase under division (C) of this section138
in any one payment, subject to rules of the public employees139
retirement board. A member is ineligible to purchase or otherwise140
obtain credit under this section for service to be used in141
calculation of any retirement benefit currently being paid or142
payable to the member in the future under any other retirement143
program or for service credit that may be transferred under144
section 145.2913 of the Revised Code.145

       (F) If a member of the public employees retirement system146
who is not a current contributor elects to receive credit under147
section 742.21 or 5505.40 of the Revised Code for service for148
which the member contributed to the retirement system or made149
payment for military service credit, the retirement system shall150
transfer to the Ohio police and fire pension fund or the state151
highway patrol retirement system, as applicable, the amount152
specified in division (D) of section 742.21 or division (B)(2) of153
section 5505.40 of the Revised Code.154

       (G) A member of the public employees retirement system who155
earned service credit in the public employees retirement system156
for full-time service as a township or municipal police officer157
and received service credit in the Ohio police and fire pension158
fund under section 742.511 or 742.512 of the Revised Code for such159
service may elect to have the credit restored as public employees160
retirement system service credit by paying the public employees161
retirement system an amount equal to the accumulated contributions162
paid by the member to the Ohio police and fire pension fund under163
section 742.511 or 742.512 of the Revised Code. When such an164
election is made, the Ohio police and fire pension fund shall165
transfer to the public employees retirement system the amount166
previously transferred under section 742.511 or 742.512 of the167
Revised Code from the public employees retirement system to the168
Ohio police and fire pension fund.169

       (H) Interest charged under this section shall be calculated170
separately for each year of service credit. Unless otherwise171
specified in this section, it shall be calculated at the lesser of172
the actuarial assumption rate for that year of the public173
employees retirement system or of the fund oruniform retirement174
system in which the credit was earned. The interest shall be175
compounded annually.176

       (I) At the request of the public employees retirement177
system, the Ohio police and fire pension fund or state highway178
patroluniform retirement system shall certify to the public179
employees retirement system a copy of the records of the service180
and contributions of a public employees retirement system member181
who seeks service credit under this section.182

       Sec. 145.2913. (A) As used in this section, "transferred183
service credit" means service credit purchased or obtained under184
section 742.21, 742.214, 742.375, 5505.201, 5505.40, or 5505.41 of185
the Revised Code prior to the date a member commenced the186
employment covered by the public employees retirement system for187
which the member is currently contributing to the system.188

       (B) A member of the public employees retirement system who189
has contributions on deposit with, but is no longer contributing190
to, a uniform retirement system shall, in computing years of191
service, be given full credit for transferred service credit if a192
transfer to the public employees retirement system is made under193
this section. At the request of a member, the uniform system194
shall transfer to the public employees retirement system the sum195
of the following:196

       (1) An amount equal to the amounts transferred to the197
uniform system under section 742.21, 742.214, 742.375, 5505.201,198
5505.40, or 5505.41 of the Revised Code;199

       (2) Interest, determined as provided in division (E) of this200
section, on the amount specified in division (B)(1) of this201
section for the period from the last day of the year in which the202
transfer under section 742.21, 742.214, 742.375, 5505.201,203
5505.40, or 5505.41 of the Revised Code was made to the date a204
transfer is made under this section.205

       (C) A member of the public employees retirement system with206
at least eighteen months of contributing service credit with the207
public employees retirement system who has received a refund of208
contributions to a uniform retirement system shall, in computing209
years of service, be given full credit for transferred service210
credit if, for each year of service, the public employees211
retirement system receives the sum of the following:212

       (1) An amount, which shall be paid by the member, equal to213
the amount refunded by the uniform system to the member for that214
year for transferred service credit, with interest on that amount215
from the date of the refund to the date a payment is made under216
this section;217

       (2) Interest, which shall be transferred by the uniform218
system, on the amount refunded to the member for the period from219
the last day of the year in which the transfer under section220
742.21, 742.214, 742.375, 5505.201, 5505.40, or 5505.41 of the221
Revised Code was made to the date the refund was made;222

       (3) If the uniform system retained any portion of the amount223
transferred under section 742.21, 742.214, 742.375, 5505.201,224
5505.40, or 5505.41 of the Revised Code, an amount, which shall be225
transferred by the uniform system, equal to the amount retained,226
with interest on that amount for the period from the last day of227
the year in which the transfer under section 742.21, 742.214,228
742.375, 5505.201, 5505.40, or 5505.41 of the Revised Code was229
made to the date a transfer is made under this section.230

       On receipt of payment from the member, the public employees231
retirement system shall notify the uniform system, which, on232
receipt of the notice, shall make the transfer required by this233
division. Interest shall be determined as provided in division234
(E) of this section.235

       (D) Service credit purchased or obtained under this section236
shall be considered the equivalent of Ohio service credit. A237
member may choose to purchase only part of the credit the member238
is eligible to purchase under division (C) of this section in any239
one payment, subject to rules adopted by the public employees240
retirement board. A member is ineligible to purchase or obtain241
service credit under this section for service to be used in the242
calculation of any retirement benefit currently being paid or243
payable to the member in the future under any other retirement244
program or for service credit that may be purchased or obtained245
under section 145.295 of the Revised Code.246

       (E) Interest charged under this section shall be calculated247
separately for each year of service credit at the lesser of the248
actuarial assumption rate for that year of the public employees249
retirement system or of the uniform retirement system to which the250
credit was transferred under section 742.21, 742.214, 742.375,251
5505.201, 5505.40, or 5505.41 of the Revised Code. The interest252
shall be compounded annually.253

       (F) Any amounts transferred or paid under divisions (B) and254
(C) of this section that are attributable to contributions made by255
the member or to amounts paid to purchase service credit shall be256
credited to the employees' savings fund created under section257
145.23 of the Revised Code. Any remaining amounts shall be258
credited to one or more of the funds created under that section as259
determined by the board.260

       (G) At the request of the public employees retirement261
system, the uniform retirement system shall certify to the public262
employees retirement system a copy of the records of the service263
and contributions of a public employees retirement system member264
who seeks service credit under this section. The uniform265
retirement system shall specify the portions of the amounts266
transferred that are attributable to employee contributions,267
employer contributions, and interest.268

       (H) If a member of the public employees retirement system269
who is not a current contributor elects to receive service credit270
under section 742.214 or 5505.41 of the Revised Code for271
transferred service credit, as defined in those sections, the272
system shall transfer to the uniform retirement system, as273
applicable, the amount specified in division (B) or (C) of section274
742.214 or division (B) or (C) of section 5505.41 of the Revised275
Code.276

       (I) The board may adopt rules to implement this section.277


       Sec.  742.21.  (A) As used in this section and sections279
742.211 to 742.213742.214 of the Revised Code:280

       (1) "Full-time service" has the meaning established by rule281
of the board of trustees of the Ohio police and fire pension fund.282

       (2) "Military service credit" means credit for service in283
the armed forces of the United States purchased or obtained from284
the fund, or from the Cincinnati retirement system, public285
employees retirement system, school employees retirement system,286
or state teachersa non-uniform retirement system.287

       (3) "Non-uniform retirement system" or "non-uniform system"288
means the public employees retirement system, school employees289
retirement system, or state teachers retirement system.290

       (B) Unless section 742.212 of the Revised Code applies and291
except as provided in division (I) of this section, in computing292
the pension and benefits payable under section 742.37 or 742.39 of293
the Revised Code, the Ohio police and fire pension fund shall give294
a member of the fund who is in the active service of a police or295
fire department and is not receiving a pension or benefit payment296
from the fund full credit for service credit earned for full-time297
service as a member of the Cincinnati retirement system or298
purchased or obtained as military service credit if, for each299
year of service credit, the fund receives the sum of the300
following:301

       (1) An amount, which shall be paid by the member, equal to302
the amount withdrawn by the member from the retirement system that303
is attributable to the year of service credit, with interest at a304
rate established by the board on that amount from the date of305
withdrawal to the date of payment;306

       (2) Interest, which shall be paid either by the member or307
the Cincinnati retirement system, on the amount withdrawn by the308
member from the Cincinnati retirement system that is attributable309
to the year of service from the last day of the year for which the310
service credit was earned or in which payment was made for311
military service credit to the date the withdrawal was made;312

       (3) An amount, which shall be paid by either the member or313
the Cincinnati retirement system, equal to the lesser of the314
amount contributed by the employer to the Cincinnati retirement315
system for the year of service or the amount that would have been316
contributed by the employer for the year of service had the member317
been employed by the member's current employer as a member of a318
police or fire department at the time the credit was earned, with319
interest on that amount from the last day of the year for which320
the service credit was earned or in which payment was made for321
military service credit to the date the payment is made;322

       (4) If the member became a member of the fund on or after323
September 16, 1998, the amount, which shall be paid by the member,324
determined pursuant to division (I) of this section.325

       Interest shall be determined in accordance with division (H)326
of this section.327

       (C)(1) Except as provided in division (I) of this section,328
in computing the pension and benefits payable under section 742.37329
or 742.39 of the Revised Code, the fund shall give a member of the330
fund who is in the active service of a police or fire department,331
is not receiving a pension or benefit payment from the fund, and332
has withdrawn the member's contributions from the public employees333
retirement system, school employees retirement system, or state334
teachersa non-uniform retirement system full credit for service335
credit earned for full-time service as a member of the public336
employees retirement system, school employees retirement system,337
or state teachers retirementnon-uniform system or purchased or338
obtained as military service credit if, for each year of service,339
the fund receives the sum of the following:340

       (a) An amount, which shall be paid by the member, equal to341
the amount withdrawn by the member from the former retirement342
non-uniform system that is attributable to that year of service343
credit, with interest at a rate established by the board on that344
amount from the date of withdrawal to the date of payment;345

       (b) If the member is seeking credit for service under the346
public employees retirement system or state teachers retirement347
system, an amount, which shall be paid by the member, equal to the348
amount of any employer contributions and interest on employee349
contributions the member received under section 145.40 or 3307.563350
of the Revised Code;351

       (c) Interest, which shall be transferred by the former352
retirementnon-uniform system, on the amount withdrawn by the353
member from the retirementnon-uniform system that is attributable354
to the year of service from the last day of the year for which the355
service credit was earned or in which payment was made for356
military service credit to the date the withdrawal was made;357

       (d) An amount, which shall be transferred by the former358
retirementnon-uniform system, equal to the lesser of the amount359
contributed by the employer to the retirementnon-uniform system360
for the year of service or the amount that would have been361
contributed by the employer for the year of service had the member362
been employed by the member's current employer as a member of a363
police or fire department at the time the credit was earned, with364
interest on thethat amount transferred from the last day of the365
year for which the service credit was earned or in which payment366
was made for military service credit to the date the transfer is367
made;368

       (e) If the member became a member of the fund on or after369
September 16, 1998, the amount, which shall be paid by the member,370
determined pursuant to division (I) of this section.371

       (2) On receipt of payment from the member, the fund shall372
notify the former retirementnon-uniform system, and on receipt of373
the notice, the retirementnon-uniform system shall make the374
transfer. Interest shall be determined in accordance with375
division (H) of this section.376

       (3) The amount transferred under division (C)(1) of this377
section by the public employees retirement system or state378
teachers retirement system shall not include any amount of379
employer contributions and interest on employee contributions the380
member received under section 145.40 or 3307.563 of the Revised381
Code.382

       (D) Except as provided in division (I) of this section, in383
computing the pension and benefits payable under section 742.37 or384
742.39 of the Revised Code, the fund shall give a member of the385
fund who is in the active service of a police or fire department,386
is not receiving a pension or benefit from the fund, and has387
contributions on deposit with the public employees retirement388
system, school employees retirement system, or state teachersa389
non-uniform retirement system full credit for service credit390
earned for full-time service as a member of one of those391
retirement systems,the non-uniform system or service credit392
purchased or obtained as military service credit, and any service393
credit obtained under section 145.295, 3307.761, or 3309.73 of394
the Revised Code for service for which contributions were made to395
the state highway patrol retirement system. The credit shall be396
given if both of the following occur:397

       (1) The retirementnon-uniform system transfers to the fund,398
for each year of service, the sum of the following:399

       (a) The amount, contributed by the member or, in the case400
of military service credit, paid by the member, that is401
attributable to that service;402

       (b) An amount equal to the lesser of the amount contributed403
by the employer to the retirementnon-uniform system for the year404
of service or the amount that would have been contributed by the405
employer for the year of service had the member been employed by406
the member's current employer as a member of a police or fire407
department at the time the credit was earned;408

       (c) An amount equal to any amount received by the retirement409
system under section 145.295, 3307.761, or 3309.73 of the Revised410
Code;411

       (d) Interest on the amounts specified in divisions412
(D)(1)(a),and (b), and (c) of this section from the last day of413
the year for which the service credit in the transferring414
retirementnon-uniform system was earned or in which payment was415
made for military service credit or credit under section 145.295,416
3307.761, or 3309.73 of the Revised Code was purchased or obtained417
to the date the transfer is made.418

       (2) If the member became a member of the fund on or after419
September 16, 1998, the member pays the amount determined pursuant420
to division (I) of this section.421

       On receipt of a request from the member, the appropriate422
retirementnon-uniform system shall make the transfer specified in423
division (D)(1) of this section. Interest shall be determined in424
accordance with division (H) of this section.425

       (E) Subject to board rules, a member of the fund may choose426
to purchase in any one payment only part of the credit the member427
is eligible to purchase under division (B) or (C)(1) of this428
section.429

       (F) At the request of the fund, the public employees430
retirement system, school employees retirement system, state431
teachersnon-uniform retirement system, or Cincinnati retirement432
system shall certify to the fund a copy of the records of the433
service and contributions of a member of the fund who seeks434
service credit under this section.435

       (G) A member of the fund is ineligible to receive credit436
under this section for service that is used in the calculation of437
any retirement benefit currently being paid or payable in the438
future to the member under any other retirement program, or439
service rendered concurrently with any other period for which440
service credit has already been granted, or for service credit441
that may be transferred under section 742.214 of the Revised Code.442

       (H) Interest charged under this section shall be calculated443
separately for each year of service credit. Unless otherwise444
specified in this section, it shall be calculated at the lesser of445
the actuarial assumption rate for that year of the fund or of the446
retirement system in which the credit was earned. The interest447
shall be compounded annually.448

       The board may, by rule, establish procedures for the receipt449
of service credit under this section.450

       (I) The amount to be paid pursuant to division (B)(4),451
(C)(4)(1)(e), or (D)(2) of this section or division (B)(2) or452
(C)(2)(b) of section 742.212 of the Revised Code is the sum of the453
following:454

       (1) An amount equal to the difference between the amount the455
member paid as employee contributions for the service and the456
amount the member would have paid had the member been employed by457
the member's current employer as a member of a police or fire458
department;459

       (2) An amount equal to the difference between the amount460
paid or transferred under division (B)(3), (C)(3)(1)(d), or461
(D)(1)(b) of this section or division (B)(2) or (C)(2)(b) of462
section 742.212 of the Revised Code and the amount that would have463
been contributed by the employer for the service had the member464
been employed by the member's current employer as a member of a465
police or fire department;466

       (3) Interest, determined in accordance with division (H) of467
this section, on the amounts specified in divisions (I)(1) and (2)468
of this section.469

       At the request of a member, in lieu of requiring payment of470
all or part of the amount determined under this division the fund471
may grant the member an amount of service credit under division472
(B), (C), or (D) of this section or division (B) or (C) of section473
742.212 of the Revised Code that is less than the amount for which474
the member is eligible. The service credit granted shall be the475
same percentage of the service credit for which the member is476
eligible that the amount the fund receives under division (B),477
(C), or (D) of this section or division (B) or (C) of section478
742.212 of the Revised Code is of the total amount it would479
receive under those divisions if the full amount determined under480
this division was paid.481

       (J)(1) Except as provided in division (J)(2) of this section482
and notwithstanding any contrary provision of this section, the483
board shall, in computing a pension or benefit under section484
742.37 or 742.39 of the Revised Code, give a member of the fund485
who is not receiving a pension or disability benefit from the fund486
full credit for service credit purchased under this section for487
service that was less than full-time service if the member488
provides evidence satisfactory to the board that, after receiving489
written notice from the fund indicating that the member would be490
permitted to purchase service credit for service that was less491
than full-time, the member changed or ceased the member's492
employment with the understanding that the credit identified in493
the notice would be used in computing a pension or benefit. If494
the board has canceled service credit purchased under this section495
for service that was less than full-time service and the member496
meets the requirements of division (J)(1) of this section, the497
board shall restore the service credit on repayment to the fund of498
the amount refunded to the member at the time of cancellation.499

       (2) If a member of the fund who is not receiving a pension500
or disability benefit from the fund purchased credit under this501
section for service that was less than full-time service and does502
not meet the requirements of division (J)(1) of this section, the503
board shall refund to the member any amounts paid to purchase the504
credit, with interest at a rate determined by the board from the505
date the member purchased the credit to the date of the refund.506

       (K) A member of the fund who has purchased service credit507
under this section, or the member's estate, is entitled to a508
refund of the amount or portion of the amount paid to purchase the509
credit if the purchased credit or portion of credit does not510
increase a pension or benefit payable under section 742.37 or511
742.39 of the Revised Code. The refund cancels an equivalent512
amount of service credit.513

       (L) If a member or former member of the fund who is not a514
current contributor and has not received a refund of accumulated515
contributions elects to receive credit under section 145.295,516
3307.761, or 3309.73 of the Revised Code for service for which517
the member contributed to the fund or purchased as military518
service credit, the fund shall transfer to the public employees519
retirement system, school employees retirement system, or state520
teachersnon-uniform retirement system the amount specified in521
division (B) of section 145.295 of the Revised Code, division522
(B)(C) of section 3307.761 of the Revised Code, or division (B) of523
section 3309.73 of the Revised Code.524

       (M) The board shall adopt rules establishing a payroll525
deduction plan for the purchase of service credit under this526
section. The rules shall meet the requirements described in527
section 742.56 of the Revised Code.528

       Sec. 742.214. (A) As used in this section, "transferred529
service credit" means service credit purchased or obtained under530
section 145.295, 145.2913, 3307.761, 3307.765, 3309.73, or531
3309.731 of the Revised Code prior to the date a member commenced532
the employment covered by the Ohio police and fire pension fund533
for which the member is currently contributing to the fund.534

       (B) A member of the Ohio police and fire pension fund who is535
in the active service of a police or fire department and has536
contributions on deposit with, but is no longer contributing to, a537
non-uniform retirement system shall, in computing years of538
service, be given full credit for transferred service credit if a539
transfer to the Ohio police and fire pension fund is made under540
this section. At the request of a member, the non-uniform system541
shall transfer to the Ohio police and fire pension fund the sum of542
the following:543

       (1) An amount equal to the amounts transferred to the544
non-uniform system under section 145.295, 145.2913, 3307.761,545
3307.765, 3309.73, or 3309.731 of the Revised Code;546

       (2) Interest, determined as provided in division (E) of this547
section, on the amount specified in division (B)(1) of this548
section for the period from the last day of the year in which the549
transfer under section 145.295, 145.2913, 3307.761, 3307.765,550
3309.73, or 3309.731 of the Revised Code was made to the date a551
transfer is made under this section.552

       (C) A member of the fund with at least eighteen months of553
contributing service credit with the Ohio police and fire pension554
fund who is in the active service of a police or fire department555
and has received a refund of contributions to a non-uniform556
retirement system shall, in computing years of service, be given557
full credit for transferred service credit if, for each year of558
service, the Ohio police and fire pension fund receives the sum of559
the following:560

       (1) An amount, which shall be paid by the member, equal to561
the amount refunded by the non-uniform system to the member for562
that year for transferred service credit, with interest on that563
amount from the date of the refund to the date a payment is made564
under this section;565

       (2) Interest, which shall be transferred by the non-uniform566
system, on the amount refunded to the member for the period from567
the last day of the year in which the transfer under section568
145.295, 145.2913, 3307.761, 3307.765, 3309.73, or 3309.731 of the569
Revised Code was made to the date the refund was made;570

       (3) If the non-uniform system retained any portion of the571
amount transferred under section 145.295, 145.2913, 3307.761,572
3307.765, 3309.73, or 3309.731 of the Revised Code, an amount,573
which shall be transferred by the non-uniform system, equal to the574
amount retained, with interest on that amount for the period from575
the last day of the year in which the transfer under section576
145.295, 145.2913, 3307.761, 3307.765, 3309.73, or 3309.731 of the577
Revised Code was made to the date a transfer is made under this578
section.579

       On receipt of payment from the member, the Ohio police and580
fire pension fund shall notify the non-uniform system, which, on581
receipt of the notice, shall make the transfer required by this582
division. Interest shall be determined as provided in division583
(E) of this section.584

       (D) Service credit purchased or obtained under this section585
shall be used in computing the pension and benefits payable under586
section 742.37 or 742.39 of the Revised Code. A member may choose587
to purchase only part of the credit the member is eligible to588
purchase under division (C) of this section in any one payment,589
subject to rules adopted by the board of trustees of the Ohio590
police and fire pension fund. A member is ineligible to purchase591
or obtain service credit under this section for service to be used592
in the calculation of any retirement benefit currently being paid593
or payable to the member in the future under any other retirement594
program or for service credit that may be purchased or obtained595
under section 742.21 of the Revised Code.596

       (E) Interest charged under this section shall be calculated597
separately for each year of service credit at the lesser of the598
actuarial assumption rate for that year of the Ohio police and599
fire pension fund or of the non-uniform retirement system to which600
the credit was transferred under section 145.295, 145.2913,601
3307.761, 3307.765, 3309.73, or 3309.731 of the Revised Code. The602
interest shall be compounded annually.603

       (F) Any amounts transferred or paid under divisions (B) and604
(C) of this section that are attributable to contributions made by605
the member or to amounts paid to purchase service credit shall be606
credited to the police officers' contribution fund or607
firefighters' contribution fund created under section 742.59 of608
the Revised Code, as applicable. Any remaining amounts shall be609
credited to one or more of the funds created under that section as610
determined by the board.611

       (G) At the request of the Ohio police and fire pension fund,612
the non-uniform retirement system shall certify to the fund a copy613
of the records of the service and contributions of a member of the614
fund who seeks service credit under this section. The non-uniform615
retirement system shall specify the portions of the amounts616
transferred that are attributable to employee contributions,617
employer contributions, and interest.618

       (H) If a member of the fund who is not a current contributor619
elects to receive service credit under section 145.2913, 3307.765,620
or 3309.731 of the Revised Code for transferred service credit, as621
defined in those sections, the fund shall transfer to the622
non-uniform retirement system, as applicable, the amount specified623
in division (B) or (C) of section 145.2913, division (B) or (C) of624
section 3307.765, or division (B) or (C) of section 3309.731 of625
the Revised Code.626

       (I) The board may adopt rules to implement this section.627


       Sec. 742.371.  (A) As used in this section, "lay off" has629
the same meaning as in division (A) of section 742.27 of the630
Revised Code.631

       (B) AExcept for service credit transferred under section632
742.214 of the Revised Code, a member of the fund who has633
voluntarily resigned or who voluntarily resigns or who has been or634
is removed from active service in a police or fire department for635
any reason other than a lay off that was involuntary, as certified636
pursuant to division (C) of this section, and receives or has637
received from a police relief and pension fund under division (I)638
of former section 741.49 of the Revised Code, or from a firemen's639
relief and pension fund under division (I) of former section640
741.18 of the Revised Code, or from a township firemen's relief641
and pension fund under division (I) of former section 521.11 of642
the Revised Code, or from the Ohio police and fire pension fund643
under division (G) of section 742.37 of the Revised Code, an644
amount equal to the sum deducted from the member's salary and645
credited to one of such funds shall, upon reinstatement to the646
active service of such police or fire department, deposit with the647
Ohio police and fire pension fund an amount equal to the sum so648
received by the member, with interest compounded annually thereon,649
at a rate to be determined by the board of trustees of the Ohio650
police and fire pension fund, from the date of such receipt to the651
date of such deposit. The member may choose to purchase only part652
of such credit in any one payment, subject to board rules. Such653
member shall not be entitled to receive any pension or benefit654
payments under division (B) or (C) of section 742.37 or section655
742.39 of the Revised Code until the member has made the deposit656
required by this section.657

       (C) A member of the fund who has been or is removed from658
active service in a police or fire department as a result of a lay659
off that was involuntary, as certified pursuant to this division,660
and receives or has received from a police relief and pension fund661
under division (I) of former section 741.49 of the Revised Code,662
or from a firemen's relief and pension fund under division (I) of663
former section 741.18 of the Revised Code, or from a township664
firemen's relief and pension fund under division (I) of former665
section 521.11 of the Revised Code, or from the Ohio police and666
fire pension fund under division (G) of section 742.37 of the667
Revised Code, an amount equal to the sum deducted from the668
member's salary and credited to one of such funds may, upon669
reinstatement to the active service of such police or fire670
department, deposit with the Ohio police and fire pension fund an671
amount equal to the sum so received by the member, with interest672
compounded annually thereon, at a rate to be determined by the673
board of trustees of the Ohio police and fire pension fund from674
the date of such receipt to the date of such deposit. The member675
may choose to purchase only part of such credit in any one676
payment, subject to board rules.677

       If any police or fire department reinstates a member of the678
fund who was removed from active service in that police or fire679
department as a result of a lay off that was involuntary, the680
police or fire department shall upon the request of that member681
certify to the fund that the member was removed from active682
service in that police or fire department as a result of a lay off683
that was involuntary.684

       Sec. 742.375. AExcept for service credit transferred under685
section 742.214 of the Revised Code, a member of the fund who is686
in the active service of a police or fire department and is not687
receiving a pension or benefit payment from the Ohio police and688
fire pension fund shall, in computing years of active service in689
such department under division (C) of section 742.37 or section690
742.39 of the Revised Code, be given full credit for the time691
served in the state highway patrol retirement system, provided692
such member pays into the Ohio police and fire pension fund the693
amount received by the member under section 5505.19 of the Revised694
Code, with interest compounded annually thereon at a rate to be695
determined by the board of trustees of the Ohio police and fire696
pension fund from the date of such receipt to the date of such697
deposit. The member may choose to purchase only part of such698
credit in any one payment, subject to board rules.699

       Upon certification by the board to the board of the state700
highway patrol retirement system of such payment by the member of701
the fund, the state highway patrol retirement board shall pay from702
the employer's accumulation fund under division (C) of section703
5505.03 of the Revised Code to the Ohio police and fire pension704
fund an amount equal to the payment of the member of the fund.705

       Sec. 3307.761.  (A) As used in this section, "militaryand706
section 3307.765 of the Revised Code:707

       (1) "Uniform retirement system" or "uniform system" means708
the Ohio police and fire pension fund or state highway patrol709
retirement system.710

       (2) "Military service credit" means credit purchased or711
obtained under this chapter or Chapter 742. or 5505. of the712
Revised Code for service in the armed forces of the United States.713

       (B) A member of the state teachers retirement system714
participating in the plan described in sections 3307.50 to 3307.79715
of the Revised Code who has contributions on deposit with the Ohio716
police and fire pension fund or the state highway patrola uniform717
retirement system shall, in computing years of total service, be718
given full credit for service credit earned under Chapter 742. or719
5505. of the Revised Code or for military service credit if a720
transfer to the state teachers retirement system is made under721
this division. At the request of the member, the Ohio police and722
fire pension fund or state highway patrol retirementuniform723
system shall transfer to the state teachers retirement system, for724
each year of service, the sum of the following:725

       (1) An amount equal to the member's accumulated726
contributions to the transferring fund oruniform system,and any727
payments by the member for military service credit, and any728
amounts paid under section 742.375 or 5505.201 of the Revised Code729
to purchase service credit;730

       (2) An amount equal to the lesser of the employer's731
contributions to the Ohio police and fire pension fund or state732
highway patrol retirementuniform system or the amount that would733
have been contributed by the employer for the service had the734
member been a member of the state teachers retirement system at735
the time the credit was earned;736

       (3) Interest, determined as provided in division (F) of this737
section, on the amounts specified in divisions (B)(1) and (2) of738
this section from the last day of the year for which the service739
credit in the transferring fund oruniform system was earned or in740
which payment was made for military service credit or service741
credit under section 742.375 or 5505.201 of the Revised Code was742
purchased or obtained to the date the transfer is made.743

       (C) A member participating in the plan described in sections744
3307.50 to 3307.79 of the Revised Code who has at least eighteen745
months of contributing service with the state teachers retirement746
system, is a former member of the Ohio police and fire pension747
fund or state highway patrola uniform retirement system, and has748
received a refund of contributions to that fund oruniform system749
shall, in computing years of total service, be given full credit750
for service credit earned under Chapter 742. or 5505. of the751
Revised Code or for military service credit if, for each year of752
service, the state teachers retirement system receives the sum of753
the following:754

       (1) An amount, which shall be paid by the member, equal to755
the amount refunded by the Ohio police and fire pension fund or756
the state highway patrol retirementuniform system to the member757
for that year for accumulated contributions and payments for758
military service credit, with interest at a rate established by759
the state teachers retirement board on that amount from the date760
of the refund to the date of the payment;761

       (2) Interest, which shall be transferred by the Ohio police762
and fire pension fund or state highway patrol retirementuniform763
system, on the amount refunded to the member that is attributable764
to the year of service from the last day of the year for which the765
service credit was earned or in which payment was made for766
military service credit to the date the refund was made;767

       (3) An amount, which shall be transferred by the Ohio police768
and fire pension fund or state highway patrol retirementuniform769
system, equal to the lesser of the employer's contributions to770
the Ohio police and fire pension fund or state highway patrol771
retirementuniform system or the amount that would have been772
contributed by the employer for the service had the member been a773
member of the state teachers retirement system at the time the774
credit was earned, with interest on that amount from the last day775
of the year for which the service credit was earned or in which776
payment was made for military service to the date of the777
transfer.778

       On receipt of payment from the member, the state teachers779
retirement system shall notify the Ohio police and fire pension780
fund or the state highway patrol retirementuniform system, which,781
on receipt of the notice, shall make the transfer required by this782
division. Interest shall be determined as provided in division783
(F) of this section.784

       A member may choose to purchase only part of the credit the785
member is eligible to purchase under this division in any one786
payment, subject to rules of the state teachers retirement board.787

       (D) A member is ineligible to obtain credit under this788
section for service that is used in the calculation of any789
retirement benefit currently being paid or payable in the future790
under any other retirement program or for service credit that may791
be transferred under section 3307.765 of the Revised Code.792

       (E) If a member of the state teachers retirement system who793
is not a current contributor elects to obtain credit under section 794
742.21 or 5505.40 of the Revised Code for service for which the795
member contributed to the state teachers retirement system or made796
paymentpurchased for military service credit, the state teachers797
retirement system shall transfer to the Ohio police and fire798
pension fund or state highway patroluniform retirement system, as799
applicable, the amount specified in division (D) of section 742.21800
or division (B)(2) of section 5505.40 of the Revised Code.801

       (F) Interest charged under this section shall be calculated802
separately for each year of service credit. Unless otherwise803
specified in this section it shall be calculated at the lesser of804
the actuarial assumption rate for that year of the state teachers805
retirement system or of the fund oruniform retirement system in806
which the credit was earned. The interest shall be compounded807
annually.808

       (G) The state teachers retirement board shall credit to a809
member's account in the teachers' savings fund the amounts810
described in divisions (B)(1) and (C)(1) of this section, except811
that the interest paid by the member under division (C)(1) of this812
section shall be credited to the employers' trust fund. The board813
shall credit to the employers' trust fund the amounts described in814
divisions (B)(2) and (3) and (C)(2) and (3) of this section.815

       (H) At the request of the state teachers retirement system,816
the Ohio police and fire pension fund or state highway patrol817
retirement system shall certify to the state teachers retirement818
system a copy of the records of the service and contributions of a819
state teachers retirement system member who seeks service credit820
under this section.821

       Sec. 3307.765. (A) As used in this section, "transferred822
service credit" means service credit purchased or obtained under823
section 742.21, 742.214, 742.375, 5505.201, 5505.40, or 5505.41 of824
the Revised Code prior to the date a member commenced the825
employment covered by the state teachers retirement system for826
which the member is currently contributing to the system.827

       (B) A member of the state teachers retirement system who has828
contributions on deposit with, but is no longer contributing to, a829
uniform retirement system shall, in computing years of total830
service, be given full credit for transferred service credit if a831
transfer to the state teachers retirement system is made under832
this section. At the request of a member, the uniform system833
shall transfer to the state teachers retirement system the sum of834
the following:835

       (1) An amount equal to the amounts transferred to the836
uniform system under section 742.21, 742.214, 742.375, 5505.201,837
5505.40, or 5505.41 of the Revised Code;838

       (2) Interest, determined as provided in division (E) of this839
section, on the amount specified in division (B)(1) of this840
section for the period from the last day of the year in which the841
transfer under section 742.21, 742.214, 742.375, 5505.201,842
5505.40, or 5505.41 of the Revised Code was made to the date a843
transfer is made under this section.844

       (C) A member of the state teachers retirement system with at845
least eighteen months of contributing service credit with the846
state teachers retirement system who has received a refund of847
contributions to a uniform retirement system shall, in computing848
years of total service, be given full credit for transferred849
service credit if, for each year of service, the state teachers850
retirement system receives the sum of the following:851

       (1) An amount, which shall be paid by the member, equal to852
the amount refunded by the uniform system to the member for that853
year for transferred service credit, with interest on that amount854
from the date of the refund to the date a payment is made under855
this section;856

       (2) Interest, which shall be transferred by the uniform857
system, on the amount refunded to the member for the period from858
the last day of the year in which the transfer under section859
742.21, 742.214, 742.375, 5505.201, 5505.40, or 5505.41 of the860
Revised Code was made to the date the refund was made;861

       (3) If the uniform system retained any portion of the amount862
transferred under section 742.21, 742.214, 742.375, 5505.201,863
5505.40, or 5505.41 of the Revised Code, an amount, which shall be864
transferred by the uniform system, equal to the amount retained,865
with interest on that amount for the period from the last day of866
the year in which the transfer under section 742.21, 742.214,867
742.375, 5505.201, 5505.40, or 5505.41 of the Revised Code was868
made to the date a transfer is made under this section.869

       On receipt of payment from the member, the state teachers870
retirement system shall notify the uniform system, which, on871
receipt of the notice, shall make the transfer required by this872
division. Interest shall be determined as provided in division873
(E) of this section.874

       (D) A member may choose to purchase only part of the credit875
the member is eligible to purchase under division (C) of this876
section in any one payment, subject to rules adopted by the state877
teachers retirement board. A member is ineligible to purchase or878
obtain service credit under this section for service to be used in879
the calculation of any retirement benefit currently being paid or880
payable to the member in the future under any other retirement881
program or for service credit that may be purchased or obtained882
under section 3307.761 of the Revised Code.883

       (E) Interest charged under this section shall be calculated884
separately for each year of service credit at the lesser of the885
actuarial assumption rate for that year of the state teachers886
retirement system or of the uniform retirement system to which the887
credit was transferred under section 742.21, 742.214, 742.375,888
5505.201, 5505.40, or 5505.41 of the Revised Code. The interest889
shall be compounded annually.890

       (F) Any amounts transferred or paid under divisions (B) and891
(C) of this section that are attributable to contributions made by892
the member or to amounts paid to purchase service credit shall be893
credited to the teachers' savings fund created under section894
3307.14 of the Revised Code. Any remaining amounts shall be895
credited to one or more of the funds created under that section as896
determined by the board.897

       (G) At the request of the state teachers retirement system,898
the uniform retirement system shall certify to the state teachers899
retirement system a copy of the records of the service and900
contributions of a state teachers retirement system member who901
seeks service credit under this section. The uniform retirement902
system shall specify the portions of the amounts transferred that903
are attributable to employee contributions, employer904
contributions, and interest.905

       (H) If a member of the state teachers retirement system who906
is not a current contributor elects to receive service credit907
under section 742.214 or 5505.41 of the Revised Code for908
transferred service credit, as defined in those sections, the909
system shall transfer to the uniform retirement system, as910
applicable, the amount specified in division (B) or (C) of section911
742.214 or division (B) or (C) of section 5505.41 of the Revised912
Code.913

       (I) The board may adopt rules to implement this section.914


       Sec.  3309.73.  (A) As used in this section, "militaryand916
section 3309.731 of the Revised Code:917

       (1) "Uniform retirement system" or "uniform system" means918
the Ohio police and fire pension fund or state highway patrol919
retirement system.920

       (2) "Military service credit" means service credit purchased921
or obtained under this chapter or Chapter 742. or 5505. of the922
Revised Code for service in the armed forces of the United States.923

       (B) A member of the school employees retirement system who924
has contributions on deposit with the Ohio police and fire pension925
fund or the state highway patrola uniform retirement system926
shall, in computing years of total service, be given full credit927
for service credit earned under Chapter 742. or 5505. of the928
Revised Code or purchased or obtained for military service credit929
if a transfer to the school employees retirement system is made930
under this division. At the request of the member, the Ohio931
police and fire pension fund or state highway patrol retirement932
uniform system shall transfer to the school employees retirement933
system, for each year of service, the sum of the following:934

       (1) An amount equal to the member's accumulated935
contributions to the transferring fund oruniform system,and any936
payments by the member for military service credit, and any937
amounts paid under section 742.375 or 5505.201 of the Revised Code938
to purchase service credit;939

       (2) An amount equal to the lesser of the employer's940
contributions to the Ohio police and fire pension fund or state941
highway patrol retirementuniform system or the amount that would942
have been contributed by the employer for the service had the943
member been a member of the school employees retirement system at944
the time the credit was earned;945

       (3) Interest, determined as provided in division (F) of this946
section, on the amounts specified in divisions (B)(1) and (2) of947
this section from the last day of the year for which the service948
credit in the transferring fund oruniform system was earned or in949
which payment was made for military service credit or service950
credit under section 742.375 or 5505.201 of the Revised Code was951
purchased or obtained to the date the transfer is made.952

       (C) A member who has at least eighteen months of953
contributing service with the school employees retirement system,954
is a former member of the Ohio police and fire pension fund or955
state highway patrola uniform retirement system, and has received956
a refund of contributions to that fund oruniform system shall, in957
computing years of total service, be given full credit for service958
credit earned under Chapter 742. or 5505. of the Revised Code or959
purchased or obtained for military service credit if, for each960
year of service, the school employees retirement system receives961
the sum of the following:962

       (1) An amount, which shall be paid by the member, equal to963
the amount refunded by the Ohio police and fire pension fund or964
the state highway patrol retirementuniform system to the member965
for that year for accumulated contributions and payments for966
purchase of credit for military service credit, with interest at967
a rate established by the school employees retirement board on968
that amount from the date of the refund to the date of the969
payment;970

       (2) Interest, which shall be transferred by the Ohio police971
and fire pension fund or state highway patrol retirementuniform972
system, on the amount refunded to the member that is attributable973
to the year of service from the last day of the year for which the974
service credit was earned or in which payment was made for975
military service credit to the date the refund was made;976

       (3) An amount, which shall be transferred by the Ohio police977
and fire pension fund or state highway patrol retirementuniform978
system, that is equal to the lesser of the employer's979
contributions to the Ohio police and fire pension fund or state980
highway patrol retirementuniform system or the amount that would981
have been contributed by the employer for the service had the982
member been a member of the school employees retirement system at983
the time the credit was earned, with interest on that amount from984
the last day of the year for which the service credit was earned985
or in which payment was made for military service credit to the986
date of the transfer.987

       On receipt of payment from the member, the school employees988
retirement system shall notify the Ohio police and fire pension989
fund or the state highway patrol retirementuniform system, which,990
on receipt of the notice, shall make the transfer required by this991
division. Interest shall be determined as provided in division992
(F) of this section. The member may choose to purchase only part993
of such credit in any one payment, subject to board rules.994

       (D) A member is ineligible to obtain service credit under995
this section for service that is used in the calculation of any996
retirement benefit currently being paid or payable in the future997
to the member under any other retirement program or for service998
credit that may be transferred under section 3309.731 of the999
Revised Code.1000

       Service credit obtained under this section shall be1001
considered the equivalent of Ohio service credit.1002

       (E) If a member of the school employees retirement system1003
who is not a current contributor elects to obtain credit under1004
section 742.21 or 5505.40 of the Revised Code for service for1005
which the member contributed to the school employees retirement1006
system or made payment for military service credit, the school1007
employees retirement system shall transfer to the Ohio police and1008
fire pension fund or state highway patroluniform retirement1009
system, as applicable, the amount specified in division (D) of1010
section 742.21 or division (B)(2) of section 5505.40 of the1011
Revised Code.1012

       (F) Interest charged under this section shall be calculated1013
separately for each year of service credit. Unless otherwise1014
specified in this section, it shall be calculated at the lesser of1015
the actuarial assumption rate for that year of the school1016
employees retirement system or of the fund oruniform retirement1017
system in which the credit was earned. The interest shall be1018
compounded annually.1019

       (G) At the request of the school employees retirement1020
system, the Ohio police and fire pension fund or state highway1021
patroluniform retirement system shall certify to the school1022
employees retirement system a copy of the records of the service1023
and contributions of a school employees retirement system member1024
who seeks service credit under this section.1025

       Sec. 3309.731. (A) As used in this section, "transferred1026
service credit" means service credit purchased or obtained under1027
section 742.21, 742.214, 742.375, 5505.201, 5505.40, or 5505.41 of1028
the Revised Code prior to the date a member commenced the1029
employment covered by the school employees retirement system for1030
which the member is currently contributing to the system.1031

       (B) A member of the school employees retirement system who1032
has contributions on deposit with, but is no longer contributing1033
to, a uniform retirement system shall, in computing years of1034
service, be given full credit for transferred service credit if a1035
transfer to the school employees retirement system is made under1036
this section. At the request of a member, the uniform system1037
shall transfer to the school employees retirement system the sum1038
of the following:1039

       (1) An amount equal to the amounts transferred to the1040
uniform system under section 742.21, 742.214, 742.375, 5505.201,1041
5505.40, or 5505.41 of the Revised Code;1042

       (2) Interest, determined as provided in division (E) of this1043
section, on the amount specified in division (B)(1) of this1044
section for the period from the last day of the year in which the1045
transfer under section 742.21, 742.214, 742.375, 5505.201,1046
5505.40, or 5505.41 of the Revised Code was made to the date a1047
transfer is made under this section.1048

       (C) A member of the school employees retirement system with1049
at least eighteen months of contributing service credit with the1050
school employees retirement system who has received a refund of1051
contributions to a uniform retirement system shall, in computing1052
years of service, be given full credit for transferred service1053
credit if, for each year of service, the school employees1054
retirement system receives the sum of the following:1055

       (1) An amount, which shall be paid by the member, equal to1056
the amount refunded by the uniform system to the member for that1057
year for transferred service credit, with interest on that amount1058
from the date of the refund to the date a payment is made under1059
this section;1060

       (2) Interest, which shall be transferred by the uniform1061
system, on the amount refunded to the member for the period from1062
the last day of the year in which the transfer under section1063
742.21, 742.214, 742.375, 5505.201, 5505.40, or 5505.41 of the1064
Revised Code was made to the date the refund was made;1065

       (3) If the uniform system retained any portion of the amount1066
transferred under section 742.21, 742.214, 742.375, 5505.201,1067
5505.40, or 5505.41 of the Revised Code, an amount, which shall be1068
transferred by the uniform system, equal to the amount retained,1069
with interest on that amount for the period from the last day of1070
the year in which the transfer under section 742.21, 742.214,1071
742.375, 5505.201, 5505.40, or 5505.41 of the Revised Code was1072
made to the date a transfer is made under this section.1073

       On receipt of payment from the member, the school employees1074
retirement system shall notify the uniform system, which, on1075
receipt of the notice, shall make the transfer required by this1076
division. Interest shall be determined as provided in division1077
(E) of this section.1078

       (D) Service credit purchased or obtained under this section1079
shall be considered the equivalent of Ohio service credit. A1080
member may choose to purchase only part of the credit the member1081
is eligible to purchase under division (C) of this section in any1082
one payment, subject to rules adopted by the school employees1083
retirement board. A member is ineligible to purchase or obtain1084
service credit under this section for service to be used in the1085
calculation of any retirement benefit currently being paid or1086
payable to the member in the future under any other retirement1087
program or for service credit that may be purchased or obtained1088
under section 3309.73 of the Revised Code.1089

       (E) Interest charged under this section shall be calculated1090
separately for each year of service credit at the lesser of the1091
actuarial assumption rate for that year of the school employees1092
retirement system or of the uniform retirement system to which the1093
credit was transferred under section 742.21, 742.214, 742.375,1094
5505.201, 5505.40, or 5505.41 of the Revised Code. The interest1095
shall be compounded annually.1096

       (F) Any amounts transferred or paid under divisions (B) and1097
(C) of this section that are attributable to contributions made by1098
the member or to amounts paid to purchase service credit shall be1099
credited to the employees' savings fund created under section1100
3309.47 of the Revised Code. Any remaining amounts shall be1101
credited to one or more of the funds created under that section as1102
determined by the board.1103

       (G) At the request of the school employees retirement1104
system, the uniform retirement system shall certify to the school1105
employees retirement system a copy of the records of the service1106
and contributions of a school employees retirement system member1107
who seeks service credit under this section. The uniform1108
retirement system shall specify the portions of the amounts1109
transferred that are attributable to employee contributions,1110
employer contributions, and interest.1111

       (H) If a member of the school employees retirement system1112
who is not a current contributor elects to receive service credit1113
under section 742.214 or 5505.41 of the Revised Code for1114
transferred service credit, as defined in those sections, the1115
system shall transfer to the uniform retirement system, as1116
applicable, the amount specified in division (B) or (C) of section1117
742.214 or division (B) or (C) of section 5505.41 of the Revised1118
Code.1119

       (I) The board may adopt rules to implement this section.1120

       Sec. 5505.201. AExcept for service credit transferred under1121
section 5505.41 of the Revised Code, a member of the state highway1122
patrol retirement system shall, in computing years of active1123
service in the highway patrol under sections 5505.16, 5505.17, and1124
5505.18 of the Revised Code, be given full credit for time served1125
as a police officer or firefighter covered under Chapter 742. and1126
former Chapters 521. and 541. of the Revised Code, provided such1127
member pays to the state highway patrol retirement system the1128
amount received by the member under division (I) of former section1129
521.11, division (I) of former section 741.18, division (I) of1130
former section 741.49, or division (G) of section 742.37 of the1131
Revised Code, with compound interest thereon at a rate to be1132
determined by the state highway patrol retirement board from the1133
date of such receipt to the date of such deposit. A member may1134
choose to purchase only part of such credit in any one payment,1135
subject to board rules.1136

       Upon certification by the state highway patrol retirement1137
board to the board of trustees of the Ohio police and fire pension1138
fund of such payment by the member, the Ohio police and fire1139
pension fund shall pay from the appropriate employers'1140
contribution fund under section 742.59 of the Revised Code to the1141
state highway patrol retirement system an amount equal to the1142
payment of the member.1143

       Sec.  5505.40.  (A) As used in this section and section1144
5505.41 of the Revised Code:1145

       (1) "Full-time service" means full-time service as defined1146
by rule which shall be adopted by the state highway patrol1147
retirement board.1148

       (2) "Military service credit" means credit for service in1149
the armed forces of the United States purchased or obtained under1150
this chapter or Chapter 145., 3307., or 3309. of the Revised Code.1151

       (3) "Non-uniform retirement system" or "non-uniform system"1152
means the public employees retirement system, school employees1153
retirement system, or state teachers retirement system.1154

       (B)(1)(a) For purposes of computing the pension payable1155
under section 5505.17 or 5505.18 of the Revised Code, a member of1156
the state highway patrol retirement system who is a former member1157
of the public employees retirement system, school employees1158
retirement system, or state teachersa non-uniform retirement1159
system and has received a return of contributions from the former1160
retirementnon-uniform system shall be given full credit for1161
service credit earned for full-time service as a member of the1162
former retirementnon-uniform system or purchased or obtained as1163
military service credit if, for each year of service credit, the1164
state highway patrol retirement system receives the sum of the1165
following:1166

       (i) An amount, which shall be paid by the member to the1167
member's credit in the employees' savings fund, equal to the1168
amount received by the member from the former retirement1169
non-uniform system for that year that is attributable to1170
contributions made for full-time service and payments for military1171
service credit, plus interest at a rate established by the board1172
on that amount from the date payment was made to the member by the1173
former retirementnon-uniform system to the date the member makes1174
the payment to the state highway patrol retirement system;1175

       (ii) If a member is seeking credit for service under the1176
public employees retirement system or state teachers retirement1177
system, an amount, which shall be paid by the member, equal to the1178
amount of any employer contributions and interest on employee1179
contributions the member received under section 145.40 or 3307.5631180
of the Revised Code;1181

       (iii) Interest, which shall be transferred by the former1182
retirementnon-uniform system, on the amount received by the1183
member that is attributable to the year of service from the last1184
day of the year for which the service credit was earned or in1185
which payment was made for military service credit to the date1186
the amount was paid to the member;1187

       (iv) An amount, which shall be transferred by the former1188
retirementnon-uniform system, equal to the lesser of the1189
employer's contributions to the former retirementnon-uniform1190
system for the year of service or the amount that would have been1191
contributed by the employer for the full-time service had the1192
member been a member of the state highway patrol retirement system1193
at the time the credit was earned, with interest on that amount1194
from the last day of the year for which the service credit was1195
earned or in which payment was made for military service credit to1196
the date the transfer is made.1197

       (b) On receipt of payment from the member, the state highway1198
patrol retirement system shall notify the former retirement1199
non-uniform system, which, on receipt of the notice, shall make1200
the transfer required by this division. Interest shall be1201
determined in accordance with division (F) of this section.1202

       (c) The amount transferred under division (B)(1)(a) of this1203
section by the public employees retirement system or state1204
teachers retirement system shall not include any amount of1205
employer contributions and interest on employee contributions the1206
member received under section 145.40 or 3307.563 of the Revised1207
Code.1208

       (2) For purposes of computing the pension payable under1209
section 5505.17 or 5505.18 of the Revised Code, a member of the1210
state highway patrol retirement system who has contributions on1211
deposit with the public employees retirement system, school1212
employees retirement system, or state teachersa non-uniform1213
retirement system shall be given full credit for service credit1214
earned for full-time service as a member of that retirement1215
non-uniform system,or any service credit purchased or obtained1216
as military service credit, and any service credit obtained under1217
section 145.295, 3307.761, or 3309.381 of the Revised Code for1218
service for which contributions were made to the Ohio police and1219
fire pension fund. The credit shall be given if, for each year of1220
service, the public employees retirement system, school employees1221
retirement system, or state teachers retirementnon-uniform system1222
transfers to the state highway patrol retirement system the sum of1223
the following:1224

       (a) The amount, contributed by the member or, in the case1225
of military service, paid by the member, that is attributable to1226
that service;1227

       (b) An amount equal to the lesser of the employer's1228
contributions to the public employees retirement system, school1229
employees retirement system, or state teachers retirement1230
non-uniform system for the year of service or the amount that1231
would have been contributed by the employer for the full-time1232
service had the member been a member of the state highway patrol1233
retirement system at the time the credit was earned;1234

       (c) An amount equal to any amount received by the retirement1235
system under section 145.295, 3307.761, or 3309.351 of the Revised1236
Code;1237

       (d) Interest, determined in accordance with division (F) of1238
this section, on the amounts specified in divisions (B)(2)(a),and1239
(b), and (c) of this section from the last day of the year for1240
which the service credit in the transferring retirement1241
non-uniform system was earned or in which payment was made for1242
military service credit or service credit under section 145.295,1243
3307.761, or 3309.351 of the Revised Code was purchased or1244
obtained to the date the transfer is made.1245

       On receipt of a request from the member, the appropriate1246
retirementnon-uniform system shall make the transfer.1247

       (3) Unless section 5505.402 of the Revised Code applies,1248
for purposes of computing the pension payable under section1249
5505.17 or 5505.18 of the Revised Code, a member of the state1250
highway patrol retirement system who has contributions on deposit1251
with the Cincinnati retirement system shall be given full credit1252
for service credit earned for full-time service as a member of1253
that retirement system or purchased or obtained as military1254
service credit if, for each year of service credit, the state1255
highway patrol retirement system receives the sum of the1256
following:1257

       (a) An amount, which shall be paid by the member to the1258
member's credit in the employees' savings fund, equal to the1259
amount withdrawn from the Cincinnati retirement system that is1260
attributable to that year of service, with interest on that amount1261
determined in accordance with division (F) of this section from1262
the date of withdrawal to the date of payment;1263

       (b) Interest, which shall be paid either by the member or1264
the Cincinnati retirement system, on the amount withdrawn from the1265
Cincinnati retirement system that is attributable to the year of1266
service from the last day of the year for which the service credit1267
was earned or in which payment was made for military service1268
credit to the date the amount was withdrawn;1269

       (c) An amount, which shall be paid either by the member or1270
the Cincinnati retirement system, equal to the lesser of the 1271
employer's contributions to the Cincinnati retirement system for1272
the year of service or the amount that would have been contributed1273
by the employer for the full-time service had the member been a1274
member of the state highway patrol retirement system at the time1275
the credit was earned, with interest on that amount from the last1276
day of the year for which the service credit was earned or in1277
which payment was made for military service to the date the1278
payment is made.1279

       (C) If a member who is not a current contributor and has not1280
received a refund of accumulated contributions elects to receive1281
credit under section 145.295, 3307.761, or 3309.3513309.73 of the1282
Revised Code for service for which the member contributed to the1283
state highway patrol retirement system and credit purchased as1284
military service credit, the state highway patrol retirement1285
system shall transfer to the appropriate retirement system the1286
amount specified in division (B)(C) of section 145.295, division1287
(B) of section 3307.761, or division (B) of section 3309.73 of1288
the Revised Code.1289

       (D)(1) A member is ineligible to purchase or otherwise1290
receive credit under this section for service that is used in the1291
calculation of any retirement benefit currently being paid or that1292
is payable in the future to the member under any other retirement1293
program, or service rendered concurrently with any other period1294
for which service credit has already been granted, or for service1295
credit that may be transferred under section 5505.41 of the1296
Revised Code.1297

       (2) Except as provided under division (D)(3) of this1298
section, no service credit purchased under this section or1299
received as a result of a transfer requested under this section1300
shall be used to determine any member's eligibility for retirement1301
under sections 5505.16 and 5505.17 of the Revised Code.1302

       (3) Service credit obtained under this section by a member1303
for military service credit or for service as a state highway1304
patrol cadet attending training school pursuant to section 5503.051305
of the Revised Code shall be used to determine the member's1306
eligibility for retirement under sections 5505.16 and 5505.17 of1307
the Revised Code.1308

       (4) Subject to rules of the state highway patrol retirement1309
system, a member may choose to purchase only part of the credit1310
the member is eligible to purchase under division (B)(1) or (3) of1311
this section.1312

       (E) At the request of the state highway patrol retirement1313
system, the public employees retirement system, school employees1314
retirement system, state teachersnon-uniform retirement system,1315
or Cincinnati retirement system shall certify to the state highway1316
patrol retirement system a copy of the records of service, salary,1317
and contributions of a member who seeks service credit under this1318
section.1319

       (F) Interest charged under this section shall be calculated1320
separately for each year of service credit. Unless otherwise1321
specified in this section, it shall be calculated at the lesser of1322
the actuarial assumption rate for that year of the state highway1323
patrol retirement system or of the retirement system in which the1324
credit was earned. The interest shall be compounded annually.1325

       (G) The state highway patrol retirement system board may1326
adopt rules establishing procedures for the purchase of service1327
credit or the transfer of contributions under this section.1328

       Sec. 5505.41. (A) As used in this section, "transferred1329
service credit" means service credit purchased or obtained under1330
section 145.295, 145.2913, 3307.761, 3307.765, 3309.73, or1331
3309.731 of the Revised Code prior to the date a member commenced1332
the employment covered by the state highway patrol retirement1333
system for which the member is currently contributing to the1334
system.1335

       (B) A member of the state highway patrol retirement system1336
who has contributions on deposit with, but is no longer1337
contributing to, a non-uniform retirement system shall, in1338
computing years of service, be given full credit for transferred1339
service credit if a transfer to the state highway patrol1340
retirement system is made under this section. At the request of a1341
member, the non-uniform system shall transfer to the state highway1342
patrol retirement system the sum of the following:1343

       (1) An amount equal to the amounts transferred to the1344
non-uniform system under section 145.295, 145.2913, 3307.761,1345
3307.765, 3309.73, or 3309.731 of the Revised Code;1346

       (2) Interest, determined as provided in division (E) of this1347
section, on the amount specified in division (B)(1) of this1348
section for the period from the last day of the year in which the1349
transfer under section 145.295, 145.2913, 3307.761, 3307.765,1350
3309.73, or 3309.731 of the Revised Code was made to the date a1351
transfer is made under this section.1352

       (C) A member with at least eighteen months of contributing1353
service credit with the state highway patrol retirement system who1354
has received a refund of contributions to a non-uniform retirement1355
system shall, in computing years of service, be given full credit1356
for transferred service credit if, for each year of service, the1357
state highway patrol retirement system receives the sum of the1358
following:1359

       (1) An amount, which shall be paid by the member, equal to1360
the amount refunded by the non-uniform system to the member for1361
that year for transferred service credit, with interest on that1362
amount from the date of the refund to the date a payment is made1363
under this section;1364

       (2) Interest, which shall be transferred by the non-uniform1365
system, on the amount refunded to the member for the period from1366
the last day of the year in which the transfer under section1367
145.295, 145.2913, 3307.761, 3307.765, 3309.73, or 3309.731 of the1368
Revised Code was made to the date the refund was made;1369

       (3) If the non-uniform system retained any portion of the1370
amount transferred under section 145.295, 145.2913, 3307.761,1371
3307.765, 3309.73, or 3309.731 of the Revised Code, an amount,1372
which shall be transferred by the non-uniform system, equal to the1373
amount retained, with interest on that amount for the period from1374
the last day of the year in which the transfer under section1375
145.295, 145.2913, 3307.761, 3307.765, 3309.73, or 3309.731 of the1376
Revised Code was made to the date a transfer is made under this1377
section.1378

       On receipt of payment from the member, the state highway1379
patrol retirement system shall notify the non-uniform system,1380
which, on receipt of the notice, shall make the transfer required1381
by this division. Interest shall be determined as provided in1382
division (E) of this section.1383

       (D) Service credit purchased or obtained under this section1384
shall be used in computing the pensions payable under section1385
5505.17 or 5505.18 of the Revised Code. A member may choose to1386
purchase only part of the credit the member is eligible to1387
purchase under division (C) of this section in any one payment,1388
subject to rules adopted by the state highway patrol retirement1389
board. A member is ineligible to purchase or obtain service1390
credit under this section for service to be used in the1391
calculation of any retirement benefit currently being paid or1392
payable to the member in the future under any other retirement1393
program or for service credit that may be purchased or obtained1394
under section 5505.40 of the Revised Code.1395

       (E) Interest charged under this section shall be calculated1396
separately for each year of service credit at the lesser of the1397
actuarial assumption rate for that year of the state highway1398
patrol retirement system or of the non-uniform retirement system1399
to which the credit was transferred under section 145.295,1400
145.2913, 3307.761, 3307.765, 3309.73, or 3309.731 of the Revised1401
Code. The interest shall be compounded annually.1402

       (F) Any amounts transferred or paid under divisions (B) and1403
(C) of this section that are attributable to contributions made by1404
the member or to amounts paid to purchase service credit shall be1405
credited to the employees' savings fund created under section1406
5505.03 of the Revised Code. Any remaining amounts shall be1407
credited to one or more of the funds created under that section as1408
determined by the board.1409

       (G) At the request of the state highway patrol retirement1410
system, the non-uniform retirement system shall certify to the1411
state highway patrol retirement system a copy of the records of1412
the service and contributions of a member who seeks service credit1413
under this section. The non-uniform retirement system shall1414
specify the portions of the amounts transferred that are1415
attributable to employee contributions, employer contributions,1416
and interest.1417

       (H) If a member who is not a current contributor elects to1418
receive service credit under section 145.2913, 3307.765, or1419
3309.731 of the Revised Code for transferred service credit, as1420
defined in those sections, the system shall transfer to the1421
non-uniform retirement system, as applicable, the amount specified1422
in division (B) or (C) of section 145.2913, division (B) or (C) of1423
section 3307.765, or division (B) or (C) of section 3309.731 of1424
the Revised Code.1425

       (I) The board may adopt rules to implement this section.1426

       Section 2. That existing sections 145.295, 742.21, 742.371,1427
742.375, 3307.761, 3309.73, 5505.201, and 5505.40 of the Revised1428
Code are hereby repealed.1429
