To waive the requirement for certain school districts | 1 |
to make up days schools are closed due to flooding | 2 |
and to declare an emergency. | 3 |
Section 1. (A) Notwithstanding sections 3313.48, 3313.481, | 4 |
and 3317.01 of the Revised Code, no school district to which the | 5 |
following conditions apply shall be required to make up any days | 6 |
or hours any of its schools are closed due to flooding during the | 7 |
2007-2008 school year: | 8 |
(1) The district was unable to make up the days specified in | 9 |
its contingency plan adopted under division (A) of section | 10 |
3313.482 of the Revised Code for the schools closed due to | 11 |
flooding because flooding prohibited the district from opening | 12 |
those schools on the days designated in the plan. | 13 |
(2) The district increased the length of school days, as | 14 |
described in division (C) of section 3313.482 of the Revised Code, | 15 |
to make up the number of days or hours any of its schools were | 16 |
closed in excess of the number permitted by sections 3313.48, | 17 |
3313.481, and 3317.01 of the Revised Code due to hazardous weather | 18 |
conditions other than flooding or any other calamity described in | 19 |
division (B) of section 3317.01 of the Revised Code. | 20 |
(B) A school district described in division (A) of this | 21 |
section shall not be considered to have failed to comply with | 22 |
division (B) of section 3317.01 of the Revised Code during the | 23 |
2007-2008 school year for purposes of receiving state payments | 24 |
under Chapter 3317. of the Revised Code in fiscal year 2009. | 25 |
Section 2. This act is hereby declared to be an emergency | 26 |
measure necessary for the immediate preservation of the public | 27 |
peace, health, and safety. The reason for such necessity is to | 28 |
ensure the uninterrupted payment of state funds to school | 29 |
districts where unforeseen flooding has prevented the districts | 30 |
from implementing their contingency plans for making up excess | 31 |
calamity days. Therefore, this act shall go into immediate effect. | 32 |
