A BILL
To enact sections 4774.01, 4774.02, 4774.04, 4774.06, 1
4774.08, 4774.10, and 4774.99 of the Revised Code 2
regarding licensure of radiologist assistants.3


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That sections 4774.01, 4774.02, 4774.04, 4774.06, 4
4774.08, 4774.10, and 4774.99 of the Revised Code be enacted to 5
read as follows:6

       Sec. 4774.01.  As used in this chapter:7

       (A) "Radiologist" means an individual holding a current, 8
valid certificate issued under Chapter 4731. of the Revised Code 9
authorizing the practice of medicine and surgery or osteopathic 10
medicine and surgery who specializes in the field of radiology.11

       (B) "Radiology" means the branch of medicine that deals with 12
the use of radioactive substances in diagnosis and treatment of 13
disease.14

       Sec. 4774.02.  (A) No person shall do any of the following 15
without a valid license issued under this chapter:16

       (1) Except as provided in division (B) of this section, 17
perform the radiologic procedures described in division (A) of 18
section 4774.08 of the Revised Code;19

       (2) Hold the person's self out in any manner as a radiologist 20
assistant, including using any sign, advertisement, card, 21
letterhead, circular, or other writing, document, or design, the 22
evident purpose of which is to induce others to believe the person 23
is authorized to practice as a radiologist assistant.24

       (B) Division (A)(1) of this section does not apply to either 25
of the following:26

       (1) An individual engaging in the scope of practice for which 27
the individual holds a valid license or certificate;28

       (2) An individual performing a task as part of an advanced 29
academic program described in division (C) of section 4774.04 of 30
the Revised Code. 31

       Sec. 4774.04.  Each person seeking to practice as a 32
radiologist assistant shall apply in writing to the department of 33
health for a license to practice as a radiologist assistant. The 34
application shall be made on a form prescribed by the department 35
and be accompanied by a license fee established in rules adopted 36
under section 4774.10 of the Revised Code.37

       An applicant under this section must provide evidence 38
satisfactory to the department of all of the following:39

       (A) That the applicant is at least eighteen years of age and 40
of good moral character;41

       (B) That the applicant is licensed as a radiographer under 42
Chapter 4773. of the Revised Code;43

       (C) That the applicant has a baccalaureate degree or 44
postbaccalaureate certificate from an advanced academic program 45
that encompasses a nationally recognized radiologist assistant 46
curriculum that includes a radiologist-directed clinical 47
preceptorship;48

       (D) That the applicant is certified in advanced cardiac life 49
support;50

       (E) That the applicant satisfies any other requirements 51
established by the public health council in rules adopted under 52
section 4774.10 of the Revised Code.53

       Sec. 4774.06.  The department of health shall issue a license 54
to practice as a radiologist assistant to each applicant who meets 55
the qualifications for licensure established in section 4774.04 of 56
the Revised Code and pays the license fee established in rules 57
adopted under section 4774.10 of the Revised Code.58

       A license issued under this section is valid for the length 59
of time specified in rules adopted under section 4774.10 of the 60
Revised Code.61

       The department may renew a license issued under this section 62
and impose continuing education requirements in accordance with 63
rules adopted under section 4774.10 of the Revised Code.64

       Sec. 4774.08.  (A) Each person holding a valid license to 65
practice as a radiologist assistant may do the following under the 66
direct supervision of a radiologist:67

       (1) Perform fluoroscopic procedures;68

       (2) Assess and evaluate the physiologic and psychological 69
responsiveness of patients undergoing radiologic procedures;70

       (3) Evaluate image quality, make initial image observations, 71
and communicate observations to the supervising radiologist;72

       (4) Administer contrast media or other medications prescribed 73
by the supervising radiologist;74

       (5) Perform any other procedures consistent with guidelines 75
adopted by the American college of radiology, the American society 76
of radiologic technologists, and the American registry of 77
radiologic technologists.78

       (B) A person licensed to practice as a radiologist assistant 79
shall not interpret images, make diagnoses, or prescribe 80
medications or therapies. 81

       (C) A radiologist supervising a radiologist assistant may 82
authorize the assistant to perform only those radiologic 83
procedures described in division (A) of this section and shall be 84
present at the location where the assistant performs the 85
radiologic procedures, consult with the assistant, and direct the 86
assistant's performance of the radiologic procedures. The 87
radiologist is not required to observe each radiologic procedure 88
the assistant performs.89

       Sec. 4774.10.  The public health council shall adopt rules in 90
accordance with Chapter 119. of the Revised Code to implement and 91
administer this chapter. The rules shall be consistent with 92
guidelines adopted by the American college of radiology, the 93
American society of radiologic technologists, and the American 94
registry of radiologic technologists, where applicable, and shall 95
establish all of the following:96

       (A) Standards and fees for issuing and renewing licenses 97
under section 4774.06 of the Revised Code, including the length of 98
time a license is valid;99

       (B) Procedures and grounds for denying applications for 100
licensure;101

       (C) Procedures and grounds for revoking or suspending 102
licenses or taking other disciplinary action against a licensee;103

       (D) Continuing education requirements for persons licensed 104
under this chapter;105

       (E) Any other requirements the council considers appropriate 106
to implement this chapter.107

       Sec. 4774.99.  Whoever violates section 4774.02 of the 108
Revised Code is guilty of a misdemeanor of the first degree on a 109
first offense and felony of the fifth degree on each subsequent 110
offense.111
