A BILL
To amend sections 507.03 and 507.04 of the Revised 1
Code to require that the township clerk personally 2
attend certain meetings of the board of township 3
trustees, to set minimum amounts for township 4
clerk bonds, and to permit certain boards of 5
township trustees to request copies of township 6
records.7


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That sections 507.03 and 507.04 of the Revised 8
Code be amended to read as follows:9

       Sec. 507.03.  The township clerk, before entering upon the 10
discharge of hisofficial duties, shall give a bond, payable to 11
the board of township trustees, with sureties approved by suchthe12
board and, in suchthe sum as it determinesdetermined by the 13
board but not less than the sum provided in this section, and14
conditioned for the faithful performance of histhe duties asof 15
the office of township clerk. SuchThis bond shall be recorded by 16
the clerk, filed with the county treasurer, and carefully17
preserved.18

       The minimum sum of the township clerk's bond shall be as 19
follows:20

       (A) In a township with a budget of fifty thousand dollars or 21
less, ten thousand dollars;22

       (B) In a township with a budget of more than fifty thousand 23
dollars but not more than one hundred thousand dollars, 24
thirty-five thousand dollars;25

       (C) In a township with a budget of more than one hundred 26
thousand dollars but not more than two hundred fifty thousand 27
dollars, sixty thousand dollars;28

       (D) In a township with a budget of more than two hundred 29
fifty thousand dollars but not more than five hundred thousand 30
dollars, eighty-five thousand dollars;31

       (E) In a township with a budget of more than five hundred 32
thousand dollars but not more than seven hundred fifty thousand 33
dollars, one hundred ten thousand dollars;34

       (F) In a township with a budget of more than seven hundred 35
fifty thousand dollars but not more than one million five hundred 36
thousand dollars, one hundred thirty-five thousand dollars;37

       (G) In a township with a budget of more than one million five 38
hundred thousand dollars but not more than three million five 39
hundred thousand dollars, one hundred sixty thousand dollars;40

       (H) In a township with a budget of more than three million 41
five hundred thousand dollars but not more than six million 42
dollars, one hundred ninety-five thousand dollars;43

       (I) In a township with a budget of more than six million 44
dollars but not more than ten million dollars, two hundred twenty 45
thousand dollars;46

       (J) In a township with a budget of more than ten million 47
dollars, two hundred fifty thousand dollars.48

       Sec. 507.04. (A) The township clerk shall keep an accurate 49
record of the proceedings of the board of township trustees at all 50
of its meetings, and of all its accounts and transactions, 51
including the acceptance of the bonds of township officers. The 52
clerk shall personally attend at least one meeting of the board 53
during each quarter of every year, unless prevented by the 54
occurrence of an emergency from attending.55

       (B) In any township where the clerk does not keep the 56
township's records in a public facility, the board of township 57
trustees, once each quarter of each year, may request the clerk to 58
provide the board with copies of township records for its review. 59
If the board makes such a request, it shall tell the clerk which 60
records it wants copies of by indicating the dates or types of the 61
records it is requesting. A request made under this section does 62
not diminish any trustee's right to inspect township records under 63
division (B) of section 149.43 of the Revised Code.64

       Section 2. That existing sections 507.03 and 507.04 of the 65
Revised Code are hereby repealed.66
