BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That sections 121.403, 4501.21, 4501.27, 5511.09, 18
and 5533.09 be amended and sections 5.033, 5.074, 5.075, 5.081, 19
5.082, 5.091, 5.2233, 5.2235, 5.2236, 5.2237, 5.2238, 5.2239, 20
5.2240, 5.2241, 5.2242, 5.2243, 5.2244, 5.2245, 5.2246, 5.2247, 21
5.2248, 5.2249, 901.91, 3701.0211, 4503.433, 4503.492, 4503.503, 22
4503.513, 4503.523, 4503.531, 4503.542, 4503.546, 4503.553, 23
4503.712, 4503.722, 4503.731, 4503.92, 4503.93, 5533.101, 24

follows:28

       Sec. 5.033. The frog Rana catesbeiana, commonly known as the29
bullfrog, is the official amphibian of the state.30

       Sec. 5.074. The great serpent mound in Adams county, the 31
largest effigy earthwork in North America at one thousand three 32
hundred thirty feet long and three feet high, is hereby designated 33
as the official effigy mound of the state.34

       Sec. 5.075. The buckeye trail, a trail that is nearly 35
fourteen hundred miles long and that extends into every region of 36
the state, is hereby designated the official trail of the state.37

       Sec. 5.081. The fruit Asimina triloba, commonly known as the 38
pawpaw, is hereby adopted as the state native fruit.39

       Sec. 5.082. The fruit Lycopersicon esculentus, commonly known 40
as the tomato, is hereby adopted as the state fruit.41

       Sec. 5.091. The children's book Lentil is hereby adopted as 42
the official children's book of the state. The author of Lentil, 43
Robert McCloskey, born in Hamilton, Ohio, is hereby designated the 44
official children's book author of the state.45

       Sec. 5.2233. The month of October is designated as "German 46
Heritage Month" to honor and recognize Ohioans of German descent 47
and their contributions to this state.48

       Sec. 5.2235. The twenty-ninth day of April is designated as 49
"Dale Earnhardt Day" in honor of Dale Earnhardt, born on that day 50
in 1951, for his passion for Nascar racing, his devotion to his 51
family and friends, and his countless contributions to the racing 52
industry in Ohio and throughout the United States.53

       Sec. 5.2236. The month of November is designated as "Epilepsy 54
Awareness Month" to increase public awareness and understanding of 55
epilepsy.56

       Sec. 5.2237. The twelfth day of June is designated as "Ronald 57
Reagan Day" in honor of the fortieth president of the United 58
States, who delivered the famous speech "Tear Down This Wall" on 59
that day in 1987 in West Berlin, Germany.60

       Sec. 5.2238. The month of March is designated as "2nd Chance 61
of Life: Saving Babies, Supporting Families Month" to support and 62
promote Ohio's safe haven law (sections 2151.3515 to 2151.3530 of 63
the Revised Code).64

       Sec. 5.2239.  The month of May is designated as "Motorcycle 65
Safety and Awareness Month" to create a broader recognition of 66
motorcycles in the overall transportation mix and to reduce the 67
number of motorcycle accidents and deaths on the roads of this 68
state.69

       Sec. 5.2240. The thirty-one days beginning on the fourteenth 70
day of June and ending on the fourteenth day of July are 71
designated as "American Flag Month."72

       Sec. 5.2241. The third week of May is designated "Co-op 73
Education Week" in recognition of post-secondary cooperative 74
education programs in Ohio, in which higher education institutions 75
and employers arrange for students to participate in both 76
traditional classroom instruction and related work experiences.77

       Sec. 5.2242. The twenty-first of December shall be designated 78
"Homeless Persons' Memorial Day" to bring attention to the tragedy 79
of homelessness. State and local governments, coalitions, and 80
other entities are encouraged to sponsor events to promote 81
awareness of the plight of the homeless and identify actions that 82
individuals and organizations may take to address the problem of 83
homelessness.84

       Sec. 5.2243. The twenty-ninth day of April is designated as 85
"Heritage and Freedom Flag of the Former Republic of Vietnam Day" 86
in honor of the heroes who gave the ultimate sacrifice for 87
freedom.88

       Sec. 5.2244. The month of September is designated as "Ovarian 89
Cancer Awareness Month."90

       Sec. 5.2245. The month of May is designated as "Nurses Month" 91
in recognition of the hard work and dedication of nurses and their 92
significant contributions in improving the health care of the 93
citizens of this state.94

       Sec. 5.2246. The sandwich known as "Carle's bratwurst" is 95
hereby adopted as the official state sandwich.96

       Sec. 5.2247. The month of February is designated as "Black 97
History Month" to encourage the study and remembrance of specific 98
historical events, dates, and people that exemplify the legacy of 99
African Americans in the United States.100

       Sec. 5.2248. The fifteenth of November is designated as 101
"Chronic Obstructive Pulmonary Disease Awareness Day" to raise 102
awareness of bronchitis and emphysema and the importance of early 103
diagnosis of these diseases.104

       Sec. 5.2249. The month of February is designated as "American 105
Heart Month" to raise awareness of the seriousness of 106
cardiovascular disease and the incidence in this state of heart 107
disease and stroke.108

       Sec. 121.403. (A) The Ohio community service council may do 109
any of the following:110

        (1) Accept monetary gifts or donations;111

        (2) Sponsor conferences, meetings, or events in furtherance 112
of the council's purpose described in section 121.40 of the 113
Revised Code and charge fees for participation or involvement in 114
the conferences, meetings, or events;115

        (3) Sell promotional items in furtherance of the council's 116
purpose described in section 121.40 of the Revised Code.117

        (B) All monetary gifts and donations, funds from the sale of 118
promotional items, contributions received from the issuance of 119
Ohio "volunteer" license plates pursuant to section 4503.93 of the 120
Revised Code, and any fees paid to the council for conferences, 121
meetings, or events sponsored by the council shall be deposited 122
into the Ohio community service council gifts and donations fund, 123
which is hereby created in the state treasury. Moneys in the fund 124
may be used only as follows:125

        (1) To pay operating expenses of the council, including 126
payroll, personal services, maintenance, equipment, and subsidy 127
payments;128

        (2) To support council programs promoting volunteerism and 129
community service in the state;130

        (3) As matching funds for federal grants.131

       Sec. 901.91. (A) There is hereby created in the state 132
treasury the Ohio agriculture license plate contribution fund, 133
which shall consist of money deposited into the fund from the 134
issuance of Ohio agriculture license plates under section 4503.503 135
of the Revised Code and any other contributions made directly to 136
it. Money in the fund shall be disbursed in the form of grants 137
approved by the Ohio agriculture license plate fund board.138

       All investment income of the fund shall be credited to the 139
fund.140

       (B) There is hereby created the Ohio agriculture license 141
plate fund board, consisting of the director of agriculture or the 142
director's designee and one member appointed by the Ohio 143
corngrowers association, one member appointed by the Ohio farm 144
bureau federation, one member appointed by the Ohio soy 145
association, and one member appointed by the Ohio state university 146
college of food, agricultural, and environmental sciences. 147
Vacancies shall be filled in the same manner as the original 148
appointment. The director or the director's designee shall be the 149
chairperson of the board. The board shall elect from among the 150
other four members a vice-chairperson and a secretary. All initial 151
appointments to the board shall be made not later than sixty days 152
after the effective date of this section.153

       (C) The board shall adopt rules in accordance with Chapter 154
119. of the Revised Code governing the award of grants from the 155
fund. Permissible uses of such grants include farmland 156
preservation, scholarships for students enrolled in a program of 157
agricultural education at an Ohio land grant university, and the 158
promotion of renewable energy sources made from agricultural 159
products from this state such as ethanol, soy biodiesel, and 160
methane.161

       (D) The department of agriculture shall furnish the board 162
with whatever the board requires to fulfill its functions.163

       Sec. 3701.0211. There is hereby created in the state treasury 164
the children with medical handicaps license plate fund. The fund 165
shall consist of the contributions that are paid to the registrar 166
of motor vehicles by applicants who obtain children with medical 167
handicaps license plates pursuant to section 4503.721 of the 168
Revised Code. Money in the fund shall be used only by the 169
department of health to comply with sections 3701.021 to 3701.028 170
of the Revised Code. All investment earnings of the fund shall be 171
credited to the fund.172

       Sec. 4501.21.  (A) There is hereby created in the state 173
treasury the license plate contribution fund. The fund shall 174
consist of all contributions paid by motor vehicle registrants and 175
collected by the registrar of motor vehicles pursuant to sections 176
4503.491, 4503.492, 4503.493, 4503.50, 4503.501, 4503.502, 177
4503.51, 4503.522, 4503.523, 4503.545, 4503.55, 4503.551, 178
4503.552, 4503.553, 4503.561, 4503.562, 4503.591, 4503.67, 179
4503.68, 4503.69, 4503.71, 4503.711, 4503.712, 4503.72, 4503.73, 180
4503.74, 4503.75, and 4503.85, and 4503.92 of the Revised Code.181

       (B) The registrar shall pay the contributions the registrar 182
collects in the fund as follows:183

       (1) The registrar shall pay the contributions received 184
pursuant to section 4503.491 of the Revised Code to the breast 185
cancer fund of Ohio, which shall use that money only to pay for 186
programs that provide assistance and education to Ohio breast 187
cancer patients and that improve access for such patients to 188
quality health care and clinical trials and shall not use any of 189
the money for abortion information, counseling, services, or other 190
abortion-related activities.191

       (2) The registrar shall pay the contributions received 192
pursuant to section 4503.492 of the Revised Code to the Ohio 193
domestic violence network, which shall distribute the 194
contributions to programs throughout the state for use in 195
providing direct services to victims of domestic violence, 196
including shelter, hotline, counseling, legal advocacy, and other 197
victim services.198

       (3) The registrar shall pay the contributions received 199
pursuant to section 4503.493 of the Revised Code to the autism 200
society of Ohio, which shall use the contributions for programs 201
and autism awareness efforts throughout the state.202

       (3)(4) The registrar shall pay the contributions the 203
registrar receives pursuant to section 4503.50 of the Revised Code 204
to the future farmers of America foundation, which shall deposit 205
the contributions into its general account to be used for 206
educational and scholarship purposes of the future farmers of 207
America foundation.208

       (4)(5) The registrar shall pay the contributions the 209
registrar receives pursuant to section 4503.501 of the Revised 210
Code to the 4-H youth development program of the Ohio state 211
university extension program, which shall use those contributions 212
to pay the expenses it incurs in conducting its educational 213
activities.214

       (5)(6) The registrar shall pay the contributions received 215
pursuant to section 4503.502 of the Revised Code to the Ohio 216
cattlemen's foundation, which shall use those contributions for 217
scholarships and other educational activities.218

       (6)(7) The registrar shall pay each contribution the 219
registrar receives pursuant to section 4503.51 of the Revised Code 220
to the university or college whose name or marking or design 221
appears on collegiate license plates that are issued to a person 222
under that section. A university or college that receives 223
contributions from the fund shall deposit the contributions into 224
its general scholarship fund.225

       (7)(8) The registrar shall pay the contributions the 226
registrar receives pursuant to section 4503.522 of the Revised 227
Code to the "friends of Perry's victory and international peace 228
memorial, incorporated," a nonprofit corporation organized under 229
the laws of this state, to assist that organization in paying the 230
expenses it incurs in sponsoring or holding charitable, 231
educational, and cultural events at the monument.232

       (8)(9) The registrar shall pay the contributions the 233
registrar receives pursuant to section 4503.523 of the Revised 234
Code to the fairport harbor west breakwall lighthouse preservation 235
society, which shall use the money to pay for the restoration, 236
maintenance, and preservation of the lighthouses of fairport 237
harbor.238

       (10) The registrar shall pay the contributions the registrar 239
receives pursuant to section 4503.55 of the Revised Code to the 240
pro football hall of fame, which shall deposit the contributions 241
into a special bank account that it establishes and which shall be 242
separate and distinct from any other account the pro football hall 243
of fame maintains, to be used exclusively for the purpose of 244
promoting the pro football hall of fame as a travel destination.245

       (9)(11) The registrar shall pay the contributions that are 246
paid to the registrar pursuant to section 4503.545 of the Revised 247
Code to the national rifle association foundation, which shall use 248
the money to pay the costs of the educational activities and 249
programs the foundation holds or sponsors in this state.250

       (10)(12) In accordance with section 955.202 of the Revised 251
Code, the registrar shall pay to the pets program funding board 252
created by that section the contributions the registrar receives 253
pursuant to section 4503.551 of the Revised Code and any other 254
money from any other source, including donations, gifts, and 255
grants, that is designated by the source to be paid to the pets 256
program funding board. The board shall use the moneys it receives 257
under this section only to support programs for the sterilization 258
of dogs and cats and for educational programs concerning the 259
proper veterinary care of those animals.260

       (11)(13) The registrar shall pay the contributions the 261
registrar receives pursuant to section 4503.552 of the Revised 262
Code to the rock and roll hall of fame and museum, incorporated.263

       (12)(14) The registrar shall pay the contributions the 264
registrar receives pursuant to section 4503.553 of the Revised 265
Code to the Ohio coalition for animals, incorporated, a nonprofit 266
corporation, which may use the money to support educational, 267
charitable, and other programs that provide care for unwanted, 268
abused, and neglected horses, as well as reasonable costs incurred 269
in association with the design, marketing, and promotion of Ohio's 270
horse license plates, and administrative costs incurred in the 271
disbursement and management of funds collected from the sale of 272
Ohio's horse license plates.273

       (15) The registrar shall pay the contributions the registrar 274
receives pursuant to section 4503.561 of the Revised Code to the 275
state of Ohio chapter of ducks unlimited, inc., which shall 276
deposit the contributions into a special bank account that it 277
establishes. The special bank account shall be separate and 278
distinct from any other account the state of Ohio chapter of ducks 279
unlimited, inc., maintains and shall be used exclusively for the 280
purpose of protecting, enhancing, restoring, and managing wetlands 281
and conserving wildlife habitat. The state of Ohio chapter of 282
ducks unlimited, inc., annually shall notify the registrar in 283
writing of the name, address, and account to which such payments 284
are to be made under division (B)(12) of this section.285

       (13)(16) The registrar shall pay the contributions the 286
registrar receives pursuant to section 4503.562 of the Revised 287
Code to the Mahoning river consortium, which shall use the money 288
to pay the expenses it incurs in restoring and maintaining the 289
Mahoning river watershed.290

       (14)(17)(a) The registrar shall pay to a sports commission 291
created pursuant to section 4503.591 of the Revised Code each 292
contribution the registrar receives under that section that an 293
applicant pays to obtain license plates that bear the logo of a 294
professional sports team located in the county of that sports 295
commission and that is participating in the license plate program 296
pursuant to division (E) of that section, irrespective of the 297
county of residence of an applicant.298

       (b) The registrar shall pay to a community charity each 299
contribution the registrar receives under section 4503.591 of the 300
Revised Code that an applicant pays to obtain license plates that 301
bear the logo of a professional sports team that is participating 302
in the license plate program pursuant to division (G) of that 303
section.304

       (15)(18) The registrar shall pay the contributions the 305
registrar receives pursuant to section 4503.67 of the Revised Code 306
to the Dan Beard council of the boy scouts of America. The council 307
shall distribute all contributions in an equitable manner 308
throughout the state to regional councils of the boy scouts.309

       (16)(19) The registrar shall pay the contributions the 310
registrar receives pursuant to section 4503.68 of the Revised Code 311
to the great river council of the girl scouts of the United States 312
of America. The council shall distribute all contributions in an 313
equitable manner throughout the state to regional councils of the 314
girl scouts.315

       (17)(20) The registrar shall pay the contributions the 316
registrar receives pursuant to section 4503.69 of the Revised Code 317
to the Dan Beard council of the boy scouts of America. The council 318
shall distribute all contributions in an equitable manner 319
throughout the state to regional councils of the boy scouts.320

       (18)(21) The registrar shall pay the contributions the 321
registrar receives pursuant to section 4503.71 of the Revised Code 322
to the fraternal order of police of Ohio, incorporated, which 323
shall deposit the fees into its general account to be used for 324
purposes of the fraternal order of police of Ohio, incorporated.325

       (19)(22) The registrar shall pay the contributions the 326
registrar receives pursuant to section 4503.711 of the Revised 327
Code to the fraternal order of police of Ohio, incorporated, which 328
shall deposit the contributions into an account that it creates to 329
be used for the purpose of advancing and protecting the law 330
enforcement profession, promoting improved law enforcement 331
methods, and teaching respect for law and order.332

       (20)(23) The registrar shall pay the contributions received 333
pursuant to section 4503.712 of the Revised Code to the Ohio 334
concerns of police survivors, which shall use those contributions 335
to assist the families of law enforcement officers who are killed 336
in the line of duty in this state.337

       (24) The registrar shall pay the contributions the registrar 338
receives pursuant to section 4503.72 of the Revised Code to the 339
organization known on March 31, 2003, as the Ohio CASA/GAL 340
association, a private, nonprofit corporation organized under 341
Chapter 1702. of the Revised Code. The Ohio CASA/GAL association 342
shall use these contributions to pay the expenses it incurs in 343
administering a program to secure the proper representation in the 344
courts of this state of abused, neglected, and dependent children, 345
and for the training and supervision of persons participating in 346
that program.347

       (21)(25) The registrar shall pay the contributions the 348
registrar receives pursuant to section 4503.73 of the Revised Code 349
to Wright B. Flyer, incorporated, which shall deposit the 350
contributions into its general account to be used for purposes of 351
Wright B. Flyer, incorporated.352

       (22)(26) The registrar shall pay the contributions the 353
registrar receives pursuant to section 4503.74 of the Revised Code 354
to the Columbus zoological park association, which shall disburse 355
the moneys to Ohio's major metropolitan zoos, as defined in 356
section 4503.74 of the Revised Code, in accordance with a written 357
agreement entered into by the major metropolitan zoos.358

       (23)(27) The registrar shall pay the contributions the 359
registrar receives pursuant to section 4503.75 of the Revised Code 360
to the rotary foundation, located on March 31, 2003, in Evanston, 361
Illinois, to be placed in a fund known as the permanent fund and 362
used to endow educational and humanitarian programs of the rotary 363
foundation.364

       (24)(28) The registrar shall pay the contributions the 365
registrar receives pursuant to section 4503.85 of the Revised Code 366
to the Ohio sea grant college program to be used for Lake Erie 367
area research projects.368

       (29) The registrar shall pay the contributions received 369
pursuant to section 4503.92 of the Revised Code to support our 370
troops, incorporated, a national nonprofit corporation, which 371
shall use those contributions in accordance with its articles of 372
incorporation and for the benefit of servicemembers of the armed 373
forces of the United States and their families when they are in 374
financial need.375

       (C) All investment earnings of the license plate contribution 376
fund shall be credited to the fund. Not later than the first day 377
of May of every year, the registrar shall distribute to each 378
entity described in divisionsdivision (B)(1) to (24) of this 379
section the investment income the fund earned the previous 380
calendar year. The amount of such a distribution paid to an entity 381
shall be proportionate to the amount of money the entity received 382
from the fund during the previous calendar year.383

       Sec. 4501.27.  (A) Except as provided in division (B) of this 384
section, on and after September 13, 1997, the registrar of motor385
vehicles, and any employee or contractor of the bureau of motor 386
vehicles, shall not knowingly disclose or otherwise make available 387
to any person or entity any personal information about an 388
individual that the bureau obtained in connection with a motor 389
vehicle record.390

       (B)(1) On and after September 13, 1997, the registrar, or an 391
employee or contractor of the bureau of motor vehicles, shall 392
disclose personal information, other than sensitive personal 393
information, about an individual that the bureau obtained in394
connection with a motor vehicle record, for use in connection with 395
any of the following matters to carry out the purposes of any 396
specified federal automobile-related act:397

       (a) Motor vehicle or driver safety and theft;398

       (b) Motor vehicle emissions;399

       (c) Motor vehicle product alterations, recalls, or400
advisories;401

       (d) Performance monitoring of motor vehicles and dealers by 402
motor vehicle manufacturers;403

       (e) Removal of non-owner records from the original owner 404
records of motor vehicle manufacturers.405

       (2) In addition to the disclosure required under division406
(B)(1) of this section, on and after September 13, 1997, the 407
registrar, or an employee or contractor of the bureau of motor 408
vehicles, may disclose personal information, other than sensitive 409
personal information, about an individual that the bureau obtained 410
in connection with a motor vehicle record, as follows:411

       (a) For the use of a government agency, including, but not 412
limited to, a court or law enforcement agency, in carrying out its413
functions, or for the use of a private person or entity acting on 414
behalf of an agency of this state, another state, the United 415
States, or a political subdivision of this state or another state 416
in carrying out its functions;417

       (b) For use in connection with matters regarding motor 418
vehicle or driver safety and theft; motor vehicle emissions; motor419
vehicle product alterations, recalls, or advisories; performance 420
monitoring of motor vehicles, motor vehicle parts, and dealers; 421
motor vehicle market research activities, including, but not 422
limited to, survey research; and removal of non-owner records from 423
the original owner records of motor vehicle manufacturers;424

       (c) For use in the normal course of business by a legitimate 425
business or an agent, employee, or contractor of a legitimate426
business, but only for one of the following purposes:427

       (i) To verify the accuracy of personal information submitted 428
to the business, agent, employee, or contractor by an individual;429

       (ii) If personal information submitted to the business, 430
agent, employee, or contractor by an individual is incorrect or no431
longer is correct, to obtain the correct information, but only for 432
the purpose of preventing fraud, by pursuing legal remedies 433
against, or recovering on a debt or security interest against, the 434
individual.435

       (d) For use in connection with a civil, criminal,436
administrative, or arbitral proceeding in a court or agency of 437
this state, another state, the United States, or a political 438
subdivision of this state or another state or before a 439
self-regulatory body, including, but not limited to, use in 440
connection with the service of process, investigation in441
anticipation of litigation, or the execution or enforcement of a 442
judgment or order;443

       (e) Pursuant to an order of a court of this state, another 444
state, the United States, or a political subdivision of this state 445
or another state;446

       (f) For use in research activities or in producing447
statistical reports, provided the personal information is not 448
published, redisclosed, or used to contact an individual;449

       (g) For use by an insurer, insurance support organization, or 450
self-insured entity, or by an agent, employee, or contractor of 451
that type of entity, in connection with any claims investigation 452
activity, anti-fraud activity, rating, or underwriting;453

       (h) For use in providing notice to the owner of a towed, 454
impounded, immobilized, or forfeited vehicle;455

       (i) For use by any licensed private investigative agency or 456
licensed security service for any purpose permitted under division457
(B)(2) of this section;458

       (j) For use by an employer or by the agent or insurer of an 459
employer to obtain or verify information relating to the holder of 460
a commercial driver's license or permit that is required under the461
"Commercial Motor Vehicle Safety Act of 1986," 100 Stat. 3207-170, 462
49 U.S.C. 2701, et seq., as now or hereafter amended;463

       (k) For use in connection with the operation of a private 464
toll transportation facility;465

       (l) For any use not otherwise identified in division (B)(2) 466
of this section that is in response to a request for individual 467
motor vehicle records, if the individual whose personal468
information is requested completes and submits to the registrar or 469
deputy registrar a form prescribed by the registrar by rule giving 470
express consent to such disclosures.471

       (m) For bulk distribution for surveys, marketing, or472
solicitations, if the individual whose personal information is 473
requested completes and submits to the registrar or a deputy474
registrar a form prescribed by the registrar by rule giving 475
express consent to such disclosures.476

       (n) For use by a person, state, or state agency that requests 477
the information, if the person, state, or state agency 478
demonstrates that it has obtained the written consent of the 479
individual to whom the information pertains;480

       (o) For use by an organization that receives a contribution 481
specified in the Revised Code that the person paid to the 482
registrar or deputy registrar when the person obtained a special 483
license plate for display on the person's motor vehicle;484

       (p) For any other use specifically authorized by law that is 485
related to the operation of a motor vehicle or to public safety.486

       (3)(a) Except as provided in division (B)(3)(b) of this 487
section, the registrar, or an employee or contractor of the bureau 488
of motor vehicles, may disclose sensitive personal information 489
about an individual that the bureau obtained in connection with a 490
motor vehicle record, only if either of the following conditions 491
are satisfied:492

       (i) The individual whose personal information is requested493
completes and submits to the registrar or deputy registrar a form 494
prescribed by the registrar by rule giving express consent to such495
disclosure;496

       (ii) The disclosure is for one or more of the purposes 497
described in division (B)(2)(a), (d), (g), or (j) of this section.498

       (b) Division (B)(3)(a) of this section does not apply to the499
disclosure of sensitive personal information that is subject to 500
section 4501.15 or 4507.53 of the Revised Code.501

       (C) On and after September 13, 1997, an authorized recipient 502
of personal information about an individual that the bureau of 503
motor vehicles obtained in connection with a motor vehicle record, 504
other than a recipient under division (B)(2)(l) or (m) of this 505
section, may resell or redisclose the personal information only 506
for a use permitted under division (B)(1), (B)(2)(a) to (k), 507
(B)(2)(n), or (B)(2)(o)(p) of this section. On and after September 508
13, 1997, an authorized recipient of personal information about an 509
individual under division (B)(2)(l) of this section may resell or 510
redisclose the information for any purpose. On and after September 511
13, 1997, an authorized recipient of personal information under 512
division (B)(2)(m) of this section may resell or redisclose the 513
information as specified pursuant to that division. On and after 514
September 13, 1997, an authorized recipient of personal 515
information about an individual under division (B) of this 516
section, other than a recipient under division (B)(2)(l) of this 517
section, that resells or rediscloses any personal information 518
covered by this section must keep for a period of five years a 519
record that identifies each person or entity that receives any of 520
the personal information and the permitted purpose for which the 521
information is to be used, and must make all such records 522
available to the registrar of motor vehicles upon the registrar's523
request.524

       (D) The registrar may establish and carry out procedures 525
under which the registrar or the registrar's agents, upon receipt 526
of a request for personal information on or after September 13, 527
1997, that does not satisfy any of the criteria for disclosure of 528
the information that are set forth in division (B)(1) or (2) of 529
this section, may notify the individual about whom the information 530
was requested, by regular mail, that the request was made. Any 531
procedures so adopted shall provide that, if the registrar or an 532
agent of the registrar mails the notice to the individual, the 533
registrar or agent shall include with the notice a copy of the534
request and conspicuously shall include in the notice a statement 535
that the information will not be released unless the individual 536
waives the individual's right to privacy regarding the information 537
that is granted under this section.538

       (E) The registrar of motor vehicles may adopt any forms and 539
rules, consistent with but no more restrictive than the540
requirements of Public Law No. 130-322, Title XXX, 18 U.S.C.541
2721-2725, that are necessary to carry out the registrar's duties 542
under this section on and after September 13, 1997.543

       (F) As used in this section:544

       (1) "Motor vehicle record" means a record that pertains to a545
motor vehicle driver's or commercial driver's license or permit, a 546
motor vehicle certificate of title, a motor vehicle registration 547
or motor vehicle identification license plates, or an 548
identification card issued by the bureau of motor vehicles.549

       (2) "Person" has the same meaning as in section 1.59 of the550
Revised Code and does not include this state, another state, or an 551
agency of this state or another state.552

       (3) "Personal information" means information that identifies 553
an individual, including, but not limited to, an individual's 554
photograph or digital image, social security number, driver or 555
driver's license identification number, name, telephone number, or 556
medical or disability information, or an individual's address 557
other than the five-digit zip code number. "Personal information" 558
does not include information pertaining to a vehicular accident, 559
driving or traffic violation, or driver's status.560

       (4) "Specified federal automobile-related act" means the561
"automobile information disclosure actAutomobile Information 562
Disclosure Act," 72 Stat. 325, 15 U.S.C. 1231-1233, the "Motor 563
Vehicle Information and Cost Saving Act," 86 Stat. 947, 15 U.S.C. 564
1901, et seq., the "National Traffic and Motor Vehicle Safety Act 565
of 1966," 80 Stat. 718, 15 U.S.C. 1381, et seq., the "Anti-car 566
Theft Act of 1992," 106 Stat. 3384, 15 U.S.C. 2021, et seq., and 567
the "Clean Air Act," 69 Stat. 322, 42 U.S.C. 7401, et seq., all as 568
now or hereafter amended.569

       (5) "Sensitive personal information" means an individual's570
photograph or digital image, social security number, or medical or571
disability information.572

       Sec. 4503.433. (A) As used in this section, "battle star" 573
means a military award approved by the chairman of the joint 574
chiefs of staff for service members who were engaged in actual 575
combat against the enemy under certain circumstances.576

       (B) Not later than six months after the effective date of 577
this section, the registrar of motor vehicles shall adopt rules to 578
do all of the following:579

       (1) Determine the combat and military license plates 580
authorized under this chapter that are appropriate for the display 581
of battle stars and select an additional design for each approved 582
combat or military license plate that includes the display of one 583
or more battle stars;584

       (2) Establish the documentary evidence that an applicant must 585
present as proof of the award upon a request under division (C) of 586
this section for the display of a battle star on an approved 587
combat or military license plate.588

       (C) Any person who is eligible for a combat or military 589
license plate under this chapter of the type approved by the 590
registrar by rule, who also has been awarded a battle star, may 591
request the issuance of the approved combat or military license 592
plate displaying the combat battle stars received by the person. 593
The request shall be accompanied by such documentary evidence in 594
support of the award as the registrar shall require by rule.595

       (D) Upon application and compliance with the requirements for 596
issuance of the approved combat or military license plate, 597
presentation of satisfactory evidence of the battle star award, 598
and compliance with all other applicable laws relating to the 599
registration of motor vehicles, the registrar shall issue to the 600
applicant the appropriate motor vehicle registration and combat or 601
military license plates displaying the appropriate battle stars.602

       Sec. 4503.492. (A) The owner or lessee of any passenger car, 603
noncommercial motor vehicle, recreational vehicle, or other 604
vehicle of a class approved by the registrar of motor vehicles may 605
apply to the registrar for the registration of the vehicle and 606
issuance of domestic violence awareness license plates. An 607
application made under this section may be combined with a request 608
for a special reserved license plate under section 4503.40 or 609
4503.42 of the Revised Code. Upon receipt of the completed 610
application and compliance by the applicant with divisions (B) and 611
(C) of this section, the registrar shall issue to the applicant 612
the appropriate vehicle registration and a set of domestic 613
violence awareness license plates and a validation sticker, or a 614
validation sticker alone when required by section 4503.191 of the 615
Revised Code.616

       In addition to the letters and numbers ordinarily inscribed 617
on the license plates, domestic violence awareness license plates 618
shall be inscribed with identifying words or markings that are 619
designed by the Ohio domestic violence network and approved by the 620
registrar. Domestic violence awareness license plates shall 621
display county identification stickers that identify the county of 622
registration by name or number.623

       (B) The domestic violence awareness license plates and a 624
validation sticker, or validation sticker alone, shall be issued 625
upon receipt of a contribution as provided in division (C)(1) of 626
this section and upon payment of the regular license tax as 627
prescribed under section 4503.04 of the Revised Code, any 628
applicable motor vehicle license tax levied under Chapter 4504. of 629
the Revised Code, any applicable additional fee prescribed by 630
section 4503.40 or 4503.42 of the Revised Code, a fee of ten 631
dollars for the purpose of compensating the bureau of motor 632
vehicles for additional services required in the issuing of 633
domestic violence awareness license plates, and compliance with 634
all other applicable laws relating to the registration of motor 635
vehicles.636

       (C)(1) For each application for registration and registration 637
renewal notice the registrar receives under this section, the 638
registrar shall collect a contribution of twenty dollars. The 639
registrar shall deposit this contribution into the state treasury 640
to the credit of the license plate contribution fund created in 641
section 4501.21 of the Revised Code.642

       (2) The registrar shall deposit the additional fee of ten 643
dollars paid to compensate the bureau for the additional services 644
required in the issuing of domestic violence awareness license 645
plates into the state treasury to the credit of the state bureau 646
of motor vehicles fund created by section 4501.25 of the Revised 647
Code.648

       Sec. 4503.503. (A) The owner or lessee of any passenger car, 649
noncommercial motor vehicle, recreational vehicle, or other 650
vehicle of a class approved by the registrar of motor vehicles may 651
apply to the registrar for the registration of the vehicle and 652
issuance of Ohio agriculture license plates. An application made 653
under this section may be combined with a request for a special 654
reserved license plate under section 4503.40 or 4503.42 of the 655
Revised Code. Upon receipt of the completed application and 656
compliance by the applicant with divisions (B) and (C) of this 657
section, the registrar shall issue to the applicant the 658
appropriate vehicle registration and a set of Ohio agriculture 659
license plates and a validation sticker, or a validation sticker 660
alone when required by section 4503.191 of the Revised Code.661

       In addition to the letters and numbers ordinarily inscribed 662
on the license plates, Ohio agriculture license plates shall be 663
inscribed with the words "agriculture - - Ohio's #1 industry" and 664
any other words or markings that are designated by the Ohio farm 665
bureau federation in consultation with representatives from 666
organizations that represent growers of commodities in this state. 667
The registrar shall approve the final design. Ohio agriculture 668
license plates shall display county identification stickers that 669
identify the county of registration by name or number.670

       (B) The Ohio agriculture license plates and a validation 671
sticker, or validation sticker alone, shall be issued upon receipt 672
of a contribution as provided in division (C) of this section and 673
upon payment of the regular license tax as prescribed under 674
section 4503.04 of the Revised Code, any applicable motor vehicle 675
license tax levied under Chapter 4504. of the Revised Code, any 676
applicable additional fee prescribed by section 4503.40 or 4503.42 677
of the Revised Code, a bureau of motor vehicles fee of ten 678
dollars, and compliance with all other applicable laws relating to 679
the registration of motor vehicles.680

       (C) For each application for registration and registration 681
renewal notice the registrar receives under this section, the 682
registrar shall collect a contribution of fifteen dollars. The 683
registrar shall transmit this contribution to the treasurer of 684
state for deposit in the Ohio agriculture license plate 685
contribution fund created in section 901.91 of the Revised Code.686

       The registrar shall transmit the bureau of motor vehicles fee 687
of ten dollars, which is to compensate the bureau for the 688
additional services required in the issuing of Ohio agriculture 689
license plates, to the treasurer of state for deposit into the 690
state treasury to the credit of the state bureau of motor vehicles 691
fund created by section 4501.25 of the Revised Code.692

       Sec. 4503.513. (A) The owner or lessee of any passenger car, 693
noncommercial motor vehicle, recreational vehicle, or vehicle of a 694
class approved by the registrar of motor vehicles, who is a member 695
of a historically black fraternity or sorority, may apply to the 696
registrar for the registration of the vehicle and issuance of 697
"historically black fraternity-sorority" license plates bearing 698
the name or Greek letters of the historically black fraternity or 699
sorority of which the applicant is a member. The request for a 700
"historically black fraternity-sorority" license plate may be 701
combined with a request for a special reserved license plate under 702
section 4503.40 or 4503.42 of the Revised Code. Upon receipt of 703
the completed application, proof of membership in a historically 704
black fraternity or sorority as required by the registrar, and 705
compliance with division (B) of this section, the registrar shall 706
issue to the applicant appropriate vehicle registration and the 707
particular "historically black fraternity-sorority" license plates 708
indicating the fraternity or sorority of which the applicant is a 709
member, with a validation sticker, or a validation sticker alone 710
when required by section 4503.191 of the Revised Code.711

       In addition to the letters and numbers ordinarily inscribed 712
thereon, each "historically black fraternity-sorority" license 713
plate shall be inscribed with the name of a historically black 714
fraternity or sorority or the Greek letters of the fraternity or 715
sorority, or both. The registrar shall approve the design of each 716
"historically black fraternity-sorority" license plate, and the 717
license plates shall bear county identification stickers that 718
identify the county of registration by name or number.719

       (B) The "historically black fraternity-sorority" license 720
plates and validation sticker shall be issued upon payment of the 721
regular license tax as prescribed under section 4503.04 of the 722
Revised Code, any applicable motor vehicle tax levied under 723
Chapter 4504. of the Revised Code, any applicable additional fee 724
prescribed by section 4503.40 or 4503.42 of the Revised Code, and 725
an additional fee of ten dollars, and compliance with all other 726
applicable laws relating to the registration of motor vehicles.727

       (C) The additional fee of ten dollars specified in division 728
(B) of this section is to compensate the bureau of motor vehicles 729
for additional services required in the issuing of "historically 730
black fraternity-sorority" license plates. The registrar shall 731
deposit this additional fee into the state treasury to the credit 732
of the state bureau of motor vehicles fund created in section 733
4501.25 of the Revised Code.734

       (D) Sections 4503.77 and 4503.78 of the Revised Code do not 735
apply to license plates issued under this section.736

       (E) As used in this section, "historically black fraternity 737
or sorority" means the alpha kappa alpha sorority, inc., alpha phi 738
alpha fraternity, inc., delta sigma theta sorority, inc., zeta phi 739
beta sorority, inc., iota phi theta fraternity, inc., kappa alpha 740
psi fraternity, inc., sigma gamma rho sorority, inc., phi beta 741
sigma fraternity, inc., and omega psi phi fraternity, inc., each 742
belonging to the national pan-hellenic council, inc.743

       Sec. 4503.523. (A) The owner or lessee of any passenger car, 744
noncommercial motor vehicle, recreational vehicle, or other 745
vehicle of a class approved by the registrar of motor vehicles may 746
apply to the registrar for the registration of the vehicle and 747
issuance of "fairport harbor breakwall lighthouse" license plates. 748
The application for fairport harbor breakwall lighthouse license 749
plates may be combined with a request for a special reserved 750
license plate under section 4503.40 or 4503.42 of the Revised 751
Code. Upon receipt of the completed application and compliance 752
with division (B) of this section, the registrar shall issue to 753
the applicant the appropriate vehicle registration, a set of 754
fairport harbor breakwall lighthouse license plates with a 755
validation sticker, or a validation sticker alone when required by 756
section 4503.191 of the Revised Code.757

       In addition to the letters and numbers ordinarily inscribed 758
on the license plates, fairport harbor breakwall lighthouse 759
license plates shall be inscribed with identifying words or 760
markings selected by the fairport harbor west breakwall lighthouse 761
preservation society and approved by the registrar. Fairport 762
harbor breakwall lighthouse license plates shall bear county 763
identification stickers that identify the county of registration 764
by name or number.765

        (B) Fairport harbor breakwall lighthouse license plates and a 766
validation sticker or, when applicable, a validation sticker alone 767
shall be issued upon submission by the applicant of an application 768
for registration of a motor vehicle under this section and a 769
contribution as provided in division (C) of this section; payment 770
of the regular license tax as prescribed under section 4503.04 of 771
the Revised Code, any applicable motor vehicle tax levied under 772
Chapter 4504. of the Revised Code, any applicable additional fee 773
prescribed by section 4503.40 or 4503.42 of the Revised Code, and 774
an additional fee of ten dollars; and compliance with all other 775
applicable laws relating to the registration of motor vehicles.776

        (C) For each application for registration and registration 777
renewal that the registrar receives under this section, the 778
registrar shall collect a contribution of fifteen dollars. The 779
registrar shall transmit this contribution to the treasurer of 780
state for deposit into the license plate contribution fund created 781
by section 4501.21 of the Revised Code.782

        The additional fee of ten dollars described in division (B) 783
of this section shall be for the purpose of compensating the 784
bureau of motor vehicles for additional services required in 785
issuing license plates under this section. The registrar shall 786
transmit that fee to the treasurer of state for deposit into the 787
state treasury to the credit of the bureau of motor vehicles fund 788
created by section 4501.25 of the Revised Code.789

       Sec. 4503.531. (A) Any person who is on active duty in the 790
armed forces of the United States or is a retired or honorably 791
discharged veteran of any branch of the armed forces of the United 792
States and who served in operation Iraqi freedom may apply to the 793
registrar of motor vehicles for the registration of any passenger 794
car, noncommercial motor vehicle, motor home, or other vehicle of 795
a class approved by the registrar the person owns or leases. The 796
application shall be accompanied by such written evidence that the 797
applicant is on active duty or is a retired or honorably 798
discharged veteran of the armed forces of the United States and 799
served in operation Iraqi freedom as the registrar shall require 800
by rule. The application may be combined with a request for a 801
special reserved license plate under section 4503.40 or 4503.42 of 802
the Revised Code.803

        (B) Upon receipt of an application for registration of a 804
motor vehicle under this section; presentation of satisfactory 805
evidence of military service in operation Iraqi freedom; payment 806
of the regular license tax as prescribed under section 4503.04 of 807
the Revised Code, any applicable local tax levied under Chapter 808
4504. of the Revised Code, and any applicable additional fee 809
prescribed by section 4503.40 or 4503.42 of the Revised Code; and 810
compliance with all other applicable laws relating to the 811
registration of motor vehicles, the registrar shall issue to the 812
applicant the appropriate motor vehicle registration and a set of 813
license plates and a validation sticker, or a validation sticker 814
alone when required by section 4503.191 of the Revised Code.815

       In addition to the letters and numbers ordinarily inscribed 816
on license plates, the license plates shall be inscribed with the 817
words "Operation Iraqi Freedom" and bear a reproduction of the 818
operation Iraqi freedom service ribbon or such other insignia 819
denoting service in operation Iraqi freedom as the United States 820
department of defense may create, as selected by the registrar. 821
The license plates shall bear county identification stickers that 822
identify the county of registration by name or number.823

        (C) Sections 4503.77 and 4503.78 of the Revised Code do not 824
apply to license plates issued under this section.825

       Sec. 4503.542. (A) Any person who was issued the World War II 826
honorable service patch or pin known as the "ruptured duck" may 827
apply to the registrar of motor vehicles for the registration of 828
any passenger car, noncommercial motor vehicle, recreational 829
vehicle, or other vehicle of a class approved by the registrar 830
that the person owns or leases. The application shall be 831
accompanied by such written evidence that the applicant was issued 832
the ruptured duck service patch or pin as the registrar shall 833
require by rule.834

       Upon receipt of an application for registration of a motor 835
vehicle under this section, presentation of satisfactory evidence 836
documenting that the applicant was issued the ruptured duck 837
service patch or pin, and payment of the regular license fees as 838
prescribed under section 4503.04 of the Revised Code and any local 839
motor vehicle license tax levied under Chapter 4504. of the 840
Revised Code, the registrar shall issue to the applicant the 841
appropriate motor vehicle registration and a set of license plates 842
and a validation sticker, or a validation sticker alone when 843
required by section 4503.191 of the Revised Code. In addition to 844
the letters and numbers ordinarily inscribed thereon, the license 845
plates shall be inscribed with the words "ruptured duck" and bear 846
a reproduction of the ruptured duck service patch or pin. The 847
license plates shall bear county identification stickers that 848
identify the county of registration by name or number.849

       (B) Sections 4503.77 and 4503.78 of the Revised Code do not 850
apply to license plates issued under this section.851

       Sec. 4503.546. (A) Any member of the immediate family of a 852
person who died in a combat zone while a member of any branch of 853
the armed forces of the United States may apply to the registrar 854
of motor vehicles for the registration of any passenger car, 855
noncommercial motor vehicle, motor home, or other vehicle of a 856
class approved by the registrar that the family member owns or 857
leases and for issuance of "gold star family" license plates for 858
that motor vehicle. The application for "gold star family" license 859
plates may be combined with a request for a special reserved 860
license plate under section 4503.40 or 4503.42 of the Revised 861
Code. Upon receipt of the completed application and compliance 862
with division (B) of this section, the registrar shall issue to 863
the applicant the appropriate vehicle registration, a set of "gold 864
star family" license plates with a validation sticker, or a 865
validation sticker alone when required by section 4503.191 of the 866
Revised Code.867

       In addition to the letters and numbers ordinarily inscribed 868
on the license plates, "gold star family" license plates shall be 869
inscribed with a gold star and the words "gold star family." "Gold 870
star family" license plates shall bear county identification 871
stickers that identify the county of registration by name or 872
number.873

       (B) "Gold star family" license plates and a validation 874
sticker or, when applicable, a validation sticker alone shall be 875
issued upon submission by the applicant of an application for 876
registration of a motor vehicle under this section, payment of the 877
regular license tax as prescribed under section 4503.04 of the 878
Revised Code, any applicable motor vehicle tax levied under 879
Chapter 4504. of the Revised Code, any applicable additional fee 880
prescribed by section 4503.40 or 4503.42 of the Revised Code, and 881
an additional fee of ten dollars, and compliance with all other 882
applicable laws relating to the registration of motor vehicles.883

       (C) The additional fee of ten dollars described in division 884
(B) of this section shall be for the purpose of compensating the 885
bureau of motor vehicles for additional services required in 886
issuing license plates under this section. The registrar shall 887
transmit that fee to the treasurer of state for deposit into the 888
state treasury to the credit of the bureau of motor vehicles fund 889
created by section 4501.25 of the Revised Code.890

       (D) No person who is not a member of the immediate family of 891
a person who died in a combat zone while a member of any branch of 892
the armed forces of the United States shall willfully and falsely 893
represent that the person is such a family member for the purpose 894
of obtaining license plates under this section.895

       (E) As used in this section, "member of the immediate family" 896
of a person who died in a combat zone while a member of any branch 897
of the armed forces of the United States means all of the 898
following:899

       (1) A spouse;900

       (2) A parent, stepparent, or other person who acted in loco 901
parentis;902

       (3) A sibling, whether of the whole or half-blood, or by 903
adoption;904

       (4) A child, including those by adoption, or a stepchild.905

       Sec. 4503.553. (A) The owner or lessee of any passenger car, 906
noncommercial motor vehicle, recreational vehicle, or other 907
vehicle of a class approved by the registrar of motor vehicles may 908
apply to the registrar for the registration of the vehicle and 909
issuance of Ohio's horse license plates. An application made under 910
this section may be combined with a request for a special reserved 911
license plate under section 4503.40 or 4503.42 of the Revised 912
Code. Upon receipt of the completed application and compliance by 913
the applicant with divisions (B) and (C) of this section, the 914
registrar shall issue to the applicant the appropriate vehicle 915
registration and a set of Ohio's horse license plates and a 916
validation sticker, or a validation sticker alone when required by 917
section 4503.191 of the Revised Code.918

       In addition to the letters and numbers ordinarily inscribed 919
on the license plates, Ohio's horse license plates shall be 920
inscribed with identifying words or markings that are designed by 921
the Ohio coalition for animals, incorporated and approved by the 922
registrar. Ohio's horse license plates shall display county 923
identification stickers that identify the county of registration 924
by name or number.925

       (B) The Ohio's horse license plates and a validation sticker, 926
or validation sticker alone, shall be issued upon receipt of a 927
contribution as provided in division (C)(1) of this section and 928
upon payment of the regular license tax as prescribed under 929
section 4503.04 of the Revised Code, any applicable motor vehicle 930
license tax levied under Chapter 4504. of the Revised Code, any 931
applicable additional fee prescribed by section 4503.40 or 4503.42 932
of the Revised Code, a bureau of motor vehicles fee of ten 933
dollars, and compliance with all other applicable laws relating to 934
the registration of motor vehicles.935

       (C) For each application for registration and registration 936
renewal notice the registrar receives under this section, the 937
registrar shall collect a contribution in an amount not to exceed 938
forty dollars, as determined by the Ohio coalition for animals, 939
incorporated. The registrar shall deposit this contribution into 940
the state treasury to the credit of the license plate contribution 941
fund created in section 4501.21 of the Revised Code.942

       The registrar shall deposit the bureau of motor vehicles fee 943
of ten dollars, which is to compensate the bureau for the 944
additional services required in the issuing of Ohio's horse 945
license plates, into the state treasury to the credit of the state 946
bureau of motor vehicles fund created by section 4501.25 of the 947
Revised Code.948

       Sec. 4503.712. (A) The owner or lessee of any passenger car, 949
noncommercial motor vehicle, recreational vehicle, or other 950
vehicle of a class approved by the registrar of motor vehicles may 951
apply to the registrar for the registration of the vehicle and 952
issuance of Ohio c.o.p.s. license plates. The application for Ohio 953
c.o.p.s. license plates may be combined with a request for a 954
special reserved license plate under section 4503.40 or 4503.42 of 955
the Revised Code. Upon receipt of the completed application and 956
compliance with divisions (B) and (C) of this section, the 957
registrar shall issue to the applicant the appropriate vehicle 958
registration and a set of Ohio c.o.p.s. license plates with a 959
validation sticker or a validation sticker alone when required by 960
section 4503.191 of the Revised Code.961

       In addition to the letters and numbers ordinarily inscribed 962
thereon, Ohio c.o.p.s. license plates shall be inscribed with 963
identifying words or markings designed by the Ohio c.o.p.s. 964
organization. Ohio c.o.p.s. license plates shall bear county 965
identification stickers that identify the county of registration 966
by name or number.967

       (B) The registrar shall issue a set of Ohio c.o.p.s. license 968
plates with a validation sticker or a validation sticker alone 969
upon receipt of a contribution as provided in division (C) of this 970
section and upon payment of the regular license fee prescribed 971
under section 4503.04 of the Revised Code, any applicable motor 972
vehicle tax levied under Chapter 4504. of the Revised Code, an 973
additional bureau of motor vehicles fee of ten dollars, and 974
compliance with all other applicable laws relating to the 975
registration of motor vehicles. If the application for Ohio 976
c.o.p.s. license plates is combined with a request for a special 977
reserved license plate under section 4503.40 or 4503.42 of the 978
Revised Code, the license plate and validation sticker shall be 979
issued upon payment of the contribution, fees, and taxes contained 980
in this division and the additional fee prescribed under section 981
4503.40 or 4503.42 of the Revised Code.982

       (C) For each application for registration and registration 983
renewal the registrar receives under this section, the registrar 984
shall collect a contribution of fifteen dollars. The registrar 985
shall transmit this contribution to the treasurer of state for 986
deposit into the license plate contribution fund created in 987
section 4501.21 of the Revised Code.988

       The registrar shall transmit the bureau of motor vehicles fee 989
of ten dollars, which is to compensate the bureau for additional 990
services required in issuing Ohio c.o.p.s. license plates, to the 991
treasurer of state for deposit into the state treasury to the 992
credit of the state bureau of motor vehicles fund created by 993
section 4501.25 of the Revised Code.994

       Sec. 4503.722. (A) The owner or lessee of any passenger car, 995
noncommercial motor vehicle, recreational vehicle, or other 996
vehicle of a class approved by the registrar of motor vehicles may 997
apply to the registrar for the registration of the vehicle and 998
issuance of children with medical handicaps license plates. The 999
application may be combined with a request for a special reserved 1000
license plate under section 4503.40 or 4503.42 of the Revised 1001
Code. Upon receipt of the completed application and compliance by 1002
the applicant with divisions (B) and (C) of this section, the 1003
registrar shall issue to the applicant the appropriate vehicle 1004
registration and a set of children with medical handicaps license 1005
plates and a validation sticker, or a validation sticker alone 1006
when required by section 4503.191 of the Revised Code.1007

        In addition to the letters and numbers ordinarily inscribed 1008
on the license plates, children with medical handicaps license 1009
plates shall be inscribed with identifying words or markings 1010
designated by the department of health and approved by the 1011
registrar. Children with medical handicaps license plates shall 1012
display county identification stickers that identify the county of 1013
registration by name or number.1014

        (B) Children with medical handicaps license plates and a 1015
validation sticker, or validation sticker alone, shall be issued 1016
upon receipt of an application for registration of a motor vehicle 1017
under this section; payment of the regular license tax as 1018
prescribed under section 4503.04 of the Revised Code, any 1019
applicable motor vehicle license tax levied under Chapter 4504. of 1020
the Revised Code, any applicable additional fee prescribed by 1021
section 4503.40 or 4503.42 of the Revised Code, an additional fee 1022
of ten dollars, and a contribution as provided in division (C) of 1023
this section; and compliance with all other applicable laws 1024
relating to the registration of motor vehicles.1025

        (C) For each application for registration and registration 1026
renewal notice the registrar receives under this section, the 1027
registrar shall collect a contribution of twenty dollars. The 1028
registrar shall transmit this contribution to the treasurer of 1029
state for deposit into the children with medical handicaps license 1030
plate fund created by section 3701.0211 of the Revised Code.1031

        The registrar shall transmit the additional fee of ten 1032
dollars, which is to compensate the bureau of motor vehicles for 1033
the additional services required in the issuing of children with 1034
medical handicaps license plates, to the treasurer of state for 1035
deposit into the state treasury to the credit of the state bureau 1036
of motor vehicles fund created by section 4501.25 of the Revised 1037
Code.1038

       Sec. 4503.731. (A) The owner or lessee of any passenger car, 1039
noncommercial motor vehicle, recreational vehicle, or vehicle of a 1040
class approved by the registrar of motor vehicles who is a member 1041
in good standing of the civil air patrol may apply to the 1042
registrar for the registration of the vehicle and issuance of 1043
civil air patrol license plates. The request for the license 1044
plates may be combined with a request for a special reserved 1045
license plate under section 4503.40 or 4503.42 of the Revised 1046
Code. Upon receipt of the completed application, presentation by 1047
the applicant of the required evidence that the applicant is a 1048
member in good standing of the civil air patrol, and compliance 1049
with division (B) of this section, the registrar shall issue to 1050
the applicant appropriate vehicle registration and a set of civil 1051
air patrol license plates and a validation sticker, or a 1052
validation sticker alone when required by section 4503.191 of the 1053
Revised Code.1054

        In addition to the letters and numbers ordinarily inscribed 1055
thereon, civil air patrol license plates shall be inscribed with 1056
identifying words and a symbol or logo designed by the civil air 1057
patrol and approved by the registrar. Civil air patrol license 1058
plates shall bear county identification stickers that identify the 1059
county of registration by name or number.1060

        (B) Civil air patrol license plates and validation stickers 1061
shall be issued upon payment of the regular license tax as 1062
prescribed under section 4503.04 of the Revised Code, any 1063
applicable motor vehicle tax levied under Chapter 4504. of the 1064
Revised Code, any applicable additional fee prescribed by section 1065
4503.40 or 4503.42 of the Revised Code, and a bureau of motor 1066
vehicles fee of ten dollars, and compliance with all other 1067
applicable laws relating to the registration of motor vehicles.1068

        (C) The registrar shall deposit the bureau of motor vehicles 1069
fee, which shall be for the purpose of compensating the bureau for 1070
additional services required in the issuing of civil air patrol 1071
license plates, into the state treasury to the credit of the state 1072
bureau of motor vehicles fund created in section 4501.25 of the 1073
Revised Code.1074

       Sec. 4503.92.  (A) The owner or lessee of any passenger car, 1075
noncommercial motor vehicle, recreational vehicle, or other 1076
vehicle of a class approved by the registrar of motor vehicles may 1077
apply to the registrar for the registration of the vehicle and 1078
issuance of "support our troops" license plates. The application 1079
may be combined with a request for a special reserved license 1080
plate under section 4503.40 or 4503.42 of the Revised Code. Upon 1081
receipt of the completed application and compliance by the 1082
applicant with divisions (B) and (C) of this section, the 1083
registrar shall issue to the applicant the appropriate vehicle 1084
registration and a set of "support our troops" license plates and 1085
a validation sticker, or a validation sticker alone when required 1086
by section 4503.191 of the Revised Code.1087

       In addition to the letters and numbers ordinarily inscribed 1088
on the license plates, "support our troops" license plates shall 1089
bear an appropriate logo and the words "support our troops." The 1090
bureau of motor vehicles shall design "support our troops" license 1091
plates, and they shall display county identification stickers that 1092
identify the county of registration by name or number.1093

       (B) "Support our troops" license plates and a validation 1094
sticker, or validation sticker alone, shall be issued upon receipt 1095
of an application for registration of a motor vehicle under this 1096
section; payment of the regular license tax as prescribed under 1097
section 4503.04 of the Revised Code, any applicable motor vehicle 1098
license tax levied under Chapter 4504. of the Revised Code, any 1099
applicable additional fee prescribed by section 4503.40 or 4503.42 1100
of the Revised Code, an additional fee of ten dollars, and a 1101
contribution as provided in division (C) of this section; and 1102
compliance with all other applicable laws relating to the 1103
registration of motor vehicles.1104

       (C) For each application for registration and registration 1105
renewal notice the registrar receives under this section, the 1106
registrar shall collect a contribution of twenty-five dollars. The 1107
registrar shall transmit this contribution to the treasurer of 1108
state for deposit into the license plate contribution fund created 1109
by section 4501.21 of the Revised Code.1110

       The registrar shall transmit the additional fee of ten 1111
dollars, which is to compensate the bureau of motor vehicles for 1112
the additional services required in the issuing of "support our 1113
troops" license plates, to the treasurer of state for deposit into 1114
the state treasury to the credit of the state bureau of motor 1115
vehicles fund created by section 4501.25 of the Revised Code.1116

       Sec. 4503.93.  (A) The owner or lessee of any passenger car, 1117
noncommercial motor vehicle, recreational vehicle, or other 1118
vehicle of a class approved by the registrar of motor vehicles may 1119
apply to the registrar for the registration of the vehicle and 1120
issuance of Ohio "volunteer" license plates. The application for 1121
Ohio "volunteer" license plates may be combined with a request for 1122
a special reserved license plate under section 4503.40 or 4503.42 1123
of the Revised Code. Upon receipt of the completed application and 1124
compliance with divisions (B) and (C) of this section, the 1125
registrar shall issue to the applicant the appropriate vehicle 1126
registration and a set of Ohio "volunteer" license plates with a 1127
validation sticker or a validation sticker alone when required by 1128
section 4503.191 of the Revised Code.1129

       In addition to the letters and numbers ordinarily inscribed 1130
on license plates, Ohio "volunteer" license plates shall be 1131
inscribed with words and markings designed by the Ohio community 1132
service council created by section 121.40 of the Revised Code and 1133
approved by the registrar. Ohio "volunteer" license plates shall 1134
bear county identification stickers that identify the county of 1135
registration by name or number.1136

       (B) Ohio "volunteer" license plates and a validation sticker, 1137
or a validation sticker alone, shall be issued upon receipt of a 1138
contribution as provided in division (C) of this section and upon 1139
payment of the regular license tax prescribed in section 4503.04 1140
of the Revised Code, any applicable motor vehicle tax levied under 1141
Chapter 4504. of the Revised Code, any applicable additional fee 1142
prescribed by section 4503.40 or 4503.42 of the Revised Code, a 1143
bureau of motor vehicles fee of ten dollars, and compliance with 1144
all other applicable laws relating to the registration of motor 1145
vehicles.1146

       (C)(1) For each application for registration and registration 1147
renewal received under this section, the registrar shall collect a 1148
contribution of fifteen dollars. The registrar shall transmit this 1149
contribution to the treasurer of state for deposit into the Ohio 1150
community service council gifts and donations fund created by 1151
section 121.403 of the Revised Code. The council shall use all 1152
such contributions for the purposes described in divisions (B)(2) 1153
and (3) of that section.1154

       (2) The registrar shall deposit the bureau of motor vehicles 1155
fee of ten dollars specified in division (B) of this section, 1156
which is for the purpose of compensating the bureau for the 1157
additional services required in issuing Ohio "volunteer" license 1158
plates, into the state bureau of motor vehicles fund created in 1159
section 4501.25 of the Revised Code.1160

       Sec. 5511.09.  Within a county, any highway or bridge that is 1161
part of the state highway system may be officially assigned a 1162
distinctive name, commemorative of an historical event or 1163
personage or a commonly accepted and appropriate name, by which 1164
the highway or bridge is known. Upon agreement of the governing 1165
bodies of the county and each township and municipal corporation 1166
within the county through which the highway extends or in which 1167
the bridge is located, a request for approval of the highway name 1168
may be submitted to the director of transportation. The agreement 1169
shall be indicated by a resolution from each governing body in 1170
support of the proposed highway or bridge name. The resolution may1171
not be withdrawn, amended, or repealed for thirty days following1172
receipt of the resolution by the requesting authority, or during1173
the time the request is pending before the director.1174

       Within thirty days after receipt of such a request, the1175
director shall inform the requesting authority of histhe1176
director's decision. If the director approves the request, the 1177
requesting authority may, at its own expense, may erect markers 1178
indicating the name of the highway or bridge within the county, 1179
provided that any marker so erected shall conform to the law of 1180
this state and to federal law and shall be in accordance with the 1181
directives for the signing of named memorial highways included in 1182
the manual adopted by the department of transportation under 1183
section 4511.09 of the Revised Code.1184

       Only one name per county shall be assigned to a highway or a 1185
bridge under this section, and the name shall apply to the entire1186
extension of the highway or the entire portion of the bridge1187
within the county. A name assigned to a state highway or part 1188
thereof or a bridge under this section may be altered or 1189
abolished, pursuant to approval of the director, in the same1190
manner as provided for assignment of the original name.1191

       This section shall not in any way modify, limit, or restrict 1192
the authority of a municipal corporation to designate within the 1193
municipal corporation, the name of a highway or a bridge that is1194
part of the state highway system. If a municipal corporation has1195
acted pursuant to its authority and designated the name of a1196
highway or bridge within the municipal corporation, no other name 1197
may be assigned to that highway or bridge under this section.1198

       Sec. 5533.09. (A)(1) That portion of the road known as 1199
interstate route seventy-six, running in an easterly and westerly 1200
direction, commencing at its intersection with interstate 1201
seventy-one in Medina county and extending through the counties of 1202
Summit and Portage to its intersection with interstate eighty in 1203
Mahoning county, shall be known as "The Military Order of the 1204
Purple Heart Memorial Highway."1205

       (2) In addition to the respective designations in sections 1206
5533.30, 5533.32, and 5533.33 of the Revised Code, the road known 1207
as interstate route seventy, extending across Ohio from the West 1208
Virginia border in Belmont county to the Indiana border in Preble 1209
county, and the road known as interstate route seventy-one, 1210
extending across Ohio from the Kentucky border in Hamilton county 1211
to its northernmost terminus in Cuyahoga county, both shall be 1212
known as the "Purple Heart Trail."1213

        (B) The director of transportation may erect suitable markers 1214
along theeach highway indicating its name.1215

       Sec. 5533.101. In addition to the name prescribed by section 1216
5533.10 of the Revised Code, that portion of the highway known as 1217
United States route fifty, commencing at mile marker number 1218
thirteen and proceeding in an easterly direction to the 1219
intersection of that United States route and state route one 1220
hundred thirty-three within Clermont county, shall be known as the 1221
"LCPL Nicholas B. Erdy Memorial Highway."1222

       The director of transportation may erect suitable markers 1223
along the highway indicating its name.1224

       Sec. 5533.116. That portion of the road known as state route 1225
one hundred thirty-one, running in an easterly and westerly 1226
direction, commencing at its intersection with interstate route 1227
two hundred seventy-five within Clermont county and extending to 1228
its intersection with state route one hundred thirty-two, shall be 1229
known as the "Sam Bateman memorial highway."1230

       The director of transportation may erect suitable markers 1231
along the highway indicating its name.1232

       Sec. 5533.281. In addition to the designation contained in 1233
section 5533.28 of the Revised Code, that portion of the road 1234
known as state route eleven, located only within Ashtabula county 1235
and running in a northerly and southerly direction, shall be known 1236
as the "Marine Private Henry Kalinowski Memorial Highway."1237

        The director of transportation may erect suitable markers 1238
along the highway indicating its name.1239

       Sec. 5533.321. The bridge that spans the south fork Licking 1240
river south of the city of Newark in Licking county and that is 1241
part of the road known as state route number thirteen shall be 1242
known as the "K.I.A. Memorial Bridge."1243

        The director of transportation may erect suitable markers 1244
upon the bridge, or the approaches thereto, indicating its name.1245

       Sec. 5533.332. In addition to the name prescribed by section 1246
5533.32 of the Revised Code, that portion of the highway known as 1247
interstate number seventy-one, running in a northerly and 1248
southerly direction within the municipal corporation of Middleburg 1249
Heights only, shall be known as the "Corporal Brad D. Squires 1250
Memorial Highway."1251

        The director of transportation may erect suitable markers 1252
along the highway indicating its name.1253

       Sec. 5533.632.  The road known as state route number two, 1254
running in an easterly and westerly direction, within the 1255
municipal corporation of Willoughby only, shall be known as the 1256
"Brian Montgomery Memorial Highway."1257

        The director of transportation may erect suitable markers 1258
along the highway indicating its name.1259

       Sec. 5533.75.  That portion of the road known as state route 1260
one hundred eighty-eight, located within Fairfield county only, 1261
shall be known as the "Deputy Ethan Collins Memorial Road."1262

       The director of transportation may erect suitable markers 1263
along the highway indicating its name.1264

       Sec. 5533.76. That portion of the road known as United States 1265
route thirty located within Crawford county, extending from the 1266
junction with state route four in an easterly direction to the 1267
junction with state route five hundred ninety-eight, shall be 1268
known as the "Lieutenant Harry L. Martin Memorial Highway."1269

        The director of transportation may erect suitable markers 1270
along the highway indicating its name.1271

       Sec. 5533.77. (A) In addition to the designation of the 1272
highway known as state route number eighty-two in section 5533.17 1273
of the Revised Code, the following portions of the following 1274
highways, located within Trumbull county only, shall be known as 1275
the "President Ronald Wilson Reagan Outerbelt":1276

       (1) State route number five, commencing at the intersection 1277
of that highway and interstate route number eighty and running in 1278
a northeasterly direction until that highway merges with state 1279
route number eighty-two;1280

       (2) The merged state highway consisting of state route number 1281
five and state route number eighty-two and running in an easterly 1282
direction until those two highways diverge;1283

       (3) State route number eighty-two, commencing at the point at 1284
which that highway and state route number five diverge and running 1285
in a southeasterly and then easterly direction until its 1286
intersection with state route number eleven.1287

       (B) The director of transportation may erect suitable markers 1288
upon those portions of those highways indicating their name.1289

       Sec. 5533.791. The road known as state route number three 1290
hundred thirty-four, located within Clark county, shall be known 1291
as the "Lance Cpl. Kevin S. Smith Memorial Highway."1292

       The director of transportation may erect suitable markers 1293
along the highway indicating its name.1294

       Sec. 5533.801. The road known as state route number 1295
ninety-three, running in a northerly and southerly direction 1296
through Lawrence county only, shall be known as the "Glenn 1297
Presnell Memorial Highway."1298

       The director of transportation may erect suitable markers 1299
along the highway indicating its name.1300

       Sec. 5533.811. The bridge that spans the Maumee River in the 1301
city of Napoleon in Henry county, and that is part of the road 1302
known as state route number one hundred eight, shall be known as 1303
the "Henry County Veterans Bridge."1304

        The director of transportation may erect suitable markers 1305
upon the bridge or its approaches indicating its name.1306

       Sec. 5533.871.  The road known as state route number six 1307
hundred sixty, located within Guernsey county, shall be known as 1308
the "Major James W. Reed Memorial Highway."1309

       The director of transportation may erect suitable markers 1310
along the highway indicating its name.1311

       Sec. 5533.91. That part of the road known as state route 1312
number forty-four, located within Lake county and commencing at 1313
the intersection of that state route and state route number two 1314
and extending in a northerly direction and ending at headlands 1315
beach state park, shall be known as the "Andy Nowacki Memorial 1316
Highway."1317

       The director of transportation may erect suitable markers 1318
along the highway indicating its name.1319

       Sec. 5533.92. That part of the road known as United States 1320
route number thirty, located within Crawford county and running in 1321
an easterly and westerly direction between state route number six 1322
hundred two and state route number sixty-one, shall be known as 1323
the "Staff Sergeant Kendall H. Ivy II Memorial Highway."1324

       The director of transportation may erect suitable markers 1325
along the highway indicating its name.1326

       Sec. 5533.93. The bridge spanning the Ohio river at Pomeroy 1327
in Meigs county shall be known as the "Bridge of Honor."1328

       The director of transportation may erect suitable markers 1329
upon the bridge or its approaches indicating its name.1330

       Section 2.  That existing sections 121.403, 4501.21, 4501.27, 1331
5511.09, and 5533.09 of the Revised Code are hereby repealed.1332

       Section 3.  Section 4501.21 of the Revised Code is presented 1333
in this act as a composite of the section as amended by both Am. 1334
Sub. H.B. 68 and Sub. H.B. 298 of the 126th General Assembly. The 1335
General Assembly, applying the principle stated in division (B) of 1336
section 1.52 of the Revised Code that amendments are to be 1337
harmonized if reasonably capable of simultaneous operation, finds 1338
that the composite is the resulting version of the section in 1339
effect prior to the effective date of the section as presented in 1340
this act.1341

       Section 4. The Department of Transportation shall erect and 1342
maintain one sign each in the northbound and southbound roadways 1343
of Interstate Highway 75 approaching Exit Number 74 that reads 1344
"Hobart Institute of Welding Technology Exit 74." The signs shall 1345
conform to the provisions contained in the manual adopted by the 1346
Department pursuant to section 4511.09 of the Revised Code 1347
regarding the size, coloring, lettering, and installation 1348
locations of the signs.1349

       Section 5. The portion of the Western Reserve Greenway Bike 1350
Path that is located within Trumbull County shall be known as the 1351
"Garrett Wonders Memorial Bikeway."1352

       Section 6. It is the intent of the General Assembly in 1353
enacting section 5.2236 of the Revised Code to increase public 1354
awareness and understanding of epilepsy.1355

       The members of the 126th General Assembly consider it vitally 1356
important that the State of Ohio join with the Epilepsy Foundation 1357
in formally designating November as Epilepsy Awareness Month. 1358
According to the United States Centers for Disease Control and 1359
Prevention (CDC), epilepsy currently affects approximately 2.7 1360
million Americans – roughly one of every one hundred individuals – 1361
with as many as 180,000 new cases diagnosed each year. Epilepsy 1362
afflicts people of all ages, but especially the very young and the 1363
elderly. The CDC estimates that about ten per cent of Americans 1364
will experience a seizure during their lifetime, and about three 1365
per cent will be diagnosed with epilepsy by age eighty.1366

       Section 7. In enacting section 5.2245 of the Revised Code, it 1367
is the intent of the General Assembly to acknowledge and celebrate 1368
the nurses of this state. Although nurses practice their 1369
profession in a wide variety of settings, including hospitals, 1370
nursing homes, other health care facilities, physician's offices, 1371
schools, and even private homes, the contributions made by the 1372
nursing profession in the improvement of the health care system 1373
are sometimes overlooked. Therefore, the members of the 126th 1374
General Assembly feel that it is vitally important that a month be 1375
formally designated as "Nurses Month" for the purpose of 1376
increasing public awareness of the role nurses play in the health 1377
and well-being of all Ohioans.1378

       Section 8. The 126th General Assembly of the state of Ohio 1379
hereby recognizes the historical significance of the mining shovel 1380
The Silver Spade, one of the largest stripping shovels ever built, 1381
and supports the efforts of the Harrison Coal and Reclamation 1382
Historical Park to save the Silver Spade as a tourist attraction.1383

       Section 9. The 126th General Assembly of the state of Ohio 1384
recognizes the significance of the eastern states, including Ohio, 1385
in the preparation for, and return of, the Lewis and Clark 1386
Expedition and hereby supports the extension of the Lewis and 1387
Clark National Historic Trail to include such additional sites.1388

       Section 10. The 126th General Assembly of the state of Ohio 1389
recognizes the importance of the National Road, known as United 1390
States Route 40, and its role in the development of this nation, 1391
and hereby designates the year 2006, the bicentennial of the 1392
authorization of the National Road by Congress, as the Year of the 1393
Historic National Road.1394
