A BILL
To amend section 3731.01 of the Revised Code to 1
exempt long-term stay hotels from the Hotel 2
License Law.3


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 3731.01 of the Revised Code be 4
amended to read as follows:5

       Sec. 3731.01. (A) As used in sections 3731.01 to 3731.21 of6
the Revised Code:7

       (1) "Hotel" means either of the following:8

       (a) Any structure consisting of one or more buildings, with 9
more than five sleeping rooms, that is kept, used, maintained,10
advertised, or held out to the public to be a place where sleeping 11
accommodations are offered for pay to transient guests for a 12
period of thirty days or less, including, but not limited to, such 13
a structure denoted as a hotel, motel, motor hotel, lodge, motor 14
lodge, bed and breakfast, or inn;15

       (b) Any structure consisting of one or more buildings, with 16
more than five sleeping rooms, that is specifically constructed, 17
kept, used, maintained, advertised, and held out to the public to 18
be a place where temporary residence is offered for pay to 19
persons, including, but not limited to, an extended stay hotel or 20
extended stay motel that is specifically constructed, and approved 21
by the building official having jurisdiction over it and by the 22
fire marshal, for extended stay temporary residence by persons, 23
and that contains six or more dwelling units with provision for24
living, eating, cooking, sanitation, and sleeping.25

       "Hotel" does not include agricultural labor camps, apartment26
houses, lodging houses, rooming houses, or hospital or college27
dormitories.28

       (2) "SRO facility" means a facility with more than five29
sleeping rooms that is kept, used, maintained, advertised, or held30
out to the public as a place where sleeping rooms are offered on a31
single room occupancy (SRO) basis and that is intended for use as32
a primary residence for residential guests for a period of more33
than thirty days.34

       "SRO facility" does not include agricultural labor camps,35
apartment houses, lodging houses, rooming houses, or hospital or36
college dormitories.37

       (3) "Single room occupancy (SRO) basis" means one occupant38
per room.39

       (B) This chapter does not apply to apartmentthe following:40

       (1) Apartment buildings and other structures in which all of 41
the units are residential premises;42

       (2) Commercial lodging houses with more than three units in 43
which all of the units are constructed, approved, and certified by 44
the building official having jurisdiction over the building as 45
residential occupancies where the occupants are primarily 46
transient in nature if all of the units are kept, used, 47
maintained, and advertised as transient residences and where the 48
minimum stay of the occupant is more than thirty days but less 49
than one year.50

       Section 2. That existing section 3731.01 of the Revised Code 51
is hereby repealed.52
