A BILL
To amend section 4507.23 and to enact section1
4507.232 of the Revised Code to provide that when2
a temporary instruction permit is issued, the3
Registrar of Motor Vehicles or deputy registrar4
also issue a removable sticker or banner that5
reads "student driver."6


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 4507.23 be amended and section7
4507.232 of the Revised Code be enacted to read as follows:8

       Sec. 4507.23.  (A) Except as provided in division (H) of this 9
section, each application for a temporary instruction permit and 10
examination shall be accompanied by a fee of fourfive dollars.11

       (B) Except as provided in division (H) of this section, each12
application for a driver's license made by a person who previously13
held such a license and whose license has expired not more than14
two years prior to the date of application, and who is required15
under this chapter to give an actual demonstration of the person's16
ability to drive, shall be accompanied by a fee of three dollars17
in addition to any other fees.18

       (C) Except as provided in divisions (E) and (H) of this19
section, each application for a driver's license, or motorcycle20
operator's endorsement, or renewal of a driver's license shall be21
accompanied by a fee of six dollars. Except as provided in22
division (H) of this section, each application for a duplicate23
driver's license shall be accompanied by a fee of two dollars and24
fifty cents. The duplicate driver's licenses issued under this25
section shall be distributed by the deputy registrar in accordance26
with rules adopted by the registrar of motor vehicles.27

       (D) Except as provided in division (H) of this section, each28
application for a motorized bicycle license or duplicate thereof29
shall be accompanied by a fee of two dollars and fifty cents.30

       (E) Except as provided in division (H) of this section, each31
application for a driver's license or renewal of a driver's32
license that will be issued to a person who is less than33
twenty-one years of age shall be accompanied by whichever of the34
following fees is applicable:35

       (1) If the person is sixteen years of age or older, but less36
than seventeen years of age, a fee of seven dollars and37
twenty-five cents;38

       (2) If the person is seventeen years of age or older, but39
less than eighteen years of age, a fee of six dollars;40

       (3) If the person is eighteen years of age or older, but less 41
than nineteen years of age, a fee of four dollars and seventy-five 42
cents;43

       (4) If the person is nineteen years of age or older, but less 44
than twenty years of age, a fee of three dollars and fifty cents;45

       (5) If the person is twenty years of age or older, but less46
than twenty-one years of age, a fee of two dollars and twenty-five47
cents.48

       (F) Neither the registrar nor any deputy registrar shall49
charge a fee in excess of one dollar and fifty cents for50
laminating a driver's license, motorized bicycle license, or51
temporary instruction permit identification cards as required by52
sections 4507.13 and 4511.521 of the Revised Code. A deputy53
registrar laminating a driver's license, motorized bicycle54
license, or temporary instruction permit identification cards55
shall retain the entire amount of the fee charged for lamination,56
less the actual cost to the registrar of the laminating materials57
used for that lamination, as specified in the contract executed by58
the bureau for the laminating materials and laminating equipment.59
The deputy registrar shall forward the amount of the cost of the60
laminating materials to the registrar for deposit as provided in61
this section.62

       (G) At the time and in the manner provided by section 4503.10 63
of the Revised Code, the deputy registrar shall transmit the fees 64
collected under divisions (A), (B), (C), (D), and (E), and those 65
portions of the fees specified in and collected under division (F) 66
of this section to the registrar. The registrar shall pay two 67
dollars and fifty cents of each fee collected under divisions (A), 68
(B), (C), (D), and (E)(1) to (4) of this section, and the entire 69
fee collected under division (E)(5) of this section, into the 70
state highway safety fund established in section 4501.06 of the 71
Revised Code, and such fees shall be used for the sole purpose of 72
supporting driver licensing activities. The remaining fees 73
collected by the registrar under this section shall be paid into 74
the state bureau of motor vehicles fund established in section 75
4501.25 of the Revised Code.76

       (H) A disabled veteran who has a service-connected disability 77
rated at one hundred per cent by the veterans' administration may 78
apply to the registrar or a deputy registrar for the issuance to 79
that veteran, without the payment of any fee prescribed in this 80
section, of any of the following items:81

       (1) A temporary instruction permit and examination;82

       (2) A new, renewal, or duplicate driver's or commercial83
driver's license;84

       (3) A motorcycle operator's endorsement;85

       (4) A motorized bicycle license or duplicate thereof;86

       (5) Lamination of a driver's license, motorized bicycle87
license, or temporary instruction permit identification card as88
provided in division (F) of this section, if the circumstances89
specified in division (H)(5) of this section are met.90

       If the driver's license, motorized bicycle license, or91
temporary instruction permit identification card of a disabled92
veteran described in division (H) of this section is laminated by93
a deputy registrar who is acting as a deputy registrar pursuant to94
a contract with the registrar that is in effect on October 14,95
1997, the disabled veteran shall be required to pay the deputy96
registrar the lamination fee provided in division (F) of this97
section. If the driver's license, motorized bicycle license, or98
temporary instruction permit identification card of such a99
disabled veteran is laminated by a deputy registrar who is acting100
as a deputy registrar pursuant to a contract with the registrar101
that is executed after October 14, 1997, the disabled veteran is102
not required to pay the deputy registrar the lamination fee103
provided in division (F) of this section.104

       A disabled veteran whose driver's license, motorized bicycle105
license, or temporary instruction permit identification card is106
laminated by the registrar is not required to pay the registrar107
any lamination fee.108

       An application made under division (H) of this section shall109
be accompanied by such documentary evidence of disability as the110
registrar may require by rule.111

       Sec. 4507.232. When the registrar of motor vehicles or a112
deputy registrar issues a temporary instruction permit under this113
chapter, the registrar or deputy registrar also shall issue to the114
applicant a sticker or banner that reads "student driver." When115
the holder of the temporary instruction permit operates a motor116
vehicle, the sticker or banner may be displayed on the motor117
vehicle to inform other motor vehicle operators that the motor118
vehicle is being operated by a holder of a temporary instruction119
permit, but such display is not required.120

       The sticker or banner may be displayed on the front 121
windshield, a side window, or the rear window of the motor vehicle 122
notwithstanding section 4513.24 and division (F) of section 123
4513.241 of the Revised Code or any rule adopted thereunder, 124
except that the sticker or banner may not be displayed in the 125
front windshield in such a manner as to conceal the vehicle 126
identification number of the motor vehicle if that number is 127
located inside the vehicle passenger compartment and is placed so 128
as to be readable from outside the motor vehicle through the front 129
windshield.130

        The registrar shall determine the size of the sticker or131
banner, which shall not exceed four inches in height by twelve132
inches in length, and the material and all other properties of the133
sticker or banner, but shall select a material so that the sticker134
or banner can be transferred readily from one motor vehicle to135
another.136

       Section 2. That existing section 4507.23 of the Revised Code137
is hereby repealed.138
