A BILL
To amend section 4501.21 and to enact section 1
4503.553 of the Revised Code to establish "Ohio's 2
Horse" license plates and to provide that money 3
from the contributions for the license plates be 4
paid to the Ohio Coalition for Animals, 5
Incorporated.6


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 4501.21 be amended and section 7
4503.553 of the Revised Code be enacted to read as follows:8

       Sec. 4501.21.  (A) There is hereby created in the state 9
treasury the license plate contribution fund. The fund shall 10
consist of all contributions paid by motor vehicle registrants and 11
collected by the registrar of motor vehicles pursuant to sections 12
4503.491, 4503.493, 4503.50, 4503.501, 4503.502, 4503.51, 13
4503.522, 4503.545, 4503.55, 4503.551, 4503.552, 4503.553,14
4503.561, 4503.562, 4503.591, 4503.67, 4503.68, 4503.69, 4503.71, 15
4503.711, 4503.72, 4503.73, 4503.74, 4503.75, and 4503.85 of the 16
Revised Code.17

       (B) The registrar shall pay the contributions the registrar 18
collects in the fund as follows:19

       (1) The registrar shall pay the contributions received 20
pursuant to section 4503.491 of the Revised Code to the breast 21
cancer fund of Ohio, which shall use that money only to pay for 22
programs that provide assistance and education to Ohio breast 23
cancer patients and that improve access for such patients to 24
quality health care and clinical trials and shall not use any of 25
the money for abortion information, counseling, services, or other 26
abortion-related activities.27

       (2) The registrar shall pay the contributions received 28
pursuant to section 4503.493 of the Revised Code to the autism 29
society of Ohio, which shall use the contributions for programs 30
and autism awareness efforts throughout the state.31

       (3) The registrar shall pay the contributions the registrar 32
receives pursuant to section 4503.50 of the Revised Code to the 33
future farmers of America foundation, which shall deposit the 34
contributions into its general account to be used for educational 35
and scholarship purposes of the future farmers of America 36
foundation.37

       (4) The registrar shall pay the contributions the registrar 38
receives pursuant to section 4503.501 of the Revised Code to the 39
4-H youth development program of the Ohio state university 40
extension program, which shall use those contributions to pay the 41
expenses it incurs in conducting its educational activities.42

       (5) The registrar shall pay the contributions received 43
pursuant to section 4503.502 of the Revised Code to the Ohio 44
cattlemen's foundation, which shall use those contributions for 45
scholarships and other educational activities.46

       (6) The registrar shall pay each contribution the registrar 47
receives pursuant to section 4503.51 of the Revised Code to the 48
university or college whose name or marking or design appears on 49
collegiate license plates that are issued to a person under that 50
section. A university or college that receives contributions from 51
the fund shall deposit the contributions into its general 52
scholarship fund.53

       (7) The registrar shall pay the contributions the registrar 54
receives pursuant to section 4503.522 of the Revised Code to the 55
"friends of Perry's victory and international peace memorial, 56
incorporated," a nonprofit corporation organized under the laws of 57
this state, to assist that organization in paying the expenses it 58
incurs in sponsoring or holding charitable, educational, and 59
cultural events at the monument.60

       (8) The registrar shall pay the contributions the registrar 61
receives pursuant to section 4503.55 of the Revised Code to the 62
pro football hall of fame, which shall deposit the contributions 63
into a special bank account that it establishes and which shall be 64
separate and distinct from any other account the pro football hall 65
of fame maintains, to be used exclusively for the purpose of 66
promoting the pro football hall of fame as a travel destination.67

       (9) The registrar shall pay the contributions that are paid 68
to the registrar pursuant to section 4503.545 of the Revised Code 69
to the national rifle association foundation, which shall use the 70
money to pay the costs of the educational activities and programs 71
the foundation holds or sponsors in this state.72

       (10) In accordance with section 955.202 of the Revised Code, 73
the registrar shall pay to the pets program funding board created 74
by that section the contributions the registrar receives pursuant 75
to section 4503.551 of the Revised Code and any other money from 76
any other source, including donations, gifts, and grants, that is 77
designated by the source to be paid to the pets program funding 78
board. The board shall use the moneys it receives under this 79
section only to support programs for the sterilization of dogs and 80
cats and for educational programs concerning the proper veterinary 81
care of those animals.82

       (11) The registrar shall pay the contributions the registrar 83
receives pursuant to section 4503.552 of the Revised Code to the 84
rock and roll hall of fame and museum, incorporated.85

       (12) The registrar shall pay the contributions the registrar 86
receives pursuant to section 4503.553 of the Revised Code to the 87
Ohio coalition for animals, incorporated, a nonprofit corporation. 88
Except as provided in division (B)(12) of this section, the coalition shall distribute the money to its members, and the members shall use the money only to pay for educational, charitable, and 89
other programs of each coalition member that provide care for unwanted, abused, and 90
neglected horses. The Ohio coalition for animals may use a portion of the 91
money to pay for reasonable marketing costs incurred in the design and 92
promotion of the license plate and for administrative costs 93
incurred in the disbursement and management of funds received 94
under this section.95

       (13) The registrar shall pay the contributions the registrar 96
receives pursuant to section 4503.561 of the Revised Code to the 97
state of Ohio chapter of ducks unlimited, inc., which shall 98
deposit the contributions into a special bank account that it 99
establishes. The special bank account shall be separate and 100
distinct from any other account the state of Ohio chapter of ducks 101
unlimited, inc., maintains and shall be used exclusively for the 102
purpose of protecting, enhancing, restoring, and managing wetlands 103
and conserving wildlife habitat. The state of Ohio chapter of 104
ducks unlimited, inc., annually shall notify the registrar in 105
writing of the name, address, and account to which such payments 106
are to be made under division (B)(12) of this section.107

       (13)(14) The registrar shall pay the contributions the 108
registrar receives pursuant to section 4503.562 of the Revised 109
Code to the Mahoning river consortium, which shall use the money 110
to pay the expenses it incurs in restoring and maintaining the 111
Mahoning river watershed.112

       (14)(15)(a) The registrar shall pay to a sports commission 113
created pursuant to section 4503.591 of the Revised Code each 114
contribution the registrar receives under that section that an 115
applicant pays to obtain license plates that bear the logo of a 116
professional sports team located in the county of that sports 117
commission and that is participating in the license plate program 118
pursuant to division (E) of that section, irrespective of the 119
county of residence of an applicant.120

       (b) The registrar shall pay to a community charity each 121
contribution the registrar receives under section 4503.591 of the 122
Revised Code that an applicant pays to obtain license plates that 123
bear the logo of a professional sports team that is participating 124
in the license plate program pursuant to division (G) of that 125
section.126

       (15)(16) The registrar shall pay the contributions the 127
registrar receives pursuant to section 4503.67 of the Revised Code 128
to the Dan Beard council of the boy scouts of America. The council 129
shall distribute all contributions in an equitable manner 130
throughout the state to regional councils of the boy scouts.131

       (16)(17) The registrar shall pay the contributions the 132
registrar receives pursuant to section 4503.68 of the Revised Code 133
to the great river council of the girl scouts of the United States 134
of America. The council shall distribute all contributions in an 135
equitable manner throughout the state to regional councils of the 136
girl scouts.137

       (17)(18) The registrar shall pay the contributions the 138
registrar receives pursuant to section 4503.69 of the Revised Code 139
to the Dan Beard council of the boy scouts of America. The council 140
shall distribute all contributions in an equitable manner 141
throughout the state to regional councils of the boy scouts.142

       (18)(19) The registrar shall pay the contributions the 143
registrar receives pursuant to section 4503.71 of the Revised Code 144
to the fraternal order of police of Ohio, incorporated, which 145
shall deposit the fees into its general account to be used for 146
purposes of the fraternal order of police of Ohio, incorporated.147

       (19)(20) The registrar shall pay the contributions the 148
registrar receives pursuant to section 4503.711 of the Revised 149
Code to the fraternal order of police of Ohio, incorporated, which 150
shall deposit the contributions into an account that it creates to 151
be used for the purpose of advancing and protecting the law 152
enforcement profession, promoting improved law enforcement 153
methods, and teaching respect for law and order.154

       (20)(21) The registrar shall pay the contributions the 155
registrar receives pursuant to section 4503.72 of the Revised Code 156
to the organization known on March 31, 2003, as the Ohio CASA/GAL 157
association, a private, nonprofit corporation organized under 158
Chapter 1702. of the Revised Code. The Ohio CASA/GAL association 159
shall use these contributions to pay the expenses it incurs in 160
administering a program to secure the proper representation in the 161
courts of this state of abused, neglected, and dependent children, 162
and for the training and supervision of persons participating in 163
that program.164

       (21)(22) The registrar shall pay the contributions the 165
registrar receives pursuant to section 4503.73 of the Revised Code 166
to Wright B. Flyer, incorporated, which shall deposit the 167
contributions into its general account to be used for purposes of 168
Wright B. Flyer, incorporated.169

       (22)(23) The registrar shall pay the contributions the 170
registrar receives pursuant to section 4503.74 of the Revised Code 171
to the Columbus zoological park association, which shall disburse 172
the moneys to Ohio's major metropolitan zoos, as defined in 173
section 4503.74 of the Revised Code, in accordance with a written 174
agreement entered into by the major metropolitan zoos.175

       (23)(24) The registrar shall pay the contributions the 176
registrar receives pursuant to section 4503.75 of the Revised Code 177
to the rotary foundation, located on March 31, 2003, in Evanston, 178
Illinois, to be placed in a fund known as the permanent fund and 179
used to endow educational and humanitarian programs of the rotary 180
foundation.181

       (24)(25) The registrar shall pay the contributions the 182
registrar receives pursuant to section 4503.85 of the Revised Code 183
to the Ohio sea grant college program to be used for Lake Erie 184
area research projects.185

       (C) All investment earnings of the license plate contribution 186
fund shall be credited to the fund. Not later than the first day 187
of May of every year, the registrar shall distribute to each 188
entity described in divisionsdivision (B)(1) to (24) of this 189
section the investment income the fund earned the previous 190
calendar year. The amount of such a distribution paid to an entity 191
shall be proportionate to the amount of money the entity received 192
from the fund during the previous calendar year.193

       Sec. 4503.553. (A) The owner or lessee of any passenger car, 194
noncommercial motor vehicle, recreational vehicle, or other 195
vehicle of a class approved by the registrar of motor vehicles may 196
apply to the registrar for the registration of the vehicle and 197
issuance of Ohio's horse license plates. An application made under 198
this section may be combined with a request for a special reserved 199
license plate under section 4503.40 or 4503.42 of the Revised 200
Code. Upon receipt of the completed application and compliance by 201
the applicant with divisions (B) and (C) of this section, the 202
registrar shall issue to the applicant the appropriate vehicle 203
registration and a set of Ohio's horse license plates and a 204
validation sticker, or a validation sticker alone when required by 205
section 4503.191 of the Revised Code.206

       In addition to the letters and numbers ordinarily inscribed 207
on the license plates, Ohio's horse license plates shall be 208
inscribed with identifying words or markings that are designed by 209
the Ohio coalition for animals, incorporated and approved by the 210
registrar. Ohio's horse license plates shall display county 211
identification stickers that identify the county of registration 212
by name or number.213

       (B) The Ohio's horse license plates and a validation sticker, 214
or validation sticker alone, shall be issued upon receipt of a 215
contribution as provided in division (C)(1) of this section and 216
upon payment of the regular license tax as prescribed under 217
section 4503.04 of the Revised Code, any applicable motor vehicle 218
license tax levied under Chapter 4504. of the Revised Code, any 219
applicable additional fee prescribed by section 4503.40 or 4503.42 220
of the Revised Code, a fee of ten dollars for the purpose of 221
compensating the bureau of motor vehicles for additional services 222
required in the issuing of Ohio's horse license plates, and 223
compliance with all other applicable laws relating to the 224
registration of motor vehicles.225

       (C)(1) For each application for registration and registration 226
renewal notice the registrar receives under this section, the 227
registrar shall collect a contribution in an amount not to exceed 228
forty dollars, as determined by the Ohio coalition for animals, 229
incorporated. The registrar shall deposit this contribution into 230
the state treasury to the credit of the license plate contribution 231
fund created in section 4501.21 of the Revised Code.232

       (2) The registrar shall deposit the additional fee of ten 233
dollars paid to compensate the bureau for the additional services 234
required in the issuing of Ohio's horse license plates into the 235
state treasury to the credit of the state bureau of motor vehicles 236
fund created by section 4501.25 of the Revised Code.237

       Section 2. That existing section 4501.21 of the Revised Code 238
is hereby repealed.239

       Section 3.  Section 4501.21 of the Revised Code is presented 240
in this act as a composite of the section as amended by both Am. 241
Sub. H.B. 68 and Sub. H.B. 298 of the 126th General Assembly. The 242
General Assembly, applying the principle stated in division (B) of 243
section 1.52 of the Revised Code that amendments are to be 244
harmonized if reasonably capable of simultaneous operation, finds 245
that the composite is the resulting version of the section in 246
effect prior to the effective date of the section as presented in 247
this act.248
