To enact sections 1751.69, 3923.651, and 5111.017 of | 1 |
the Revised Code to require certain health care | 2 |
policies, contracts, agreements, and plans, as | 3 |
well as the state's Medicaid program, to provide | 4 |
benefits for colorectal examinations and | 5 |
laboratory tests for cancer. | 6 |
Section 1. That sections 1751.69, 3923.651, and 5111.017 of | 7 |
the Revised Code be enacted to read as follows: | 8 |
Sec. 1751.69. (A) Notwithstanding section 3901.71 of the | 9 |
Revised Code, each individual or group health insuring corporation | 10 |
policy, contract, or agreement providing basic health care | 11 |
services that is delivered, issued for delivery, or renewed in | 12 |
this state shall provide benefits for the expenses of colorectal | 13 |
cancer examinations and laboratory tests for cancer for any | 14 |
nonsymptomatic individual who is either of the following: | 15 |
(1) Fifty years of age or older; | 16 |
(2) Less than fifty years of age and at high risk for | 17 |
colorectal cancer according to the most recently published | 18 |
colorectal cancer screening guidelines of the American cancer | 19 |
society. | 20 |
(B) The benefits provided under division (A) of this section | 21 |
shall be provided for examinations and laboratory tests that are | 22 |
performed in accordance with the most recently published cancer | 23 |
screening guidelines of the American cancer society. | 24 |
(C) The benefits provided under division (A) of this section | 25 |
shall be subject to the same terms and conditions, including | 26 |
copayment charges, that apply to similar benefits provided under | 27 |
the policy, contract, or agreement. | 28 |
Sec. 3923.651. (A) Notwithstanding section 3901.71 of the | 29 |
Revised Code, each policy of individual or group sickness and | 30 |
accident insurance that is delivered, issued for delivery, or | 31 |
renewed in this state and each public employee benefit plan shall | 32 |
provide benefits for the expenses of colorectal cancer | 33 |
examinations and laboratory tests for cancer for any | 34 |
nonsymptomatic individual who is either of the following: | 35 |
(1) Fifty years of age or older; | 36 |
(2) Less than fifty years of age and at high risk for | 37 |
colorectal cancer according to the most recently published | 38 |
colorectal cancer screening guidelines of the American cancer | 39 |
society. | 40 |
(B) The benefits provided under division (A) of this section | 41 |
shall be provided for examinations and laboratory tests that are | 42 |
performed in accordance with the most recently published cancer | 43 |
screening guidelines of the American cancer society. | 44 |
(C) The benefits provided under division (A) of this section | 45 |
shall be subject to the same terms and conditions, including | 46 |
copayments and deductibles, that apply to similar benefits | 47 |
provided under the policy. | 48 |
(D) This section does not apply to any policy that provides | 49 |
coverage for specific diseases or accidents only, or to any | 50 |
hospital indemnity, medicare supplement, or other policy that | 51 |
offers only supplemental benefits. | 52 |
Sec. 5111.017. (A) The provision of medical assistance under | 53 |
this chapter shall include coverage of colorectal cancer | 54 |
examinations and laboratory tests for cancer for any | 55 |
nonsymptomatic individual who is either of the following: | 56 |
(1) Fifty years of age or older; | 57 |
(2) Less than fifty years of age and at high risk for | 58 |
colorectal cancer according to the most recently published | 59 |
colorectal cancer screening guidelines of the American cancer | 60 |
society. | 61 |
(B) The coverage provided under division (A) of this section | 62 |
shall be provided for examinations and laboratory tests that are | 63 |
performed in accordance with the most recently published cancer | 64 |
screening guidelines of the American cancer society. | 65 |
