A BILL
To amend section 4764.43 and to enact section 1
4765.431 of the Revised Code to modify the 2
staffing requirements for ambulances during 3
emergency runs and while transporting patients.4


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 4765.43 be amended and section 5
4765.431 of the Revised Code be enacted to read as follows:6

       Sec. 4765.43.  (A) A person who drives an ambulance that is 7
equipped for emergency medical services, is not required by this 8
chapter to be certified as an emergency medical technician-basic, 9
emergency medical technician-intermediate, or emergency medical 10
technician-paramedic.11

       (B)(1) During each emergency run made by an ambulance that is12
equipped for emergency medical services and is operated by an13
emergency medical service organization that does not utilize any14
volunteer emergency medical service providers or does not 15
substantially utilize those providers, the ambulance shall be 16
staffed by at least two EMTs-basic, EMTs-I, or paramedics. At any 17
time a patient is being transported inWhen an ambulance is so 18
staffed, it may be driven by a person who is not certified as an 19
EMT-basic, EMT-I, or paramedic.20

       (2) During each emergency run made by an ambulance that is 21
equipped for emergency medical services and is operated by an 22
emergency medical service organization that substantially utilizes 23
volunteer emergency medical service providers, the ambulance shall 24
be staffed by at least two EMTs-basic, EMTs-I, or paramedicsone 25
first responder and one EMT-basic, EMT-I, or paramedic. At all 26
other times during an emergency run, the ambulance shall be 27
staffed by at least one EMT-basic, EMT-I, or paramedic. When an 28
ambulance is so staffed, it may be driven by a person who is not 29
certified as ana first responder, EMT-basic, EMT-I, or paramedic. 30
If circumstances so require, an ambulance that is staffed by only 31
one first responder and one EMT-basic, EMT-I, or paramedic may be 32
driven by the first responder who is staffing the ambulance with 33
the EMT-basic, EMT-I, or paramedic.34

        (C) For purposes of division (B) of this section, an 35
emergency medical service organization substantially utilizes 36
volunteer emergency medical service providers if the organization 37
uses only volunteer first responders, volunteer EMTs-basic, 38
volunteer EMTs-I, or volunteer paramedics, or a combination of 39
such volunteers, for fifty per cent or more of the time during any 40
seven-day period in which the organization makes emergency medical 41
services available to the public.42

       Sec. 4765.431. No emergency medical service organization 43
shall permit an individual who is younger than eighteen years of 44
age to drive an ambulance.45

       Section 2. That existing section 4765.43 of the Revised Code 46
is hereby repealed.47
