in any full-time, part-time, reserve, auxiliary, or other
capacity | 35 |
and are serving, or during the year covered by the report
have | 36 |
served, the agency or entity in any of those peace officer | 37 |
capacities. The agency or entity shall provide the roster in the | 38 |
manner and format, and by the date, prescribed by the executive | 39 |
director of the Ohio peace officer training commission. | 40 |
(B) A member of the public employees
retirement system who | 54 |

retirement

transfer to the Ohio police and fire

highway patrol retirement system, as
applicable, the amount | 152 |
specified in division (D) of section

5505.40 of the Revised Code. | 154 |
(G) A member of the public employees retirement system who | 155 |
earned service credit in the public employees retirement system | 156 |
for full-time service as a township or municipal police officer | 157 |
and received service credit in the Ohio police and
fire pension | 158 |
fund under section 742.511
or 742.512 of
the Revised Code for such | 159 |
service may elect to have the credit
restored as public employees | 160 |
retirement system service credit by
paying the public employees | 161 |
retirement system an amount equal to
the accumulated contributions | 162 |
paid by the member to the Ohio
police
and fire pension fund
under | 163 |
section 742.511
or 742.512 of the Revised Code. When such an | 164 |
election is made,
the Ohio police and
fire
pension fund shall | 165 |
transfer to the public employees retirement system the amount | 166 |
previously transferred under section 742.511 or 742.512 of the | 167 |
Revised Code from the public employees retirement system to the | 168 |
Ohio police and fire
pension fund. | 169 |
Sec. 145.2913. (A) As used in this section, "transferred | 183 |
service credit" means service credit purchased or obtained under | 184 |
section 742.21, 742.214, 742.375, 5505.201, 5505.40, or 5505.41 of | 185 |
the
Revised Code prior to the date a member commenced the | 186 |
employment
covered by the public employees retirement system for | 187 |
which the
member is currently contributing to the system. | 188 |
(B) A member of the public employees retirement system who | 189 |
has contributions on deposit with, but is no longer contributing | 190 |
to, a uniform retirement system shall, in computing years of | 191 |
service, be given full credit for transferred service credit if a | 192 |
transfer to the public employees retirement system is made under | 193 |
this section. At the request of a member, the uniform system | 194 |
shall transfer to the public employees retirement system the sum | 195 |
of the following: | 196 |
(2) Interest, determined as provided in division (E) of this | 200 |
section, on the amount specified in division (B)(1) of this | 201 |
section for the period from the last day of the year in which the | 202 |
transfer under section 742.21, 742.214, 742.375, 5505.201, | 203 |
5505.40, or 5505.41 of the Revised Code was made to the date a | 204 |
transfer is made under this section. | 205 |
(C) A member of the public employees retirement system with | 206 |
at least eighteen months of contributing service credit with the | 207 |
public employees retirement system who has received a refund of | 208 |
contributions to a uniform retirement system shall, in computing | 209 |
years of service, be given full credit for transferred service | 210 |
credit if, for each year of service, the public employees | 211 |
retirement system receives the sum of the following: | 212 |
(3) If the uniform system retained any portion of the amount | 223 |
transferred under section 742.21, 742.214, 742.375, 5505.201, | 224 |
5505.40, or 5505.41 of the Revised Code, an amount, which shall be | 225 |
transferred by the uniform system, equal to the amount retained, | 226 |
with interest on that amount for the period from the last day of | 227 |
the year in which the transfer under section 742.21, 742.214, | 228 |
742.375, 5505.201, 5505.40, or 5505.41 of the Revised Code was | 229 |
made to the date a transfer is made under this section. | 230 |
(D) Service credit purchased or obtained under this section | 236 |
shall be considered the equivalent of Ohio service credit. A | 237 |
member may choose to purchase only part of the credit the member | 238 |
is eligible to purchase under division (C) of this section in any | 239 |
one payment, subject to rules adopted by the public employees | 240 |
retirement board. A member is ineligible to purchase or obtain | 241 |
service credit under this section for service to be used in the | 242 |
calculation of any retirement benefit currently being paid or | 243 |
payable to the member in the future under any other retirement | 244 |
program or for service credit that may be purchased or obtained | 245 |
under section 145.295 of the Revised Code. | 246 |
(E) Interest charged under this section shall be calculated | 247 |
separately for each year of service credit at the lesser of the | 248 |
actuarial assumption rate for that year of the public employees | 249 |
retirement system or of the uniform retirement system to which the | 250 |
credit was transferred under section 742.21, 742.214, 742.375, | 251 |
5505.201, 5505.40, or 5505.41 of the Revised Code. The interest | 252 |
shall be compounded annually. | 253 |
(G) At the request of the public employees retirement | 261 |
system, the uniform retirement system shall certify to the public | 262 |
employees retirement system a copy of the records of the service | 263 |
and contributions of a public employees retirement system member | 264 |
who seeks service credit under this section. The uniform | 265 |
retirement system shall specify the portions of the amounts | 266 |
transferred that are attributable to employee contributions, | 267 |
employer contributions, and interest. | 268 |
(H) If a member of the public employees retirement system | 269 |
who is not a current contributor elects to receive service credit | 270 |
under section 742.214 or 5505.41 of the Revised Code for | 271 |
transferred service credit, as defined in those sections, the | 272 |
system shall transfer to the uniform retirement system, as | 273 |
applicable, the amount specified in division (B) or (C) of section | 274 |
742.214 or division (B) or (C) of section 5505.41 of the Revised | 275 |
Code. | 276 |
(B) Unless section 742.212 of the Revised Code applies and | 291 |
except as provided
in division (I) of this section, in computing | 292 |
the
pension and benefits payable under
section 742.37 or 742.39 of | 293 |
the Revised Code,
the Ohio police and fire pension fund
shall give | 294 |
a member of the fund who is in the active service of a
police or | 295 |
fire department and is not receiving a pension or
benefit payment | 296 |
from the fund full credit for service credit earned for

service as a member of the Cincinnati
retirement system or | 298 |
purchased or
obtained as

service credit, the fund receives the

(3) An amount, which shall be paid by either the member

Cincinnati retirement system, equal to the lesser of the | 314 |

full-time service as a member of

retirement
systems,the non-uniform system or

purchased or obtained as military

credit obtained under section
145.295, 3307.761,

the Revised Code for
service for which

the state highway patrol
retirement
system. The credit shall be | 396 |

(d) Interest on the amounts specified in divisions | 412 |

(G) A member of the fund is ineligible to receive
credit | 436 |
under this
section for service that is used in the calculation of | 437 |
any
retirement benefit currently being paid or payable in the | 438 |
future
to the member
under any other retirement program,
or | 439 |
service rendered concurrently with any
other
period for which | 440 |
service credit has already been granted, or for service credit | 441 |
that may be transferred under section 742.214 of the Revised Code. | 442 |
At the request of a member, in lieu of requiring
payment of | 470 |
all or part of the amount determined under this
division the fund | 471 |
may grant the member an amount of service
credit under division | 472 |
(B),
(C), or (D) of this section or division (B) or (C) of
section | 473 |
742.212 of the Revised Code that is less than the amount for which | 474 |
the member is
eligible.
The service credit granted shall be the | 475 |
same percentage of the
service credit for which the member is | 476 |
eligible that the amount
the fund receives under division (B), | 477 |
(C), or (D) of this section or division (B) or (C) of
section | 478 |
742.212 of the Revised Code is of the total
amount it would | 479 |
receive under those divisions if the full amount
determined under | 480 |
this division was paid. | 481 |
(J)(1) Except as provided in division (J)(2) of
this section | 482 |
and notwithstanding any contrary provision of this
section, the | 483 |
board shall, in computing a pension or benefit
under section | 484 |
742.37 or 742.39 of the Revised
Code, give a member of the fund | 485 |
who is not receiving a pension or disability benefit from the
fund | 486 |
full credit for service credit purchased under this section
for | 487 |
service that was less than full-time service if the member | 488 |
provides
evidence satisfactory to the board that, after
receiving | 489 |
written notice from the fund indicating that the
member would be | 490 |
permitted to purchase service credit for service that
was less | 491 |
than full-time, the member changed or ceased the
member's | 492 |
employment with the understanding that the credit
identified in | 493 |
the notice would be used in computing a pension or
benefit. If | 494 |
the board has
canceled service credit purchased under this section | 495 |
for service
that was less than full-time service and the member | 496 |
meets the
requirements of division (J)(1)
of this section, the | 497 |
board shall restore the service credit on
repayment to the fund of | 498 |
the amount refunded to the member at
the time of cancellation. | 499 |
(2) If a member of the fund who is not receiving a
pension | 500 |
or disability benefit from the fund purchased credit
under this | 501 |
section for service that was less than full-time
service and does | 502 |
not meet the requirements of division
(J)(1) of this section, the | 503 |
board shall refund to the member any amounts paid to purchase
the | 504 |
credit, with interest at a rate determined by the board from
the | 505 |
date the member purchased the credit to the date of the
refund. | 506 |
(L) If a member or former member of the fund who is not a | 514 |
current contributor and has not received a refund of
accumulated | 515 |
contributions elects to receive
credit under section 145.295, | 516 |
3307.761, or
3309.73 of the Revised Code for service for
which | 517 |
the member contributed to the fund or purchased as military | 518 |
service credit, the fund shall
transfer to the
public employees | 519 |
retirement system, school employees
retirement system, or state | 520 |
teachersnon-uniform retirement system the amount
specified in | 521 |
division (B) of
section 145.295 of the
Revised Code, division | 522 |
(B)(C) of section
3307.761 of the
Revised Code, or division (B) of | 523 |

of the Revised Code. | 524 |
Sec. 742.214. (A) As used in this section, "transferred | 529 |
service credit" means service credit purchased or obtained under | 530 |
section 145.295, 145.2913, 3307.761, 3307.765, 3309.73, or | 531 |
3309.731 of the Revised Code prior to the date a member commenced | 532 |

non-uniform retirement system shall, in computing years of | 538 |
service, be given full credit for transferred service credit if a | 539 |
transfer to the Ohio police and fire pension fund is made under | 540 |
this section. At the request of a member, the non-uniform system | 541 |
shall transfer to the Ohio police and fire pension fund the sum of | 542 |
the following: | 543 |
(2) Interest, determined as provided in division (E) of this | 547 |
section, on the amount specified in division (B)(1) of this | 548 |
section for the period from the last day of the year in which the | 549 |
transfer under section 145.295, 145.2913, 3307.761, 3307.765, | 550 |
3309.73, or 3309.731 of the Revised Code was made to the date a | 551 |
transfer is made under this section. | 552 |
(C) A member of the fund with at least eighteen months of | 553 |
contributing service credit with the Ohio police and fire pension | 554 |
fund who is in the active service of a police or fire department | 555 |
and has received a refund of contributions to a non-uniform | 556 |
retirement system shall, in computing years of service, be given | 557 |
full credit for transferred service credit if, for each year of | 558 |
service, the Ohio police and fire pension fund receives the sum of | 559 |
the following: | 560 |
(2) Interest, which shall be transferred by the non-uniform | 566 |
system, on the amount refunded to the member for the period from | 567 |
the last day of the year in which the transfer under section | 568 |
145.295, 145.2913, 3307.761, 3307.765, 3309.73, or 3309.731 of the | 569 |
Revised Code was made to the date the refund was made; | 570 |
(3) If the non-uniform system retained any portion of the | 571 |
amount transferred under section 145.295, 145.2913, 3307.761, | 572 |
3307.765, 3309.73, or 3309.731 of the Revised Code, an amount, | 573 |
which shall be transferred by the non-uniform system, equal to the | 574 |
amount retained, with interest on that amount for the period from | 575 |
the last day of the year in which the transfer under section | 576 |
145.295, 145.2913, 3307.761, 3307.765, 3309.73, or 3309.731 of the | 577 |
Revised Code was made to the date a transfer is made under this | 578 |
section. | 579 |
(D) Service credit purchased or obtained under this section | 585 |
shall be used in computing the pension and benefits payable under | 586 |
section 742.37 or 742.39 of the Revised Code. A member may choose | 587 |
to purchase only part of the credit the member is eligible to | 588 |
purchase under division (C) of this section in any one payment, | 589 |
subject to rules adopted by the board of trustees of the Ohio | 590 |
police and fire pension fund. A member is ineligible to purchase | 591 |
or obtain service credit under this section for service to be used | 592 |
in the calculation of any retirement benefit currently being paid | 593 |
or payable to the member in the future under any other retirement | 594 |
program or for service credit that may be purchased or obtained | 595 |
under section 742.21 of the Revised Code. | 596 |
(E) Interest charged under this section shall be calculated | 597 |
separately for each year of service credit at the lesser of the | 598 |
actuarial assumption rate for that year of the Ohio police and | 599 |
fire pension fund or of the non-uniform retirement system to which | 600 |

(G) At the request of the Ohio police and fire pension fund, | 612 |
the non-uniform retirement system shall certify to the fund a copy | 613 |
of the records of the service and contributions of a member of the | 614 |
fund who seeks service credit under this section. The non-uniform | 615 |
retirement system shall specify the portions of the amounts | 616 |
transferred that are attributable to employee contributions, | 617 |
employer contributions, and interest. | 618 |
(H) If a member of the fund who is not a current contributor | 619 |
elects to receive service credit under section 145.2913, 3307.765, | 620 |
or 3309.731 of the Revised Code for transferred service credit, as | 621 |
defined in those sections, the fund shall transfer to the | 622 |
non-uniform retirement system, as applicable, the amount specified | 623 |
in division (B) or (C) of section 145.2913, division (B) or (C) of | 624 |
section 3307.765, or division (B) or (C) of section 3309.731 of | 625 |
the Revised Code. | 626 |
(B)
AExcept for service credit transferred under section | 632 |

voluntarily resigned or

with interest compounded annually
thereon, | 649 |
at
a rate to be
determined by the board of trustees of the Ohio | 650 |

pension fund, from the date of
such
receipt to the | 651 |

deposit. The member may choose to
purchase only part | 652 |

credit in any one payment, subject to

member
shall not be entitled to receive any
pension or benefit | 654 |

or from a firemen's relief and pension fund under

Ohio police and | 666 |
fire
pension fund under division
(G) of section 742.37 of the | 667 |
Revised Code, an amount equal to the
sum deducted from the | 668 |
member's salary and credited to one of
such funds
may, upon | 669 |
reinstatement to the active service of such police or
fire | 670 |
department, deposit with the Ohio police and fire
pension fund an | 671 |
amount equal to the sum so received by the
member, with interest | 672 |
compounded annually thereon, at a rate to be
determined by the | 673 |
board of trustees of the Ohio police and
fire pension fund from | 674 |
the date of such receipt to
the
date of such deposit. The member | 675 |
may choose to purchase only

Sec. 742.375. AExcept for service credit transferred under | 685 |
section 742.214 of the Revised Code, a member of the fund who is | 686 |
in the active

5505.40, or 5505.41 of the Revised Code, an amount, which shall be | 864 |
transferred by the uniform system, equal to the amount retained, | 865 |

the year in which the transfer under section 742.21, 742.214, | 867 |
742.375, 5505.201, 5505.40, or 5505.41 of the Revised Code was | 868 |

(D) A member may choose to purchase only part of the credit | 875 |
the member is eligible to purchase under division (C) of this | 876 |
section in any one payment, subject to rules adopted by the state | 877 |
teachers retirement board. A member is ineligible to purchase or | 878 |
obtain service credit under this section for service to be used in | 879 |
the calculation of any retirement benefit currently being paid or | 880 |
payable to the member in the future under any other retirement | 881 |
program or for service credit that may be purchased or obtained | 882 |
under section 3307.761 of the Revised Code. | 883 |
(E) Interest charged under this section shall be calculated | 884 |
separately for each year of service credit at the lesser of the | 885 |
actuarial assumption rate for that year of the state teachers | 886 |
retirement system or of the uniform retirement system to which the | 887 |
credit was transferred under section 742.21, 742.214, 742.375, | 888 |
5505.201, 5505.40, or 5505.41 of the Revised Code. The interest | 889 |
shall be compounded annually. | 890 |
(G) At the request of the state teachers retirement system, | 898 |
the uniform retirement system shall certify to the state teachers | 899 |
retirement system a copy of the records of the service and | 900 |
contributions of a state teachers retirement system member who | 901 |
seeks service credit under this section. The uniform retirement | 902 |
system shall specify the portions of the amounts transferred that | 903 |
are attributable to employee contributions, employer | 904 |
contributions, and interest. | 905 |
(H) If a member of the state teachers retirement system who | 906 |
is not a current contributor elects to receive service credit | 907 |
under section 742.214 or 5505.41 of the Revised Code for | 908 |
transferred service credit, as defined in those sections, the | 909 |
system shall transfer to the uniform retirement system, as | 910 |
applicable, the amount specified in division (B) or (C) of section | 911 |
742.214 or division (B) or (C) of section 5505.41 of the Revised | 912 |

(B) A member of the school employees retirement

(C) A member of the school employees retirement system with | 1049 |

contributions to a uniform retirement system shall, in computing | 1052 |
years of service, be given full credit for transferred service | 1053 |
credit if, for each year of service, the school employees | 1054 |
retirement system receives the sum of the following: | 1055 |

system shall transfer to the uniform retirement system, as | 1116 |
applicable, the amount specified in division (B) or (C) of section | 1117 |

(B) A member of the state highway patrol retirement system | 1336 |

contributing to, a non-uniform retirement system shall, in | 1338 |
computing years of service, be given full credit for transferred | 1339 |
service credit if a transfer to the state highway patrol | 1340 |
retirement system is made under this section. At the request of a | 1341 |
member, the non-uniform system shall transfer to the state highway | 1342 |
patrol retirement system the sum of the following: | 1343 |

(3) If the non-uniform system retained any portion of the | 1370 |

3307.765, 3309.73, or 3309.731 of the Revised Code, an amount, | 1372 |
which shall be transferred by the non-uniform system, equal to the | 1373 |
amount retained, with interest on that amount for the period from | 1374 |
the last day of the year in which the transfer under section | 1375 |
145.295, 145.2913, 3307.761, 3307.765, 3309.73, or 3309.731 of the | 1376 |
Revised Code was made to the date a transfer is made under this | 1377 |

(D) Service credit purchased or obtained under this section | 1384 |
shall be used in computing the pensions payable under section | 1385 |
5505.17 or 5505.18 of the Revised Code. A member may choose to | 1386 |
purchase only part of the credit the member is eligible to | 1387 |
purchase under division (C) of this section in any one payment, | 1388 |
subject to rules adopted by the state highway patrol retirement | 1389 |
board. A member is ineligible to purchase or obtain service | 1390 |
credit under this section for service to be used in the | 1391 |
calculation of any retirement benefit currently being paid or | 1392 |
payable to the member in the future under any other retirement | 1393 |
program or for service credit that may be purchased or obtained | 1394 |
under section 5505.40 of the Revised Code. | 1395 |
(E) Interest charged under this section shall be calculated | 1396 |
separately for each year of service credit at the lesser of the | 1397 |
actuarial assumption rate for that year of the state highway | 1398 |
patrol retirement system or of the non-uniform retirement system | 1399 |
to which the credit was transferred under section 145.295, | 1400 |
145.2913, 3307.761, 3307.765, 3309.73, or 3309.731 of the Revised | 1401 |
Code. The interest shall be compounded annually. | 1402 |
(G) At the request of the state highway patrol retirement | 1410 |
system, the non-uniform retirement system shall certify to the | 1411 |
state highway patrol retirement system a copy of the records of | 1412 |
the service and contributions of a member who seeks service credit | 1413 |
under this section. The non-uniform retirement system shall | 1414 |
specify the portions of the amounts transferred that are | 1415 |
attributable to employee contributions, employer contributions, | 1416 |
and interest. | 1417 |
(H) If a member who is not a current contributor elects to | 1418 |
receive service credit under section 145.2913, 3307.765, or | 1419 |
3309.731 of the Revised Code for transferred service credit, as | 1420 |
defined in those sections, the system shall transfer to the | 1421 |
non-uniform retirement system, as applicable, the amount specified | 1422 |
in division (B) or (C) of section 145.2913, division (B) or (C) of | 1423 |
section 3307.765, or division (B) or (C) of section 3309.731 of | 1424 |
