A BILL
To enact section 4511.121 of the Revised Code to 1
prohibit the use or possession of a mobile 2
infrared transmitter under certain conditions.3


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 4511.121 of the Revised Code be 4
enacted to read as follows:5

       Sec. 4511.121. (A)(1) No person shall possess a mobile 6
infrared transmitter if all of the following apply:7

       (a) The transmitter is readily accessible to a power source.8

       (b) The transmitter is in operable condition.9

       (c) The person is located in the near vicinity of a traffic 10
control signal so that the transmitter is capable of affecting the 11
operation of the traffic control signal.12

       (2) No person shall use a mobile infrared transmitter to 13
affect the operation of the traffic control signal.14

       (B) This section does not apply to either of the following:15

       (1) Any person acting in an official capacity on behalf of 16
the state or local authority having jurisdiction over a traffic 17
control signal;18

       (2) A person while occupying a public safety vehicle as 19
defined in division (E)(1), (2), (3), or (4) of section 4511.01 of 20
the Revised Code.21

       (C) Whoever violates division (A)(1) of this section is 22
guilty of a misdemeanor of the fourth degree. Whoever violates 23
division (A)(2) of this section is guilty of a misdemeanor of the 24
first degree.25

       (D) As used in this section, "mobile infrared transmitter" 26
means any device or mechanism that emits infrared signals with the 27
purpose of affecting the operation of a traffic control signal.28
