A BILL
To amend sections 4725.18 and 4733.11 of the Revised 1
Code to permit the State Board of Optometry to 2
license optometrists licensed by another state or 3
a Canadian province regardless of whether the 4
other state or province similarly licenses holders 5
of Ohio licenses and to clarify education 6
requirements in the engineers and surveyors 7
licensing law.8


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That sections 4725.18 and 4733.11 of the Revised 9
Code be amended to read as follows:10

       Sec. 4725.18.  (A) The state board of optometry may issue a11
certificate of licensure and therapeutic pharmaceutical agents12
certificate by endorsement to an individual licensed as an13
optometrist by another state or a Canadian province if the board14
determines that the other state or province has standards for the15
practice of optometry that are at least as stringent as the16
standards established under sections 4725.01 to 4725.34 of the17
Revised Code and the other state similarly grants licenses to18
practice optometry to individuals who hold certificates of19
licensure issued by the boardindividual meets the conditions 20
specified in division (B) of this section. The certificates may be 21
issued only by an affirmative vote of a majority of the board's 22
members.23

       (B) To receiveAn individual seeking a certificate of 24
licensure and therapeutic pharmaceutical agents certificate under25
pursuant to this section shall submit an application to the board. 26
To receive the certificates, an applicant must meet all of the 27
following conditions:28

       (1) Hold a license to practice optometry from the other state29
that isMeet the same qualifications that an individual must meet 30
under divisions (B)(1) to (4) of section 4725.12 of the Revised 31
Code to receive a certificate of licensure and therapeutic 32
pharmaceutical agents certificate under that section;33

        (2) Be licensed to practice optometry by a state or province 34
that requires passage of a written, entry-level examination at the 35
time of initial licensure;36

        (3) Be licensed in good standing by the optometry licensing 37
agency of the other state or province, evidenced by submission of38
a letter from the licensing agency of the other state or province 39
attesting to the applicant's good standing;40

       (2)(4) Provide the board with certified reports from the 41
optometry licensing agencies of all states and provinces in which 42
the applicant is licensed or has been licensed to practice 43
optometry describing all past and pending actions taken by those 44
agencies with respect to the applicant's authority to practice 45
optometry in those jurisdictions, including such actions as 46
investigations, entering into consent agreements, suspensions, 47
revocations, and refusals to issue or renew a license;48

        (5) Have been actively engaged in the practice of optometry,49
including the use of therapeutic pharmaceutical agents, for at50
least three years immediately preceding making application under51
this section;52

       (3)(6) Pay the nonrefundable application fees established53
under section 4725.34 of the Revised Code for a certificate of54
licensure and therapeutic pharmaceutical agents certificate;55

       (4)(7) Submit all transcripts, reports, or other information56
the board requires;57

       (5)(8) Participate in a two-hour instruction session provided 58
by the board on the optometry statutes and rules of this state or 59
pass an Ohio optometry jurisprudence test administered by the 60
board;61

        (9) Pass all or part of the licensing examination accepted by 62
the board under section 4725.11 of the Revised Code, if the board 63
determines that testing is necessary to determine whether the 64
applicant's qualifications are sufficient for issuance of a65
certificate of licensure and therapeutic pharmaceutical agents66
certificate under this section.67

       (C) If the applicant meets the conditions specified in68
division (B) of this section and the board has not;69

       (10) Not have been previously denied issuance of a license to 70
the applicant,certificate by the board may, by an affirmative 71
vote of a majority of its members, issue to the applicant a72
certificate of licensure and therapeutic pharmaceutical agents73
certificate.74

       Sec. 4733.11.  (A) The state board of registration for75
professional engineers and surveyors shall consider an applicant 76
to be qualified for registration as a professional engineer if an77
applicant satisfies all of the requirements listed in either78
division (A)(1) or (2) of this section as follows:79

       (1)(a) Graduation from an accredited engineering curriculum 80
of four years or more;81

       (b) A specific record of four years or more of practical82
experience in engineering work completed in addition to, and not83
overlapping in time, any school work completed under division84
(A)(1)(a) of this section that is acceptable to the board, not85
more than two years of which may be before graduation but after86
the completion of the second year of college, indicating that the87
applicant is competent to be placed in responsible charge of such88
work;89

       (c) Passing the prescribed written or written and oral 90
examinations under divisions (A) and (B) of section 4733.13 of the91
Revised Code.92

       (2)(a) Graduation from a college curriculum in engineering of 93
four years or more that is not approved by the engineering94
accreditation commission of the accreditation board for95
engineering and technology, or graduation from a college96
curriculum in engineering technology of four years or more that is 97
accredited by the technical accreditation commission of the 98
accreditation board for engineering and technology;99

       (b) Eight years or more of practical experience in100
engineering work completed in addition to, and not overlapping in101
time, any school work completed under division (A)(2)(a) of this102
section that is acceptable to the state board of registration for103
professional engineers and surveyors, not more than two years of104
which may be before college graduation but after completion of the105
second year of college, indicating that the applicant is competent106
to be placed in responsible charge of such work;107

       (c) Passing the prescribed written or written and oral108
examinations under divisions (A) and (B) of section 4733.13 of the109
Revised Code.110

       (B) The state board of registration for professional111
engineers and surveyors shall consider an applicant to be112
qualified for registration as a professional surveyor if the113
applicant satisfies all of the requirements listed in either114
division (B)(1) or (2) of this section as follows:115

       (1)(a) Graduation from an approved curriculum in surveying of116
four years or more;117

       (b) A specific record of four years or more of surveying118
office and field experience completed in addition to, and not119
overlapping in time, any school work completed under division120
(B)(1)(a) of this section that is of a character acceptable to the121
board, at least two years of which shall be after college122
graduation, with at least two of the four years of work in the123
surveying of land boundaries under the direct supervision of a124
professional surveyor, who may indicate in writing that the125
applicant is competent to be placed in responsible charge of the126
work;127

       (c) Passing the prescribed written or written and oral128
examinations under divisions (A) and (C) of section 4733.13 of the129
Revised Code.130

       (2)(a) Graduation from an accredited curriculum in civil131
engineering of four years or more in a recognized school or132
college;133

       (b) Successful completion of at least twenty-four quarter134
hours, or equivalent semester or trimester hours, of approved135
surveying courses in surveying and mapping arts and sciences,136
except that courses successfully completed as prior studies may be137
credited by the board toward this requirement, of which at least138
eight quarter hours, or equivalent semester or trimester hours,139
are in surveying of land boundaries;140

       (c) A specific record of four years or more of surveying141
office and field experience completed in addition to, and not142
overlapping in time, any school work completed under division143
(B)(2)(a) of this section that is of a character acceptable to the 144
board, at least two years of which shall be after college145
graduation, with at least two of the four years of work in146
surveying of land boundaries under the direct supervision of a147
professional surveyor, who may indicate in writing that the148
applicant is competent to be placed in responsible charge of the149
work;150

       (d) Passing the prescribed written or written and oral151
examinations under divisions (A) and (C) of section 4733.13 of the152
Revised Code.153

       (C) Engineering experience, for a professional engineer's154
practical experience requirement, or surveying experience, for a155
professional surveyor's practical experience requirement, in any156
of the armed forces of the United States or civilian war services 157
may be credited for registration, if the experience is acceptable158
to the board.159

       (D) As used in this section, "an approved curriculum in160
surveying" is one which has been accredited by the related161
accreditation committee of the accreditation board for engineering162
and technology or one which has been approved by the state board163
of registration for professional engineers and surveyors.164

       (E) No person is eligible for registration as a professional165
engineer, or professional surveyor, who is not of good character166
and reputation.167

       (F) In considering the qualifications of applicants,168
responsible charge of engineering or surveying teaching may be169
construed as responsible charge of engineering or surveying work,170
respectively. No applicant shall receive credit for more than six 171
years of engineering or surveying experience because of172
educational qualifications. The mere execution, as a contractor,173
of work designed by a professional engineer or professional174
surveyor, or the supervision of the construction of such work as a 175
superintendent is not deemed to be practical experience in176
engineering or surveying work.177

       (G) Every person applying for registration as a professional 178
engineer or professional surveyor shall be required to pass the 179
fundamentals examination and the principles and practice 180
examination as provided in section 4733.13 of the Revised Code. In 181
addition to passing each requisite examination, each applicant 182
must submit evidence, satisfactory to the board, that the 183
applicant has completed the practical experience required in this 184
section.185

       (H) The board shall require the applicant for registration as 186
a professional engineer or professional surveyor to take two 187
examinations. The first examination, known as the fundamentals188
examination, may be taken by the applicant at any time after the189
applicant has completed the required education under division (A) 190
or (B) of this section, or, at the discretion of the board, an191
applicant may be permitted to take the first examination during192
the applicant's concluding term of an approved curriculum in193
engineering or surveying of four years or more.194

       (I) When the applicant has passed the fundamentals195
examination, the applicant shall be given an appropriate196
certificate by the board showing the applicant's status as an197
engineer intern or surveyor intern.198

       (J) The applicant is not eligible to take the second199
examination, known as the principles and practice examination,200
until the applicant has passed the fundamentals examination.201

       (K) Any person having the necessary qualifications to entitle 202
the person to registration is eligible for registration though the 203
person may not be practicing the person's profession at the time 204
of making application.205

       Section 2. That existing sections 4725.18 and 4733.11 of the 206
Revised Code are hereby repealed.207
