A BILL
To amend sections 1901.02 and 2301.02 of the Revised 1
Code to clarify that the former township of 2
Northampton is no longer within the jurisdiction 3
of the Akron Municipal Court and to create one 4
additional judge for the Summit County Court of 5
Common Pleas to be elected in 2006.6


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1.  That sections 1901.02 and 2301.02 of the Revised 7
Code be amended to read as follows:8

       Sec. 1901.02.  (A) The municipal courts established by9
section 1901.01 of the Revised Code have jurisdiction within the10
corporate limits of their respective municipal corporations, or,11
for the Clermont county municipal court, within the municipal12
corporation or unincorporated territory in which it is13
established, and are courts of record. Each of the courts shall be 14
styled ".................................. municipal court,"15
inserting the name of the municipal corporation, except the16
following courts, which shall be styled as set forth below:17

       (1) The municipal court established in Chesapeake that shall18
be styled and known as the "Lawrence county municipal court";19

       (2) The municipal court established in Cincinnati that shall20
be styled and known as the "Hamilton county municipal court";21

       (3) The municipal court established in Ravenna that shall be22
styled and known as the "Portage county municipal court";23

       (4) The municipal court established in Athens that shall be24
styled and known as the "Athens county municipal court";25

       (5) The municipal court established in Columbus that shall be 26
styled and known as the "Franklin county municipal court";27

       (6) The municipal court established in London that shall be28
styled and known as the "Madison county municipal court";29

       (7) The municipal court established in Newark that shall be30
styled and known as the "Licking county municipal court";31

       (8) The municipal court established in Wooster that shall be32
styled and known as the "Wayne county municipal court";33

       (9) The municipal court established in Wapakoneta that shall34
be styled and known as the "Auglaize county municipal court";35

       (10) The municipal court established in Troy that shall be36
styled and known as the "Miami county municipal court";37

       (11) The municipal court established in Bucyrus that shall be 38
styled and known as the "Crawford county municipal court";39

       (12) The municipal court established in Logan that shall be40
styled and known as the "Hocking county municipal court";41

       (13) The municipal court established in Urbana that shall be42
styled and known as the "Champaign county municipal court";43

       (14) The municipal court established in Jackson that shall be 44
styled and known as the "Jackson county municipal court";45

       (15) The municipal court established in Springfield that46
shall be styled and known as the "Clark county municipal court";47

       (16) The municipal court established in Kenton that shall be48
styled and known as the "Hardin county municipal court";49

       (17) The municipal court established within Clermont county50
in Batavia or in any other municipal corporation or unincorporated51
territory within Clermont county that is selected by the52
legislative authority of that court that shall be styled and known53
as the "Clermont county municipal court";54

       (18) The municipal court established in Wilmington that,55
beginning July 1, 1992, shall be styled and known as the "Clinton56
county municipal court";57

       (19) The municipal court established in Port Clinton that58
shall be styled and known as "the Ottawa county municipal court";59

       (20) The municipal court established in Lancaster that,60
beginning January 2, 2000, shall be styled and known as the61
"Fairfield county municipal court";62

       (21) The municipal court established within Columbiana county 63
in Lisbon or in any other municipal corporation or unincorporated64
territory selected pursuant to division (I) of section 1901.021 of 65
the Revised Code, that shall be styled and known as the 66
"Columbiana county municipal court";67

       (22) The municipal court established in Georgetown that,68
beginning February 9, 2003, shall be styled and known as the69
"Brown county municipal court";70

       (23) The municipal court established in Mount Gilead that,71
beginning January 1, 2003, shall be styled and known as the72
"Morrow county municipal court";73

       (24) The municipal court established in Greenville that, 74
beginning January 1, 2005, shall be styled and known as the "Darke 75
county municipal court."76

       (B) In addition to the jurisdiction set forth in division (A) 77
of this section, the municipal courts established by section78
1901.01 of the Revised Code have jurisdiction as follows:79

       The Akron municipal court has jurisdiction within Bath,80
Northampton, Richfield, and Springfield townships, and within the81
municipal corporations of Fairlawn, Lakemore, and Mogadore, in82
Summit county.83

       The Alliance municipal court has jurisdiction within84
Lexington, Marlboro, Paris, and Washington townships in Stark85
county.86

       The Ashland municipal court has jurisdiction within Ashland87
county.88

       The Ashtabula municipal court has jurisdiction within89
Ashtabula, Plymouth, and Saybrook townships in Ashtabula county.90

       The Athens county municipal court has jurisdiction within91
Athens county.92

       The Auglaize county municipal court has jurisdiction within93
Auglaize county.94

       The Avon Lake municipal court has jurisdiction within the95
municipal corporations of Avon and Sheffield in Lorain county.96

       The Barberton municipal court has jurisdiction within97
Coventry, Franklin, and Green townships, within all of Copley98
township except within the municipal corporation of Fairlawn, and99
within the municipal corporations of Clinton and Norton, in Summit100
county.101

       The Bedford municipal court has jurisdiction within the102
municipal corporations of Bedford Heights, Oakwood, Glenwillow,103
Solon, Bentleyville, Chagrin Falls, Moreland Hills, Orange,104
Warrensville Heights, North Randall, and Woodmere, and within105
Warrensville and Chagrin Falls townships, in Cuyahoga county.106

       The Bellefontaine municipal court has jurisdiction within107
Logan county.108

       The Bellevue municipal court has jurisdiction within Lyme and109
Sherman townships in Huron county and within York township in110
Sandusky county.111

       The Berea municipal court has jurisdiction within the112
municipal corporations of Strongsville, Middleburgh Heights, Brook113
Park, Westview, and Olmsted Falls, and within Olmsted township, in114
Cuyahoga county.115

       The Bowling Green municipal court has jurisdiction within the116
municipal corporations of Bairdstown, Bloomdale, Bradner, Custar,117
Cygnet, Grand Rapids, Haskins, Hoytville, Jerry City, Milton118
Center, North Baltimore, Pemberville, Portage, Rising Sun,119
Tontogany, Wayne, and Weston, and within Bloom, Center, Freedom,120
Grand Rapids, Henry, Jackson, Liberty, Middleton, Milton,121
Montgomery, Plain, Portage, Washington, Webster, and Weston122
townships in Wood county.123

       Beginning February 9, 2003, the Brown county municipal court124
has jurisdiction within Brown county.125

       The Bryan municipal court has jurisdiction within Williams126
county.127

       The Cambridge municipal court has jurisdiction within128
Guernsey county.129

       The Campbell municipal court has jurisdiction within130
Coitsville township in Mahoning county.131

       The Canton municipal court has jurisdiction within Canton,132
Lake, Nimishillen, Osnaburg, Pike, Plain, and Sandy townships in133
Stark county.134

       The Celina municipal court has jurisdiction within Mercer135
county.136

       The Champaign county municipal court has jurisdiction within137
Champaign county.138

       The Chardon municipal court has jurisdiction within Geauga139
county.140

       The Chillicothe municipal court has jurisdiction within Ross141
county.142

       The Circleville municipal court has jurisdiction within143
Pickaway county.144

       The Clark county municipal court has jurisdiction within145
Clark county.146

       The Clermont county municipal court has jurisdiction within147
Clermont county.148

       The Cleveland municipal court has jurisdiction within the149
municipal corporation of Bratenahl in Cuyahoga county.150

       Beginning July 1, 1992, the Clinton county municipal court151
has jurisdiction within Clinton county.152

       The Columbiana county municipal court has jurisdiction within153
all of Columbiana county except within the municipal corporation154
of East Liverpool and except within Liverpool and St. Clair155
townships.156

       The Coshocton municipal court has jurisdiction within157
Coshocton county.158

       The Crawford county municipal court has jurisdiction within159
Crawford county.160

       The Cuyahoga Falls municipal court has jurisdiction within161
Boston, Hudson, Northfield Center, Sagamore Hills, and Twinsburg162
townships, and within the municipal corporations of Boston163
Heights, Hudson, Munroe Falls, Northfield, Peninsula,164
Reminderville, Silver Lake, Stow, Tallmadge, Twinsburg, and165
Macedonia, in Summit county.166

       Beginning January 1, 2005, the Darke county municipal court 167
has jurisdiction within Darke county except within the municipal 168
corporation of Bradford.169

       The Defiance municipal court has jurisdiction within Defiance170
county.171

       The Delaware municipal court has jurisdiction within Delaware172
county.173

       The East Liverpool municipal court has jurisdiction within174
Liverpool and St. Clair townships in Columbiana county.175

       The Eaton municipal court has jurisdiction within Preble176
county.177

       The Elyria municipal court has jurisdiction within the178
municipal corporations of Grafton, LaGrange, and North Ridgeville,179
and within Elyria, Carlisle, Eaton, Columbia, Grafton, and180
LaGrange townships, in Lorain county.181

       The Fairborn municipal court has jurisdiction within the182
municipal corporation of Beavercreek and within Bath and183
Beavercreek townships in Greene county.184

       Beginning January 2, 2000, the Fairfield county municipal185
court has jurisdiction within Fairfield county.186

       The Findlay municipal court has jurisdiction within all of187
Hancock county except within Washington township.188

       The Fostoria municipal court has jurisdiction within Loudon189
and Jackson townships in Seneca county, within Washington township190
in Hancock county, and within Perry township in Wood county.191

       The Franklin municipal court has jurisdiction within Franklin192
township in Warren county.193

       The Franklin county municipal court has jurisdiction within194
Franklin county.195

       The Fremont municipal court has jurisdiction within Ballville196
and Sandusky townships in Sandusky county.197

       The Gallipolis municipal court has jurisdiction within Gallia198
county.199

       The Garfield Heights municipal court has jurisdiction within200
the municipal corporations of Maple Heights, Walton Hills, Valley201
View, Cuyahoga Heights, Newburgh Heights, Independence, and202
Brecksville in Cuyahoga county.203

       The Girard municipal court has jurisdiction within Liberty,204
Vienna, and Hubbard townships in Trumbull county.205

       The Hamilton municipal court has jurisdiction within Ross and206
St. Clair townships in Butler county.207

       The Hamilton county municipal court has jurisdiction within208
Hamilton county.209

       The Hardin county municipal court has jurisdiction within210
Hardin county.211

       The Hillsboro municipal court has jurisdiction within all of212
Highland county except within Madison township.213

       The Hocking county municipal court has jurisdiction within214

       The Huron municipal court has jurisdiction within all of216
Huron township in Erie county except within the municipal217

       The Ironton municipal court has jurisdiction within Aid,219
Decatur, Elizabeth, Hamilton, Lawrence, Upper, and Washington220
townships in Lawrence county.221

       The Jackson county municipal court has jurisdiction within222
Jackson county.223

       The Kettering municipal court has jurisdiction within the224
municipal corporations of Centerville and Moraine, and within225
Washington township, in Montgomery county.226

       Until January 2, 2000, the Lancaster municipal court has227
jurisdiction within Fairfield county.228

       The Lawrence county municipal court has jurisdiction within229
the townships of Fayette, Mason, Perry, Rome, Symmes, Union, and230
Windsor in Lawrence county.231

       The Lebanon municipal court has jurisdiction within232
Turtlecreek township in Warren county.233

       The Licking county municipal court has jurisdiction within234
Licking county.235

       The Lima municipal court has jurisdiction within Allen236
county.237

       The Lorain municipal court has jurisdiction within the238
municipal corporation of Sheffield Lake, and within Sheffield239
township, in Lorain county.240

       The Lyndhurst municipal court has jurisdiction within the241
municipal corporations of Mayfield Heights, Gates Mills, Mayfield,242
Highland Heights, and Richmond Heights in Cuyahoga county.243

       The Madison county municipal court has jurisdiction within244
Madison county.245

       The Mansfield municipal court has jurisdiction within246
Madison, Springfield, Sandusky, Franklin, Weller, Mifflin, Troy,247
Washington, Monroe, Perry, Jefferson, and Worthington townships,248
and within sections 35-36-31 and 32 of Butler township, in249
Richland county.250

       The Marietta municipal court has jurisdiction within251
Washington county.252

       The Marion municipal court has jurisdiction within Marion253

       The Marysville municipal court has jurisdiction within Union255
county.256

       The Mason municipal court has jurisdiction within Deerfield257
township in Warren county.258

       The Massillon municipal court has jurisdiction within259
Bethlehem, Perry, Sugar Creek, Tuscarawas, Lawrence, and Jackson260
townships in Stark county.261

       The Maumee municipal court has jurisdiction within the262
municipal corporations of Waterville and Whitehouse, within263
Waterville and Providence townships, and within those portions of264
Springfield, Monclova, and Swanton townships lying south of the265
northerly boundary line of the Ohio turnpike, in Lucas county.266

       The Medina municipal court has jurisdiction within the267
municipal corporations of Briarwood Beach, Brunswick,268
Chippewa-on-the-Lake, and Spencer and within the townships of269
Brunswick Hills, Chatham, Granger, Hinckley, Lafayette,270
Litchfield, Liverpool, Medina, Montville, Spencer, and York271
townships, in Medina county.272

       The Mentor municipal court has jurisdiction within the273
municipal corporation of Mentor-on-the-Lake in Lake county.274

       The Miami county municipal court has jurisdiction within275
Miami county and within the part of the municipal corporation of276
Bradford that is located in Darke county.277

       The Miamisburg municipal court has jurisdiction within the278
municipal corporations of Germantown and West Carrollton, and279
within German and Miami townships in Montgomery county.280

       The Middletown municipal court has jurisdiction within281
Madison township, and within all of Lemon township, except within282
the municipal corporation of Monroe, in Butler county.283

       Beginning January 1, 2003, the Morrow county municipal court284
has jurisdiction within Morrow county.285

       The Mount Vernon municipal court has jurisdiction within Knox286
county.287

       The Napoleon municipal court has jurisdiction within Henry288
county.289

       The New Philadelphia municipal court has jurisdiction within290
the municipal corporation of Dover, and within Auburn, Bucks,291
Fairfield, Goshen, Jefferson, Warren, York, Dover, Franklin,292
Lawrence, Sandy, Sugarcreek, and Wayne townships in Tuscarawas293
county.294

       The Newton Falls municipal court has jurisdiction within295
Bristol, Bloomfield, Lordstown, Newton, Braceville, Southington,296
Farmington, and Mesopotamia townships in Trumbull county.297

       The Niles municipal court has jurisdiction within the298
municipal corporation of McDonald, and within Weathersfield299
township in Trumbull county.300

       The Norwalk municipal court has jurisdiction within all of301
Huron county except within the municipal corporation of Bellevue302
and except within Lyme and Sherman townships.303

       The Oberlin municipal court has jurisdiction within the304
municipal corporations of Amherst, Kipton, Rochester, South305
Amherst, and Wellington, and within Henrietta, Russia, Camden,306
Pittsfield, Brighton, Wellington, Penfield, Rochester, and307
Huntington townships, and within all of Amherst township except308
within the municipal corporation of Lorain, in Lorain county.309

       The Oregon municipal court has jurisdiction within the310
municipal corporation of Harbor View, and within Jerusalem311
township, in Lucas county, and north within Maumee Bay and Lake312
Erie to the boundary line between Ohio and Michigan between the313
easterly boundary of the court and the easterly boundary of the314
Toledo municipal court.315

       The Ottawa county municipal court has jurisdiction within316
Ottawa county.317

       The Painesville municipal court has jurisdiction within318
Painesville, Perry, Leroy, Concord, and Madison townships in Lake319
county.320

       The Parma municipal court has jurisdiction within the321
municipal corporations of Parma Heights, Brooklyn, Linndale, North322
Royalton, Broadview Heights, Seven Hills, and Brooklyn Heights in323
Cuyahoga county.324

       The Perrysburg municipal court has jurisdiction within the325
municipal corporations of Luckey, Millbury, Northwood, Rossford,326
and Walbridge, and within Perrysburg, Lake, and Troy townships, in327
Wood county.328

       The Portage county municipal court has jurisdiction within329
Portage county.330

       The Portsmouth municipal court has jurisdiction within Scioto331
county.332

       The Rocky River municipal court has jurisdiction within the333
municipal corporations of Bay Village, Westlake, Fairview Park,334
and North Olmsted, and within Riveredge township, in Cuyahoga335
county.336

       The Sandusky municipal court has jurisdiction within the337
municipal corporations of Castalia and Bay View, and within338
Perkins township, in Erie county.339

       The Shaker Heights municipal court has jurisdiction within340
the municipal corporations of University Heights, Beachwood,341
Pepper Pike, and Hunting Valley in Cuyahoga county.342

       The Shelby municipal court has jurisdiction within Sharon,343
Jackson, Cass, Plymouth, and Blooming Grove townships, and within344
all of Butler township except sections 35-36-31 and 32, in345
Richland county.346

       The Sidney municipal court has jurisdiction within Shelby347
county.348

       The Struthers municipal court has jurisdiction within the349
municipal corporations of Lowellville, New Middleton, and Poland,350
and within Poland and Springfield townships in Mahoning county.351

       The Sylvania municipal court has jurisdiction within the352
municipal corporations of Berkey and Holland, and within Sylvania,353
Richfield, Spencer, and Harding townships, and within those354
portions of Swanton, Monclova, and Springfield townships lying355
north of the northerly boundary line of the Ohio turnpike, in356
Lucas county.357

       The Tiffin municipal court has jurisdiction within Adams, Big358
Spring, Bloom, Clinton, Eden, Hopewell, Liberty, Pleasant, Reed,359
Scipio, Seneca, Thompson, and Venice townships in Seneca county.360

       The Toledo municipal court has jurisdiction within Washington361
township, and within the municipal corporation of Ottawa Hills, in362
Lucas county.363

       The Upper Sandusky municipal court has jurisdiction within364
Wyandot county.365

       The Vandalia municipal court has jurisdiction within the366
municipal corporations of Clayton, Englewood, and Union, and367
within Butler, Harrison, and Randolph townships, in Montgomery368
county.369

       The Van Wert municipal court has jurisdiction within Van Wert370
county.371

       The Vermilion municipal court has jurisdiction within the372
townships of Vermilion and Florence in Erie county and within all373
of Brownhelm township except within the municipal corporation of374
Lorain, in Lorain county.375

       The Wadsworth municipal court has jurisdiction within the376
municipal corporations of Gloria Glens Park, Lodi, Seville, and377
Westfield Center, and within Guilford, Harrisville, Homer, Sharon,378
Wadsworth, and Westfield townships in Medina county.379

       The Warren municipal court has jurisdiction within Warren and380
Champion townships, and within all of Howland township except381
within the municipal corporation of Niles, in Trumbull county.382

       The Washington Court House municipal court has jurisdiction383
within Fayette county.384

       The Wayne county municipal court has jurisdiction within385
Wayne county.386

       The Willoughby municipal court has jurisdiction within the387
municipal corporations of Eastlake, Wickliffe, Willowick,388
Willoughby Hills, Kirtland, Kirtland Hills, Waite Hill,389
Timberlake, and Lakeline, and within Kirtland township, in Lake390
county.391

       Through June 30, 1992, the Wilmington municipal court has392
jurisdiction within Clinton county.393

       The Xenia municipal court has jurisdiction within394
Caesarcreek, Cedarville, Jefferson, Miami, New Jasper, Ross,395
Silvercreek, Spring Valley, Sugarcreek, and Xenia townships in396
Greene county.397

       (C) As used in this section:398

       (1) "Within a township" includes all land, including, but not 399
limited to, any part of any municipal corporation, that is400
physically located within the territorial boundaries of that401
township, whether or not that land or municipal corporation is402
governmentally a part of the township.403

       (2) "Within a municipal corporation" includes all land within 404
the territorial boundaries of the municipal corporation and any 405
townships that are coextensive with the municipal corporation.406

       Sec. 2301.02.  The number of judges of the court of common407
pleas for each county, the time for the next election of the408
judges in the several counties, and the beginning of their terms409
shall be as follows:410

       (A) In Adams, Ashland, Fayette, and Pike counties, one judge, 411
elected in 1956, term to begin February 9, 1957;412

       In Brown, Crawford, Defiance, Highland, Holmes, Morgan,413
Ottawa, and Union counties, one judge, to be elected in 1954, term414
to begin February 9, 1955;415

       In Auglaize county, one judge, to be elected in 1956, term to416
begin January 9, 1957;417

       In Coshocton, Darke, Fulton, Gallia, Guernsey, Hardin,418
Jackson, Knox, Madison, Mercer, Monroe, Paulding, Vinton, and 419
Wyandot counties, one judge, to be elected in 1956, term to begin 420
January 1, 1957;421

       In Morrow county, two judges, one to be elected in 1956, term 422
to begin January 1, 1957, and one to be elected in 2006, term to 423
begin January 1, 2007;424

       In Logan county, two judges, one to be elected in 1956, term 425
to begin January 1, 1957, and one to be elected in 2004, term to 426
begin January 2, 2005;427

       In Carroll, Champaign, Clinton, Hocking, Meigs, Pickaway,428
Preble, Shelby, Van Wert, and Williams counties, one judge, to be429
elected in 1952, term to begin January 1, 1953;430

       In Harrison and Noble counties, one judge, to be elected in431
1954, term to begin April 18, 1955;432

       In Henry county, two judges, one to be elected in 1956, term 433
to begin May 9, 1957, and one to be elected in 2004, term to begin 434
January 1, 2005;435

       In Putnam county, one judge, to be elected in 1956, term to 436
begin May 9, 1957;437

       In Huron county, one judge, to be elected in 1952, term to438
begin May 14, 1953;439

       In Perry county, one judge, to be elected in 1954, term to440
begin July 6, 1956;441

       In Sandusky county, two judges, one to be elected in 1954,442
term to begin February 10, 1955, and one to be elected in 1978,443
term to begin January 1, 1979;444

       (B) In Allen county, three judges, one to be elected in 1956, 445
term to begin February 9, 1957, the second to be elected in 1958, 446
term to begin January 1, 1959, and the third to be elected in 447
1992, term to begin January 1, 1993;448

       In Ashtabula county, three judges, one to be elected in 1954,449
term to begin February 9, 1955, one to be elected in 1960, term to450
begin January 1, 1961, and one to be elected in 1978, term to451
begin January 2, 1979;452

       In Athens county, two judges, one to be elected in 1954, term453
to begin February 9, 1955, and one to be elected in 1990, term to454
begin July 1, 1991;455

       In Erie county, four judges, one to be elected in 1956, term456
to begin January 1, 1957, the second to be elected in 1970, term 457
to begin January 2, 1971, the third to be elected in 2004, term to 458
begin January 2, 2005, and the fourth to be elected in 2008, term 459
to begin February 9, 2009;460

       In Fairfield county, three judges, one to be elected in 1954,461
term to begin February 9, 1955, the second to be elected in 1970,462
term to begin January 1, 1971, and the third to be elected in463
1994, term to begin January 2, 1995;464

       In Geauga county, two judges, one to be elected in 1956, term465
to begin January 1, 1957, and the second to be elected in 1976,466
term to begin January 6, 1977;467

       In Greene county, four judges, one to be elected in 1956,468
term to begin February 9, 1957, the second to be elected in 1960,469
term to begin January 1, 1961, the third to be elected in 1978,470
term to begin January 2, 1979, and the fourth to be elected in471
1994, term to begin January 1, 1995;472

       In Hancock county, two judges, one to be elected in 1952,473
term to begin January 1, 1953, and the second to be elected in474
1978, term to begin January 1, 1979;475

       In Lawrence county, two judges, one to be elected in 1954,476
term to begin February 9, 1955, and the second to be elected in477
1976, term to begin January 1, 1977;478

       In Marion county, three judges, one to be elected in 1952,479
term to begin January 1, 1953, the second to be elected in 1976,480
term to begin January 2, 1977, and the third to be elected in481
1998, term to begin February 9, 1999;482

       In Medina county, three judges, one to be elected in 1956,483
term to begin January 1, 1957, the second to be elected in 1966,484
term to begin January 1, 1967, and the third to be elected in485
1994, term to begin January 1, 1995;486

       In Miami county, two judges, one to be elected in 1954, term487
to begin February 9, 1955, and one to be elected in 1970, term to488
begin on January 1, 1971;489

       In Muskingum county, three judges, one to be elected in 1968,490
term to begin August 9, 1969, one to be elected in 1978, term to 491
begin January 1, 1979, and one to be elected in 2002, term to 492
begin January 2, 2003;493

       In Portage county, three judges, one to be elected in 1956,494
term to begin January 1, 1957, the second to be elected in 1960,495
term to begin January 1, 1961, and the third to be elected in496
1986, term to begin January 2, 1987;497

       In Ross county, two judges, one to be elected in 1956, term498

respectively; one to be elected in 1964, term to begin January 3,657

beginning January 4, 1977, to January 6, 1977; two to be elected660
in 1990, terms to begin July 1, 1991, and July 2, 1991,661

       In Stark county, eight judges; one to be elected in 1958,664
term to begin on January 2, 1959; two to be elected in 1954, terms665
to begin on January 1, 1955, and February 9, 1955, respectively;666
two to be elected in 1952, terms to begin January 1, 1953, and667
April 16, 1953, respectively; one to be elected in 1966, term to668
begin on January 4, 1967; and two to be elected in 1992, terms to669
begin January 1, 1993, and January 2, 1993, respectively;670

       In Summit county, eleventwelve judges; four to be elected in671
1954, terms to begin January 1, 1955, January 2, 1955, January 3,672
1955, and February 9, 1955, respectively; three to be elected in673
1958, terms to begin January 1, 1959, January 2, 1959, and May 17, 674
1959, respectively; one to be elected in 1966, term to begin675
January 4, 1967; one to be elected in 1968, term to begin January676
5, 1969; one to be elected in 1990, term to begin May 1, 1991; and677
one to be elected in 1992, term to begin January 6, 1993; and one 678
to be elected in 2006, term to begin January 3, 2007.679

       Notwithstanding the foregoing provisions, in any county680
having two or more judges of the court of common pleas, in which681
more than one-third of the judges plus one were previously elected682
at the same election, if the office of one of those judges so683
elected becomes vacant more than forty days prior to the second684
general election preceding the expiration of that judge's term,685
the office that that judge had filled shall be abolished as of the686
date of the next general election, and a new office of judge of687
the court of common pleas shall be created. The judge who is to688
fill that new office shall be elected for a six-year term at the689
next general election, and the term of that judge shall commence690
on the first day of the year following that general election, on691
which day no other judge's term begins, so that the number of692
judges that the county shall elect shall not be reduced.693

       Judges of the probate division of the court of common pleas694
are judges of the court of common pleas but shall be elected695
pursuant to sections 2101.02 and 2101.021 of the Revised Code,696
except in Adams, Harrison, Henry, Morgan, Noble, and Wyandot 697
counties in which the judge of the court of common pleas elected 698
pursuant to this section also shall serve as judge of the probate 699
division, except in Lorain county in which the judges of the 700
domestic relations division of the Lorain county court of common 701
pleas elected pursuant to this section also shall perform the 702
duties and functions of the judge of the probate division, and 703
except in Morrow county in which the successors to the judge of 704
the court of common pleas elected in 1956 pursuant to this section 705
also shall serve as judge of the probate division.706

       Section 2. That existing sections 1901.02 and 2301.02 of the 707
Revised Code are hereby repealed.708
