A BILL
To authorize the conveyance of state-owned real 1
estate located in Wood County.2


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. (A) The Governor is hereby authorized to execute a 3
deed in the name of the state conveying to the Board of Trustees 4
of Lake Township (purchaser), and the purchaser's successors and 5
assigns or heirs and assigns, all of the state's right, title, and 6
interest in the following described real estate:7

       Situated in the Township of Lake, County of Wood, State of 8
Ohio, and being part of the N1/2 of the W1/2 of the SW1/4 of 9
Section 10, T7N, R12E, a tract of land bounded and described as 10
follows:11

       Commencing at a railroad spike found marking the southwest 12
corner of the SW1/4 of Section 10;13

       thence along the west line of said SW1/4, also being the 14
centerline of Lemoyne Road (R/W Varies), N00°48'00"W, a distance 15
of 1320.38 feet to mag nail set marking the southwest corner of a 16
0.67 acre tract of land as described in Volume 600, Page 874 of 17
the Wood County Deed Records and being Station 13+33.02 in the 18
centerline survey of Lemoyne Road as described in Ohio Department 19
of Transportation Plan W00-280-0.00;20

       thence along the south line of said 0.67 acre tract, 21
N89°31'07"E, a distance of 130.00 feet to an iron pin found on the 22
easterly right-of-way line of said Lemoyne Road and being the 23
PRINCIPAL Point of Beginning of the tract of land herein 24
described, said beginning point also described as being 130.00 25
feet right angle dimension east of Station 13+32.73 in the 26
centerline survey of said Lemoyne Road;27

       thence from the above described PRINCIPAL Point of Beginning 28
and continuing along said easterly right-of-way line, N00°48'00"W, 29
a distance of 92.27 feet to an iron pin set and being 130.00 feet 30
right angle dimension east of Station 14+25.00 in said centerline 31
survey of Lemoyne Road;32

       thence continuing along said easterly right-of-way line, 33
S89°12'00"W, a distance of 28.80 feet to an iron pin set and being 34
101.20 feet right angle dimension east of Station 14+25.00 in said 35
centerline survey of Lemoyne Road;36

       thence continuing along said easterly right-of-way line, 37
N00°48'00"W, a distance of 75.00 feet to an iron pin set and being 38
101.20 feet right angle dimension east of Station 15+00.00 in said 39
centerline survey of Lemoyne Road;40

       thence continuing along said easterly right-of-way line, 41
N08°04'00"E, a distance of 89.52 feet to an iron pin set on the 42
north line of a 2.158 acre tract of land as described in Volume 43
364, Page 135 of the Wood County Deed Records and being 115.00 44
feet right angle dimension east of Station 15+88.02 in said 45
centerline survey of Lemoyne Road;46

       thence along the north line of said 2.158 acre tract, 47
N89°12'00"E, a distance of 165.69 feet to the centerline of 48
Interstate No. 280, passing a point at 26.53 feet on the westerly 49
limited access right of way line of Interstate No. 280, referenced 50
by a monument found north 0.38 feet and east 0.43 feet from said 51
point;52

       thence along the centerline of said Interstate No. 280, 53
S35°04'00"E, a distance of 311.62 feet;54

       thence along the south line of said 2.158 acre tract, also 55
being the north line of a 10 acre tract of land as described in 56
Volume 701, Page 787 of the Wood County Deed Records, S89°31'07"W, 57
a distance of 326.15 feet to the PRINCIPAL Point of Beginning, 58
passing an iron pin found at 139.69 feet on the westerly limited 59
access right of way line of Interstate No. 280 and containing 60
1.497 total acres of land, of which 0.822 acres lie in the 61
Easement for Highway Purposes for Interstate No. 280, more or 62
less, subject however to all legal highways and prior easements 63
of record.64

The above legal description is based on a land survey performed 66
during October, 2007 by Peterman Associates, Inc. and was 67
prepared by Nick E. Nigh, Professional Surveyor #7384.68

The above legal description is comprised of all of the acreage 69
from tax parcel number H28-712-1000-0000-5000.70



NOTE:        The bearings in this legal description are based upon an 72
        assumed meridian and are used only for the purpose of 73
        describing angular measurements. I.P. Set=5/8" x 30" Rebar 74
        with Peterman Associates' Cap.75
       

       (B) Consideration for the conveyance of the real estate 76
described in division (A) of this section shall be $40,000.77

        (C) The purchaser shall pay the costs of the conveyance.78

        (D) At the request of the Superintendent of the State Highway 79
Patrol, the Auditor of State, with the assistance of the Attorney 80
General, shall prepare a deed to the real estate described in 81
division (A) of this section. The deed shall state the 82
consideration. The deed shall be executed by the Governor in the 83
name of the state, countersigned by the Secretary of State, sealed 84
with the Great Seal of the State, presented in the Office of the 85
Auditor of State for recording, and delivered to the purchaser at 86
closing. The purchaser shall present the deed for recording in the 87
Office of the Wood County Recorder.88

        (E) The net proceeds of the sale of the real estate described 89
in division (A) of this section shall be deposited in the state 90
treasury to the credit of the State Highway Patrol's operating 91
expense account in the State Highway Safety Fund Group (Fund 036).92

       Section 2. This act shall expire on January 4, 2009.93
