A BILL
To authorize the conveyance of state-owned real 1
estate located in Warren County to the City of 2
Mason, and to declare an emergency.3


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. The Governor is hereby authorized to execute a 4
deed in the name of the state, conveying to the City of Mason in 5
Warren County, and its successors and assigns, all of the state's 6
right, title, and interest in the following described real estate:7

       Parcel Number 1:8

       Situated in Section 5, Town 3, Range 2, City of Mason, Warren 9
County, Ohio and being a 22.929 acre parcel further described as 10
follows:11

       Begin at a found 1" iron pin on the southeast corner of lot 9 12
of Glenmeadow Subdivision, as recorded in Plat Book 26, page 42-43 13
of the Warren County Recorder's Office, said pin also on a 14
northerly line of Charlie and Bonnie Lawson, as recorded in 15
Official Record 437, page 355; thence, departing said Lawson, and 16
with said Glenmeadow, North 04°27'50" East, 1366.92 feet, to a 17
found 1" iron pin on a southerly line of Everybody's Farm, as 18
recorded in Official Record 1607, Page 525; thence, departing said 19
Glenmeadow, and with said Everybody's Farm, the following two 20
courses: North 78°16'54" East, 621.07 feet, to a set 5/8" iron 21
pin; thence, South 85°32'10" East, 220.00 feet, to a point being 22
referenced by a found 5/8" iron pin, North 04°56'30" West, 0.20 23
feet, said point being the true point of beginning:24

       thence from the true point of beginning thus found, 25
continuing with said Everybody's Farm, the following four courses: 26
South 40°47'57" East, 343.34 feet, to a point being referenced by 27
a found 5/8" iron pin, South 74°37'43" East, 0.28 feet;28

       thence South 11°18'42" West, 497.25 feet, to a point being 29
referenced by a found disturbed 5/8" iron pin, South 05°42'25" 30
West, 0.14 feet;31

       thence South 24°39'00" West, 280.00 feet, to a point being 32
referenced by a found 5/8" iron pin, North 68°34'00" East, 0.39 33
feet;34

       thence South 40°21'00" East, passing a point being referenced 35
by a found 5/8" iron pin, South 49°39'00" West, 0.11 feet, at 36
150.37 feet, and a point being referenced by a found 5/8" iron 37
pin, North 49°39'00" West, 0.25 feet at 159.82 feet, a total 38
distance of 200.00 feet, to the centerline of Reading Road;39

       thence departing said Everybody's Farm, and with said 40
centerline, South 49°39'00" West, 1071.83 feet;41

       thence departing said centerline, and with the new division 42
line, the following five courses: North 04°24'30" East, 402.77 43
feet, to a set 5/8" iron pin;44

       thence South 89°00'18" West, 265.86 feet, to a set 5/8" iron 45
pin;46

       thence North 04°27'50" East, 820.00 feet, to a set 5/8" iron 47

       thence South 85°32'28" East, 598.58 feet, to a set 5/8" iron 49

       thence North 20°17'34" East, 725.46 feet, to the true point 51
of beginning, containing 22.929 acres of land subject to all 52
easements and rights of way of record.53

       The above description was prepared from a survey made by 54
Jeffrey O. Lambert, Registered Surveyor #7568 in the State of 55
Ohio, April 10, 2003. The Plat of which is recorded in Volume____, 56
Page____, of the Warren County Engineer's Record of Land Division.57

       Parcel Number 2:60

       Situated in Section 5, Town 3, Range 2, City of Mason, Warren 61
County, Ohio and being a 11.000 acre parcel further described as 62
follows:63

       Begin at found 1" iron pin on the southeast corner of lot 9 64
of Glenmeadow Subdivision, as recorded in Plat Book 26, page 42-43 65
of the Warren County Recorder's Office, said pin also on a 66
northerly line of Charlie and Bonnie Lawson, as recorded in 67
Official Record 437, page 355, and the true point of beginning;68

       thence from the true point of beginning, departing said 69
Lawson, and continuing with said Glenmeadow, North 04°27'50" East, 70
passing a found 1/2" iron pin at 1205.44 feet, a total distance of 71
1366.92 feet, to a found 1" iron pin on the southerly line of 72
Everybody's Farm, as recorded in Official Record 1607, page 525;73

       thence departing said Glenmeadow Subdivision, and with said 74
Everybody's Farm, the following 2 courses:75

       thence North 78°16'54" East, 621.07 feet, to a set 5/8" iron 76

       thence South 85°32'10" East, 220.00 feet, to a point being 78
referenced by a found 5/8" iron pin, North 04°56'30" West, 0.20 79

       thence departing said Everybody's Farm, and with the new 81

       thence departing said division line, and with said 92
centerline, South 49°39'00" West, 28.17 feet, to a point on a 93
westerly line of said Lawson;94

       thence departing said centerline, and with said Lawson, the 95
following two courses: North 04°24'30" East, passing a set 5/8" 96
iron pin at 70.40 feet, a total distance of 400.62 feet, to a 97
found stone;98

       thence South 89°00'18" West, 265.88 feet, to the true point 99
of beginning, containing 11.000 acres of land subject to all 100
easements and rights of way of record.101

       The above description was prepared from a survey made by 102
Jeffrey O. Lambert, Registered Surveyor #7568 in the State of 103
Ohio, April 10, 2003.104

       The Plat of which is recorded in Volume____, Page____, of the 105
Warren County Engineer's Record of Land Division.106

       Section 2. Consideration for the conveyance of the real 107
estate described in Section 1 of this act is the purchase price of 108
$105,000.00.109

       Section 3.  The conveyance of the real estate described in 110
Section 1 of this act as Parcel Number 2 is subject to the 111
condition that the City of Mason convey Parcel Number 2 to the 112
Warren County Board of Mental Retardation and Developmental 113
Disabilities within six months from the effective date of this 114
act. If the City of Mason does not convey Parcel Number 2 to the 115
Warren County Board of Mental Retardation and Developmental 116
Disabilities within that six-month period, all right, title, and 117
interest in the real estate described in Section 1 of this act as 118
Parcel Number 2 shall revert to the state without the need for any 119
further action by the state.120

       Section 4. The conveyance of real estate described in Section 121
1 of this act is subject to the condition that the city of Mason 122
shall provide reasonable access to Parcel Number 2 over and 123
through Parcel Number 1.124

       Section 5. Upon payment of the purchase price, the Auditor of 125
State, with the assistance of the Attorney General, shall prepare 126
a deed to the real estate described in Section 1 of this act. The 127
deed shall state the consideration, conditions, and possibility of 128
reverter described in Sections 2, 3, and 4 of this act. The deed 129
shall be executed by the Governor in the name of the state, 130
countersigned by the Secretary of State, sealed with the Great 131
Seal of the State, presented in the Office of the Auditor of State 132
for recording, and delivered to the City of Mason. The City of 133
Mason shall present the deed for recording in the Office of the 134
Warren County Recorder.135

       Section 6. The City of Mason shall pay the costs of the 136
conveyance of the real estate described in Section 1 of this act.137

       Section 7. This act shall expire one year after its effective 138
date.139

       Section 8. This act is hereby declared to be an emergency 140
measure necessary for the immediate preservation of the public 141
peace, health, and safety. The reason for the necessity is that 142
immediate action is required to enable the City of Mason to 143
provide storm water, drainage, and flood control. Therefore, this 144
act shall go into immediate effect.145
