A BILL
To enact section 1349.18 of the Revised Code to1
prohibit the recording of more than the last five2
digits of a credit card account number, or3
recording the expiration date of a credit card, on4
an electronically printed receipt provided to a5
credit cardholder, and to provide civil remedies6
for a violation of the act and for enforcement by7
the Attorney General.8


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 1349.18 of the Revised Code be9
enacted to read as follows:10

       Sec. 1349.18. (A) No person or limited liability company that11
accepts credit cards for the transaction of business shall print12
more than the last five digits of the credit card account number,13
or print the expiration date of a credit card, on any receipt14
provided to the cardholder.15

       (B) This section applies only to receipts that are16
electronically printed and does not apply to any transaction in17
which the sole means of recording the cardholder's credit card18
account number is by handwriting or by an imprint or copy of the19
credit card.20

       (C) A violation of this section is deemed an unfair or21
deceptive act or practice in violation of section 1345.02 of the22
Revised Code. A person injured by a violation of this section has23
a cause of action and is entitled to the same relief available to24
a consumer under section 1345.09 of the Revised Code, and all25
powers and remedies available to the attorney general to enforce26
sections 1345.01 to 1345.13 of the Revised Code are available to27
the attorney general to enforce this section.28

       Section 2. Section 1 of this act shall take effect on July 1,29
2003.30
