To amend section 5517.02 and to enact sections | 1 |

5533.73 of the Revised Code to designate | 3 |
Interstate Route 75 as the "Pearl Harbor Memorial | 4 |
Highway" and to permit the Director of | 5 |
Transportation to erect markers along the highway | 6 |
indicating its name, to name four roads and a | 7 |
bridge in Butler County, and to specify those | 8 |
Department of Transportation projects requiring | 9 |
the use of a force account project assessment | 10 |
form. | 11 |
Section 1. That section 5517.02 be amended and sections | 12 |
5533.241, 5533.69, 5533.70, 5533.71, 5533.72, and 5533.73 of the | 13 |
Revised Code be enacted to read as follows: | 14 |
Sec. 5517.02. (A) Before undertaking the construction, | 15 |
reconstruction by widening or resurfacing, or
improvement | 16 |

thereon, or the installation | 18 |
control signal on a state highway, the director of transportation | 19 |
shall make an estimate of the cost of the work using the force | 20 |
account project assessment form developed by the auditor of state | 21 |
under section 117.16 of the Revised Code. In constructing, or | 22 |
reconstructing by widening or resurfacing, improving, maintaining, | 23 |
and repairing state highways, and the bridges and culverts | 24 |
thereon, and in installing, maintaining, and repairing traffic | 25 |
control signals on state highways, the director, except as | 26 |
provided in division (B) of this section, shall proceed by | 27 |
contract let to the lowest competent and responsible bidder, after | 28 |
advertisement as provided in section 5525.01 of the Revised Code. | 29 |
(B)(1) Where the work contemplated is the construction of a | 30 |
bridge or culvert, or the installation of a traffic control | 31 |
signal, estimated to cost not more than fifty thousand dollars, | 32 |
the director may proceed by employing labor, purchasing materials, | 33 |
and furnishing equipment. | 34 |
(2) The director may also proceed with maintenance or repair | 35 |
work by employing labor, purchasing materials, and furnishing | 36 |
equipment, provided the total estimated cost of the completed | 37 |
operation, or series of connected operations, does not exceed | 38 |
twenty-five thousand dollars per mile of highway, exclusive of | 39 |
structures and traffic control signals, or fifty thousand dollars | 40 |
for any single structure or traffic control signal. | 41 |
(3) The director may proceed by furnishing equipment, | 42 |
purchasing materials, and employing labor in the erection of | 43 |
temporary bridges or the making of temporary repairs to a highway | 44 |
or bridge rendered necessary by flood, landslide, or other | 45 |
extraordinary emergency. If the director determines inability to | 46 |
complete such emergency work by force account, the director may | 47 |
contract for any part of the work, with or without advertising for | 48 |
bids, as the director considers for the best interest of the | 49 |
department of transportation. | 50 |
Sec. 5533.241. (A) In addition to the designation in section | 51 |
5533.24 of the Revised Code, the road known as interstate route | 52 |
seventy-five, running in a southerly direction from the city of | 53 |
Toledo in Lucas county, through the counties of Wood, Hancock, | 54 |
Allen, Auglaize, Shelby, Miami, Montgomery, Warren, and Butler to | 55 |
the city of Cincinnati in Hamilton county, also shall be known as | 56 |
the "Pearl Harbor Memorial Highway." | 57 |
(B) The director of transportation may erect suitable markers | 58 |
along the highway indicating its name. If the director erects such | 59 |
markers, the markers, to the greatest extent possible, shall be | 60 |
located near Toledo, Lima, Dayton, and Cincinnati. | 61 |
(C) The department of transportation may accept private | 62 |
contributions to pay all or part of the costs of manufacturing, | 63 |
erecting, and maintaining the markers. Any private money received | 64 |
by the department for the purposes of this section shall be | 65 |
deposited in the state treasury to the credit of the state highway | 66 |
operating fund or any other fund of the department as determined | 67 |
by the director. | 68 |
Sec. 5533.69. The road known as state route number one | 69 |
hundred twenty-six, commencing in the community of Venice in | 70 |
Butler county and extending westward to the Indiana border, shall | 71 |
be known as the "Governor William Bebb Bicentennial Roadway." | 72 |
The director of transportation may erect suitable markers | 73 |
along the highway indicating its name. | 74 |
Sec. 5533.70. The road known as state route number seven | 75 |
hundred forty-four, commencing in the municipal corporation of | 76 |
Somerville in Butler county and extending eastward to the | 77 |
intersection of that road and state route number one hundred | 78 |
twenty-two in that county, shall be known as the "Governor James | 79 |
M. Cox Bicentennial Roadway." | 80 |
The director of transportation may erect suitable markers | 81 |
along the highway indicating its name. | 82 |
Sec. 5533.71. In addition to the designation in section | 83 |
5533.14 of the Revised Code, the road known as state route number | 84 |
four, commencing at the intersection of that road and High Street | 85 |
in the municipal corporation of Hamilton in Butler county and | 86 |
extending northeasterly to the intersection of that state route | 87 |
and central avenue in the municipal corporation of Middletown in | 88 |
that county, shall be known as the "Governor James E. Campbell | 89 |
Bicentennial Roadway." | 90 |
The director of transportation may erect suitable markers | 91 |
along the highway indicating its name. | 92 |
Sec. 5533.72. The road known as United States route number | 93 |
one hundred twenty-seven, commencing in the municipal corporation | 94 |
of Seven Mile in Butler county and extending northward to the | 95 |
intersection of that United States route and United States route | 96 |
number thirty-five in the municipal corporation of Eaton in Preble | 97 |
county, shall be known as the "Governor Andrew L. Harris | 98 |
Bicentennial Roadway." | 99 |
The director of transportation may erect suitable markers | 100 |
along the highway indicating its name. | 101 |
Sec. 5533.73. The Maud-Hughes road bridge spanning Gregory | 102 |
Creek in Butler county, located at mile twenty-three and | 103 |
eighteen-hundredths of state route number one hundred twenty-nine, | 104 |
shall be known as the "William R. Foster Bridge." | 105 |
The director of transportation may erect suitable markers | 106 |
upon the bridge, or the approaches thereto, indicating its name. | 107 |
Section 2. That existing section 5517.02 of the Revised Code | 108 |
is hereby repealed. | 109 |
