A BILL

To amend section 5511.09 of the Revised Code to 1
permit local jurisdictions to request the Director 2
of Transportation to designate a name for a bridge 3
that is part of the highway system. 4

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 5511.09 of the Revised Code be 5
amended to read as follows: 6

       Sec. 5511.09. Within a county, any highway or bridge that is 7
part of the state highway system may be officially assigned a 8
distinctive name, commemorative of an historical event or 9
personage or a commonly accepted and appropriate name, by which 10
the highway or bridge is known. Upon agreement of the governing 11
bodies of the county and each township and municipal corporation 12
within the county through which the highway extends or in which 13
the bridge is located, a request for approval of the highway or 14
bridge name may be submitted to the director of transportation. 15
The agreement shall be indicated by a resolution from each 16
governing body in support of the proposed highway or bridge name. 17
The resolution may not be withdrawn, amended, or repealed for 18
thirty days following receipt of the resolution by the requesting 19
authority, or during the time the request is pending before the 20
director. 21

       Within thirty days after receipt of such a request, the 22
director shall inform the requesting authority of ~~his~~the 23
director's decision. If the director approves the request, the 24
requesting authority ~~may~~, at its own expense, may erect markers 25
indicating the name of the highway or bridge within the county, 26
provided that any marker so erected shall conform to the law of 27
this state and to federal law and shall be in accordance with the 28
directives for the signing of named memorial highways included in 29
the manual adopted by the department of transportation under 30
section 4511.09 of the Revised Code. 31

       Only one name per county shall be assigned to a highway or a 32
bridge under this section, and the name shall apply to the entire 33
extension of the highway or the entire portion of the bridge 34
within the county. A name assigned to a state highway or part 35
thereof or a bridge under this section may be altered or 36
abolished, pursuant to approval of the director, in the same 37
manner as provided for assignment of the original name. 38

       This section shall not in any way modify, limit, or restrict 39
the authority of a municipal corporation to designate within the 40
municipal corporation, the name of a highway or a bridge that is 41
part of the state highway system. If a municipal corporation has 42
acted pursuant to its authority and designated the name of a 43
highway or bridge within the municipal corporation, no other name 44
may be assigned to that highway or bridge under this section. 45

       Section 2. That existing section 5511.09 of the Revised Code 46
is hereby repealed. 47
