A BILL
To enact section 126.50 of the Revised Code to 1
require the Department of Budget and Management to 2
electronically publish information regarding state 3
awards.4


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 126.50 of the Revised Code be enacted 5
to read as follows:6

       Sec. 126.50.  (A) As used in this section:7

       (1) "Entity" means, whether for profit or nonprofit, a 8
corporation, association, partnership, limited liability company, 9
sole proprietorship, or other business entity. "Entity" does not 10
include an individual who receives state assistance that is not 11
related to the individual's business.12

       (2)(a) "State award" means state financial assistance and 13
expenditures of not less than one thousand dollars in any of the 14
following forms:15

       (i) Grants, subgrants, loans, awards, cooperative agreements, 16
or other similar forms of financial assistance;17

       (ii) Contracts, subcontracts, purchase orders, task orders, 18
delivery orders, or other similar types of transactions.19

       (b) "State award" does not include compensation received as 20
an employee of the state.21

       (B) The office of budget and management shall establish and 22
maintain a single searchable web site, accessible by the public at 23
no cost, that includes all of the following information for each 24
state award:25

       (1) The name and location of the entity receiving the award;26

       (2) The amount of the award or, if more than one award, the 27
aggregate amount of the awards;28

       (3) The purpose of the award;29

       (4) The agency or other instrumentality of the state that is 30
requesting or providing the award.31

       (C) The office of budget and management may consult with 32
other state agencies in the development, establishment, operation, 33
and support of the web site. The web site shall list state awards 34
by fiscal year in which the award is made, beginning with fiscal 35
year 2009. Awards shall be posted on the web site within thirty 36
days after being made. The office of budget and management shall 37
provide an opportunity for public comment as to the utility of 38
the web site and any suggested improvements.39

       (D) Nothing in this section shall be construed as requiring 40
the disclosure of confidential information.41
