To amend sections 4725.18 and 4733.11 of the Revised | 1 |
Code to permit the State Board of Optometry to | 2 |
license optometrists licensed by another state or | 3 |
a Canadian province regardless of whether the | 4 |
other state or province similarly licenses holders | 5 |
of Ohio licenses and to clarify education | 6 |
requirements in the engineers and surveyors | 7 |
licensing law. | 8 |
Section 1. That sections 4725.18 and 4733.11 of the Revised | 9 |
Code be amended to read as follows: | 10 |
Sec. 4725.18. (A) The state board of optometry may issue a | 11 |
certificate of licensure and therapeutic pharmaceutical agents | 12 |
certificate by endorsement to an individual licensed as an | 13 |
optometrist by another state or a Canadian province if the board | 14 |
determines that the other state or province has standards for the | 15 |
practice of optometry that are at least as stringent as the | 16 |
standards established under sections 4725.01 to 4725.34 of the | 17 |
Revised
Code
and the | 18 |

specified in division (B) of this section. The certificates may be | 21 |
issued only by an affirmative vote of a majority of the board's | 22 |
members. | 23 |
(B) | 24 |
licensure and therapeutic
pharmaceutical agents
certificate | 25 |
pursuant to this section shall submit an application to the board. | 26 |
To receive the certificates, an applicant must meet all of the | 27 |
following conditions: | 28 |
(1) | 29 |

under divisions (B)(1) to (4) of section 4725.12 of the Revised | 31 |
Code to receive a certificate of licensure and therapeutic | 32 |
pharmaceutical agents certificate under that section; | 33 |
(2) Be licensed to practice optometry by a state or province | 34 |
that requires passage of a written, entry-level examination at the | 35 |
time of initial licensure; | 36 |
(3) Be licensed in good standing by the optometry licensing | 37 |
agency of the other state or province, evidenced by submission of | 38 |
a letter from the licensing agency of the other state or province | 39 |
attesting to the applicant's good standing; | 40 |

optometry licensing agencies of all states and provinces in which | 42 |
the applicant is licensed or has been licensed to practice | 43 |
optometry describing all past and pending actions taken by those | 44 |
agencies with respect to the applicant's authority to practice | 45 |
optometry in those jurisdictions, including such actions as | 46 |
investigations, entering into consent agreements, suspensions, | 47 |
revocations, and refusals to issue or renew a license; | 48 |
(5) Have been actively engaged in the practice of optometry, | 49 |
including the use of therapeutic pharmaceutical agents, for at | 50 |
least three years immediately preceding making application under | 51 |
this section; | 52 |

under section 4725.34 of the Revised Code for a certificate of | 54 |
licensure and therapeutic pharmaceutical agents certificate; | 55 |

the board requires; | 57 |
| 58 |
by the board on the optometry statutes and rules of this state or | 59 |
pass an Ohio optometry jurisprudence test administered by the | 60 |
board; | 61 |
(9) Pass all or part of the licensing examination accepted by | 62 |
the board under section 4725.11 of the Revised Code, if the board | 63 |
determines that testing is necessary to determine whether the | 64 |
applicant's qualifications are sufficient for issuance of a | 65 |
certificate of licensure and therapeutic pharmaceutical agents | 66 |

Sec. 4733.11. (A) The state board of registration for | 75 |
professional engineers and surveyors shall consider an applicant | 76 |
to be qualified for registration as a professional engineer if an | 77 |
applicant satisfies all of the requirements listed in either | 78 |
division (A)(1) or (2) of this section as follows: | 79 |
(1)(a) Graduation from an accredited engineering curriculum | 80 |
of four years or more; | 81 |
(b) A specific record of four years or more of practical | 82 |
experience in engineering work completed in addition to, and not | 83 |
overlapping in time, any school work completed under division | 84 |
(A)(1)(a) of this section that is acceptable to the board, not | 85 |
more than two years of which may be before graduation but after | 86 |
the completion of the second year of college, indicating that the | 87 |
applicant is competent to be placed in responsible charge of such | 88 |
work; | 89 |
(c) Passing the prescribed written or written and oral | 90 |
examinations under divisions (A) and (B) of section 4733.13 of the | 91 |
Revised Code. | 92 |
(2)(a) Graduation from a college curriculum in engineering of | 93 |
four years or more that is not approved by the engineering | 94 |
accreditation commission of the accreditation board for | 95 |
engineering and technology, or graduation from a college | 96 |
curriculum in engineering technology of four years or more that is | 97 |
accredited by the technical accreditation commission of the | 98 |
accreditation board for engineering and technology; | 99 |
(b) Eight years or more of practical experience in | 100 |
engineering work completed in addition to, and not overlapping in | 101 |
time, any school work completed under division (A)(2)(a) of this | 102 |
section that is acceptable to the state board of registration for | 103 |
professional engineers and surveyors, not more than two years of | 104 |
which may be before college graduation but after completion of the | 105 |
second year of college, indicating that the applicant is competent | 106 |
to be placed in responsible charge of such work; | 107 |
(c) Passing the prescribed written or written and oral | 108 |
examinations under divisions (A) and (B) of section 4733.13 of the | 109 |
Revised Code. | 110 |
(B) The state board of registration for professional | 111 |
engineers and surveyors shall consider an applicant to be | 112 |
qualified for registration as a professional surveyor if the | 113 |
applicant satisfies all of the requirements listed in either | 114 |
division (B)(1) or (2) of this section as follows: | 115 |
(1)(a) Graduation from an approved curriculum in surveying of | 116 |
four years or more; | 117 |
(b) A specific record of four years or more of surveying | 118 |
office and field experience completed in addition to, and not | 119 |
overlapping in time, any school work completed under division | 120 |
(B)(1)(a) of this section that is of a character acceptable to the | 121 |
board, at least two years of which shall be after college | 122 |
graduation, with at least two of the four years of work in the | 123 |
surveying of land boundaries under the direct supervision of a | 124 |
professional surveyor, who may indicate in writing that the | 125 |
applicant is competent to be placed in responsible charge of the | 126 |
work; | 127 |
(c) Passing the prescribed written or written and oral | 128 |
examinations under divisions (A) and (C) of section 4733.13 of the | 129 |
Revised Code. | 130 |
(2)(a) Graduation from an accredited curriculum in civil | 131 |
engineering of four years or more in a recognized school or | 132 |
college; | 133 |
(b) Successful completion of at least twenty-four quarter | 134 |
hours, or equivalent semester or trimester hours, of approved | 135 |
surveying courses in surveying and mapping arts and sciences, | 136 |
except that courses successfully completed as prior studies may be | 137 |
credited by the board toward this requirement, of which at least | 138 |
eight quarter hours, or equivalent semester or trimester hours, | 139 |
are in surveying of land boundaries; | 140 |
(c) A specific record of four years or more of surveying | 141 |
office and field experience completed in addition to, and not | 142 |
overlapping in time, any school work completed under division | 143 |
(B)(2)(a) of this section that is of a character acceptable to the | 144 |
board, at least two years of which shall be after college | 145 |
graduation, with at least two of the four years of work in | 146 |
surveying of land boundaries under the direct supervision of a | 147 |
professional surveyor, who may indicate in writing that the | 148 |
applicant is competent to be placed in responsible charge of the | 149 |
work; | 150 |
(d) Passing the prescribed written or written and oral | 151 |
examinations under divisions (A) and (C) of section 4733.13 of the | 152 |
Revised Code. | 153 |
(C) Engineering experience, for a professional engineer's | 154 |
practical experience requirement, or surveying experience, for a | 155 |
professional surveyor's practical experience requirement, in any | 156 |
of the armed forces of the United States or civilian war services | 157 |
may be credited for registration, if the experience is acceptable | 158 |
to the board. | 159 |
(D) As used in this section, "an approved curriculum in | 160 |
surveying" is one which has been accredited by the related | 161 |
accreditation committee of the accreditation board for engineering | 162 |
and technology or one which has been approved by the state board | 163 |
of registration for professional engineers and surveyors. | 164 |
(E) No person is eligible for registration as a professional | 165 |
engineer, or professional surveyor, who is not of good character | 166 |
and reputation. | 167 |
(F) In considering the qualifications of applicants, | 168 |
responsible charge of engineering or surveying teaching may be | 169 |
construed as responsible charge of engineering or surveying work, | 170 |
respectively. No applicant shall receive credit for more than six | 171 |
years of engineering or surveying experience because of | 172 |
educational qualifications. The mere execution, as a contractor, | 173 |
of work designed by a professional engineer or professional | 174 |
surveyor, or the supervision of the construction of such work as a | 175 |
superintendent is not deemed to be practical experience in | 176 |
engineering or surveying work. | 177 |
(G) Every person applying for registration as a professional | 178 |
engineer or professional surveyor shall be required to pass the | 179 |
fundamentals examination and the principles and practice | 180 |
examination as provided in section 4733.13 of the Revised Code. In | 181 |
addition to passing each requisite examination, each applicant | 182 |
must submit evidence, satisfactory to the board, that the | 183 |
applicant has completed the practical experience required in this | 184 |
section. | 185 |
(H) The board shall require the applicant for registration as | 186 |
a professional engineer or professional surveyor to take two | 187 |
examinations. The first examination, known as the fundamentals | 188 |
examination, may be taken by the applicant at any time after the | 189 |
applicant has completed the required education under division (A) | 190 |
or (B) of this section, or, at the discretion of the board, an | 191 |
applicant may be permitted to take the first examination during | 192 |
the applicant's concluding term of an approved curriculum in | 193 |
engineering or surveying of four years or more. | 194 |
(I) When the applicant has passed the fundamentals | 195 |
examination, the applicant shall be given an appropriate | 196 |
certificate by the board showing the applicant's status as an | 197 |
engineer intern or surveyor intern. | 198 |
(J) The applicant is not eligible to take the second | 199 |
examination, known as the principles and practice examination, | 200 |
until the applicant has passed the fundamentals examination. | 201 |
(K) Any person having the necessary qualifications to entitle | 202 |
the person to registration is eligible for registration though the | 203 |
person may not be practicing the person's profession at the time | 204 |
of making application. | 205 |
Section 2. That existing sections 4725.18 and 4733.11 of the | 206 |
Revised Code are hereby repealed. | 207 |
