A BILL
To amend sections 5.04 and 5.10 of the Revised Code1
to add a representation of the Wright Brothers'2
first piloted airplane to the Coat of Arms and3
Great Seal of the State of Ohio.4


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1.  That sections 5.04 and 5.10 of the Revised Code5
be amended to read as follows:6

       Sec. 5.04.  The coat of arms of the state shall consist of7
the following device: a circular shield; in the right foreground8
of the shield a full sheaf of wheat bound and standing erect; in9
the left foreground, a cluster of seventeen arrows bound in the10
center and resembling in form the sheaf of wheat; in the11
background, a representation of Mount Logan, Ross county, as12
viewed from Adena state memorial; over the mount, a rising sun13
three-quarters exposed and radiating thirteen rays to represent14
the thirteen original colonies shining over the first state in the15
northwest territory, the exterior extremities of which rays form a16
semicircle; above and to the left of the sun, a representation of17
the first piloted airplane, flown by the Wright brothers in 1903;18
and uniting the background and foreground, a representation of the19
Scioto river and cultivated fields.20

       The coat of arms of the state shall correspond substantially21
with the following design: 22

 

When the coat of arms of the state is reproduced in color, the25
colors used shall be substantially the same as the natural color26
of the terrain and objects shown.27

       Sec. 5.10.  All official seals shall have engraved thereonon28
them the coat of arms of the state, as described in section 5.0429
of the Revised Code.30

       The great seal of the state shall be two and one-half inches31
in diameter and shall consist of the coat of arms of the state32
within a circle having a diameter of one and three-fourths inches,33
surrounded by the words "THE GREAT SEAL OF THE STATE OF OHIO" in34
news gothic capitals. The great seal of the state shall correspond 35
substantially with the following design:36

 

       The design of the great seal shall not be reproduced, except39
as required by any provision of the Ohio Constitution and the40
Revised Code, unless permission to do so is first obtained from41
the governor. The governor may authorize reproduction of the42
design of the great seal when the purpose is to do any of the43
following:44

       (A) Permit publication of a reproduction of the great seal of 45
the state of Ohio;46

       (B) Aid educational or historical programs;47

       (C) Promote the economic or cultural development of the state 48
in a manner deemed appropriate by the governor.49

       A permanent record shall be kept in the governor's office of50
each permit to reproduce the design of the great seal.51

       No person shall use or permit to be used any reproduction or52
facsimile of the great seal or a counterfeit or nonofficial53
version of the great seal for any purpose not authorized by the54
governor.55

       The seal of the supreme court shall consist of the coat of56
arms of the state within a circle one and three-fourths inches in57
diameter and shall be surrounded by the words "THE SUPREME COURT58
OF THE STATE OF OHIO."59

       The seal of each court of appeals, court of common pleas, and60
probate court shall consist of the coat of arms of the state61
within a circle one and one-fourth inches in diameter, and each62
seal shall be surrounded by the words "COURT OF APPEALS,63
................ County, Ohio"; "COMMON PLEAS COURT,64
................ County, Ohio"; or "PROBATE COURT,65
................ County, Ohio."66

       (Insert the name of the proper county.)67

       The seals of all other courts of record shall be of the same68
size as the seal of the court of common pleas, and each shall be69
surrounded by the proper name of the court.70

       The seal of the secretary of state shall consist of the coat71
of arms of the state within a circle one and one-fourth inches in72
diameter and shall be surrounded by the words "THE SEAL OF THE73
SECRETARY OF STATE OF OHIO."74

       The seal of the auditor of state shall consist of the coat of75
arms of the state within a circle of one and one-fourth inches in76
diameter, and shall be surrounded by the words "THE SEAL OF THE77
AUDITOR OF STATE OF OHIO."78

       The seal of the treasurer of state shall consist of the coat79
of arms of the state within a circle one and one-fourth inches in80
diameter, and shall be surrounded by the words "THE SEAL OF THE81
TREASURER OF STATE OF OHIO."82

       The seal of the lieutenant governor shall consist of the coat83
of arms of the state within a circle one and one-fourth inches in84
diameter and shall be surrounded by the words "THE SEAL OF THE85
LIEUTENANT GOVERNOR OF STATE OF OHIO."86

       The seal of the attorney general shall consist of the coat of87
arms of the state within a circle one and one-fourth inches in88
diameter and shall be surrounded by the words "THE SEAL OF THE89
ATTORNEY GENERAL OF STATE OF OHIO."90

       The seal of each benevolent institution shall consist of the91
coat of arms of the state within a circle one and one-fourth92
inches in diameter and shall be surrounded by the proper name of93
the institution.94

       The seals of all other state, county, and municipal agencies,95
divisions, boards, and commissions shall consist of the coat of96
arms of the state within a circle one and one-fourth inches in97
diameter and shall be surrounded by the proper name of the office.98

       All seals mentioned in this section shall contain the words99
and devices mentioned in this section and no other.100

       Section 2.  That existing sections 5.04 and 5.10 of the101
Revised Code are hereby repealed.102
