A BILL
To enact sections 1751.69, 3923.651, and 5111.017 of1
the Revised Code to require certain health care2
policies, contracts, agreements, and plans, as 3
well as the state's Medicaid program, to provide 4
benefits for colorectal examinations and 5
laboratory tests for cancer.6


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That sections 1751.69, 3923.651, and 5111.017 of 7
the Revised Code be enacted to read as follows:8

       Sec. 1751.69.  (A) Notwithstanding section 3901.71 of the9
Revised Code, each individual or group health insuring corporation10
policy, contract, or agreement providing basic health care11
services that is delivered, issued for delivery, or renewed in12
this state shall provide benefits for the expenses of colorectal 13
cancer examinations and laboratory tests for cancer for any 14
nonsymptomatic individual who is either of the following:15

       (1) Fifty years of age or older;16

       (2) Less than fifty years of age and at high risk for17
colorectal cancer according to the most recently published18
colorectal cancer screening guidelines of the American cancer19
society.20

       (B) The benefits provided under division (A) of this section21
shall be provided for examinations and laboratory tests that are22
performed in accordance with the most recently published cancer23
screening guidelines of the American cancer society.24

       (C) The benefits provided under division (A) of this section25
shall be subject to the same terms and conditions, including26
copayment charges, that apply to similar benefits provided under27
the policy, contract, or agreement.28

       Sec. 3923.651. (A) Notwithstanding section 3901.71 of the29
Revised Code, each policy of individual or group sickness and30
accident insurance that is delivered, issued for delivery, or31
renewed in this state and each public employee benefit plan shall 32
provide benefits for the expenses of colorectal cancer 33
examinations and laboratory tests for cancer for any 34
nonsymptomatic individual who is either of the following:35

       (1) Fifty years of age or older;36

       (2) Less than fifty years of age and at high risk for37
colorectal cancer according to the most recently published38
colorectal cancer screening guidelines of the American cancer39
society.40

       (B) The benefits provided under division (A) of this section41
shall be provided for examinations and laboratory tests that are42
performed in accordance with the most recently published cancer43
screening guidelines of the American cancer society.44

       (C) The benefits provided under division (A) of this section45
shall be subject to the same terms and conditions, including46
copayments and deductibles, that apply to similar benefits47
provided under the policy.48

       (D) This section does not apply to any policy that provides49
coverage for specific diseases or accidents only, or to any50
hospital indemnity, medicare supplement, or other policy that51
offers only supplemental benefits.52

       Sec. 5111.017. (A) The provision of medical assistance under53
this chapter shall include coverage of colorectal cancer54
examinations and laboratory tests for cancer for any55
nonsymptomatic individual who is either of the following:56

       (1) Fifty years of age or older;57

       (2) Less than fifty years of age and at high risk for58
colorectal cancer according to the most recently published59
colorectal cancer screening guidelines of the American cancer60
society.61

       (B) The coverage provided under division (A) of this section62
shall be provided for examinations and laboratory tests that are63
performed in accordance with the most recently published cancer64
screening guidelines of the American cancer society.65
