A BILL
To amend section 4501.21 and to enact section 1
4503.494 of the Revised Code to create "Multiple 2
Sclerosis Awareness" license plates.3


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1.  That section 4501.21 be amended and section 4
4503.494 of the Revised Code be enacted to read as follows:5

       Sec. 4501.21.  (A) There is hereby created in the state 6
treasury the license plate contribution fund. The fund shall 7
consist of all contributions paid by motor vehicle registrants and 8
collected by the registrar of motor vehicles pursuant to sections 9
4503.491, 4503.493, 4503.494, 4503.50, 4503.501, 4503.502, 10
4503.51, 4503.522, 4503.545, 4503.55, 4503.551, 4503.552, 11
4503.561, 4503.562, 4503.591, 4503.67, 4503.68, 4503.69, 4503.71, 12
4503.711, 4503.72, 4503.73, 4503.74, 4503.75, and 4503.85 of the 13
Revised Code.14

       (B) The registrar shall pay the contributions the registrar 15
collects in the fund as follows:16

       (1) The registrar shall pay the contributions received 17
pursuant to section 4503.491 of the Revised Code to the breast 18
cancer fund of Ohio, which shall use that money only to pay for 19
programs that provide assistance and education to Ohio breast 20
cancer patients and that improve access for such patients to 21
quality health care and clinical trials and shall not use any of 22
the money for abortion information, counseling, services, or other 23
abortion-related activities.24

       (2) The registrar shall pay the contributions received 25
pursuant to section 4503.493 of the Revised Code to the autism 26
society of Ohio, which shall use the contributions for programs 27
and autism awareness efforts throughout the state.28

       (3) The registrar shall pay the contributions the registrar 29
receives pursuant to section 4503.494 of the Revised Code to the 30
national multiple sclerosis society for distribution in equal 31
amounts to the northwestern Ohio, Ohio buckeye, and Ohio valley 32
chapters of the national multiple sclerosis society. These 33
chapters shall use the money they receive under this section to 34
assist in paying the expenses they incur in providing services 35
directly to their clients.36

       (4) The registrar shall pay the contributions the registrar 37
receives pursuant to section 4503.50 of the Revised Code to the 38
future farmers of America foundation, which shall deposit the 39
contributions into its general account to be used for educational 40
and scholarship purposes of the future farmers of America 41
foundation.42

       (4)(5) The registrar shall pay the contributions the 43
registrar receives pursuant to section 4503.501 of the Revised 44
Code to the 4-H youth development program of the Ohio state 45
university extension program, which shall use those contributions 46
to pay the expenses it incurs in conducting its educational 47
activities.48

       (5)(6) The registrar shall pay the contributions received 49
pursuant to section 4503.502 of the Revised Code to the Ohio 50
cattlemen's foundation, which shall use those contributions for 51
scholarships and other educational activities.52

       (6)(7) The registrar shall pay each contribution the 53
registrar receives pursuant to section 4503.51 of the Revised 54
Code to the university or college whose name or marking or design 55
appears on collegiate license plates that are issued to a person 56
under that section. A university or college that receives 57
contributions from the fund shall deposit the contributions into 58
its general scholarship fund.59

       (7)(8) The registrar shall pay the contributions the 60
registrar receives pursuant to section 4503.522 of the Revised 61
Code to the "friends of Perry's victory and international peace 62
memorial, incorporated," a nonprofit corporation organized under 63
the laws of this state, to assist that organization in paying the 64
expenses it incurs in sponsoring or holding charitable, 65
educational, and cultural events at the monument.66

       (8)(9) The registrar shall pay the contributions the 67
registrar receives pursuant to section 4503.55 of the Revised 68
Code to the pro football hall of fame, which shall deposit the 69
contributions into a special bank account that it establishes and 70
which shall be separate and distinct from any other account the 71
pro football hall of fame maintains, to be used exclusively for 72
the purpose of promoting the pro football hall of fame as a 73
travel destination.74

       (9)(10) The registrar shall pay the contributions that are 75
paid to the registrar pursuant to section 4503.545 of the Revised 76
Code to the national rifle association foundation, which shall 77
use the money to pay the costs of the educational activities and 78
programs the foundation holds or sponsors in this state.79

       (10)(11) In accordance with section 955.202 of the Revised 80
Code, the registrar shall pay to the pets program funding board 81
created by that section the contributions the registrar receives 82
pursuant to section 4503.551 of the Revised Code and any other 83
money from any other source, including donations, gifts, and 84
grants, that is designated by the source to be paid to the pets 85
program funding board. The board shall use the moneys it receives 86
under this section only to support programs for the sterilization 87
of dogs and cats and for educational programs concerning the 88
proper veterinary care of those animals.89

       (11)(12) The registrar shall pay the contributions the 90
registrar receives pursuant to section 4503.552 of the Revised 91
Code to the rock and roll hall of fame and museum, incorporated.92

       (12)(13) The registrar shall pay the contributions the 93
registrar receives pursuant to section 4503.561 of the Revised 94
Code to the state of Ohio chapter of ducks unlimited, inc., which 95
shall deposit the contributions into a special bank account that 96
it establishes. The special bank account shall be separate and 97
distinct from any other account the state of Ohio chapter of ducks 98
unlimited, inc., maintains and shall be used exclusively for the 99
purpose of protecting, enhancing, restoring, and managing wetlands 100
and conserving wildlife habitat. The state of Ohio chapter of 101
ducks unlimited, inc., annually shall notify the registrar in 102
writing of the name, address, and account to which payments are to 103
be made under division (B)(12) of this section.104

       (13)(14) The registrar shall pay the contributions the 105
registrar receives pursuant to section 4503.562 of the Revised 106
Code to the Mahoning river consortium, which shall use the money 107
to pay the expenses it incurs in restoring and maintaining the 108
Mahoning river watershed.109

       (14)(15)(a) The registrar shall pay to a sports commission 110
created pursuant to section 4503.591 of the Revised Code each 111
contribution the registrar receives under that section that an 112
applicant pays to obtain license plates that bear the logo of a 113
professional sports team located in the county of that sports 114
commission and that is participating in the license plate program 115
pursuant to division (E) of that section, irrespective of the 116
county of residence of an applicant.117

       (b) The registrar shall pay to a community charity each 118
contribution the registrar receives under section 4503.591 of the 119
Revised Code that an applicant pays to obtain license plates that 120
bear the logo of a professional sports team that is participating 121
in the license plate program pursuant to division (G) of that 122
section.123

       (15)(16) The registrar shall pay the contributions the 124
registrar receives pursuant to section 4503.67 of the Revised 125
Code to the Dan Beard council of the boy scouts of America. The 126
council shall distribute all contributions in an equitable manner 127
throughout the state to regional councils of the boy scouts.128

       (16)(17) The registrar shall pay the contributions the 129
registrar receives pursuant to section 4503.68 of the Revised 130
Code to the great river council of the girl scouts of the United 131
States of America. The council shall distribute all contributions 132
in an equitable manner throughout the state to regional councils 133
of the girl scouts.134

       (17)(18) The registrar shall pay the contributions the 135
registrar receives pursuant to section 4503.69 of the Revised 136
Code to the Dan Beard council of the boy scouts of America. The 137
council shall distribute all contributions in an equitable manner 138
throughout the state to regional councils of the boy scouts.139

       (18)(19) The registrar shall pay the contributions the 140
registrar receives pursuant to section 4503.71 of the Revised 141
Code to the fraternal order of police of Ohio, incorporated, 142
which shall deposit the fees into its general account to be used 143
for purposes of the fraternal order of police of Ohio, 144
incorporated.145

       (19)(20) The registrar shall pay the contributions the 146
registrar receives pursuant to section 4503.711 of the Revised 147
Code to the fraternal order of police of Ohio, incorporated, 148
which shall deposit the contributions into an account that it 149
creates to be used for the purpose of advancing and protecting 150
the law enforcement profession, promoting improved law 151
enforcement methods, and teaching respect for law and order.152

       (20)(21) The registrar shall pay the contributions the 153
registrar receives pursuant to section 4503.72 of the Revised 154
Code to the organization known on March 31, 2003, as the Ohio 155
CASA/GAL association, a private, nonprofit corporation organized 156
under Chapter 1702. of the Revised Code. The Ohio CASA/GAL 157
association shall use these contributions to pay the expenses it 158
incurs in administering a program to secure the proper 159
representation in the courts of this state of abused, neglected, 160
and dependent children, and for the training and supervision of 161
persons participating in that program.162

       (21)(22) The registrar shall pay the contributions the 163
registrar receives pursuant to section 4503.73 of the Revised 164
Code to Wright B. Flyer, incorporated, which shall deposit the 165
contributions into its general account to be used for purposes of 166
Wright B. Flyer, incorporated.167

       (22)(23) The registrar shall pay the contributions the 168
registrar receives pursuant to section 4503.74 of the Revised 169
Code to the Columbus zoological park association, which shall 170
disburse the moneys to Ohio's major metropolitan zoos, as defined 171
in section 4503.74 of the Revised Code, in accordance with a 172
written agreement entered into by the major metropolitan zoos.173

       (23)(24) The registrar shall pay the contributions the 174
registrar receives pursuant to section 4503.75 of the Revised 175
Code to the rotary foundation, located on March 31, 2003, in 176
Evanston, Illinois, to be placed in a fund known as the permanent 177
fund and used to endow educational and humanitarian programs of 178
the rotary foundation.179

       (24)(25) The registrar shall pay the contributions the 180
registrar receives pursuant to section 4503.85 of the Revised 181
Code to the Ohio sea grant college program to be used for Lake 182
Erie area research projects.183

       (C) All investment earnings of the license plate contribution 184
fund shall be credited to the fund. Not later than the first day 185
of May of every year, the registrar shall distribute to each 186
entity described in divisionsdivision (B)(1) to (24) of this 187
section the investment income the fund earned the previous 188
calendar year. The amount of such a distribution paid to an 189
entity shall be proportionate to the amount of money the entity 190
received from the fund during the previous calendar year.191

       Sec. 4503.494. (A) The owner or lessee of any passenger car, 192
noncommercial motor vehicle, recreational vehicle, motorcycle, or 193
other vehicle of a class approved by the registrar of motor 194
vehicles may apply to the registrar for the registration of the 195
vehicle and issuance of "multiple sclerosis awareness" license 196
plates. The application may be combined with a request for a 197
special reserved license plate under section 4503.40 or 4503.42 of 198
the Revised Code. Upon receipt of the completed application and 199
compliance by the applicant with divisions (B) and (C) of this 200
section, the registrar shall issue to the applicant the 201
appropriate vehicle registration and a set of "multiple sclerosis 202
awareness" license plates and a validation sticker, or a 203
validation sticker alone when required by section 4503.191 of the 204
Revised Code.205

       In addition to the letters and numbers ordinarily inscribed 206
on the license plates, "multiple sclerosis awareness" license 207
plates shall bear words selected by and a logo designed by the 208
national multiple sclerosis society. The registrar shall approve 209
the final design. "Multiple sclerosis awareness" license plates 210
shall display county identification stickers that identify the 211
county of registration by name or number.212

       (B) "Multiple sclerosis awareness" license plates and a 213
validation sticker, or validation sticker alone, shall be issued 214
upon receipt of an application for registration of a motor vehicle 215
under this section; payment of the regular license tax as 216
prescribed under section 4503.04 of the Revised Code, any 217
applicable motor vehicle license tax levied under Chapter 4504. of 218
the Revised Code, any applicable additional fee prescribed by 219
section 4503.40 or 4503.42 of the Revised Code, an additional fee 220
of ten dollars, and a contribution as provided in division (C) of 221
this section; and compliance with all other applicable laws 222
relating to the registration of motor vehicles.223

       (C) The registrar shall collect a contribution of fifteen 224
dollars for each application for registration and registration 225
renewal notice the registrar receives under this section. The 226
registrar shall transmit this contribution to the treasurer of 227
state for deposit into the state treasury to the credit of the 228
license plate contribution fund created by section 4501.21 of the 229
Revised Code.230

       The registrar shall transmit the additional fee of ten 231
dollars, which is to compensate the bureau of motor vehicles for 232
the additional services required in the issuing of "multiple 233
sclerosis awareness" license plates, to the treasurer of state for 234
deposit into the state treasury to the credit of the state bureau 235
of motor vehicles fund created by section 4501.25 of the Revised 236
Code.237

       Section 2.  That existing section 4501.21 of the Revised Code 238
is hereby repealed.239

       Section 3.  Section 4501.21 of the Revised Code is presented 240
in this act as a composite of the section as amended by both Am. 241
Sub. H.B. 68 and Sub. H.B. 298 of the 126th General Assembly. The 242
General Assembly, applying the principle stated in division (B) 243
of section 1.52 of the Revised Code that amendments are to be 244
harmonized if reasonably capable of simultaneous operation, finds 245
that the composite is the resulting version of the section in 246
effect prior to the effective date of the section as presented in 247
this act.248
