A BILL
To enact sections 3701.136, 3701.137, 3701.138, and 1
3701.139 of the Revised Code to establish the Bed 2
Bug Awareness, Education, and Prevention Program 3
and to make an appropriation.4


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That sections 3701.136, 3701.137, 3701.138, and 5
3701.139 of the Revised Code be enacted to read as follows:6

       Sec. 3701.136. As used in sections 3701.136 to 3701.139 of 7
the Revised Code:8

       (A) "Hotel" means every establishment kept, used, maintained, 9
advertised, or held out to the public as a place where sleeping 10
accommodations are offered to guests, in which five or more rooms 11
are used for the accommodation of such guests, whether the rooms 12
are in one or several structures.13

        (B) "Residential dwelling" means a building used or intended 14
to be used as a personal residence by the owner, part owner, or 15
lessee of the building, or any person authorized by such a person 16
to use the building as a personal residence.17

       Sec. 3701.137. The bed bug awareness, education, and 18
prevention program is hereby established in the department of 19
health with the assistance of and in consultation with the 20
research office of the division of travel and tourism of the 21
department of development.22

       Sec. 3701.138. (A) The department of health shall make 23
available on its web site information on the increasing incidences 24
of bed bug (cimex lectularius) infestation and post notices that 25
bed bugs are a public nuisance dangerous to public health. The 26
director of health shall do all of the following:27

       (1) Educate hotel owners, residential dwellers, and citizens 28
of this state on the difference between bed bugs and similar types 29
of vermin so they can be easily recognized and treated 30
accordingly.31

        (2) Encourage hotel owners and residential dwellers to 32
closely monitor floors, carpets, and bed linen and mattresses for 33
signs of infestation to facilitate effective, timely treatment to 34
prevent the spread and incidence of infestation.35

       (3) Assist in and promote the development of safe and 36
effective treatment methods or options to eradicate bed bug 37
infestation in hotels and residential dwellings.38

       (B) The department of health shall adopt rules as necessary 39
to implement this section. The rules shall be adopted in 40
accordance with Chapter 119. of the Revised Code.41

       Sec. 3701.139. The department of health shall make available 42
to the public a toll-free telephone number for any person seeking 43
to report an incidence of bed bug infestation or to request 44
information. The department may make the toll-free number 45
available by maintaining a toll-free telephone line specifically 46
for accepting calls regarding bed bugs or by using a toll-free 47
telephone line that the department maintains for accepting calls 48
regarding other matters.49

       Section 2. All items in this section are hereby appropriated 50
as designated out of any moneys in the state treasury to the 51
credit of the General Revenue Fund Group. For all appropriations 52
made in this act, those in the first column are for fiscal year 53
2008 and those in the second column are for fiscal year 2009. The 54
appropriations made in this act are in addition to any other 55
appropriations made for the FY 2008-2009 biennium.56

       Within the limits set forth in this act, the Director of 62
Budget and Management shall establish accounts indicating the 63
source and amount of funds for each appropriation made in this 64
act, and shall determine the form and manner in which 65
appropriation accounts shall be maintained. Expenditures from 66
appropriations contained in this act shall be accounted for as 67
though made in Am. Sub. H.B. 119 of the 127th General Assembly.68

        The appropriations made in this act are subject to all 69
provisions of Am. Sub. H.B. 119 of the 127th General Assembly that 70
are generally applicable to such appropriations.71

       Section 3. The sections of law contained in this act, and the 72
items of which they are composed, are not subject to the 73
referendum. Therefore, under Ohio Constitution, Article II, 74
Section 1d and section 1.471 of the Revised Code, the sections of 75
law contained in this act, and the items of which they are 76
composed, go into immediate effect when this act becomes law.77
