A BILL
To amend sections 3335.02, 3337.01, 3339.01, 3341.02, 1
3343.02, 3344.01, 3350.01, 3352.01, 3356.01, 2
3357.112, 3359.01, 3360.01, 3361.01, and 3362.01 3
of the Revised Code to permit any technical 4
college that is not co-located with another 5
institution of higher education to acquire housing 6
and dining facilities and to permit the Governor 7
to reappoint trustees of state universities and 8
the Medical College of Ohio.9


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That sections 3335.02, 3337.01, 3339.01, 3341.02, 10
3343.02, 3344.01, 3350.01, 3352.01, 3356.01, 3357.112, 3359.01, 11
3360.01, 3361.01, and 3362.01 of the Revised Code be amended to 12
read as follows:13

       Sec. 3335.02.  (A) The government of the Ohio state14
university shall be vested in a board of eleven trustees, who15
shall be appointed by the governor, with the advice and consent of 16
the senate. Two of the eleven trustees shall be students at the 17
Ohio state university, and their selection and terms shall be in 18
accordance with division (B) of this section. Except for the terms 19
of student members, terms of office shall be for nine years, 20
commencing on the fourteenth day of May and ending on the21
thirteenth day of May. Each trustee shall hold office from the22
date of his appointment until the end of the term for which hethe 23
trustee was appointed. Any trustee appointed to fill a vacancy24
occurring prior to the expiration of the term for which histhe 25
trustee's predecessor was appointed shall hold office for the 26
remainder of such term. Any trustee shall continue in office 27
subsequent to the expiration date of histhe trustee's term until 28
histhe trustee's successor takes office, or until a period of 29
sixty days has elapsed, whichever occurs first. No person who has 30
served a full nine-year term or more than six years of such a term 31
shall be eligible for reappointment until a period of four years 32
has elapsed since the last day of the term for which the person 33
previously served. The trustees shall not receive compensation for 34
their services, but shall be paid their reasonable necessary 35
expenses while engaged in the discharge of their official duties.36

       (B) The student members of the board of trustees of the Ohio 37
state university have no voting power on the board. Student38
members shall not be considered as members of the board in39
determining whether a quorum is present. Student members shall not 40
be entitled to attend executive sessions of the board. The student 41
members of the board shall be appointed by the governor, with the 42
advice and consent of the senate, from a group of five candidates 43
selected pursuant to a procedure adopted by the university's 44
student governments and approved by the university's board of 45
trustees. The initial term of office of one of the student members 46
shall commence on May 14, 1988 and shall expire on May 13, 1989, 47
and the initial term of office of the other student member shall 48
commence on May 14, 1988 and expire on May 13, 1990. Thereafter, 49
terms of office of student members shall be for two years, each 50
term ending on the same day of the same month of the year as the 51
term it succeeds. In the event a student member cannot fulfill his52
a two-year term, a replacement shall be selected to fill the 53
unexpired term in the same manner used to make the original 54
selection.55

       Sec. 3337.01.  (A) The body politic and corporate by the name 56
and style of "The President and Trustees of the Ohio University" 57
now in the university instituted and established in Athens by the 58
name and style of "The Ohio University" shall consist of a board 59
of trustees composed of eleven members, who shall be appointed by 60
the governor, with the advice and consent of the senate. At least 61
five of the trustees who are not students shall be graduates of 62
Ohio university. Two of the trustees shall be students at Ohio 63
university, and their selection and terms shall be in accordance 64
with division (B) of this section. A majority of the board 65
constitutes a quorum. Except for the terms of student members, 66
terms of office shall be for nine years, commencing on the 67
fourteenth day of May and ending on the thirteenth day of May, 68
except that upon expiration of the term ending on May 14, 1978, 69
the new term which succeeds it shall commence on May 15, 1978 and 70
end on May 13, 1987. Each member shall hold office from the date 71
of his appointment until the end of the term for which hethe 72
member was appointed. Any member appointed to fill a vacancy 73
occurring prior to the expiration of the term for which histhe 74
member's predecessor was appointed shall hold office for the 75
remainder of such term. Any member shall continue in office 76
subsequent to the expiration date of histhe member's term until 77
histhe member's successor takes office, or until a period of 78
sixty days has elapsed, whichever occurs first. No person who has 79
served a full nine-year term or more than six years of such a term 80
shall be eligible for reappointment until a period of four years 81
has elapsed since the last day of the term for which the person 82
previously served. Such trustees shall receive no compensation for 83
their services, but shall be paid their actual and necessary 84
expenses while engaged in the discharge of their official duties.85

       (B) The student members of the board of trustees of the Ohio 86
university have no voting power on the board. Student members 87
shall not be considered as members of the board in determing88
determining whether a quorum is present. Student members shall not 89
be entitled to attend executive sessions of the board. The student 90
members of the board shall be appointed by the governor, with the 91
advice and consent of the senate, from a group of five candidates 92
selected pursuant to a procedure adopted by the university's 93
student governments and approved by the university's board of 94
trustees. The initial term of office of one of the student members 95
shall commence on May 14, 1988 and shall expire on May 13, 1989, 96
and the initial term of office of the other student member shall 97
commence on May 14, 1988 and expire on May 13, 1990. Thereafter, 98
terms of office of student members shall be for two years, each 99
term ending on the same day of the same month of the year as the 100
term it succeeds. In the event that a student member cannot 101
fulfill histhe student member's two-year term, a replacement 102
shall be selected to fill the unexpired term in the same manner 103
used to make the original selection.104

       Sec. 3339.01.  (A) The government of Miami university shall 105
be vested in eleven trustees, who shall be appointed by the106
governor with the advice and consent of the senate. Two of the107
trustees shall be students at Miami university, and their108
selection and terms shall be in accordance with division (B) of109
this section. A majority of the board constitutes a quorum. Except 110
for the terms of student members, terms of office shall be for 111
nine years, commencing on the first day of March and ending on the 112
last day of February, except that upon expiration of the trustee 113
term ending on March 1, 1974, the trustee term which succeeds it 114
shall commence on March 2, 1974 and end on February 28, 1983; upon 115
expiration of the trustee term ending on March 1, 1977, the 116
trustee term which succeeds it shall commence on March 2, 1977 and 117
end on February 28, 1986; upon expiration of the trustee term 118
ending on March 1, 1978, the trustee term which succeeds it shall 119
commence on March 2, 1978 and end on February 28, 1987; and upon 120
expiration of the trustee term ending on March 1, 1979, the 121
trustee term which succeeds it shall commence on March 2, 1979 and 122
end on February 29, 1988. Each trustee shall hold office from the 123
date of his appointment until the end of the term for which hethe 124
trustee was appointed. Any trustee appointed to fill a vacancy 125
occurring prior to the end of the term for which histhe trustee's126
predecessor was appointed shall hold office for the remainder of127
such term. Any trustee shall continue in office subsequent to the 128
expiration date of histhe trustee's term until hisa successor 129
takes office, or until a period of sixty days has elapsed, 130
whichever occurs first. No person who has served a full nine-year 131
term or more than six years of such a term shall be eligible for132
reappointment until a period of four years has elapsed since the 133
last day of the term for which the person previously served. The 134
trustees shall receive no compensation for their services but 135
shall be paid their reasonable necessary expenses while engaged in 136
the discharge of their official duties.137

       (B) The student members of the board of trustees of Miami138
university have no voting power on the board. Student members139
shall not be considered as members of the board in determining140
whether a quorum is present. Student members shall not be entitled 141
to attend executive sessions of the board. The student members of 142
the board shall be appointed by the governor, with the advice and 143
consent of the senate, from a group of five candidates selected 144
pursuant to a procedure adopted by the university's student 145
governments and approved by the university's board of trustees. 146
The initial term of office of one of the student members shall 147
commence on March 1, 1988 and shall expire on February 28, 1989, 148
and the initial term of office of the other student member shall 149
commence on March 1, 1988 and expire on February 28, 1990. 150
Thereafter, terms of office of student members shall be for two 151
years, each term ending on the last day of February. In the event 152
that a student member cannot fulfill histhe student member's153
two-year term, a replacement shall be selected to fill the154
unexpired term in the same manner used to make the original155
selection.156

       Sec. 3341.02.  (A) The government of Bowling Green state157
university is vested in a board of eleven trustees, who shall be158
appointed by the governor, with the advice and consent of the159
senate. Two of the trustees shall be students at Bowling Green160
state university, and their selection and terms shall be in161
accordance with division (B) of this section. A majority of the162
board constitutes a quorum. Except for the terms of student163
members, terms of office shall be for nine years, commencing on164
the seventeenth day of May and ending on the sixteenth day of May. 165
No person who has served a full nine-year term or more than six 166
years of such a term shall be eligible for reappointment until a 167
period of four years has elapsed since the last day of the term 168
for which the person previously served.169

       (B) The student members of the board of trustees of Bowling 170
Green state university have no voting power on the board. Student 171
members shall not be considered as members of the board in 172
determining whether a quorum is present. Student members shall not 173
be entitled to attend executive sessions of the board. The student 174
members of the board shall be appointed by the governor, with the 175
advice and consent of the senate, from a group of five candidates 176
selected pursuant to a procedure adopted by the university's 177
student governments and approved by the university's board of 178
trustees. The initial term of office of one of the student members 179
shall commence on March 17, 1988, and shall expire on March 16, 180
1989, and the initial term of office of the other student member 181
shall commence on March 17, 1988, and expire on March 16, 1990. 182
After the effective date of this amendmentSeptember 22, 2000, 183
terms of office shall commence on the seventeenth day of May and 184
shall end on the sixteenth day of May. Terms of office of student185
members shall be for two years, each term ending on the same day186
of the same month of the year as the term it succeeds. In the187
event that a student member cannot fulfill the student member's 188
two-year term, a replacement shall be selected in the manner used 189
for the original selection to fill the unexpired term.190

       (C) The government of Kent state university is vested in a191
board of eleven trustees, who shall be appointed by the governor,192
with the advice and consent of the senate. Two of the trustees193
shall be students at Kent state university, and their selection194
and terms shall be in accordance with division (D) of this195
section. A majority of the board constitutes a quorum. Except for 196
the terms of student members, terms of office shall be for nine 197
years, commencing on the seventeenth day of May and ending on the 198
sixteenth day of May. No person who has served a full nine-year 199
term or more than six years of such a term shall be eligible for 200
reappointment until a period of four years has elapsed since the 201
last day of the term for which the person previously served.202

       (D) The student members of the board of trustees of Kent203
state university have no voting power on the board. Student204
members shall not be considered as members of the board in205
determining whether a quorum is present. Student members shall not 206
be entitled to attend executive sessions of the board. The student 207
members of the board shall be appointed by the governor, with the 208
advice and consent of the senate, from a group of five candidates 209
selected pursuant to a procedure adopted by the university's 210
student governments and approved by the university's board of 211
trustees. The initial term of office of one of the student members 212
shall commence on May 17, 1988, and shall expire on May 16, 1989, 213
and the initial term of office of the other student member shall 214
commence on May 17, 1988, and expire on May 16, 1990. Thereafter, 215
terms of office of student members shall be for two years, each 216
term ending on the same day of the same month of the year as the 217
term it succeeds. In the event that a student member cannot 218
fulfill the student member's two-year term, a replacement shall be 219
selected to fill the unexpired term in the same manner used to 220
make the original selection.221

       (E) The trustees shall receive no compensation for their222
services but shall be paid their reasonable necessary expenses223
while engaged in the discharge of their official duties.224

       (F) Each trustee shall hold office from the date of225
appointment until the end of the term for which the trustee was 226
appointed. Any trustee appointed to fill a vacancy occurring prior 227
to the expiration of the term for which the trustee's predecessor228
was appointed shall hold office for the remainder of such term. 229
Any trustee shall continue in office subsequent to the expiration 230
date of the trustee's term until a successor takes office, or 231
until a period of sixty days has elapsed, whichever occurs first.232

       Sec. 3343.02.  (A) The government of Central state university 233
shall be vested in a board of trustees to be known as "the board 234
of trustees of the Central state university." Such board shall 235
consist of eleven members who shall be appointed by the governor, 236
with the advice and consent of the senate. Two of the trustees 237
shall be students at Central state university, and their selection 238
and terms shall be in accordance with division (B) of this 239
section. A majority of the board constitutes a quorum. Except for 240
the student members, terms of office shall be for nine years, 241
commencing on the first day of July and ending on the thirtieth 242
day of June. Each member shall hold office from the date of his243
appointment until the end of the term for which hethe member was 244
appointed. Any member appointed to fill a vacancy occurring prior 245
to the expiration of the term for which histhe member's246
predecessor was appointed shall hold office for the remainder of 247
such term. Any member shall continue in office subsequent to the248
expiration date of histhe member's term until histhe member's249
successor takes office, or until a period of sixty days has 250
elapsed, whichever occurs first. No person who has served a full251
nine-year term or more than six years of such a term shall be 252
eligible for reappointment until a period of four years has 253
elapsed since the last day of the term for which the person 254
previously served.255

       (B) The student members of the board of trustees of Central 256
state university have no voting power on the board. Student 257
members shall not be considered as members of the board in 258
determining whether a quorum is present. Student members shall not 259
be entitled to attend executive sessions of the board. The student 260
members of the board shall be appointed by the governor, with the 261
advice and consent of the senate, from a group of five candidates 262
selected pursuant to a procedure adopted by the university's 263
student governments and approved by the university's board of 264
trustees. The initial term of office of one of the student members 265
shall commence on July 1, 1988 and shall expire on June 30, 1989, 266
and the initial term of office of the other student member shall 267
commence on July 1, 1988 and expire on June 30, 1990. Thereafter, 268
terms of office of student members shall be for two years, each 269
term ending on the same day of the same month of the year as the 270
term it succeeds. In the event that a student member cannot 271
fulfill hisa two-year term, a replacement shall be selected to 272
fill the unexpired term in the same manner used to make the 273
original selection.274

       Sec. 3344.01.  (A) There is hereby created the Cleveland275
state university. The government of the Cleveland state university 276
is vested in a board of eleven trustees, who shall be appointed by 277
the governor, with the advice and consent of the senate. Two of 278
the trustees shall be students at the Cleveland state university, 279
and their selection and terms shall be in accordance with division 280
(B) of this section. Except for the student members, terms of 281
office shall be for nine years, commencing on the second day of 282
May and ending on the first day of May. Each trustee shall hold 283
office from the date of his appointment until the end of the term 284
for which hethe trustee was appointed. Any trustee appointed to 285
fill a vacancy occurring prior to the expiration of the term for 286
which histhe trustee's predecessor was appointed shall hold 287
office for the remainder of such term. Any trustee shall continue 288
in office subsequent to the expiration date of histhe trustee's289
term until histhe trustee's successor takes office, or until a 290
period of sixty days has elapsed, whichever occurs first. No 291
person who has served a full nine-year term or more than six years292
of such a term shall be eligible for reappointment until a period 293
of four years has elapsed since the last day of the term for which 294
the person previously served. The trustees shall receive no 295
compensation for their services but shall be paid their reasonable 296

       (B) The student members of the board of trustees of the299
Cleveland state university have no voting power on the board.300

members of the board shall be appointed by the governor, with the 304
advice and consent of the senate, from a group of five candidates 305
selected pursuant to a procedure adopted by the university's 306
student governments and approved by the university's board of 307
trustees. The initial term of office of one of the student members 308
shall commence on May 2, 1988 and shall expire on May 1, 1989, and 309
the initial term of office of the other student member shall 310
commence on May 2, 1988 and expire on May 1, 1990. Thereafter, 311
terms of office of student members shall be for two years, each 312
term ending on the same day of the same month of the year as the 313
term it succeeds. In the event that a student member cannot 314
fulfill hisa two-year term, a replacement shall be selected to 315
fill the unexpired term in the same manner used to make the 316
original selection.317

       Sec. 3350.01.  There is hereby created the medical college of 318
Ohio at Toledo. The government of the medical college of Ohio at 319
Toledo is vested in a board of nine trustees, who shall be320
appointed by the governor, with the advice and consent of the321
senate. Upon December 18, 1964, nine trustees shall be appointed322
immediately, one for a term ending May 1, 1965, one for a term323
ending May 1, 1966, one for a term ending May 1, 1967, one for a324
term ending May 1, 1968, one for a term ending May 1, 1969, one325
for a term ending May 1, 1970, one for a term ending May 1, 1971,326
one for a term ending May 1, 1972, and one for a term ending May327
1, 1973. Thereafter, terms of office shall be for nine years,328
commencing on the second day of May and ending on the first day of 329
May. Each trustee shall hold office from the date of his330
appointment until the end of the term for which hethe trustee was 331
appointed. Any trustee appointed to fill a vacancy occurring prior 332
to the expiration of the term for which histhe trustee's333
predecessor was appointed shall hold office for the remainder of 334
such term. Any trustee shall continue in office subsequent to the 335
expiration date of histhe trustee's term until histhe trustee's336
successor takes office, or until a period of sixty days has 337
elapsed, whichever occurs first. No person who has served a full 338
nine-year term or more than six years of such a term shall be 339
eligible to reappointment until a period of four years has elapsed 340
since the last day of the term for which the person previously 341
served. The trustees shall receive no compensation for their 342
services but shall be paid their reasonable necessary expenses 343
while engaged in the discharge of their official duties. A 344
majority of the board constitutes a quorum.345

       Sec. 3352.01.  (A) There is hereby created a state university 346
to be known as "Wright state university." The government of Wright 347
state university is vested in a board of eleven trustees, who 348
shall be appointed by the governor, with the advice and consent of 349
the senate. Two of the trustees shall be students at Wright state 350
university, and their selection and terms shall be in accordance 351
with division (B) of this section. Except for the terms of student 352
members, terms of office shall be for nine years, commencing on 353
the first day of July and ending on the thirtieth day of June. 354
Each trustee shall hold office from the date of his appointment 355
until the end of the term for which hethe trustee was appointed. 356
Any trustee appointed to fill a vacancy occurring prior to the 357
expiration of the term for which histhe trustee's predecessor was 358
appointed shall hold office for the remainder of such term. Any 359
trustee shall continue in office subsequent to the expiration date 360
of histhe trustee's term until histhe trustee's successor takes 361
office, or until a period of sixty days has elapsed, whichever 362
occurs first. No person who has served a full nine-year term or 363
more than six years of such a term shall be eligible for364
reappointment until a period of four years has elapsed since the 365
last day of the term for which the person previously served. The 366
trustees shall receive no compensation for their services but 367

       (B) The student members of the board of trustees of Wright371
state university have no voting power on the board. Student372
members shall not be considered as members of the board in373
determining whether a quorum is present. Student members shall not 374
be entitled to attend executive sessions of the board. The student 375
members of the board shall be appointed by the governor, with the 376
advice and consent of the senate, from a group of five candidates 377
selected pursuant to a procedure adopted by the university's 378
student governments and approved by the university's board of 379
trustees. The initial term of office of one of the student members 380
shall commence on July 1, 1988 and shall expire on June 30, 1989, 381
and the initial term of office of the other student member shall 382
commence on July 1, 1988 and shall expire on June 30, 1990. 383
Thereafter, terms of office of student members shall be for two 384
years, each term ending on the same day of the same month of the 385
year as the term it succeeds. In the event that a student member 386
cannot fulfill hisa two-year term, a replacement shall be 387
selected to fill the unexpired term in the same manner used to 388
make the original selection.389

       Sec. 3356.01. (A) There is hereby created Youngstown state 390
university. The government of Youngstown state university is 391
vested in a board of eleven trustees, who shall be appointed by 392
the governor, with the advice and consent of the senate. Two of 393
the trustees shall be students at Youngstown state university, and 394
their selection and terms shall be in accordance with division (B) 395
of this section. Except for the terms of student members, terms of 396
office shall be for nine years, commencing on the second day of 397
May and ending on the first day of May. Each trustee shall hold 398
office from the date of his appointment until the end of the term 399
for which hethe trustee was appointed. Any trustee appointed to 400
fill a vacancy occurring prior to the expiration of the term for 401
which histhe trustee's predecessor was appointed shall hold 402
office for the remainder of such term. Any trustee shall continue 403
in office subsequent to the expiration date of histhe trustee's404
term until histhe trustee's successor takes office, or until a 405
period of sixty days has elapsed, whichever occurs first. No 406
person who has served a full nine-year term or more than six years 407
of such a term shall be eligible to reappointment until a period 408
of four years has elapsed since the last day of the term for which 409
the person previously served. The trustees shall receive no410
compensation for their services but shall be paid their reasonable 411
necessary expenses while engaged in the discharge of their duties. 412
A majority of the board constitutes a quorum.413

       (B) The student members of the board of trustees of414
Youngstown state university have no voting power on the board.415
Student members shall not be considered as members of the board in 416
determining whether a quorum is present. Student members shall not 417
be entitled to attend executive sessions of the board. The student 418
members of the board shall be appointed by the governor, with the 419
advice and consent of the senate, from a group of five candidates 420
selected pursuant to a procedure adopted by the university's 421
student governments and approved by the university's board of 422
trustees. The initial term of office of one of the student members 423
shall commence on May 2, 1988 and shall expire on May 1, 1989, and 424
the initial term of office of the other student member shall 425
commence on May 2, 1988 and expire on May 1, 1990. Thereafter, 426
terms of office of student members shall be for two years, each 427
term ending on the same day of the same month of the year as the 428
term it succeeds. In the event that a student member cannot 429
fulfill hisa two-year term, a replacement shall be selected to 430
fill the unexpired term in the same manner used to make the 431
original selection.432

       Sec. 3357.112.  (A)(1) Each technical college district may 433
acquire, by purchase, lease, lease-purchase, lease with option to 434
purchase, or otherwise, construct, equip, furnish, reconstruct, 435
alter, enlarge, remodel, renovate, rehabilitate, improve, 436
maintain, repair, and operate, and lease to or from others, 437
auxiliary facilities or education facilities, except housing and 438
dining facilities, and may pay for the facilities out of available439
receipts of such district. To pay all or part of the costs of 440
auxiliary facilities or education facilities, except housing and 441
dining facilities, and any combination of them, and to refund 442
obligations previously issued for such purpose, each technical 443
college district may issue obligations in the manner provided by 444
and subject to the applicable provisions of section 3345.12 of the445
Revised Code.446

       (2) Notwithstanding division (A)(1) of this section, a 447
technical college that is not co-located with another institution 448
of higher education also may acquire, by purchase, lease, 449
lease-purchase, lease with option to purchase, or otherwise, 450
construct, equip, furnish, reconstruct, alter, enlarge, remodel, 451
renovate, rehabilitate, improve, maintain, repair, and operate, 452
and lease to or from others, housing and dining facilities, and 453
may pay for the facilities out of available receipts of the 454
district. To pay all or part of the costs of housing and dining 455
facilities, and to refund obligations previously issued for such 456
purpose, the technical college district may issue obligations in 457
the manner provided by and subject to the applicable provisions of 458
section 3345.12 of the Revised Code.459

       (B) Except as otherwise provided in this section, the 460
definitions set forth in section 3345.12 of the Revised Code apply 461
to this section.462

       (C) Fee variations provided for in division (G) of section 463
3357.09 of the Revised Code need not be applied to fees pledged to464
secure obligations.465

       (D) The obligations authorized by this section are not bonded466
indebtedness of the technical college district, shall not 467
constitute general obligations or the pledge of the full faith and 468
credit of such district, and the holders or owners thereof shall 469
have no right to require the board to levy or collect any taxes 470
for the payment of bond service charges, but they shall have the 471
right to payment thereof solely from the available receipts and472
funds pledged for such payment as authorized by section 3345.12 of 473
the Revised Code and this section.474

       The bond proceedings may provide the method whereby the 475
general administrative overhead expense of the district shall be 476
allocated among the several operations and facilities of the 477
district for purposes of determining any operating and maintenance 478
expenses payable from the pledged available receipts prior to the 479
provision for payment of bond service charges, and for other 480
purposes of the bond proceedings.481

       (E) The powers granted in this section are in addition to any482
other powers at any time granted by the Constitution and laws of 483
the state, and not in derogation thereof or restrictions thereon.484

       Sec. 3359.01.  (A) There is hereby created a state university 485
to be known as "The University of Akron." The government of the 486
university of Akron is vested in a board of eleven trustees who 487
shall be appointed by the governor, with the advice and consent of 488
the senate. Two of the trustees shall be students at the 489
university of Akron, and their selection and terms shall be in 490
accordance with division (B) of this section. Except for the terms 491
of student members, terms of office shall be for nine years, 492
commencing on the second day of July and ending on the first day 493
of July. Each trustee shall hold office from the date of his494
appointment until the end of the term for which hethe trustee was 495
appointed. Any trustee appointed to fill a vacancy occurring prior 496
to the expiration of the term for which histhe trustee's497
predecessor was appointed shall hold office for the remainder of498
such term. Any trustee shall continue in office subsequent to the 499
expiration date of histhe trustee's term until histhe trustee's500
successor takes office, or until a period of sixty days has 501
elapsed, whichever occurs first. No person who has served a full502
nine-year term or more than six years of such a term shall be 503
eligible for reappointment until a period of four years has 504
elapsed since the last day of the term for which the person 505
previously served. The trustees shall receive no compensation for506
their services but shall be paid their reasonable necessary507
expenses while engaged in the discharge of their official duties.508
A majority of the board constitutes a quorum.509

       (B) The student members of the board of trustees of the510

and the initial term of office of the other student member shall 521
commence on July 2, 1988 and expire on July 1, 1990. Thereafter, 522
terms of office of student members shall be for two years, each 523
term ending on the same day of the same month of the year as the 524
term it succeeds. In the event that a student member cannot 525
fulfill hisa two-year term, a replacement shall be selected to 526
fill the unexpired term in the same manner used to make the 527
original selection.528

       Sec. 3360.01.  (A) There is hereby created a state university 529
to be known as "The University of Toledo." The government of the 530
university of Toledo is vested in a board of eleven trustees who 531
shall be appointed by the governor, with the advice and consent of 532
the senate. Two of the trustees shall be students at the 533
university of Toledo, and their selection and terms shall be in 534
accordance with division (B) of this section. Except for the terms 535

cannot fulfill hisa two-year term, a replacement shall be 570
selected to fill the unexpired term in the same manner used to 571
make the original selection.572

       Sec. 3361.01.  (A) There is hereby created a state university 573
to be known as the "university of Cincinnati." The government of 574
the university of Cincinnati is vested in a board of eleven 575
trustees who shall be appointed by the governor with the advice 576
and consent of the senate. Two of the trustees shall be students 577
at the university of Cincinnati, and their selection and terms 578
shall be in accordance with division (B) of this section. The 579
terms of the first nine members of the board of trustees shall 580
commence upon the effective date of the transfer of assets of the 581
state-affiliated university of Cincinnati to the university of 582
Cincinnati hereby created. One of such trustees shall be appointed 583
for a term ending on the first day of January occurring at least 584
twelve months after such date of transfer, and each of the other 585
trustees shall be appointed for respective terms ending on each 586
succeeding first day of January, so that one term will expire on 587
each first day of January after expiration of the shortest term. 588
Except for the two student trustees, each successor trustee shall 589
be appointed for a term ending on the first day of January, nine 590
years from the expiration date of the term the trustee succeeds, 591
except that any person appointed to fill a vacancy shall be 592
appointed to serve only for the unexpired term.593

       Any trustee shall continue in office subsequent to the594
expiration date of the trustee's term until the trustee's 595
successor takes office, or until a period of sixty days has 596
elapsed, whichever occurs first.597

       No person who has served a full nine-year term or longer or598
more than six years of such a term shall be eligible to599

term it succeeds. In the event that a student cannot fulfill a 621
two-year term, a replacement shall be selected to fill the 622
unexpired term in the same manner used to make the original 623
selection.624

       Sec. 3362.01.  (A) There is hereby created a state university 625
to be known as "Shawnee state university." The government of 626
Shawnee state university is vested in a board of eleven trustees 627
who shall be appointed by the governor with the advice and consent 628
of the senate. Two of the trustees shall be students at Shawnee 629
state university, and their selection and terms shall be in 630
accordance with division (B) of this section. The remaining 631
trustees shall be appointed as follows: one for a term of one 632
year, one for a term of two years, one for a term of three years, 633
one for a term of four years, one for a term of five years, one 634
for a term of six years, one for a term of seven years, one for a 635
term of eight years, and one for a term of nine years. Thereafter, 636
terms shall be for nine years. All terms of office shall commence 637
on the first day of July and end on the thirtieth day of June. At 638
least five of the trustees, excluding the two student members, 639
shall be residents of territory that constitutes the Shawnee state 640
community college district on the effective date of this section641

       Section 2. That existing sections 3335.02, 3337.01, 3339.01, 679
3341.02, 3343.02, 3344.01, 3350.01, 3352.01, 3356.01, 3357.112, 680
3359.01, 3360.01, 3361.01, and 3362.01 of the Revised Code are 681
hereby repealed.682
