To amend sections 3121.59 and 3121.64, to enact | 1 |
section 3125.141, and to repeal sections 3121.60 | 2 |
and 3121.63 of the Revised Code to allow a child | 3 |
support enforcement agency to contract with a | 4 |
private person or entity to provide service of | 5 |
process or to compensate a sheriff for service of | 6 |
process, to eliminate the Program Income Fund, and | 7 |
to require monthly distributions of administrative | 8 |
charge amounts to each county child support | 9 |
enforcement agency. | 10 |
Section 1. That sections 3121.59 and 3121.64 be amended and | 11 |
section 3125.141 of the Revised Code be enacted to read as | 12 |
follows: | 13 |
Sec. 3121.59. A fine imposed pursuant to division (B) of | 14 |
section 3121.99 of the Revised Code shall be paid to the office of | 15 |
child support in the department of job and family services or, | 16 |
pursuant to section 3125.29 of the Revised Code, to the child | 17 |
support enforcement agency. The amount of the fine that does not | 18 |
exceed the amount of arrearage under the child support order shall | 19 |
be disbursed in accordance with the child support order. The | 20 |
amount of the fine that exceeds the amount of the arrearage shall | 21 |
be considered program income | 22 |

Sec. 3121.64. On receipt of administrative charges under | 24 |
section 3121.56 of the Revised Code, the office of child support | 25 |
shall determine the charge amounts collected from obligors under | 26 |
support orders being administered by the child support enforcement | 27 |
agency in each
county and distribute | 28 |
agency an amount equal to the charges attributable to the agency. | 29 |
Sec. 3125.141. In providing for service of process of a | 30 |
notice or order as required under this chapter or Chapter 3111., | 31 |
3115., 3119., 3121., or 3123. of the Revised Code and in | 32 |
accordance with the provisions of the Rules of Civil Procedure | 33 |
that govern service of process, a child support enforcement agency | 34 |
may do one or both of the following: | 35 |
(A) Contract with the sheriff of the county served by the | 36 |
agency to compensate the sheriff's office for service of process, | 37 |
which may include additional incentives for successful service of | 38 |
process; | 39 |
(B) Contract with a private person or entity to provide | 40 |
service of process for the agency. | 41 |
Section 2. That existing sections 3121.59 and 3121.64 and | 42 |
sections Sec. 3121.60. and Sec. 3121.63. of the Revised Code are hereby | 43 |
repealed. | 44 |
