A BILL
To amend sections 2151.3516 and 3313.60 of the 1
Revised Code to increase the number of hours after 2
birth that a parent may voluntarily deliver the 3
child to a safe haven without the parent 4
expressing an intent to return for the child and 5
to include awareness of the Safe Havens Law in the 6
health curriculum prescribed for high school 7
students.8


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That sections 2151.3516 and 3313.60 of the Revised 9
Code be amended to read as follows:10

       Sec. 2151.3516.  The following persons, while acting in an11
official capacity, shall take possession of a child who is12
seventy-twoone hundred forty-four hours old or younger if that 13
child's parent has voluntarily delivered the child to that person 14
without the parent expressing an intent to return for the child.15

       (A) A peace officer on behalf of the law enforcement agency16
that employs the officer;17

       (B) A hospital employee on behalf of the hospital that has18
granted the person privilege to practice at the hospital or that19
employs the person;20

       (C) An emergency medical service worker on behalf of the21
emergency medical service organization that employs the worker or22
for which the worker provides services.23

       Sec. 3313.60.  Notwithstanding division (D) of section24
3311.52 of the Revised Code, divisions (A) to (E) of this section25
do not apply to any cooperative education school district26
established pursuant to divisions (A) to (C) of section 3311.52 of27
the Revised Code.28

       (A) The board of education of each city and exempted village29
school district, the governing board of each educational service30
center, and the board of each cooperative education school31
district established pursuant to section 3311.521 of the Revised32
Code shall prescribe a curriculum for all schools under their33
control. Except as provided in division (E) of this section, in34
any such curriculum there shall be included the study of the35
following subjects:36

       (1) The language arts, including reading, writing, spelling,37
oral and written English, and literature;38

       (2) Geography, the history of the United States and of Ohio,39
and national, state, and local government in the United States,40
including a balanced presentation of the relevant contributions to41
society of men and women of African, Mexican, Puerto Rican, and42
American Indian descent as well as other ethnic and racial groups43
in Ohio and the United States;44

       (3) Mathematics;45

       (4) Natural science, including instruction in the46
conservation of natural resources;47

       (5) Health education, which shall include instruction in:48

       (a) The nutritive value of foods, including natural and49
organically produced foods, the relation of nutrition to health,50
the use and effects of food additives;51

       (b) The harmful effects of and legal restrictions against the 52
use of drugs of abuse, alcoholic beverages, and tobacco;53

       (c) Venereal disease education, except that upon written54
request of the student's parent or guardian, a student shall be55
excused from taking instruction in venereal disease education;56

       (d) In grades kindergarten through six, instruction in57
personal safety and assault prevention, except that upon written58
request of the student's parent or guardian, a student shall be59
excused from taking instruction in personal safety and assault60
prevention;61

       (e) In high school, information about section 2151.3516 of 62
the Revised Code, pertaining to the permissible desertion of a 63
child less than one hundred forty-four hours after birth by a 64
parent with no intent to return for the child.65

       (6) Physical education;66

       (7) The fine arts, including music;67

       (8) First aid, including a training program in68
cardiopulmonary resuscitation, safety, and fire prevention, except69
that upon written request of the student's parent or guardian, a70
student shall be excused from taking instruction in71
cardiopulmonary resuscitation.72

       (B) Except as provided in division (E) of this section, every 73
school or school district shall include in the requirements for 74
promotion from the eighth grade to the ninth grade one year's75
course of study of American history.76

       (C) Except as provided in division (E) of this section, every 77
high school shall include in the requirements for graduation from 78
any curriculum one unit of American history and government,79
including a study of the constitutions of the United States and of80
Ohio.81

       (D) Except as provided in division (E) of this section, basic 82
instruction in geography, United States history, the government of 83
the United States, the government of the state of Ohio, local 84
government in Ohio, the Declaration of Independence, the United 85
States Constitution, and the Constitution of the state of Ohio 86
shall be required before pupils may participate in courses87
involving the study of social problems, economics, foreign88
affairs, United Nations, world government, socialism and89
communism.90

       (E) For each cooperative education school district91
established pursuant to section 3311.521 of the Revised Code and92
each city, exempted village, and local school district that has93
territory within such a cooperative district, the curriculum94
adopted pursuant to divisions (A) to (D) of this section shall95
only include the study of the subjects that apply to the grades96
operated by each such school district. The curriculums for such97
schools, when combined, shall provide to each student of these98
districts all of the subjects required under divisions (A) to (D)99
of this section.100

       (F) The board of education of any cooperative education101
school district established pursuant to divisions (A) to (C) of102
section 3311.52 of the Revised Code shall prescribe a curriculum103
for the subject areas and grade levels offered in any school under104
its control.105

       (G) Upon the request of any parent or legal guardian of a106
student, the board of education of any school district shall107
permit the parent or guardian to promptly examine, with respect to108
the parent's or guardian's own child:109

       (1) Any survey or questionnaire, prior to its administration110
to the child;111

       (2) Any textbook, workbook, software, video, or other112
instructional materials being used by the district in connection113
with the instruction of the child;114

       (3) Any completed and graded test taken or survey or115
questionnaire filled out by the child;116

       (4) Copies of the statewide academic standards and each model 117
curriculum developed pursuant to section 3301.079 of the Revised 118
Code, which copies shall be available at all times during school 119
hours in each district school building.120

       Section 2. That existing sections 2151.3516 and 3313.60 of 121
the Revised Code are hereby repealed.122
