A BILL
To enact section 4511.092 of the Revised Code to 1
allow the use of a traffic law photo-monitoring 2
device to detect traffic law violations only if a 3
law enforcement officer is present at the location 4
of the device and issues tickets at the time and 5
location of the violations.6


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1.  That section 4511.092 of the Revised Code be 7
enacted to read as follows:8

       Sec. 4511.092. (A) As used in this section:9

        (1) "Law enforcement agency" means any law enforcement agency 10
of a local authority.11

        (2) "Law enforcement officer" means any law enforcement 12
officer employed by a law enforcement agency of a local authority.13

        (3) "Local authority" means a municipal corporation, county, 14
or township.15

        (4) "Traffic law photo-monitoring device" means an electronic 16
system consisting of a photographic, video, or electronic camera 17
and a means of sensing the presence of a motor vehicle that 18
automatically produces photographs, videotape, or digital images 19
of the vehicle, its operator, or its license plate.20

       (B) A local authority that authorizes the law enforcement 21
agency of that local authority to utilize a traffic law 22
photo-monitoring device within its boundaries to determine 23
compliance with, or to detect a violation of, a municipal 24
ordinance or any provision of the Revised Code that governs or 25
regulates the operation of motor vehicles shall provide that the 26
traffic law photo-monitoring device shall be so utilized and 27
operated for such purposes only when a law enforcement officer is 28
present at the location of the traffic law photo-monitoring device 29
and issues tickets, citations, or summonses at the time and 30
location of the traffic law violations.31

       (C) The state highway patrol shall not utilize a traffic law 32
photo-monitoring device to determine compliance with, or to detect 33
a violation of, any provision of the Revised Code that governs or 34
regulates the operation of motor vehicles unless a state highway 35
patrol trooper is present at the location of the traffic law 36
photo-monitoring device and issues tickets, citation, or summonses 37
at the time and location of the traffic law violations.38
