A BILL
To amend sections 4777.01, 4777.02, 4777.03, and 1
4777.04 of the Revised Code to make changes 2
related to the prohibition against using certain 3
titles in the practice of occupational safety or 4
industrial hygiene.5


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That sections 4777.01, 4777.02, 4777.03, and 6
4777.04 of the Revised Code be amended to read as follows:7

       Sec. 4777.01.  As used in this chapter:8

       (A) "The practice of industrial hygiene" means the 9
anticipation, prevention, recognition, evaluation, elimination, 10
and control of environmental, biological, chemical, physical, and 11
ergonomic factors and stresses arising in or from the workplace 12
that may cause sickness, impaired health and well-being, or 13
significant discomfort among workers or the general public.14

       (B) "Certified Industrial Hygienist" or "CIH" means a person 15
who meets the requirements of division (A) of section 4777.03 of 16
the Revised Code.17

       (C) "Industrial Hygienist In TrainingCertified Associate 18
Industrial Hygienist" or "IHITCAIH" means a person who meets the 19
requirements of division (B) of section 4777.03 of the Revised 20
Code.21

       (D) "The practice of occupational safety" means the 22
preservation of human and material resources through the 23
systematic application of education, chemistry, physics, 24
biological, ergonomic, psychological, physiological, and 25
management principles for anticipating, identifying, and 26
evaluating hazardous systems, conditions, and practices in the 27
workplace and developing, implementing, and administering programs 28
to alleviate those hazards.29

       (E) "Certified Safety Professional" or "CSP" means a person 30
who meets the requirements of division (C) of section 4777.03 of 31
the Revised Code.32

       (F) "Associate Safety Professional" or "ASP" means a person 33
who meets the requirements of division (D) of section 4777.03 of 34
the Revised Code.35

       (G) "The practice of health physics" is that science and art 36
devoted to the anticipation, recognition, evaluation, and control 37
of radioactive material releases and potential radiation hazards 38
in or from the workplace that may cause impaired health and 39
well-being or injury among workers, and may also impact the 40
general community and the environment.41

        (H) "Certified Health Physicist" or "CHP" means a person who 42
meets the requirements of division (E) of section 4777.03 of the 43
Revised Code.44

        (I) "Registered Radiation Protection Technologist" or "RRPT" 45
means a person who meets the requirements of division (F) of 46
section 4777.03 of the Revised Code.47

       Sec. 4777.02.  No person shall assume or use the title or 48
designation "Certified Industrial Hygienist," "Industrial49
Hygienist In TrainingCertified Associate Industrial Hygienist," 50
"Certified Safety Professional," or "Associate Safety 51
Professional," "Certified Health Physicist" or "Registered 52
Radiation Protection Technologist," or any of the abbreviations53
"CIH," "IHITCAIH," "CSP," or "ASP," "CHP," or "RRPT" unless the 54
person has been awarded the title by the American board of55
industrial hygiene or the board of certified safety professionals 56
the American board of health physics or the national registry of 57
radiation protection technologists as specified in section 4777.03 58
of the Revised Code.59

       Sec. 4777.03.  (A) In order to use the title "Certified60
Industrial Hygienist," or the abbreviation "CIH," a person shall 61
possess a valid, unexpired certification from the American board 62
of industrial hygiene.63

       (B) In order to use the title "Industrial Hygienist In64
Training,Certified Associate Industrial Hygienist" or the 65
abbreviation "IHITCAIH," a person shall possess a valid, 66
unexpired certification from the American board of industrial 67
hygiene.68

       (C) In order to use the title "Certified Safety69
Professional," or the abbreviation "CSP," a person shall possess a 70
valid, unexpired certification from the board of certified safety71
professionals.72

       (D) In order to use the title "Associate Safety 73
Professional," or the abbreviation "ASP," a person shall possess a74
valid, unexpired certification from the board of certified safety 75
professionals.76

       (E) In order to use the title "Certified Health Physicist" or 77
the abbreviation "CHP," a person shall possess a valid, unexpired 78
certification from the American board of health physicists.79

        (F) In order to use the title "Registered Radiation 80
Protection Technologist" or the abbreviation "RRPT," a person 81
shall possess a valid, unexpired registration from the national 82
registry of radiation protection technologists.83

       Sec. 4777.04.  The following persons are not prohibited from 84
engaging in the practice of industrial hygiene and, the practice 85
of health physics, or the practice of occupational safety:86

       (A) A person working as an apprentice under the supervision 87
of a Certified Industrial Hygienist, Industrial Hygienist In88
TrainingCertified Associate Industrial Hygienist, Certified 89
Safety Professional, or Associate Safety Professional, Certified 90
Health Physicist or Registered Radiation Protection Technologist;91

       (B) A person engaging in the supervised practice of92
industrial hygiene, the practice of health physics, or the 93
practice of occupational safety through a course of study in that 94
practice;95

       (C) A person who holds a certification, registration, or96
license under another section of the Revised Code if that person 97
does not violate section 4777.02 of the Revised Code;98

       (D) A person engaging in activities within the scope of the 99
practice of industrial hygiene, the practice of health physics, or 100
the practice of occupational safety who does not meet the 101
requirements specified in section 4777.03 of the Revised Code,102
including a person who is certified, registered, or licensed by 103
groups, organizations, or certifying bodies other than the104
American board of industrial hygiene or the board of certified 105
safety professionals, the American board of health physics or the 106
national registry of radiation protection technologists if that 107
person does not violate section 4777.02 of the Revised Code.108

       Section 2. That existing sections 4777.01, 4777.02, 4777.03, 109
and 4777.04 of the Revised Code are hereby repealed.110
