To enact section 3703.25 of the Revised Code to | 1 |
prohibit a person from selling a water key to any | 2 |
individual other than a plumber. | 3 |
Section 1. That section 3703.25 of the Revised Code be | 4 |
enacted to read as follows: | 5 |
Sec. 3703.25. (A) As used in this section: | 6 |
(1) "Plumber" means an individual who holds the individual's | 7 |
self out to the public as providing plumbing services. | 8 |
(2) "Water key" means a device an individual uses to turn on | 9 |
and off the supply of water to real property. | 10 |
(B) No person shall sell a water key to an individual unless | 11 |
both of the following criteria are satisfied: | 12 |
(1) The individual purchasing a water key is one of the | 13 |
following individuals: | 14 |
(a) A plumber who is licensed as a plumbing contractor under | 15 |
Chapter 4740. of the Revised Code or who is licensed, certified, | 16 |
or registered by a municipal corporation; | 17 |
(b) A plumber who is not licensed, certified, or registered | 18 |
as described under division (B)(1)(a) of this section but | 19 |
satisfies one of the following criteria: | 20 |
(i) The plumber has registered the plumber's business with | 21 |
the secretary of state. | 22 |
(ii) The plumber advertises the services provided through the | 23 |
plumber's business in a newspaper of general circulation, a | 24 |
telephone book, electronic media that is available to the public, | 25 |
or another advertising media that is owned and operated by a | 26 |
person other than the plumber. | 27 |
(2) The plumber purchasing the water key provides proof of | 28 |
compliance with division (B)(1) of this section to the person from | 29 |
whom the plumber purchases the water key. | 30 |
