A BILL
To amend section 3719.41 of the Revised Code to list 1
Salvia divinorum as a controlled substance.2


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 3719.41 of the Revised Code be 3
amended to read as follows:4

       Sec. 3719.41.  Controlled substance schedules I, II, III, IV, 5
and V are hereby established, which schedules include the6
following, subject to amendment pursuant to section 3719.43 or7
3719.44 of the Revised Code.8

SCHEDULE I

       Any of the following opiates, including their isomers,11

possible within the specific chemical designation. For the122
purposes of this division only, "isomer" includes the optical 123
isomers, position isomers, and geometric isomers.124

       (1) Alpha-ethyltryptamine (some trade or other names: 125
etryptamine; Monase; alpha-ethyl-1H-indole-3-ethanamine;126
3-(2-aminobutyl) indole; alpha-ET; and AET);127

2-amino-5-phenyl-2-oxazoline; or 222

       (2) Cathinone (some trade or other names:224

       (A) Narcotics-opium and opium derivatives241

       Unless specifically excepted under federal drug abuse control 242
laws or unless listed in another schedule, any of the following 243
substances whether produced directly or indirectly by extraction 244
from substances of vegetable origin, independently by means of 245
chemical synthesis, or by a combination of extraction and chemical 246
synthesis:247

       (1) Opium and opiate, and any salt, compound, derivative, or 248
preparation of opium or opiate, excluding apomorphine,249
thebaine-derived butorphanol, dextrorphan, nalbuphine, nalmefene,250
naloxone, and naltrexone, and their respective salts, but251
including the following:252

       (a) Raw opium;253

       (b) Opium extracts;254

       (c) Opium fluid extracts;255

       (a) Phenylacetone (some trade or other names:373

       (A) Stimulants380

       Unless specifically excepted under federal drug abuse control 381
laws or unless listed in another schedule, any material, compound, 382
mixture, or preparation that contains any quantity of the 383
following substances having a stimulant effect on the central384
nervous system, including their salts, their optical isomers,385
position isomers, or geometric isomers, and salts of these386
isomers, whenever the existence of these salts, isomers, and salts387
of isomers is possible within the specific chemical designation:388

       (1) All stimulant compounds, mixtures, and preparations389
included in schedule III pursuant to the federal drug abuse390
control laws and regulations adopted under those laws;391

       (2) Benzphetamine;392

       (3) Chlorphentermine;393

       (B) Depressants396

       Unless specifically excepted under federal drug abuse control 397
laws or unless listed in another schedule, any material, compound, 398
mixture, or preparation that contains any quantity of the 399
following substances having a depressant effect on the central 400
nervous system:401

       (1) Any compound, mixture, or preparation containing402
amobarbital, secobarbital, pentobarbital, or any salt of any of403
these drugs, and one or more other active medicinal ingredients404
that are not listed in any schedule;405

       (2) Any suppository dosage form containing amobarbital,406
secobarbital, pentobarbital, or any salt of any of these drugs and 407
approved by the food and drug administration for marketing only as 408
a suppository;409

       (3) Any substance that contains any quantity of a derivative 410
of barbituric acid or any salt of a derivative of barbituric acid;411

       (4) Chlorhexadol;412

       (5) Ketamine, its salts, isomers, and salts of isomers (some 413
other names for ketamine: 414
(+/-)-2-(2-chlorophenyl)-2-(methylamino)-cyclohexanone);415

       (6) Lysergic acid;416

       (7) Lysergic acid amide;417

       (8) Methyprylon;418

       (9) Sulfondiethylmethane;419

       (C) Narcotic antidotes429

       (1) Nalorphine.430

       (D) Narcotics-narcotic preparations431

       Unless specifically excepted under federal drug abuse control 432
laws or unless listed in another schedule, any material, compound, 433
mixture, or preparation that contains any of the following 434
narcotic drugs, or their salts calculated as the free anhydrous 435
base or alkaloid, in limited quantities as set forth below:436

       (1) Not more than 1.8 grams of codeine per 100 milliliters or 437
not more than 90 milligrams per dosage unit, with an equal or438
greater quantity of an isoquinoline alkaloid of opium;439

       (2) Not more than 1.8 grams of codeine per 100 milliliters or 440
not more than 90 milligrams per dosage unit, with one or more441
active, nonnarcotic ingredients in recognized therapeutic amounts;442

       (3) Not more than 300 milligrams of dihydrocodeinone per 100 443
milliliters or not more than 15 milligrams per dosage unit, with a 444
fourfold or greater quantity of an isoquinoline alkaloid of opium;445

       (4) Not more than 300 milligrams of dihydrocodeinone per 100 446
milliliters or not more than 15 milligrams per dosage unit, with 447
one or more active, nonnarcotic ingredients in recognized448
therapeutic amounts;449

       (5) Not more than 1.8 grams of dihydrocodeine per 100450
milliliters or not more than 90 milligrams per dosage unit, with451
one or more active, nonnarcotic ingredients in recognized452
therapeutic amounts;453

       (6) Not more than 300 milligrams of ethylmorphine per 100454
milliliters or not more than 15 milligrams per dosage unit, with455
one or more active, nonnarcotic ingredients in recognized456
therapeutic amounts;457

       (7) Not more than 500 milligrams of opium per 100 milliliters 458
or per 100 grams or not more than 25 milligrams per dosage unit, 459
with one or more active, nonnarcotic ingredients in recognized 460
therapeutic amounts;461

       (8) Not more than 50 milligrams of morphine per 100462
milliliters or per 100 grams, with one or more active, nonnarcotic 463
ingredients in recognized therapeutic amounts.464

       (E) Anabolic steroids465

       Unless specifically excepted under federal drug abuse control 466
laws or unless listed in another schedule, any material, compound, 467
mixture, or preparation that contains any quantity of the 468
following substances, including their salts, esters, isomers, and 469
salts of esters and isomers, whenever the existence of these470
salts, esters, and isomers is possible within the specific471
chemical designation:472

       (1) Anabolic steroids. Except as otherwise provided in473
division (E)(1) of schedule III, "anabolic steroids" means any474
drug or hormonal substance that is chemically and475
pharmacologically related to testosterone (other than estrogens,476
progestins, and corticosteroids) and that promotes muscle growth.477
"Anabolic steroids" does not include an anabolic steroid that is478
expressly intended for administration through implants to cattle479
or other nonhuman species and that has been approved by the United 480
States secretary of health and human services for that481

any of the following narcotic drugs, or their salts calculated as638
the free anhydrous base or alkaloid, in limited quantities as set639
forth below, and that includes one or more nonnarcotic active640
medicinal ingredients in sufficient proportion to confer upon the641
compound, mixture, or preparation valuable medicinal qualities642
other than those possessed by narcotic drugs alone:643

       (1) Not more than 200 milligrams of codeine per 100644
milliliters or per 100 grams;645

       (2) Not more than 100 milligrams of dihydrocodeine per 100646
milliliters or per 100 grams;647

       (3) Not more than 100 milligrams of ethylmorphine per 100648
milliliters or per 100 grams;649

       (4) Not more than 2.5 milligrams of diphenoxylate and not650
