A BILL
To amend section 4501.21 and to enact section 1
4503.496 of the Revised Code to create "Sickle 2
Cell Anemia Awareness" license plates.3


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 4501.21 be amended and section 4
4503.496 of the Revised Code be enacted to read as follows:5

       Sec. 4501.21.  (A) There is hereby created in the state 6
treasury the license plate contribution fund. The fund shall 7
consist of all contributions paid by motor vehicle registrants and 8
collected by the registrar of motor vehicles pursuant to sections 9
4503.491, 4503.493, 4503.496, 4503.50, 4503.501, 4503.502, 10
4503.51, 4503.522, 4503.545, 4503.55, 4503.551, 4503.552, 11
4503.561, 4503.562, 4503.591, 4503.67, 4503.68, 4503.69, 4503.71, 12
4503.711, 4503.72, 4503.73, 4503.74, 4503.75, and 4503.85 of the 13
Revised Code.14

       (B) The registrar shall pay the contributions the registrar 15
collects in the fund as follows:16

       (1) The registrar shall pay the contributions received 17
pursuant to section 4503.491 of the Revised Code to the breast 18
cancer fund of Ohio, which shall use that money only to pay for 19
programs that provide assistance and education to Ohio breast 20
cancer patients and that improve access for such patients to 21
quality health care and clinical trials and shall not use any of 22
the money for abortion information, counseling, services, or other 23
abortion-related activities.24

       (2) The registrar shall pay the contributions received 25
pursuant to section 4503.493 of the Revised Code to the autism 26
society of Ohio, which shall use the contributions for programs 27
and autism awareness efforts throughout the state.28

       (3) The registrar shall pay the contributions the registrar 29
receives pursuant to section 4503.496 of the Revised Code to the 30
Ohio sickle cell and health association, which shall use the 31
contributions to help support educational, clinical, and social 32
support services for adults who have sickle cell disease.33

       (4) The registrar shall pay the contributions the registrar 34
receives pursuant to section 4503.50 of the Revised Code to the 35
future farmers of America foundation, which shall deposit the 36
contributions into its general account to be used for educational 37
and scholarship purposes of the future farmers of America 38
foundation.39

       (4)(5) The registrar shall pay the contributions the 40
registrar receives pursuant to section 4503.501 of the Revised 41
Code to the 4-H youth development program of the Ohio state 42
university extension program, which shall use those contributions 43
to pay the expenses it incurs in conducting its educational 44
activities.45

       (5)(6) The registrar shall pay the contributions received 46
pursuant to section 4503.502 of the Revised Code to the Ohio 47
cattlemen's foundation, which shall use those contributions for 48
scholarships and other educational activities.49

       (6)(7) The registrar shall pay each contribution the 50
registrar receives pursuant to section 4503.51 of the Revised 51
Code to the university or college whose name or marking or design 52
appears on collegiate license plates that are issued to a person 53
under that section. A university or college that receives 54
contributions from the fund shall deposit the contributions into 55
its general scholarship fund.56

       (7)(8) The registrar shall pay the contributions the 57
registrar receives pursuant to section 4503.522 of the Revised 58
Code to the "friends of Perry's victory and international peace 59
memorial, incorporated," a nonprofit corporation organized under 60
the laws of this state, to assist that organization in paying the 61
expenses it incurs in sponsoring or holding charitable, 62
educational, and cultural events at the monument.63

       (8)(9) The registrar shall pay the contributions the 64
registrar receives pursuant to section 4503.55 of the Revised 65
Code to the pro football hall of fame, which shall deposit the 66
contributions into a special bank account that it establishes and 67
which shall be separate and distinct from any other account the 68
pro football hall of fame maintains, to be used exclusively for 69
the purpose of promoting the pro football hall of fame as a 70
travel destination.71

       (9)(10) The registrar shall pay the contributions that are 72
paid to the registrar pursuant to section 4503.545 of the Revised 73
Code to the national rifle association foundation, which shall 74
use the money to pay the costs of the educational activities and 75
programs the foundation holds or sponsors in this state.76

       (10)(11) In accordance with section 955.202 of the Revised 77
Code, the registrar shall pay to the pets program funding board 78
created by that section the contributions the registrar receives 79
pursuant to section 4503.551 of the Revised Code and any other 80
money from any other source, including donations, gifts, and 81
grants, that is designated by the source to be paid to the pets 82
program funding board. The board shall use the moneys it receives 83
under this section only to support programs for the sterilization 84
of dogs and cats and for educational programs concerning the 85
proper veterinary care of those animals.86

       (11)(12) The registrar shall pay the contributions the 87
registrar receives pursuant to section 4503.552 of the Revised 88
Code to the rock and roll hall of fame and museum, incorporated.89

       (12)(13) The registrar shall pay the contributions the 90
registrar receives pursuant to section 4503.561 of the Revised 91
Code to the state of Ohio chapter of ducks unlimited, inc., which 92
shall deposit the contributions into a special bank account that 93
it establishes. The special bank account shall be separate and 94
distinct from any other account the state of Ohio chapter of ducks 95
unlimited, inc., maintains and shall be used exclusively for the 96
purpose of protecting, enhancing, restoring, and managing wetlands 97
and conserving wildlife habitat. The state of Ohio chapter of 98
ducks unlimited, inc., annually shall notify the registrar in 99
writing of the name, address, and account to which payments are to 100
be made under division (B)(12)(13) of this section.101

       (13)(14) The registrar shall pay the contributions the 102
registrar receives pursuant to section 4503.562 of the Revised 103
Code to the Mahoning river consortium, which shall use the money 104
to pay the expenses it incurs in restoring and maintaining the 105
Mahoning river watershed.106

       (14)(15)(a) The registrar shall pay to a sports commission 107
created pursuant to section 4503.591 of the Revised Code each 108
contribution the registrar receives under that section that an 109
applicant pays to obtain license plates that bear the logo of a 110
professional sports team located in the county of that sports 111
commission and that is participating in the license plate program 112
pursuant to division (E) of that section, irrespective of the 113
county of residence of an applicant.114

       (b) The registrar shall pay to a community charity each 115
contribution the registrar receives under section 4503.591 of the 116
Revised Code that an applicant pays to obtain license plates that 117
bear the logo of a professional sports team that is participating 118
in the license plate program pursuant to division (G) of that 119
section.120

       (15)(16) The registrar shall pay the contributions the 121
registrar receives pursuant to section 4503.67 of the Revised 122
Code to the Dan Beard council of the boy scouts of America. The 123
council shall distribute all contributions in an equitable manner 124
throughout the state to regional councils of the boy scouts.125

       (16)(17) The registrar shall pay the contributions the 126
registrar receives pursuant to section 4503.68 of the Revised 127
Code to the great river council of the girl scouts of the United 128
States of America. The council shall distribute all contributions 129
in an equitable manner throughout the state to regional councils 130
of the girl scouts.131

       (17)(18) The registrar shall pay the contributions the 132
registrar receives pursuant to section 4503.69 of the Revised 133
Code to the Dan Beard council of the boy scouts of America. The 134
council shall distribute all contributions in an equitable manner 135
throughout the state to regional councils of the boy scouts.136

       (18)(19) The registrar shall pay the contributions the 137
registrar receives pursuant to section 4503.71 of the Revised 138
Code to the fraternal order of police of Ohio, incorporated, 139
which shall deposit the fees into its general account to be used 140
for purposes of the fraternal order of police of Ohio, 141
incorporated.142

       (19)(20) The registrar shall pay the contributions the 143
registrar receives pursuant to section 4503.711 of the Revised 144
Code to the fraternal order of police of Ohio, incorporated, 145
which shall deposit the contributions into an account that it 146
creates to be used for the purpose of advancing and protecting 147
the law enforcement profession, promoting improved law 148
enforcement methods, and teaching respect for law and order.149

       (20)(21) The registrar shall pay the contributions the 150
registrar receives pursuant to section 4503.72 of the Revised 151
Code to the organization known on March 31, 2003, as the Ohio 152
CASA/GAL association, a private, nonprofit corporation organized 153
under Chapter 1702. of the Revised Code. The Ohio CASA/GAL 154
association shall use these contributions to pay the expenses it 155
incurs in administering a program to secure the proper 156
representation in the courts of this state of abused, neglected, 157
and dependent children, and for the training and supervision of 158
persons participating in that program.159

       (21)(22) The registrar shall pay the contributions the 160
registrar receives pursuant to section 4503.73 of the Revised 161
Code to Wright B. Flyer, incorporated, which shall deposit the 162
contributions into its general account to be used for purposes of 163
Wright B. Flyer, incorporated.164

       (22)(23) The registrar shall pay the contributions the 165
registrar receives pursuant to section 4503.74 of the Revised 166
Code to the Columbus zoological park association, which shall 167
disburse the moneys to Ohio's major metropolitan zoos, as defined 168
in section 4503.74 of the Revised Code, in accordance with a 169
written agreement entered into by the major metropolitan zoos.170

       (23)(24) The registrar shall pay the contributions the 171
registrar receives pursuant to section 4503.75 of the Revised 172
Code to the rotary foundation, located on March 31, 2003, in 173
Evanston, Illinois, to be placed in a fund known as the permanent 174
fund and used to endow educational and humanitarian programs of 175
the rotary foundation.176

       (24)(25) The registrar shall pay the contributions the 177
registrar receives pursuant to section 4503.85 of the Revised 178
Code to the Ohio sea grant college program to be used for Lake 179
Erie area research projects.180

       (C) All investment earnings of the license plate contribution 181
fund shall be credited to the fund. Not later than the first day 182
of May of every year, the registrar shall distribute to each 183
entity described in divisionsdivision (B)(1) to (24) of this 184
section the investment income the fund earned the previous 185
calendar year. The amount of such a distribution paid to an 186
entity shall be proportionate to the amount of money the entity 187
received from the fund during the previous calendar year.188

       Sec. 4503.496.  (A) The owner or lessee of any passenger car, 189
noncommercial motor vehicle, recreational vehicle, motorcycle, or 190
other vehicle of a class approved by the registrar of motor 191
vehicles may apply to the registrar for the registration of the 192
vehicle and issuance of "sickle cell anemia awareness" license 193
plates. The application may be combined with a request for a 194
special reserved license plate under section 4503.40 or 4503.42 of 195
the Revised Code. Upon receipt of the completed application and 196
compliance by the applicant with divisions (B) and (C) of this 197
section, the registrar shall issue to the applicant the 198
appropriate vehicle registration and a set of "sickle cell anemia 199
awareness" license plates and a validation sticker, or a 200
validation sticker alone when required by section 4503.191 of the 201
Revised Code.202

       In addition to the letters and numbers ordinarily inscribed 203
on the license plates, "sickle cell anemia awareness" license 204
plates shall bear words selected by and a logo designed by the 205
Ohio sickle cell and health association. The registrar shall 206
approve the final design. "Sickle cell anemia awareness" license 207
plates shall display county identification stickers that identify 208
the county of registration by name or number.209

       (B) "Sickle cell anemia awareness" license plates and a 210
validation sticker, or validation sticker alone, shall be issued 211
upon receipt of an application for registration of a motor vehicle 212
under this section; payment of the regular license tax as 213
prescribed under section 4503.04 of the Revised Code, any 214
applicable motor vehicle license tax levied under Chapter 4504. of 215
the Revised Code, any applicable additional fee prescribed by 216
section 4503.40 or 4503.42 of the Revised Code, an additional fee 217
of ten dollars, and a contribution as provided in division (C) of 218
this section; and compliance with all other applicable laws 219
relating to the registration of motor vehicles.220

       (C) The registrar shall collect a contribution of ten dollars 221
for each application for registration and registration renewal 222
notice the registrar receives under this section. The registrar 223
shall transmit this contribution to the treasurer of state for 224
deposit into the state treasury to the credit of the license plate 225
contribution fund created by section 4501.21 of the Revised Code.226

       The registrar shall transmit the additional fee of ten 227
dollars, which is to compensate the bureau of motor vehicles for 228
the additional services required in the issuing of "sickle cell 229
anemia awareness" license plates, to the treasurer of state for 230
deposit into the state treasury to the credit of the state bureau 231
of motor vehicles fund created by section 4501.25 of the Revised 232
Code.233

       Section 2.  That existing section 4501.21 of the Revised Code 234
is hereby repealed.235

       Section 3.  Section 4501.21 of the Revised Code is presented 236
in this act as a composite of the section as amended by both Am. 237
Sub. H.B. 68 and Sub. H.B. 298 of the 126th General Assembly. The 238
General Assembly, applying the principle stated in division (B) 239
of section 1.52 of the Revised Code that amendments are to be 240
harmonized if reasonably capable of simultaneous operation, finds 241
that the composite is the resulting version of the section in 242
effect prior to the effective date of the section as presented in 243
this act.244
