Section 3. The conveyance of the real estate described in | 101 |
Section 1 of this act as Parcel Number 1 is subject to the | 102 |
condition that the city of Mason is not to use the parcel for any | 103 |
type of residential or commercial facility. If the city of Mason | 104 |
uses the parcel for any type of residential or commercial | 105 |
facility, all right, title, and interest in the parcel shall | 106 |
revert to the state without the need for any further action by the | 107 |
state. | 108 |
Further, the conveyance of the real estate described in | 109 |
Section 1 of this act as Parcel Number 1 is subject to the | 110 |
condition that the city of Mason is not to convey any or all of | 111 |
the parcel to any non-state entity for a period of fifteen years | 112 |
from the effective date of this act. If the city of Mason attempts | 113 |
to convey any or all of the parcel contrary to this provision, all | 114 |
right, title, and interest in the parcel shall immediately revert | 115 |
to the state without the need for any further action by the state. | 116 |
Section 4. The conveyance of the real estate described in | 117 |
Section 1 of this act as Parcel Number 2 is subject to the | 118 |
condition that the city of Mason convey the parcel to the Board of | 119 |
County Commissioners of Warren County on behalf of the Warren | 120 |
County Board of Mental Retardation and Developmental Disabilities | 121 |
within six months from the effective date of this act. If the city | 122 |
of Mason does not convey the parcel to the Board of County | 123 |
Commissioners of Warren County on behalf of the Warren County | 124 |
Board of Mental Retardation and Developmental Disabilities within | 125 |
that six-month period, all right, title, and interest in the | 126 |
parcel shall revert to the state without the need for any further | 127 |
action by the state. | 128 |
Further, in the conveyance of the real estate described in | 129 |
Section 1 of this act as Parcel Number 2 to the Board of County | 130 |
Commissioners of Warren County on behalf of the Warren County | 131 |
Board of Mental Retardation and Developmental Disabilities, the | 132 |
city of Mason shall include a condition that the parcel is not to | 133 |
be used for any residential or commercial facilities. If the city | 134 |
of Mason does not include that condition in that conveyance, all | 135 |
right, title, and interest in the parcel shall revert to the state | 136 |
without the need for any further action by the state. | 137 |
And, further, in the conveyance of the real estate described | 138 |
in Section 1 of this act as Parcel Number 2 to the Board of County | 139 |
Commissioners of Warren County on behalf of the Warren County | 140 |
Board of Mental Retardation and Developmental Disabliities, the | 141 |
city of Mason shall include a condition that the county is not to | 142 |
convey any or all of the parcel to any non-state entity for a | 143 |
period of fifteen years from the date of the conveyance. If the | 144 |
city of Mason does not include that condition in the conveyance to | 145 |
the Board of County Commissioners of Warren County, all right, | 146 |
title, and interest in the parcel shall immediately revert to the | 147 |
state without the need for any further action by the state. | 148 |
Section 6. Upon payment of the purchase price, the Auditor of | 153 |
State, with the assistance of the Attorney General, shall prepare | 154 |
a deed to the real estate described in Section 1 of this act. The | 155 |
deed shall state the consideration, conditions, and possibilities | 156 |
of reverter described in Sections 2, 3, 4, and 5 of this act. The | 157 |
deed shall be executed by the Governor in the name of the state, | 158 |
countersigned by the Secretary of State, sealed with the Great | 159 |
Seal of the State, presented in the Office of the Auditor of State | 160 |
for recording, and delivered to the city of Mason. The city of | 161 |
Mason shall present the deed for recording in the Office of the | 162 |
Warren County Recorder. | 163 |
