A BILL

To enact section 3345.43 of the Revised Code to

require state institutions of higher education to

2

designate their law enforcement and medical

3

services units and their threat assessment teams

4

as "school officials" for purposes of receiving

5

student education records under federal law.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

Section 1. That section 3345.43 of the Revised Code be	7
enacted to read as follows:	8

Sec. 3345.43. (A) As used in this section:

(1) "Mental health professional" has the same meaning as in	10
section 2305.51 of the Revised Code.	11

(2) "State institution of higher education" has the same	12
meaning as in section 3345.011 of the Revised Code.	13

(B) Each state institution of higher education shall	14
designate personnel of its law enforcement unit and its student	15
medical services unit, including mental health professionals of	16
that unit, and personnel assigned to its threat assessment team as	17
"school officials" for purposes of receiving student education	18
records in compliance with the "Family Educational Rights and	19
Privacy Act," 20 U.S.C. 1232g. Accordingly, each institution shall	20
include acknowledgment of that designation in the notice required	21
under 20 U.S.C. 1232g(a) and 34 C.F.R 99.7.	22
