A BILL
To amend sections 4777.01, 4777.02, 4777.03, and 1
4777.04 of the Revised Code to change the 2
professional title "Industrial Hygienist in 3
Training" to "Certified Associate Industrial 4
Hygienist" with respect to the practice of 5
industrial hygiene.6


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That sections 4777.01, 4777.02, 4777.03, and 7
4777.04 of the Revised Code be amended to read as follows:8

       Sec. 4777.01.  As used in this chapter:9

       (A) "The practice of industrial hygiene" means the 10
anticipation, prevention, recognition, evaluation, elimination, 11
and control of environmental, biological, chemical, physical, and 12
ergonomic factors and stresses arising in or from the workplace 13
that may cause sickness, impaired health and well-being, or 14
significant discomfort among workers or the general public.15

       (B) "Certified Industrial Hygienist" or "CIH" means a person 16
who meets the requirements of division (A) of section 4777.03 of 17
the Revised Code.18

       (C) "Industrial Hygienist In TrainingCertified Associate 19
Industrial Hygienist" or "IHITCAIH" means a person who meets the 20
requirements of division (B) of section 4777.03 of the Revised 21
Code.22

       (D) "The practice of occupational safety" means the 23
preservation of human and material resources through the 24
systematic application of education, chemistry, physics, 25
biological, ergonomic, psychological, physiological, and 26
management principles for anticipating, identifying, and 27
evaluating hazardous systems, conditions, and practices in the 28
workplace and developing, implementing, and administering programs 29
to alleviate those hazards.30

       (E) "Certified Safety Professional" or "CSP" means a person 31
who meets the requirements of division (C) of section 4777.03 of 32
the Revised Code.33

       (F) "Associate Safety Professional" or "ASP" means a person 34
who meets the requirements of division (D) of section 4777.03 of 35
the Revised Code.36

       Sec. 4777.02.  No person shall assume or use the title or 37
designation "Certified Industrial Hygienist," "Industrial38
Hygienist In TrainingCertified Associate Industrial Hygienist," 39
"Certified Safety Professional," or "Associate Safety 40
Professional," or any of the abbreviations "CIH," "IHITCAIH," 41
"CSP," or "ASP," unless the person has been awarded the title by 42
the American board of industrial hygiene or the board of certified43
safety professionals as specified in section 4777.03 of the 44
Revised Code.45

       Sec. 4777.03.  (A) In order to use the title "Certified46
Industrial Hygienist," or the abbreviation "CIH," a person shall 47
possess a valid, unexpired certification from the American board 48
of industrial hygiene.49

       (B) In order to use the title "Industrial Hygienist In50
Training,Certified Associate Industrial Hygienist" or the 51
abbreviation "IHITCAIH," a person shall possess a valid, 52
unexpired certification from the American board of industrial 53
hygiene.54

       (C) In order to use the title "Certified Safety55
Professional," or the abbreviation "CSP," a person shall possess a 56
valid, unexpired certification from the board of certified safety57
professionals.58

       (D) In order to use the title "Associate Safety 59
Professional," or the abbreviation "ASP," a person shall possess a60
valid, unexpired certification from the board of certified safety 61
professionals.62

       Sec. 4777.04.  The following persons are not prohibited from 63
engaging in the practice of industrial hygiene and the practice of 64
occupational safety:65

       (A) A person working as an apprentice under the supervision 66
of a Certified Industrial Hygienist, Industrial Hygienist In67
TrainingCertified Associate Industrial Hygienist, Certified 68
Safety Professional, or Associate Safety Professional;69

       (B) A person engaging in the supervised practice of70
industrial hygiene or the practice of occupational safety through 71
a course of study in that practice;72

       (C) A person who holds a certification, registration, or73
license under another section of the Revised Code if that person 74
does not violate section 4777.02 of the Revised Code;75

       (D) A person engaging in activities within the scope of the 76
practice of industrial hygiene or the practice of occupational 77
safety who does not meet the requirements specified in section 78
4777.03 of the Revised Code, including a person who is certified, 79
registered, or licensed by groups, organizations, or certifying 80
bodies other than the American board of industrial hygiene or the 81
board of certified safety professionals, if that person does not82
violate section 4777.02 of the Revised Code.83

       Section 2. That existing sections 4777.01, 4777.02, 4777.03, 84
and 4777.04 of the Revised Code are hereby repealed.85
