| To enact section 4511.121 of the Revised Code to | 1 |
| prohibit the use or possession of a mobile | 2 |
| infrared transmitter under certain conditions. | 3 |
| Section 1. That section 4511.121 of the Revised Code be | 4 |
| enacted to read as follows: | 5 |
| Sec. 4511.121. (A)(1) No person shall possess a mobile | 6 |
| infrared transmitter if all of the following apply: | 7 |
| (a) The transmitter is readily accessible to a power source. | 8 |
| (b) The transmitter is in operable condition. | 9 |
| (c) The person is located in the near vicinity of a traffic | 10 |
| control signal so that the transmitter is capable of affecting the | 11 |
| operation of the traffic control signal. | 12 |
| (2) No person shall use a mobile infrared transmitter to | 13 |
| affect the operation of the traffic control signal. | 14 |
| (B) This section does not apply to either of the following: | 15 |
| (1) Any person acting in an official capacity on behalf of | 16 |
| the state or local authority having jurisdiction over a traffic | 17 |
| control signal; | 18 |
| (2) A person while occupying a public safety vehicle as | 19 |
| defined in division (E)(1), (2), (3), or (4) of section 4511.01 of | 20 |
| the Revised Code. | 21 |
| (C) Whoever violates division (A)(1) of this section is | 22 |
| guilty of a misdemeanor of the fourth degree. Whoever violates | 23 |
| division (A)(2) of this section is guilty of a misdemeanor of the | 24 |
| first degree. | 25 |
| (D) As used in this section, "mobile infrared transmitter" | 26 |
| means any device or mechanism that emits infrared signals with the | 27 |
| purpose of affecting the operation of a traffic control signal. | 28 |
