A BILL
To enact section 5101.90 of the Revised Code to 1
create the Ohio Department of Job and Family 2
Services Oversight Commission.3


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 5101.90 of the Revised Code be 4
enacted to read as follows:5

       Sec. 5101.90.  (A) There is hereby created the Ohio 6
department of job and family services oversight commission. The 7
commission shall annually review the management practices, 8
financial oversight practices, and focus of the Ohio department of 9
job and family services.10

       (B) The commission shall consist of the following members, 11
each with the authority to vote on matters before the commission:12

       (1) Two members of the senate: one appointed by the president 13
of the senate from the majority party and one appointed by the 14
minority leader of the senate from the minority party;15

       (2) Two members of the house of representatives: one 16
appointed by the speaker of the house of representatives from the 17
majority party and one appointed by the minority leader of the 18
house of representatives from the minority party;19

       (3) Two members of the business community: one appointed by 20
the president of the senate who shall be a certified public 21
accountant and one appointed by the speaker of the house of 22
representatives;23

       (4) One member who receives services from the department of 24
job and family services, appointed by the minority leader of the 25
senate.26

       Initial members shall be appointed not later than ninety days 27
after the effective date of this section. Members may be 28
reappointed. Vacancies shall be filled in the manner provided for 29
original appointments. They shall be filled not later than ninety 30
days after a vacancy occurs. Any member appointed to fill a 31
vacancy occurring prior to the expiration date of the term for 32
which the member's predecessor was appointed shall hold office as 33
a member for the remainder of that term. A member shall continue 34
in office subsequent to the expiration date of the member's term 35
until a successor takes office or until a period of sixty days has 36
elapsed, whichever comes first. 37

       Terms of office shall be two years, with each term ending on 38
the same day of the same month as did the term it succeeds.39

       The members of the commission shall annually elect a 40
chairperson.41

       (C) Members shall receive no compensation, but may be 42
reimbursed for actual and necessary expenses incurred in 43
performance of official duties.44

       (D) Not later than the first day of January of each 45
odd-numbered year, the commission shall submit to the general 46
assembly a written report of its review of the department. 47

       (E) The commission shall cease to exist six years after the 48
effective date of this section.49
