A BILL
To enact section 4511.093 of the Revised Code to 1
require any local authority that enforces any 2
traffic law by means of traffic law 3
photo-monitoring devices to erect signs on every 4
highway that is not a freeway that is part of the 5
state highway system and that enters that local 6
authority, informing inbound traffic that the 7
local authority utilizes traffic law 8
photo-monitoring devices to enforce traffic laws.9


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 4511.093 of the Revised Code be 10
enacted to read as follows:11

       Sec. 4511.093. (A) As used in this section:12

        (1) "Local authority" means a municipal corporation, county, 13
or township.14

        (2) "Traffic law photo-monitoring device" means an electronic 15
system consisting of a photographic, video, or electronic camera 16
and a means of sensing the presence of a motor vehicle that 17
automatically produces photographs, videotape, or digital images 18
of the vehicle or its license plate.19

        (B) No local authority shall use traffic law photo-monitoring 20
devices to enforce any traffic law until after it has erected 21
signs on every highway that is not a freeway that is part of the 22
state highway system and that enters that local authority. The 23
signs shall inform inbound traffic that the local authority 24
utilizes traffic law photo-monitoring devices to enforce traffic 25
laws. The signs shall be erected within the first three hundred 26
feet of the boundary of the local authority or, if the signs 27
cannot be located within the first three hundred feet of the 28
boundary of the local authority, as close to that distance as 29
possible, and the local authority is responsible for all costs 30
associated with the erection, maintenance, and replacement, if 31
necessary, of the signs. All signs erected under this division 32
shall conform in size, color, location, and content to standards 33
contained in the manual adopted by the department of 34
transportation pursuant to section 4511.09 of the Revised Code 35
and shall remain in place for as long as the local authority 36
utilizes traffic law photo-monitoring devices to enforce any 37
traffic law. Any ticket, citation, or summons issued by or on 38
behalf of the local authority for any traffic law violation based 39
upon evidence gathered by a traffic law photo-monitoring device 40
before the signs have been erected is invalid.41

       (C) A local authority that uses traffic law photo-monitoring 42
devices to enforce any traffic law at an intersection where 43
traffic is controlled by traffic control signals that exhibit 44
different colored lights or colored lighted arrows shall conform 45
the timing of the yellow lights and yellow arrows of those traffic 46
control signals to the provisions of the manual adopted by the 47
department of transportation under section 4511.09 of the Revised 48
Code that are applicable to that type of intersection.49

       Section 2. Section 1 of this act takes effect six months 50
after the effective date of this act.51
