A BILL
To amend section 3719.41 of the Revised Code to list 1
Salvia divinorum as a controlled substance.2


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 3719.41 of the Revised Code be 3
amended to read as follows:4

       Sec. 3719.41.  Controlled substance schedules I, II, III, IV, 5
and V are hereby established, which schedules include the6
following, subject to amendment pursuant to section 3719.43 or7
3719.44 of the Revised Code.8

SCHEDULE I

       (A) Narcotics-opiates10

       Any of the following opiates, including their isomers,11
esters, ethers, salts, and salts of isomers, esters, and ethers,12
unless specifically excepted under federal drug abuse control13

existence of these salts, isomers, and salts of isomers is121
possible within the specific chemical designation. For the122
purposes of this division only, "isomer" includes the optical 123
isomers, position isomers, and geometric isomers.124

       (1) Alpha-ethyltryptamine (some trade or other names: 125
etryptamine; Monase; alpha-ethyl-1H-indole-3-ethanamine;126
3-(2-aminobutyl) indole; alpha-ET; and AET);127

       (2) 4-bromo-2,5-dimethoxyamphetamine (some trade or other128
names: 4-bromo-2,5-dimethoxy-alpha-methyphenethylamine;129

activity such as the following: delta-1-cis or trans184
tetrahydrocannabinol, and their optical isomers; delta-6-cis or185
trans tetrahydrocannabinol, and their optical isomers;186
delta-3,4-cis or trans tetrahydrocannabinol, and its optical187
isomers. (Since nomenclature of these substances is not188
internationally standardized, compounds of these structures,189
regardless of numerical designation of atomic positions, are190
covered.));191

       (28) Ethylamine analog of phencyclidine (some trade or other 192
names: N-ethyl-1-phenylcyclohexylamine; (1-phenyl-cyclohexyl193
phenylcyclohexyl)ethylamine; N-(1-phenylcyclohexyl)ethylamine;194
cyclohexamine; PCE);195

       (29) Pyrrolidine analog of phencyclidine (some trade or other 196
names: 1-(1-phenylcyclohexyl)pyrrolidine; PCPy; PHP);197

federal drug abuse control laws, whenever the existence of these 209
salts, isomers, and salts of isomers is possible within the 210
specific chemical designation:211

       (1) Mecloqualone;212

       (2) Methaqualone.213

       (E) Stimulants214

       Unless specifically excepted or unless listed in another215
schedule, any material, compound, mixture, or preparation that216
contains any quantity of the following substances having a217
stimulant effect on the central nervous system, including their218
salts, isomers, and salts of isomers:219

       (1) Aminorex (some other names: aminoxaphen; 220
2-amino-5-phenyl-2-oxazoline; or 221
4,5-dihydro-5-phenyl-2-oxazolamine);222

       (2) Cathinone (some trade or other names:223
2-amino-1-phenyl-1-propanone, alpha-aminopropiophenone, 224
2-aminopropiophenone, and norephedrone);225

       (3) Fenethylline;226

       (4) Methcathinone (some other names: 227
2-(methylamino)-propiophenone; alpha-(methylamino)propiophenone; 228

SCHEDULE II

       (A) Narcotics-opium and opium derivatives240

       Unless specifically excepted under federal drug abuse control 241
laws or unless listed in another schedule, any of the following 242
substances whether produced directly or indirectly by extraction 243
from substances of vegetable origin, independently by means of 244
chemical synthesis, or by a combination of extraction and chemical 245
synthesis:246

       (1) Opium and opiate, and any salt, compound, derivative, or 247
preparation of opium or opiate, excluding apomorphine,248
thebaine-derived butorphanol, dextrorphan, nalbuphine, nalmefene,249
naloxone, and naltrexone, and their respective salts, but250
including the following:251

       (a) Raw opium;252

       (b) Opium extracts;253

       (c) Opium fluid extracts;254

       (d) Powdered opium;255

       (e) Granulated opium;256

       (f) Tincture of opium;257

       (4) Coca leaves and any salt, compound, derivative, or274
preparation of coca leaves (including cocaine and ecgonine, their275
salts, isomers, and derivatives, and salts of those isomers and276

thereof that is chemically equivalent to or identical with any of278
these substances, except that the substances shall not include279
decocainized coca leaves or extraction of coca leaves, which280

straw in either liquid, solid, or powder form that contains the283
phenanthrene alkaloids of the opium poppy).284

       (B) Narcotics-opiates285

       Unless specifically excepted under federal drug abuse control 286
laws or unless listed in another schedule, any of the following 287
opiates, including their isomers, esters, ethers, salts, and salts 288
of isomers, esters, and ethers, whenever the existence of these 289
isomers, esters, ethers, and salts is possible within the specific 290
chemical designation, but excluding dextrorphan and 291

nervous system, including their salts, isomers, and salts of 343
isomers, whenever the existence of these salts, isomers, and salts 344

       (F) Immediate precursors366

       Unless specifically excepted under federal drug abuse control 367
laws or unless listed in another schedule, any material, compound, 368
mixture, or preparation that contains any quantity of the 369
following substances:370

       (1) Immediate precursor to amphetamine and methamphetamine:371

       (a) Phenylacetone (some trade or other names:372
phenyl-2-propanone; P2P; benzyl methyl ketone; methyl benzyl373
ketone);374

       (2) Immediate precursors to phencyclidine (PCP):375

       (a) 1-phenylcyclohexylamine;376

       (b) 1-piperidinocyclohexanecarbonitrile (PCC).377

SCHEDULE III

       (A) Stimulants379

       Unless specifically excepted under federal drug abuse control 380
laws or unless listed in another schedule, any material, compound, 381
mixture, or preparation that contains any quantity of the 382
following substances having a stimulant effect on the central383
nervous system, including their salts, their optical isomers,384
position isomers, or geometric isomers, and salts of these385
isomers, whenever the existence of these salts, isomers, and salts386
of isomers is possible within the specific chemical designation:387

       (1) All stimulant compounds, mixtures, and preparations388
included in schedule III pursuant to the federal drug abuse389
control laws and regulations adopted under those laws;390

       (2) Benzphetamine;391

       (3) Chlorphentermine;392

       (4) Clortermine;393

       (5) Phendimetrazine.394

       (B) Depressants395

       Unless specifically excepted under federal drug abuse control 396
laws or unless listed in another schedule, any material, compound, 397
mixture, or preparation that contains any quantity of the 398
following substances having a depressant effect on the central 399
nervous system:400

       (1) Any compound, mixture, or preparation containing401
amobarbital, secobarbital, pentobarbital, or any salt of any of402
these drugs, and one or more other active medicinal ingredients403
that are not listed in any schedule;404

       (2) Any suppository dosage form containing amobarbital,405
secobarbital, pentobarbital, or any salt of any of these drugs and 406
approved by the food and drug administration for marketing only as 407
a suppository;408

       (3) Any substance that contains any quantity of a derivative 409
of barbituric acid or any salt of a derivative of barbituric acid;410

       (4) Chlorhexadol;411

       (5) Ketamine, its salts, isomers, and salts of isomers (some 412
other names for ketamine: 413
(+/-)-2-(2-chlorophenyl)-2-(methylamino)-cyclohexanone);414

       (6) Lysergic acid;415

       (7) Lysergic acid amide;416

       (8) Methyprylon;417

       (9) Sulfondiethylmethane;418

       (10) Sulfonethylmethane;419

       (11) Sulfonmethane;420

       (12) Tiletamine, zolazepam, or any salt of tiletamine or421

trade or other names for zolazepam: 4-(2-fluorophenyl)-6,8-425
dihydro-1,3,8-trimethylpyrazolo-[3, 4-e][1,4]-diazepin-7(1H)-one;426
flupyrazapon).427

       (C) Narcotic antidotes428

       (1) Nalorphine.429

       (D) Narcotics-narcotic preparations430

       Unless specifically excepted under federal drug abuse control 431
laws or unless listed in another schedule, any material, compound, 432
mixture, or preparation that contains any of the following 433
narcotic drugs, or their salts calculated as the free anhydrous 434
base or alkaloid, in limited quantities as set forth below:435

       (1) Not more than 1.8 grams of codeine per 100 milliliters or 436
not more than 90 milligrams per dosage unit, with an equal or437
greater quantity of an isoquinoline alkaloid of opium;438

       (2) Not more than 1.8 grams of codeine per 100 milliliters or 439
not more than 90 milligrams per dosage unit, with one or more440
active, nonnarcotic ingredients in recognized therapeutic amounts;441

       (3) Not more than 300 milligrams of dihydrocodeinone per 100 442
milliliters or not more than 15 milligrams per dosage unit, with a 443
fourfold or greater quantity of an isoquinoline alkaloid of opium;444

       (4) Not more than 300 milligrams of dihydrocodeinone per 100 445
milliliters or not more than 15 milligrams per dosage unit, with 446
one or more active, nonnarcotic ingredients in recognized447
therapeutic amounts;448

       (5) Not more than 1.8 grams of dihydrocodeine per 100449
milliliters or not more than 90 milligrams per dosage unit, with450
one or more active, nonnarcotic ingredients in recognized451
therapeutic amounts;452

       (6) Not more than 300 milligrams of ethylmorphine per 100453
milliliters or not more than 15 milligrams per dosage unit, with454
one or more active, nonnarcotic ingredients in recognized455
therapeutic amounts;456

       (7) Not more than 500 milligrams of opium per 100 milliliters 457
or per 100 grams or not more than 25 milligrams per dosage unit, 458
with one or more active, nonnarcotic ingredients in recognized 459
therapeutic amounts;460

       (8) Not more than 50 milligrams of morphine per 100461
milliliters or per 100 grams, with one or more active, nonnarcotic 462
ingredients in recognized therapeutic amounts.463

       (E) Anabolic steroids464

       Unless specifically excepted under federal drug abuse control 465
laws or unless listed in another schedule, any material, compound, 466
mixture, or preparation that contains any quantity of the 467
following substances, including their salts, esters, isomers, and 468
salts of esters and isomers, whenever the existence of these469
salts, esters, and isomers is possible within the specific470
chemical designation:471

       (1) Anabolic steroids. Except as otherwise provided in472
division (E)(1) of schedule III, "anabolic steroids" means any473
drug or hormonal substance that is chemically and474
pharmacologically related to testosterone (other than estrogens,475
progestins, and corticosteroids) and that promotes muscle growth.476
"Anabolic steroids" does not include an anabolic steroid that is477
expressly intended for administration through implants to cattle478
or other nonhuman species and that has been approved by the United 479
States secretary of health and human services for that480
administration, unless a person prescribes, dispenses, or481
distributes this type of anabolic steroid for human use. "Anabolic 482
steroid" includes, but is not limited to, the following:483

       (a) Boldenone;484

       (b) Chlorotestosterone (4-chlortestosterone);485

       (c) Clostebol;486

       (d) Dehydrochlormethyltestosterone;487

the free anhydrous base or alkaloid, in limited quantities as set638
forth below, and that includes one or more nonnarcotic active639
medicinal ingredients in sufficient proportion to confer upon the640
compound, mixture, or preparation valuable medicinal qualities641
other than those possessed by narcotic drugs alone:642

       (1) Not more than 200 milligrams of codeine per 100643
milliliters or per 100 grams;644

       (2) Not more than 100 milligrams of dihydrocodeine per 100645
milliliters or per 100 grams;646

       (3) Not more than 100 milligrams of ethylmorphine per 100647
