A BILL
To enact section 3721.60 of the Revised Code to 1
require the Department of Job and Family Services 2
to pay a nonprofit nursing home that does not 3
participate in the Medicaid program an annual 4
refund.5


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 3721.60 of the Revised Code be 6
enacted to read as follows:7

       Sec. 3721.60. (A) As used in this section:8

       "Medicaid" has the same meaning as in section 5111.01 of the 9
Revised Code. 10

       "Nonprofit nursing home" means a nursing home licensed under 11
section 3721.02 or 3721.09 of the Revised Code, including any part 12
of a home for the aging licensed as a nursing home, that is exempt 13
from taxation under section 501(c)(3) of the Internal Revenue Code 14
of 1986.15

       "Nursing facility" has the same meaning as in section 5111.20 16
of the Revised Code.17

       "Nursing facility services" means nursing facility services 18
covered by the medicaid program that a nursing facility provides 19
to a resident of the nursing facility who is a medicaid recipient 20
eligible for medicaid-covered nursing facility services.21

       (B) With funds appropriated to the department of job and 22
family services for the medicaid program, the department shall pay 23
each nonprofit nursing home that is not a nursing facility and 24
does not participate in the medicaid program an annual refund 25
equal to the lesser of the following:26

       (1) Six dollars and twenty-five cents multiplied by the 27
product of the following:28

       (a) The nonprofit nursing home's licensed bed capacity as of 29
the last day of the previous year;30

       (b) The number of days in the year for which the refund is to 31
be paid.32

       (2) Fifty per cent of the amount the department would pay the 33
nonprofit nursing home under the medicaid program for services 34
that would be nursing facility services if the nonprofit nursing 35
home was a nursing facility that the nonprofit nursing home 36
provided the previous year to residents of the nonprofit nursing 37
home who are eligible for medicaid and nursing facility services.38

       (C) The director of job and family services shall adopt rules 39
in accordance with Chapter 119. of the Revised Code as necessary 40
to implement this section. The director shall adopt the initial 41
rules not later than December 31, 2007.42
