A BILL
To amend section 4501.21 and to enact section 4503.86 1
of the Revised Code to create "Ohio Barber" 2
license plates.3


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 4501.21 be amended and section 4
4503.86 of the Revised Code be enacted to read as follows:5

       Sec. 4501.21.  (A) There is hereby created in the state 6
treasury the license plate contribution fund. The fund shall 7
consist of all contributions paid by motor vehicle registrants and 8
collected by the registrar of motor vehicles pursuant to sections 9
4503.491, 4503.493, 4503.50, 4503.501, 4503.502, 4503.51, 10
4503.522, 4503.545, 4503.55, 4503.551, 4503.552, 4503.561, 11
4503.562, 4503.591, 4503.67, 4503.68, 4503.69, 4503.71, 4503.711, 12
4503.72, 4503.73, 4503.74, 4503.75, and 4503.85, and 4503.86 of 13
the Revised Code.14

       (B) The registrar shall pay the contributions the registrar 15
collects in the fund as follows:16

       (1) The registrar shall pay the contributions received 17
pursuant to section 4503.491 of the Revised Code to the breast 18
cancer fund of Ohio, which shall use that money only to pay for 19
programs that provide assistance and education to Ohio breast 20
cancer patients and that improve access for such patients to 21
quality health care and clinical trials and shall not use any of 22
the money for abortion information, counseling, services, or other 23
abortion-related activities.24

       (2) The registrar shall pay the contributions received 25
pursuant to section 4503.493 of the Revised Code to the autism 26
society of Ohio, which shall use the contributions for programs 27
and autism awareness efforts throughout the state.28

       (3) The registrar shall pay the contributions the registrar 29
receives pursuant to section 4503.50 of the Revised Code to the 30
future farmers of America foundation, which shall deposit the 31
contributions into its general account to be used for educational 32
and scholarship purposes of the future farmers of America 33
foundation.34

       (4) The registrar shall pay the contributions the registrar 35
receives pursuant to section 4503.501 of the Revised Code to the 36
4-H youth development program of the Ohio state university 37
extension program, which shall use those contributions to pay the 38
expenses it incurs in conducting its educational activities.39

       (5) The registrar shall pay the contributions received 40
pursuant to section 4503.502 of the Revised Code to the Ohio 41
cattlemen's foundation, which shall use those contributions for 42
scholarships and other educational activities.43

       (6) The registrar shall pay each contribution the registrar 44
receives pursuant to section 4503.51 of the Revised Code to the 45
university or college whose name or marking or design appears on 46
collegiate license plates that are issued to a person under that 47
section. A university or college that receives contributions from 48
the fund shall deposit the contributions into its general 49
scholarship fund.50

       (7) The registrar shall pay the contributions the registrar 51
receives pursuant to section 4503.522 of the Revised Code to the 52
"friends of Perry's victory and international peace memorial, 53
incorporated," a nonprofit corporation organized under the laws of 54
this state, to assist that organization in paying the expenses it 55
incurs in sponsoring or holding charitable, educational, and 56
cultural events at the monument.57

       (8) The registrar shall pay the contributions the registrar 58
receives pursuant to section 4503.55 of the Revised Code to the 59
pro football hall of fame, which shall deposit the contributions 60
into a special bank account that it establishes and which shall be 61
separate and distinct from any other account the pro football hall 62
of fame maintains, to be used exclusively for the purpose of 63
promoting the pro football hall of fame as a travel destination.64

       (9) The registrar shall pay the contributions that are paid 65
to the registrar pursuant to section 4503.545 of the Revised Code 66
to the national rifle association foundation, which shall use the 67
money to pay the costs of the educational activities and programs 68
the foundation holds or sponsors in this state.69

       (10) In accordance with section 955.202 of the Revised Code, 70
the registrar shall pay to the pets program funding board created 71
by that section the contributions the registrar receives pursuant 72
to section 4503.551 of the Revised Code and any other money from 73
any other source, including donations, gifts, and grants, that is 74
designated by the source to be paid to the pets program funding 75
board. The board shall use the moneys it receives under this 76
section only to support programs for the sterilization of dogs and 77
cats and for educational programs concerning the proper veterinary 78
care of those animals.79

       (11) The registrar shall pay the contributions the registrar 80
receives pursuant to section 4503.552 of the Revised Code to the 81
rock and roll hall of fame and museum, incorporated.82

       (12) The registrar shall pay the contributions the registrar 83
receives pursuant to section 4503.561 of the Revised Code to the 84
state of Ohio chapter of ducks unlimited, inc., which shall 85
deposit the contributions into a special bank account that it 86
establishes. The special bank account shall be separate and 87
distinct from any other account the state of Ohio chapter of ducks 88
unlimited, inc., maintains and shall be used exclusively for the 89
purpose of protecting, enhancing, restoring, and managing wetlands 90
and conserving wildlife habitat. The state of Ohio chapter of 91
ducks unlimited, inc., annually shall notify the registrar in 92
writing of the name, address, and account to which payments are to 93
be made under division (B)(12) of this section.94

       (13) The registrar shall pay the contributions the registrar 95
receives pursuant to section 4503.562 of the Revised Code to the 96
Mahoning river consortium, which shall use the money to pay the 97
expenses it incurs in restoring and maintaining the Mahoning river 98
watershed.99

       (14)(a) The registrar shall pay to a sports commission 100
created pursuant to section 4503.591 of the Revised Code each 101
contribution the registrar receives under that section that an 102
applicant pays to obtain license plates that bear the logo of a 103
professional sports team located in the county of that sports 104
commission and that is participating in the license plate program 105
pursuant to division (E) of that section, irrespective of the 106
county of residence of an applicant.107

       (b) The registrar shall pay to a community charity each 108
contribution the registrar receives under section 4503.591 of the 109
Revised Code that an applicant pays to obtain license plates that 110
bear the logo of a professional sports team that is participating 111
in the license plate program pursuant to division (G) of that 112
section.113

       (15) The registrar shall pay the contributions the registrar 114
receives pursuant to section 4503.67 of the Revised Code to the 115
Dan Beard council of the boy scouts of America. The council shall 116
distribute all contributions in an equitable manner throughout the 117
state to regional councils of the boy scouts.118

       (16) The registrar shall pay the contributions the registrar 119
receives pursuant to section 4503.68 of the Revised Code to the 120
great river council of the girl scouts of the United States of 121
America. The council shall distribute all contributions in an 122
equitable manner throughout the state to regional councils of the 123
girl scouts.124

       (17) The registrar shall pay the contributions the registrar 125
receives pursuant to section 4503.69 of the Revised Code to the 126
Dan Beard council of the boy scouts of America. The council shall 127
distribute all contributions in an equitable manner throughout the 128
state to regional councils of the boy scouts.129

       (18) The registrar shall pay the contributions the registrar 130
receives pursuant to section 4503.71 of the Revised Code to the 131
fraternal order of police of Ohio, incorporated, which shall 132
deposit the fees into its general account to be used for purposes 133
of the fraternal order of police of Ohio, incorporated.134

       (19) The registrar shall pay the contributions the registrar 135
receives pursuant to section 4503.711 of the Revised Code to the 136
fraternal order of police of Ohio, incorporated, which shall 137
deposit the contributions into an account that it creates to be 138
used for the purpose of advancing and protecting the law 139
enforcement profession, promoting improved law enforcement 140
methods, and teaching respect for law and order.141

       (20) The registrar shall pay the contributions the registrar 142
receives pursuant to section 4503.72 of the Revised Code to the 143
organization known on March 31, 2003, as the Ohio CASA/GAL 144
association, a private, nonprofit corporation organized under 145
Chapter 1702. of the Revised Code. The Ohio CASA/GAL association 146
shall use these contributions to pay the expenses it incurs in 147
administering a program to secure the proper representation in the 148
courts of this state of abused, neglected, and dependent children, 149
and for the training and supervision of persons participating in 150
that program.151

       (21) The registrar shall pay the contributions the registrar 152
receives pursuant to section 4503.73 of the Revised Code to Wright 153
B. Flyer, incorporated, which shall deposit the contributions into 154
its general account to be used for purposes of Wright B. Flyer, 155
incorporated.156

       (22) The registrar shall pay the contributions the registrar 157
receives pursuant to section 4503.74 of the Revised Code to the 158
Columbus zoological park association, which shall disburse the 159
moneys to Ohio's major metropolitan zoos, as defined in section 160
4503.74 of the Revised Code, in accordance with a written 161
agreement entered into by the major metropolitan zoos.162

       (23) The registrar shall pay the contributions the registrar 163
receives pursuant to section 4503.75 of the Revised Code to the 164
rotary foundation, located on March 31, 2003, in Evanston, 165
Illinois, to be placed in a fund known as the permanent fund and 166
used to endow educational and humanitarian programs of the rotary 167
foundation.168

        (24) The registrar shall pay the contributions the registrar 169
receives pursuant to section 4503.85 of the Revised Code to the 170
Ohio sea grant college program to be used for Lake Erie area 171
research projects.172

       (25) The registrar shall pay the contributions the registrar 173
receives pursuant to section 4503.86 of the Revised Code to the 174
Ohio barber association. The association shall use ten dollars of 175
each contribution to pay for scholarships the association awards 176
to deserving students to enable the students to attend a barber 177
college located in this state. The association shall use the 178
remaining five dollars of each contribution to pay any expenses 179
the association incurs in connection with the Ohio barber museum 180
located in Canal Winchester in Franklin county.181

       (C) All investment earnings of the license plate contribution 182
fund shall be credited to the fund. Not later than the first day 183
of May of every year, the registrar shall distribute to each 184
entity described in divisions (B)(1) to (24)(25) of this section 185
the investment income the fund earned the previous calendar year. 186
The amount of such a distribution paid to an entity shall be 187
proportionate to the amount of money the entity received from the 188
fund during the previous calendar year.189

       Sec. 4503.86. (A) The owner or lessee of any passenger car, 190
noncommercial motor vehicle, recreational vehicle, motorcycle, or 191
other vehicle of a class approved by the registrar of motor 192
vehicles may apply to the registrar for the registration of the 193
vehicle and issuance of "Ohio barber" license plates. The 194
application may be combined with a request for a special reserved 195
license plate under section 4503.40 or 4503.42 of the Revised 196
Code. Upon receipt of the completed application and compliance by 197
the applicant with divisions (B) and (C) of this section, the 198
registrar shall issue to the applicant the appropriate vehicle 199
registration and a set of Ohio barber license plates and a 200
validation sticker, or a validation sticker alone when required by 201
section 4503.191 of the Revised Code.202

       In addition to the letters and numbers ordinarily inscribed 203
on the license plates, Ohio barber license plates shall bear the 204
words "Ohio barber" and a logo designed by the Ohio barber 205
association and approved by the registrar. Ohio barber license 206
plates shall display county identification stickers that identify 207
the county of registration by name or number.208

       (B) Ohio barber license plates and a validation sticker, or 209
validation sticker alone, shall be issued upon receipt of an 210
application for registration of a motor vehicle under this 211
section; payment of the regular license tax as prescribed under 212
section 4503.04 of the Revised Code, any applicable motor vehicle 213
license tax levied under Chapter 4504. of the Revised Code, any 214
applicable additional fee prescribed by section 4503.40 or 4503.42 215
of the Revised Code, an additional fee of ten dollars, and a 216
contribution as provided in division (C) of this section; and 217
compliance with all other applicable laws relating to the 218
registration of motor vehicles.219

       (C) The registrar shall collect a contribution of fifteen 220
dollars for each application for registration and registration 221
renewal notice the registrar receives under this section. The 222
registrar shall transmit this contribution to the treasurer of 223
state for deposit into the state treasury to the credit of the 224
license plate contribution fund created by section 4501.21 of the 225
Revised Code.226

       The registrar shall transmit the additional fee of ten 227
dollars, which is to compensate the bureau of motor vehicles for 228
the additional services required in the issuing of Ohio barber 229
license plates, to the treasurer of state for deposit into the 230
state treasury to the credit of the state bureau of motor vehicles 231
fund created by section 4501.25 of the Revised Code.232

       Section 2. That existing section 4501.21 of the Revised Code 233
is hereby repealed.234

       Section 3.  Section 4501.21 of the Revised Code is presented 235
in this act as a composite of the section as amended by both Am. 236
Sub. H.B. 68 and Sub. H.B. 298 of the 126th General Assembly. The 237
General Assembly, applying the principle stated in division (B) 238
of section 1.52 of the Revised Code that amendments are to be 239
harmonized if reasonably capable of simultaneous operation, finds 240
that the composite is the resulting version of the section in 241
effect prior to the effective date of the section as presented in 242
this act.243
