A BILL
To amend sections 4507.23, 4507.24, and 4507.50 of 1
the Revised Code to permit retired and honorably 2
discharged veterans of the armed forces of the 3
United States and the Ohio National Guard to apply 4
for state-issued identification cards and new and 5
renewal driver's licenses without the payment of 6
any fee.7


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That sections 4507.23, 4507.24, and 4507.50 of the 8
Revised Code be amended to read as follows:9

       Sec. 4507.23.  (A) Except as provided in division (I) of this 10
section, each application for a temporary instruction permit and 11
examination shall be accompanied by a fee of five dollars.12

       (B) Except as provided in division (I) of this section, each13
application for a driver's license made by a person who previously14
held such a license and whose license has expired not more than15
two years prior to the date of application, and who is required16
under this chapter to give an actual demonstration of the person's17
ability to drive, shall be accompanied by a fee of three dollars18
in addition to any other fees.19

       (C) Except as provided in divisions (E) and, (I), and (J) of 20
this section, each application for a driver's license, or 21
motorcycle operator's endorsement, or renewal of a driver's 22
license shall be accompanied by a fee of six dollars. Except as 23
provided in division (I) of this section, each application for a24
duplicate driver's license shall be accompanied by a fee of two25
dollars and fifty cents. The duplicate driver's licenses issued26
under this section shall be distributed by the deputy registrar in 27
accordance with rules adopted by the registrar of motor vehicles.28

       (D) Except as provided in division (I) of this section, each29
application for a motorized bicycle license or duplicate thereof30
shall be accompanied by a fee of two dollars and fifty cents.31

       (E) Except as provided in divisiondivisions (I) and (J) of 32
this section, each application for a driver's license or renewal 33
of a driver's license that will be issued to a person who is less34
than twenty-one years of age shall be accompanied by whichever of35
the following fees is applicable:36

       (1) If the person is sixteen years of age or older, but less37
than seventeen years of age, a fee of seven dollars and38
twenty-five cents;39

       (2) If the person is seventeen years of age or older, but40
less than eighteen years of age, a fee of six dollars;41

       (3) If the person is eighteen years of age or older, but less 42
than nineteen years of age, a fee of four dollars and seventy-five 43
cents;44

       (4) If the person is nineteen years of age or older, but less 45
than twenty years of age, a fee of three dollars and fifty cents;46

       (5) If the person is twenty years of age or older, but less47
than twenty-one years of age, a fee of two dollars and twenty-five48
cents.49

       (F) Neither the registrar nor any deputy registrar shall50
charge a fee in excess of one dollar and fifty cents for51
laminating a driver's license, motorized bicycle license, or52
temporary instruction permit identification cards as required by53
sections 4507.13 and 4511.521 of the Revised Code. A deputy54
registrar laminating a driver's license, motorized bicycle55
license, or temporary instruction permit identification cards56
shall retain the entire amount of the fee charged for lamination,57
less the actual cost to the registrar of the laminating materials58
used for that lamination, as specified in the contract executed by59
the bureau for the laminating materials and laminating equipment.60
The deputy registrar shall forward the amount of the cost of the61
laminating materials to the registrar for deposit as provided in62
this section.63

       (G) Except as provided in divisiondivisions (I) and (J) of 64
this section and except for the renewal of a driver's license, 65
commencing on October 1, 2003, each transaction described in 66
divisions (A), (B), (C), (D), and (E) of this section shall be 67
accompanied by an additional fee of twelve dollars. A transaction 68
involving the renewal of a driver's license with an expiration 69
date on or after that date shall be accompanied by an additional 70
fee of twelve dollars. The additional fee is for the purpose of 71
defraying the department of public safety's costs associated with 72
the administration and enforcement of the motor vehicle and 73
traffic laws of Ohio.74

       (H) At the time and in the manner provided by section 4503.10 75
of the Revised Code, the deputy registrar shall transmit the fees 76
collected under divisions (A), (B), (C), (D), and (E), those 77
portions of the fees specified in and collected under division 78
(F), and the additional fee under division (G) of this section to 79
the registrar. The registrar shall pay two dollars and fifty cents 80
of each fee collected under divisions (A), (B), (C), (D), and 81
(E)(1) to (4) of this section, and the entire fee collected under 82
division (E)(5) of this section, into the state highway safety 83
fund established in section 4501.06 of the Revised Code, and such 84
fees shall be used for the sole purpose of supporting driver 85
licensing activities. The registrar also shall pay the entire fee 86
collected under division (G) of this section into the state 87
highway safety fund created in section 4501.06 of the Revised 88
Code. The remaining fees collected by the registrar under this 89
section shall be paid into the state bureau of motor vehicles fund 90
established in section 4501.25 of the Revised Code.91

       (I) A disabled veteran who has a service-connected disability 92
rated at one hundred per cent by the veterans' administration93
department of veterans affairs may apply to the registrar or a94
deputy registrar for the issuance to that veteran, without the95
payment of any fee prescribed in this section, of any of the96
following items:97

       (1) A temporary instruction permit and examination;98

       (2) A new, renewal, or duplicate driver's or commercial99
driver's license;100

       (3) A motorcycle operator's endorsement;101

       (4) A motorized bicycle license or duplicate thereof;102

       (5) Lamination of a driver's license, motorized bicycle103
license, or temporary instruction permit identification card as104
provided in division (F) of this section, if the circumstances105
specified in division (I)(5) of this section are met.106

       If the driver's license, motorized bicycle license, or107
temporary instruction permit identification card of a disabled108
veteran described in division (I) of this section is laminated by109
a deputy registrar who is acting as a deputy registrar pursuant to110
a contract with the registrar that is in effect on October 14,111
1997, the disabled veteran shall be required to pay the deputy112
registrar the lamination fee provided in division (F) of this113
section. If the driver's license, motorized bicycle license, or114
temporary instruction permit identification card of such a115
disabled veteran is laminated by a deputy registrar who is acting116
as a deputy registrar pursuant to a contract with the registrar117
that is executed after October 14, 1997, the disabled veteran is118
not required to pay the deputy registrar the lamination fee119
provided in division (F) of this section.120

       A disabled veteran whose driver's license, motorized bicycle121
license, or temporary instruction permit identification card is122
laminated by the registrar is not required to pay the registrar123
any lamination fee.124

       An application made under division (I) of this section shall125
be accompanied by such documentary evidence of disability as the126
registrar may require by rule.127

       (J)(1) Any person who is a retired or honorably discharged 128
veteran of any branch of the armed forces of the United States or 129
the Ohio national guard may apply to the registrar or a deputy 130
registrar for the issuance of a new or renewal driver's license 131
without the payment of any fee prescribed in this section, 132
including payment of any lamination fee, and without payment of 133
any registrar service fee or deputy registrar service fee. The 134
application shall be accompanied by such written evidence that the 135
applicant is a retired or honorably discharged veteran of a branch 136
of the armed forces of the United States or the Ohio national 137
guard as the registrar shall require by rule.138

        (2) Division (J)(1) of this section does not apply to any of 139
the following:140

        (a) Any permit, license, or examination specified in Chapter 141
4506. of the Revised Code;142

        (b) A temporary instruction permit and examination;143

       (c) A duplicate driver's license;144

       (d) A motorcycle operator's endorsement;145

        (e) A motorized bicycle license or duplicate thereof.146

       Sec. 4507.24.  (A) Except as provided in division (B)(C) of147
this section, each deputy registrar may collect a fee not to148
exceed the following:149

       (1) Three dollars and seventy-five cents commencing on July150
1, 2001, four dollars and twenty-five cents commencing on January151
1, 2003, and four dollars and fifty cents commencing on January 1,152
2004, for each application for renewal of a driver's license153
received by the deputy registrar, when the applicant is required154
to submit to a screening of the applicant's vision under section155
4507.12 of the Revised Code;156

       (2) Two dollars and seventy-five cents commencing on July 1,157
2001, three dollars and twenty-five cents commencing on January 1,158
2003, and three dollars and fifty cents commencing on January 1,159
2004, for each application for a driver's license, or motorized160
bicycle license, or for renewal of such a license, received by the161
deputy registrar, when the applicant is not required to submit to162
a screening of the applicant's vision under section 4507.12 of the163
Revised Code.164

       (B) The fees prescribed by division (A) of this section shall 165
be in addition to the fee for a temporary instruction permit and 166
examination, a driver's license, a motorized bicycle license, or 167
duplicates thereof, and shall compensate the deputy registrar for 168
the deputy registrar's services, for office and rental expense, 169
and for costs as provided in division (C)(D) of this section, as 170
are necessary for the proper discharge of the deputy registrar's171
duties under sections 4507.01 to 4507.39 of the Revised Code.172

       (C)(1) A disabled veteran who has a service-connected173
disability rated at one hundred per cent by the veterans'174
administrationdepartment of veterans affairs is required to pay 175
the applicable fee prescribed in division (A) of this section if 176
the disabled veteran submits an application for a driver's license 177
or motorized bicycle license or a renewal of either of these 178
licenses to a deputy registrar who is acting as a deputy registrar 179
pursuant to a contract with the registrar that is in effect on the 180
effective date of this amendment. The disabled veteran also is 181
required to submit with the disabled veteran's application such 182
documentary evidence of disability as the registrar may require by 183
rule.184

       A disabled veteran who submits an application described in185
this division is not required to pay either of the fees prescribed186
in division (A) of this section if the disabled veteran submits187
the application to a deputy registrar who is acting as a deputy188
registrar pursuant to a contract with the registrar that is189
executed after the effective date of this amendment. The disabled190
veteran still is required to submit with the disabled veteran's191
application such documentary evidence of disability as the192
registrar may require by rule.193

       A disabled veteran who submits an application described in194
this division directly to the registrar is not required to pay195
either of the fees prescribed in division (A) of this section if196
the disabled veteran submits with the disabled veteran's197
application such documentary evidence of disability as the198
registrar may require by rule.199

       (C)(2) Any person who is a retired or honorably discharged 200
veteran of any branch of the armed forces of the United States or 201
the Ohio national guard is not required to pay either of the fees 202
prescribed in division (A) of this section when the person submits 203
an application for a driver's license or for renewal of a driver's 204
license. The application shall be accompanied by such written 205
evidence that the applicant is a retired or honorably discharged 206
veteran of a branch of the armed forces of the United States or 207
the Ohio national guard as the registrar shall require by rule.208

        (D) Each deputy registrar shall transmit to the registrar of209
motor vehicles, at such time and in such manner as the registrar210
shall require by rule, an amount of each fee collected under211
division (A)(1) of this section as shall be determined by the212
registrar. The registrar shall pay all such moneys so received213
into the state bureau of motor vehicles fund created in section214
4501.25 of the Revised Code.215

       Sec. 4507.50.  (A) The registrar of motor vehicles or a216
deputy registrar, upon receipt of an application filed in217
compliance with section 4507.51 of the Revised Code by any person218
who is a resident or a temporary resident of this state and,219
except as otherwise provided in this section, is not licensed as220
an operator of a motor vehicle in this state or another licensing221
jurisdiction, and, except as provided in division (B) of this222
section, upon receipt of a fee of three dollars and fifty cents,223
shall issue an identification card to that person.224

       Any person who is a resident or temporary resident of this225
state whose Ohio driver's or commercial driver's license has been226
suspended or canceled, upon application in compliance with section227
4507.51 of the Revised Code and, except as provided in division228
(B) of this section, payment of a fee of three dollars and fifty229
cents, may be issued a temporary identification card. The230
temporary identification card shall be identical to an231
identification card, except that it shall be printed on its face232
with a statement that the card is valid during the effective dates233
of the suspension or cancellation of the cardholder's license, or234
until the birthday of the cardholder in the fourth year after the235
date on which it is issued, whichever is shorter. The cardholder236
shall surrender the identification card to the registrar or any237
deputy registrar before the cardholder's driver's or commercial238
driver's license is restored or reissued.239

       Except as provided in division (B) of this section, the240
deputy registrar shall be allowed a fee of two dollars and 241
seventy-five cents commencing on July 1, 2001, three dollars and242
twenty-five cents commencing on January 1, 2003, and three dollars243
and fifty cents commencing on January 1, 2004, for each244
identification card issued under this section. The fee allowed to245
the deputy registrar shall be in addition to the fee for issuing246
an identification card.247

       Neither the registrar nor any deputy registrar shall charge a248
fee in excess of one dollar and fifty cents for laminating an249
identification card or temporary identification card. A deputy250
registrar laminating such a card shall retain the entire amount of251
the fee charged for lamination, less the actual cost to the252
registrar of the laminating materials used for that lamination, as253
specified in the contract executed by the bureau for the254
laminating materials and laminating equipment. The deputy255
registrar shall forward the amount of the cost of the laminating256
materials to the registrar for deposit as provided in this257
section.258

       The fee collected for issuing an identification card under259
this section, except the fee allowed to the deputy registrar,260
shall be paid into the state treasury to the credit of the state261
bureau of motor vehicles fund created in section 4501.25 of the262
Revised Code.263

       (B) A disabled veteran who has a service-connected disability 264
rated at one hundred per cent by the veterans' administration265
department of veterans affairs and any person who is a retired or 266
honorably discharged veteran of any branch of the armed forces of 267
the United States or the Ohio national guard may apply to the 268
registrar or a deputy registrar for the issuance to that veteran 269
of an identification card or a temporary identification card under270
this section without payment of any fee prescribed in division (A) 271
of this section, including any lamination fee.272

       An application made under this division (B) of this section273
shall be accompanied by such documentary evidence of disability or 274
status as a retired or honorably discharged veteran of a branch of 275
the armed forces of the United States or the Ohio national guard276
as the registrar mayshall require by rule.277

       Section 2. That existing sections 4507.23, 4507.24, and 278
4507.50 of the Revised Code are hereby repealed.279
