A BILL
To amend Sections 263.10, 263.20.90, and 375.10 of 1
Am. Sub. H.B. 119 of the 127th General Assembly, 2
to amend Section 235.10.40 of Am. Sub. H.B. 699 3
of the 126th General Assembly, and to repeal 4
Section 375.20.80 of Am. Sub. H.B. 119 of the 5
127th General Assembly to increase the funds 6
available for the Ohio Research Scholars Program 7
and to permit a nonpublic four-year Ohio 8
university to submit a proposal for the Ohio 9
Research Scholars Program if the proposal is to 10
be implemented in collaboration with a state 11
college or university.12

       Sec. 263.20.90. CLEAN OHIO OPERATING EXPENSES110

       The foregoing appropriation item 195-663, Clean Ohio 111
Operating, shall be used by the Department of Development in 112
administering sections 122.65 to 122.658 of the Revised Code.113

       THIRD FRONTIER OPERATING114

       The foregoing appropriation item 195-686, Third Frontier 115
Operating, shall be used for operating expenses incurred by the 116
Department of Development in administering sections 184.10 to 117
184.20 of the Revised Code.118

       THIRD FRONTIER RESEARCH & DEVELOPMENT PROJECTS AND RESEARCH & 119
DEVELOPMENT TAXABLE BOND PROJECTS120

       The foregoing appropriation items 195-687, Third Frontier 121
Research & Development Projects, and 195-692, Research & 122
Development Taxable Bond Projects, shall be used by the Department 123
of Development to fund selected projects. These projects are 124
designated as costs of research and development projects to which 125
the proceeds of the Third Frontier Research and Development Fund 126
(Fund 011) and the Research & Development Taxable Bond Project 127
Fund (Fund 014) are to be applied.128

       Of the foregoing appropriation items 195-687, Third Frontier 129
Research and Development Projects, and 195-692, Research & 130
Development Taxable Bond Projects, up to $8,600,000 in fiscal year 131
2008, shall be used by the Office of Information Technology, in 132
partnership with the Ohio Supercomputer Center's OSCnet, to 133
acquire the equipment and services necessary to migrate state 134
agencies' network to the existing OSCnet network backbone. This 135
state network shall be known as the NextGen Network.136

        Notwithstanding sections 184.10 to 184.20 of the Revised 137
Code, up to $20,000,000 in fiscal year 2009 from the total of the 138
amounts in appropriation items 195-687, Third Frontier Research & 139
Development Projects, and 195-692, Research & Development Taxable 140
Bond Projects, and up to $12,000,000 in each fiscal year from 141
appropriation item 195-687, Third Frontier Research & Development 142
Projects, shall be used to fund the Ohio Research Scholars 143
Program in the Board of Regents pursuant to sections 3333.60 to 144
3333.70 of the Revised Code.145

       Notwithstanding sections 184.10 to 184.20 of the Revised 146
Code, at the direction of the Director of Budget and Management up 147
to $18,000,000 in each fiscal year from appropriation item 148
195-687, Third Frontier Research & Development Projects, and 149
appropriation item 195-692, Research & Development Taxable Bond 150
Projects, shall be used to fund the Research Incentive Program in 151
the Board of Regents.152

       On or before June 30, 2008, any unencumbered balances of the 153
foregoing appropriation items 195-687, Third Frontier Research & 154
Development Projects, and 195-692, Research & Development Taxable 155
Bond Projects, for fiscal year 2008 are hereby appropriated for 156
the same purposes for fiscal year 2009.157

       AUTHORITY TO ISSUE AND SELL ORIGINAL OBLIGATIONS158

       The Ohio Public Facilities Commission, upon request of the 159
Department of Development, is hereby authorized to issue and sell, 160
in accordance with Section 2p of Article VIII, Ohio Constitution, 161
and particularly sections 151.01 and 151.10 of the Revised Code, 162
original obligations of the State of Ohio in an aggregate amount 163
not to exceed $150,000,000. The authorized obligations shall be 164
issued and sold from time to time and in amounts necessary to 165
ensure sufficient moneys to the credit of the Third Frontier 166
Research & Development Fund (Fund 011) to pay costs of research 167
and development projects.168

       JOB READY SITE OPERATING169

       The foregoing appropriation item 195-688, Job Ready Site 170
Operating, shall be used for operating expenses incurred by the 171
Department of Development in administering sections 122.085 to 172
122.0820 of the Revised Code. Operating expenses include, but are 173
not limited to, certain expenses of the District Public Works 174
Integrating Committees, audit and accountability activities, and 175
costs associated with formal certifications verifying that site 176
infrastructure is in place and is functional.177

       Section 2. That existing Sections 263.10, 263.20.90, and 281
375.10 of Am. Sub. H.B. 119 of the 127th General Assembly are 282
hereby repealed.283

       Section 3. That Section 235.10.40 of Am. Sub. H.B. 699 of the 284
126th General Assembly be amended to read as follows:285

       Sec. 235.10.40. RESEARCH FACILITY ACTION AND INVESTMENT FUNDS286

       TheOf the foregoing appropriation item CAP-032, Research 287
Facility Action and Investment Funds, up to $3,000,000 shall be 288
used to support the Ohio Research Scholars Program. Any money 289
from this earmark used for capital projects under the Ohio 290
Research Scholars Program shall not be subject to rule 3333-1-21 291
of the Administrative Code, but shall be subject to any rule 292
adopted to administer the Ohio Research Scholars Program.293

       The remainder of foregoing appropriation item CAP-032, 294
Research Facility Action and Investment Funds, shall be used for 295
a program of grants to be administered by the Board of Regents to 296
provide timely availability of capital facilities for research 297
programs and research-oriented instructional programs at or 298
involving state-supported and state-assisted institutions of299
higher education.300

       Section 4. That existing Section 235.10.40 of Am. Sub. H.B. 301
699 of the 126th General Assembly is hereby repealed.302

       Section 5. That Section 375.20.80 of Am. Sub. H.B. 119 of the 303
127th General Assembly is hereby repealed.304

       Section 6. Notwithstanding section 3333.67 of the Revised 305
Code, an institution of higher education shall not be required to 306
deposit into an endowment fund the grants awarded under the Ohio 307
Research Scholars Program other than those funded by GRF 308
appropriation item 235-439, Ohio Research Scholars, as originally 309
appropriated in Am. Sub. H.B. 119 of the 127th General Assembly. 310
The grant agreement for an Ohio Research Scholars award shall 311
specify, if applicable, the portion of the award that is required 312
to be deposited in an endowment fund and the portion that is 313
restricted for capital projects.314

       Notwithstanding sections 3333.61 to 3333.70 of the Revised 315
Code, a nonpublic four-year Ohio institution of higher education 316
may submit a proposal for the Ohio Research Scholars Program to 317
recruit scientists to the faculty of the nonpublic institution if 318
the proposal is to be implemented in collaboration with a state 319
university or college, as defined in section 3333.60 of the 320
Revised Code. If the Chancellor of the Board of Regents grants a 321
nonpublic institution an award under the Ohio Research Scholars 322
Program, the nonpublic institution shall comply with all 323
requirements of sections 3333.61 to 3333.70 of the Revised Code 324
and the rules adopted under section 3333.61 of the Revised Code 325
that apply to state universities or colleges awarded grants under 326

       Section 7. The sections of law contained in this act, and the 328
items of which they are composed, are not subject to referendum. 329
Therefore, under Ohio Constitution, Article II, Section 1d and 330
section 1.471 of the Revised Code, the sections and items of law 331
go into immediate effect when this act becomes law.332
