A BILL
To amend sections 901.04, 4501.21, 4503.77, and 1
4503.78 and to enact sections 901.90, 4503.503, 2
4503.504, and 4503.553 of the Revised Code to 3
establish a threshold of 500 annual special 4
license plate registrations for all special 5
license plates, to create "Ohio Agriculture" 6
license plates and to create the Ohio 7
Agriculture License Plate Scholarship Program, 8
to create "Ohio Sustainable Agriculture" license 9
plates, and to create "Ohio's Horse" license 10
plates and to provide that money from the 11
contributions for the license plates be paid to 12
the Ohio Coalition for Animals, Incorporated.13


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That sections 901.04, 4501.21, 4503.77, and 14
4503.78 be amended and sections 901.90, 4503.503, 4503.504, and 15
4503.553 of the Revised Code be enacted to read as follows:16

       Sec. 901.04.  (A) The department of agriculture may solicit17
or accept from any public or private source and shall deposit in18
the state treasury to the credit of the agro Ohio fund any grant,19
gift, devise, or bequest of money made to or for the use of the20
department in fulfilling its statutory duties or for promoting any21
part of the public welfare that is under the supervision and22
control of the department. The department may also accept and hold 23
on behalf of this state any grant, gift, devise, or bequest of24
other property made to or for the use of the department or for25
promoting any part of the public welfare that is under the26
supervision and control of the department. The department may27
contract for and carry out the terms and conditions of any devise,28
grant, gift, or donation that may be so made.29

       (B) There is hereby created in the state treasury the agro30
Ohio fund, to which shall be credited all sums received under31
division (A) of this section and, divisions (A)(2) and (C) of32
section 2105.09 of the Revised Code, and section 4503.504 of the 33
Revised Code. All money received under divisions (A)(2) and (C) of 34
section 2105.09 of the Revised Code shall be used for the benefit 35
of agriculture. All money received under section 4503.504 of the 36
Revised Code shall be used for the benefit of sustainable 37
agriculture markets in the state as determined by the director of 38
agriculture.39

       (C) The director may use all or any portion of the moneys in40
the agro Ohio fund to award grants for the purpose of promoting41
agriculture in this state. With respect to such grants that42
consist of moneys other than federal moneys, the director shall43
adopt rules in accordance with Chapter 119. of the Revised Code44
establishing all of the following:45

       (1) Specific purposes for which grants may be awarded;46

       (2) Procedures for soliciting grant applications, applying47
for grants, awarding grants, and otherwise administering grants;48

       (3) Eligibility criteria for receiving grants that must be49
satisfied by applicants for the grants;50

       (4) Any other procedures and requirements that are necessary51
to administer a grant program.52

       (D) Federal moneys deposited into the agro Ohio fund shall be 53
used in accordance with any terms that federal law prescribes for 54
their use.55

       Sec. 901.90. (A) There is hereby created in the state 56
treasury the Ohio agriculture license plate scholarship fund 57
consisting of the contributions the registrar of motor vehicles 58
receives pursuant to section 4503.503 of the Revised Code. Money 59
shall be expended from the fund only as provided in division (C) 60
of this section.61

       (B)(1) There is hereby created the Ohio agriculture license 62
plate scholarship fund board, consisting of the director of 63
agriculture or the director's designee and one representative 64
appointed by each of the following organizations:65

       (a) The Ohio agriculture council;66

       (b) The Ohio corngrowers association;67

       (c) The Ohio farm bureau federation;68

       (d) The Ohio soy association;69

       (e) The Ohio state university college of food, agricultural, 70
and environmental sciences;71

       (f) The Ohio young farmers association.72

       (2) All original appointments to the board shall be made not 73
later than ninety days after the effective date of this section, 74
and all vacancies shall be filled in the same manner as the 75
original appointment. Members of the board shall serve without 76
compensation but shall be reimbursed for the actual expenses they 77
incur in performing their duties. The director of agriculture or 78
the director's designee shall serve as chairperson. The board 79
shall adopt rules governing their meetings and proceedings.80

       (C) There is hereby established the Ohio agriculture license 81
plate scholarship program to benefit students who attend an 82
institution of higher learning located in this state and are 83
enrolled in a program that is related to agriculture. The board 84
shall adopt rules governing all aspects of the program, 85
including any additional eligibility requirements, the 86
application process, scholarship amounts, and any requirements a 87
student must meet in order to retain a scholarship.88

       All decisions of the board relating to the scholarship 89
program, including the decision to award, renew, not renew, or 90
revoke a scholarship, are final.91

       Sec. 4501.21.  (A) There is hereby created in the state 92
treasury the license plate contribution fund. The fund shall 93
consist of all contributions paid by motor vehicle registrants and 94
collected by the registrar of motor vehicles pursuant to sections 95
4503.491, 4503.493, 4503.50, 4503.501, 4503.502, 4503.51, 96
4503.522, 4503.545, 4503.55, 4503.551, 4503.552, 4503.553,97
4503.561, 4503.562, 4503.591, 4503.67, 4503.68, 4503.69, 4503.71, 98
4503.711, 4503.72, 4503.73, 4503.74, 4503.75, and 4503.85 of the 99
Revised Code.100

       (B) The registrar shall pay the contributions the registrar 101
collects in the fund as follows:102

       (1) The registrar shall pay the contributions received 103
pursuant to section 4503.491 of the Revised Code to the breast 104
cancer fund of Ohio, which shall use that money only to pay for 105
programs that provide assistance and education to Ohio breast 106
cancer patients and that improve access for such patients to 107
quality health care and clinical trials and shall not use any of 108
the money for abortion information, counseling, services, or other 109
abortion-related activities.110

       (2) The registrar shall pay the contributions received 111
pursuant to section 4503.493 of the Revised Code to the autism 112
society of Ohio, which shall use the contributions for programs 113
and autism awareness efforts throughout the state.114

       (3) The registrar shall pay the contributions the registrar 115
receives pursuant to section 4503.50 of the Revised Code to the 116
future farmers of America foundation, which shall deposit the 117
contributions into its general account to be used for educational 118
and scholarship purposes of the future farmers of America 119
foundation.120

       (4) The registrar shall pay the contributions the registrar 121
receives pursuant to section 4503.501 of the Revised Code to the 122
4-H youth development program of the Ohio state university 123
extension program, which shall use those contributions to pay the 124
expenses it incurs in conducting its educational activities.125

       (5) The registrar shall pay the contributions received 126
pursuant to section 4503.502 of the Revised Code to the Ohio 127
cattlemen's foundation, which shall use those contributions for 128
scholarships and other educational activities.129

       (6) The registrar shall pay each contribution the registrar 130
receives pursuant to section 4503.51 of the Revised Code to the 131
university or college whose name or marking or design appears on 132
collegiate license plates that are issued to a person under that 133
section. A university or college that receives contributions from 134
the fund shall deposit the contributions into its general 135
scholarship fund.136

       (7) The registrar shall pay the contributions the registrar 137
receives pursuant to section 4503.522 of the Revised Code to the 138
"friends of Perry's victory and international peace memorial, 139
incorporated," a nonprofit corporation organized under the laws of 140
this state, to assist that organization in paying the expenses it 141
incurs in sponsoring or holding charitable, educational, and 142
cultural events at the monument.143

       (8) The registrar shall pay the contributions the registrar 144
receives pursuant to section 4503.55 of the Revised Code to the 145
pro football hall of fame, which shall deposit the contributions 146
into a special bank account that it establishes and which shall be 147
separate and distinct from any other account the pro football hall 148
of fame maintains, to be used exclusively for the purpose of 149
promoting the pro football hall of fame as a travel destination.150

       (9) The registrar shall pay the contributions that are paid 151
to the registrar pursuant to section 4503.545 of the Revised Code 152
to the national rifle association foundation, which shall use the 153
money to pay the costs of the educational activities and programs 154
the foundation holds or sponsors in this state.155

       (10) In accordance with section 955.202 of the Revised Code, 156
the registrar shall pay to the pets program funding board created 157
by that section the contributions the registrar receives pursuant 158
to section 4503.551 of the Revised Code and any other money from 159
any other source, including donations, gifts, and grants, that is 160
designated by the source to be paid to the pets program funding 161
board. The board shall use the moneys it receives under this 162
section only to support programs for the sterilization of dogs and 163
cats and for educational programs concerning the proper veterinary 164
care of those animals.165

       (11) The registrar shall pay the contributions the registrar 166
receives pursuant to section 4503.552 of the Revised Code to the 167
rock and roll hall of fame and museum, incorporated.168

       (12) The registrar shall pay the contributions the registrar 169
receives pursuant to section 4503.553 of the Revised Code to the 170
Ohio coalition for animals, incorporated, a nonprofit corporation. 171
Except as provided in division (B)(12) of this section, the 172
coalition shall distribute the money to its members, and the 173
members shall use the money only to pay for educational, 174
charitable, and other programs of each coalition member that 175
provide care for unwanted, abused, and neglected horses. The Ohio 176
coalition for animals may use a portion of the money to pay for 177
reasonable marketing costs incurred in the design and promotion 178
of the license plate and for administrative costs incurred in the 179
disbursement and management of funds received under this section.180

       (13) The registrar shall pay the contributions the registrar 181
receives pursuant to section 4503.561 of the Revised Code to the 182
state of Ohio chapter of ducks unlimited, inc., which shall 183
deposit the contributions into a special bank account that it 184
establishes. The special bank account shall be separate and 185
distinct from any other account the state of Ohio chapter of ducks 186
unlimited, inc., maintains and shall be used exclusively for the 187
purpose of protecting, enhancing, restoring, and managing wetlands 188
and conserving wildlife habitat. The state of Ohio chapter of 189
ducks unlimited, inc., annually shall notify the registrar in 190
writing of the name, address, and account to which such payments 191
are to be made under division (B)(12) of this section.192

       (13)(14) The registrar shall pay the contributions the 193
registrar receives pursuant to section 4503.562 of the Revised 194
Code to the Mahoning river consortium, which shall use the money 195
to pay the expenses it incurs in restoring and maintaining the 196
Mahoning river watershed.197

       (14)(15)(a) The registrar shall pay to a sports commission 198
created pursuant to section 4503.591 of the Revised Code each 199
contribution the registrar receives under that section that an 200
applicant pays to obtain license plates that bear the logo of a 201
professional sports team located in the county of that sports 202
commission and that is participating in the license plate program 203
pursuant to division (E) of that section, irrespective of the 204
county of residence of an applicant.205

       (b) The registrar shall pay to a community charity each 206
contribution the registrar receives under section 4503.591 of the 207
Revised Code that an applicant pays to obtain license plates that 208
bear the logo of a professional sports team that is participating 209
in the license plate program pursuant to division (G) of that 210
section.211

       (15)(16) The registrar shall pay the contributions the 212
registrar receives pursuant to section 4503.67 of the Revised Code 213
to the Dan Beard council of the boy scouts of America. The council 214
shall distribute all contributions in an equitable manner 215
throughout the state to regional councils of the boy scouts.216

       (16)(17) The registrar shall pay the contributions the 217
registrar receives pursuant to section 4503.68 of the Revised Code 218
to the great river council of the girl scouts of the United States 219
of America. The council shall distribute all contributions in an 220
equitable manner throughout the state to regional councils of the 221
girl scouts.222

       (17)(18) The registrar shall pay the contributions the 223
registrar receives pursuant to section 4503.69 of the Revised Code 224
to the Dan Beard council of the boy scouts of America. The council 225
shall distribute all contributions in an equitable manner 226
throughout the state to regional councils of the boy scouts.227

       (18)(19) The registrar shall pay the contributions the 228
registrar receives pursuant to section 4503.71 of the Revised Code 229
to the fraternal order of police of Ohio, incorporated, which 230
shall deposit the fees into its general account to be used for 231
purposes of the fraternal order of police of Ohio, incorporated.232

       (19)(20) The registrar shall pay the contributions the 233
registrar receives pursuant to section 4503.711 of the Revised 234
Code to the fraternal order of police of Ohio, incorporated, which 235
shall deposit the contributions into an account that it creates to 236
be used for the purpose of advancing and protecting the law 237
enforcement profession, promoting improved law enforcement 238
methods, and teaching respect for law and order.239

       (20)(21) The registrar shall pay the contributions the 240
registrar receives pursuant to section 4503.72 of the Revised Code 241
to the organization known on March 31, 2003, as the Ohio CASA/GAL 242
association, a private, nonprofit corporation organized under 243
Chapter 1702. of the Revised Code. The Ohio CASA/GAL association 244
shall use these contributions to pay the expenses it incurs in 245
administering a program to secure the proper representation in the 246
courts of this state of abused, neglected, and dependent children, 247
and for the training and supervision of persons participating in 248
that program.249

       (21)(22) The registrar shall pay the contributions the 250
registrar receives pursuant to section 4503.73 of the Revised Code 251
to Wright B. Flyer, incorporated, which shall deposit the 252
contributions into its general account to be used for purposes of 253
Wright B. Flyer, incorporated.254

       (22)(23) The registrar shall pay the contributions the 255
registrar receives pursuant to section 4503.74 of the Revised Code 256
to the Columbus zoological park association, which shall disburse 257
the moneys to Ohio's major metropolitan zoos, as defined in 258
section 4503.74 of the Revised Code, in accordance with a written 259
agreement entered into by the major metropolitan zoos.260

       (23)(24) The registrar shall pay the contributions the 261
registrar receives pursuant to section 4503.75 of the Revised Code 262
to the rotary foundation, located on March 31, 2003, in Evanston, 263
Illinois, to be placed in a fund known as the permanent fund and 264
used to endow educational and humanitarian programs of the rotary 265
foundation.266

       (24)(25) The registrar shall pay the contributions the 267
registrar receives pursuant to section 4503.85 of the Revised Code 268
to the Ohio sea grant college program to be used for Lake Erie 269
area research projects.270

       (C) All investment earnings of the license plate contribution 271
fund shall be credited to the fund. Not later than the first day 272
of May of every year, the registrar shall distribute to each 273
entity described in divisionsdivision (B)(1) to (24) of this 274
section the investment income the fund earned the previous 275
calendar year. The amount of such a distribution paid to an entity 276
shall be proportionate to the amount of money the entity received 277
from the fund during the previous calendar year.278

       Sec. 4503.503. (A) The owner or lessee of any passenger car, 279
noncommercial motor vehicle, recreational vehicle, or other 280
vehicle of a class approved by the registrar of motor vehicles may 281
apply to the registrar for the registration of the vehicle and 282
issuance of "Ohio agriculture" license plates. The application for 283
"Ohio agriculture" license plates may be combined with a request 284
for a special reserved license plate under section 4503.40 or 285
4503.42 of the Revised Code. Upon receipt of the completed 286
application and compliance with division (B) of this section, the 287
registrar shall issue to the applicant the appropriate vehicle 288
registration and a set of "Ohio agriculture" license plates with a 289
validation sticker or a validation sticker alone when required by 290
section 4503.191 of the Revised Code.291

       In addition to the letters and numbers ordinarily inscribed 292
thereon, "Ohio agriculture" license plates shall be inscribed with 293
words and markings selected and designed by the Ohio farm bureau 294
federation, in consultation with representatives of agricultural 295
commodity organizations of this state. The registrar shall approve 296
the final design. "Ohio agriculture" license plates shall bear 297
county identification stickers that identify the county of 298
registration by name or number.299

       (B) "Ohio agriculture" license plates and validation stickers 300
shall be issued upon payment of the regular license tax as 301
prescribed under section 4503.04 of the Revised Code, any 302
applicable motor vehicle tax levied under Chapter 4504. of the 303
Revised Code, any applicable fee prescribed by section 4503.40 or 304
4503.42 of the Revised Code, a bureau of motor vehicles 305
administrative fee of ten dollars, the contribution specified 306
under division (C) of this section, and compliance with all other 307
applicable laws relating to the registration of motor vehicles.308

       (C) For each application for registration and registration 309
renewal received under this section, the registrar shall collect a 310
contribution of twenty dollars. The registrar shall transmit this 311
contribution to the treasurer of state for deposit in the Ohio 312
agriculture license plate scholarship fund created in section 313
901.90 of the Revised Code.314

       (D) The registrar shall deposit the bureau administrative fee 315
of ten dollars specified in division (B) of this section, the 316
purpose of which is to compensate the bureau for the additional 317
services required in the issuing of the applicant's "Ohio 318
agriculture" license plates, into the state bureau of motor 319
vehicles fund created in section 4501.25 of the Revised Code.320

       Sec. 4503.504.  (A) The owner or lessee of any passenger 321
car, noncommercial motor vehicle, recreational vehicle, or other 322
vehicle of a class approved by the registrar of motor vehicles may 323
apply to the registrar for the registration of the vehicle and 324
issuance of "Ohio sustainable agriculture" license plates. The 325
application for "Ohio sustainable agriculture" license plates may 326
be combined with a request for a special reserved license plate 327
under section 4503.40 or 4503.42 of the Revised Code. Upon receipt 328
of the completed application and compliance with division (B) of 329
this section, the registrar shall issue to the applicant the 330
appropriate vehicle registration and a set of "Ohio sustainable 331
agriculture" license plates with a validation sticker or a 332
validation sticker alone when required by section 4503.191 of the 333
Revised Code.334

       In addition to the letters and numbers ordinarily inscribed 335
thereon, "Ohio sustainable agriculture" license plates shall be 336
inscribed with words and markings selected and designed by the 337
department of agriculture. The registrar shall approve the final 338
design. "Ohio sustainable agriculture" license plates shall bear 339
county identification stickers that identify the county of 340
registration by name or number.341

       (B) "Ohio sustainable agriculture" license plates and 342
validation stickers shall be issued upon payment of the regular 343
license tax as prescribed under section 4503.04 of the Revised 344
Code, any applicable motor vehicle tax levied under Chapter 4504. 345
of the Revised Code, any applicable fee prescribed by section 346
4503.40 or 4503.42 of the Revised Code, a bureau of motor vehicles 347
administrative fee of ten dollars, the contribution specified 348
under division (C) of this section, and compliance with all other 349
applicable laws relating to the registration of motor vehicles.350

       (C) For each application for registration and registration 351
renewal received under this section, the registrar shall collect a 352
contribution of twenty dollars. The registrar shall transmit this 353
contribution to the treasurer of state for deposit in the agro 354
Ohio fund created in section 901.04 of the Revised Code.355

       (D) The registrar shall deposit the bureau administrative fee 356
of ten dollars specified in division (B) of this section, the 357
purpose of which is to compensate the bureau for the additional 358
services required in the issuing of the applicant's "Ohio 359
sustainable agriculture" license plates, into the state bureau of 360
motor vehicles fund created in section 4501.25 of the Revised 361
Code.362

       Sec. 4503.553. (A) The owner or lessee of any passenger car, 363
noncommercial motor vehicle, recreational vehicle, or other 364
vehicle of a class approved by the registrar of motor vehicles may 365
apply to the registrar for the registration of the vehicle and 366
issuance of Ohio's horse license plates. An application made under 367
this section may be combined with a request for a special reserved 368
license plate under section 4503.40 or 4503.42 of the Revised 369
Code. Upon receipt of the completed application and compliance by 370
the applicant with divisions (B) and (C) of this section, the 371
registrar shall issue to the applicant the appropriate vehicle 372
registration and a set of Ohio's horse license plates and a 373
validation sticker, or a validation sticker alone when required by 374
section 4503.191 of the Revised Code.375

       In addition to the letters and numbers ordinarily inscribed 376
on the license plates, Ohio's horse license plates shall be 377
inscribed with identifying words or markings that are designed by 378
the Ohio coalition for animals, incorporated and approved by the 379
registrar. Ohio's horse license plates shall display county 380
identification stickers that identify the county of registration 381
by name or number.382

       (B) The Ohio's horse license plates and a validation sticker, 383
or validation sticker alone, shall be issued upon receipt of a 384
contribution as provided in division (C)(1) of this section and 385
upon payment of the regular license tax as prescribed under 386
section 4503.04 of the Revised Code, any applicable motor vehicle 387
license tax levied under Chapter 4504. of the Revised Code, any 388
applicable additional fee prescribed by section 4503.40 or 4503.42 389
of the Revised Code, a fee of ten dollars for the purpose of 390
compensating the bureau of motor vehicles for additional services 391
required in the issuing of Ohio's horse license plates, and 392
compliance with all other applicable laws relating to the 393
registration of motor vehicles.394

       (C)(1) For each application for registration and registration 395
renewal notice the registrar receives under this section, the 396
registrar shall collect a contribution in an amount not to exceed 397
forty dollars, as determined by the Ohio coalition for animals, 398
incorporated. The registrar shall deposit this contribution into 399
the state treasury to the credit of the license plate contribution 400
fund created in section 4501.21 of the Revised Code.401

       (2) The registrar shall deposit the additional fee of ten 402
dollars paid to compensate the bureau for the additional services 403
required in the issuing of Ohio's horse license plates into the 404
state treasury to the credit of the state bureau of motor vehicles 405
fund created by section 4501.25 of the Revised Code.406

       Sec. 4503.77.  (A) As used in this section, "nonstandard:407

       (1) "Nonstandard license plate" means all of the following:408

       (1)(a) A license plate issued under sections 4503.52, 409
4503.55, 4503.56, 4503.57, 4503.70, 4503.71, 4503.72, and 4503.75 410
of the Revised Code;411

       (2)(b) A license plate issued under a program that is 412
reestablished under division (D) of this section and that meets 413
the requirements contained in division (B) of section 4503.78 of 414
the Revised Code;415

       (3)(c) Except as may otherwise be specifically provided by 416
law, any license plate created after the effective date of this 417
sectionAugust 21, 1997.418

       (2) For purposes of license plates issued under sections 419
4503.503 and 4503.504 of the Revised Code, "sponsor" includes the 420
Ohio agriculture license plate scholarship fund board created in 421
section 901.90 of the Revised Code and the director of 422
agriculture.423

       (B)(1) If, during any calendar year commencing with 1998, the424
total number of motor vehicle registrations involving a particular 425
type of nonstandard license plate is less than one thousandfive 426
hundred, including both new registrations and registration 427
renewals, the registrar of motor vehicles, on or after the first 428
day of January, but not later than the fifteenth day of January 429
of the following year, shall send a written notice to the sponsor 430
of that type of nonstandard license plate, if a sponsor exists, 431
informing the sponsor of this fact. The registrar also shall432
inform the sponsor that if, during the calendar year in which the 433
written notice is sent, the total number of motor vehicle 434
registrations involving the sponsor's nonstandard license plate 435
again is less than one thousandfive hundred, the program 436
involving that type of nonstandard license plate will be 437
terminated on the thirty-first day of December of the calendar 438
year in which the written notice is sent and, except as provided 439
in division (C) of this section, no motor vehicle registration 440
application involving either the actual issuance of that type of441
nonstandard license plate or the registration renewal of a motor 442
vehicle displaying that type of nonstandard license plate will be 443
accepted by the registrar or a deputy registrar beginning the444
first day of January of the next calendar year. The registrar also 445
shall inform the sponsor that if the program involving the446
sponsor's nonstandard license plate is terminated under this 447
section, it may be reestablished pursuant to division (D) of this 448
section.449

       (2) If, during any calendar year commencing with 1998, the 450
total number of motor vehicle registrations involving a particular 451
type of nonstandard license plate is less than one thousandfive 452
hundred, including both new registrations and registration 453
renewals, and no sponsor exists for that license plate, the454
registrar shall issue a public notice on or after the first day 455
of January, but not later than the fifteenth day of January of 456
the following year, stating that fact. The notice also shall 457
inform the public that if, during the calendar year in which the 458
registrar issues the public notice, the total number of motor 459
vehicle registrations for that type of nonstandard license plate,460
including both new registrations and registration renewals, again 461
is less than one thousandfive hundred, the program involving 462
that type of nonstandard license plate will be terminated on the 463
thirty-first day of December of the calendar year in which the 464
registrar issues the public notice and, except as provided in465
division (C) of this section, no motor vehicle registration 466
application involving either the actual issuance of that type of 467
nonstandard license plate or the registration renewal of a motor 468
vehicle displaying that type of nonstandard license plate will be 469
accepted by the registrar or a deputy registrar beginning on the 470
first day of January of the next calendar year.471

       (C) If the program involving a type of nonstandard license 472
plate is terminated under division (B) of this section, the 473
registration of any motor vehicle displaying that type of 474
nonstandard license plate at the time of termination may be 475
renewed so long as the nonstandard license plates remain476
serviceable. If the nonstandard license plates of such a motor 477
vehicle become unfit for service, the owner of the motor vehicle 478
may apply for the issuance of nonstandard license plates of that 479
same type, but the registrar or deputy registrar shall issue such 480
nonstandard license plates only if at the time of application the 481
stock of the bureau contains license plates of that type of482
nonstandard license plate. If, at the time of such application, 483
the stock of the bureau does not contain license plates of that 484
type of nonstandard license plate, the registrar or deputy 485
registrar shall inform the owner of that fact, and the application 486
shall be refused.487

       If the program involving a type of nonstandard license plate 488
is terminated under division (B) of this section and the 489
registration of motor vehicles displaying such license plates 490
continues as permitted by this division, the registrar, for as 491
long as such registrations continue to be issued, shall continue 492
to collect and distribute any contribution that was required to be 493
collected and distributed prior to the termination of that 494
program.495

       (D) If the program involving a nonstandard license plate is 496
terminated under division (B)(1) of this section, the sponsor of 497
that license plate may apply to the registrar for the 498
reestablishment of the program. If the program involving that 499
nonstandard license plate is reestablished, the reestablishment is 500
subject to division (B) of section 4503.78 of the Revised Code.501

       Sec. 4503.78.  (A) Except as may otherwise be specifically502
provided by law, after the effective date of this section, the 503
registrar of motor vehicles shall not be required to implement any 504
legislation that creates a license plate and provides for its 505
issuance until the registrar receives written statements from not 506
less than one thousandfive hundred persons, indicating that they 507
intend to apply for and obtain such license plates for their 508
motor vehicles. The registrar may require such statements to be 509
made on a form the registrar provides.510

       (B) If a program involving a nonstandard license plate is 511
terminated under division (B)(1) of section 4503.77 of the 512
Revised Code, the sponsor of that license plate may apply to the 513
registrar for the reestablishment of that program, as permitted by 514
division (D) of that section. The registrar shall not reestablish 515
the program involving that nonstandard license plate until the516
registrar receives written statements from not less than one 517
thousandfive hundred persons, indicating that they intend to 518
apply for and obtain such license plates for their motor 519
vehicles. The registrar may require such statements to be made on 520
a form approved by the registrar.521

       In determining whether one thousandfive hundred persons have 522
so indicated their intentions, the registrar shall include in the 523
total the number of motor vehicles that continue to display the 524
nonstandard license plate of the terminated program, as permitted 525
by division (C) of section 4503.77 of the Revised Code.526

       Section 2. That existing sections 901.04, 4501.21, 4503.77, 527
and 4503.78 of the Revised Code are hereby repealed.528

       Section 3.  Section 4501.21 of the Revised Code is presented 529
in this act as a composite of the section as amended by both Am. 530
Sub. H.B. 68 and Sub. H.B. 298 of the 126th General Assembly. The 531
General Assembly, applying the principle stated in division (B) of 532
section 1.52 of the Revised Code that amendments are to be 533
harmonized if reasonably capable of simultaneous operation, finds 534
that the composite is the resulting version of the section in 535
effect prior to the effective date of the section as presented in 536
this act.537
