A BILL
To amend sections 5511.09 and 5589.081 of the Revised 1
Code to permit local jurisdictions to request the 2
Director of Transportation to designate a name 3
for a bridge that is part of the highway system 4
and to allow the use of retractable studded snow 5
tires any time of year so long as the studs are 6
not extended during prohibited times.7


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That sections 5511.09 and 5589.081 of the Revised 8
Code be amended to read as follows:9

       Sec. 5511.09.  Within a county, any highway or bridge that is 10
part of the state highway system may be officially assigned a 11
distinctive name, commemorative of an historical event or 12
personage or a commonly accepted and appropriate name, by which 13
the highway or bridge is known. Upon agreement of the governing 14
bodies of the county and each township and municipal corporation 15
within the county through which the highway extends or in which 16
the bridge is located, a request for approval of the highway or 17
bridge name may be submitted to the director of transportation. 18
The agreement shall be indicated by a resolution from each 19
governing body in support of the proposed highway or bridge name. 20
The resolution may not be withdrawn, amended, or repealed for 21
thirty days following receipt of the resolution by the requesting 22
authority, or during the time the request is pending before the 23
director.24

       Within thirty days after receipt of such a request, the25
director shall inform the requesting authority of histhe26
director's decision. If the director approves the request, the 27
requesting authority may, at its own expense, may erect markers 28
indicating the name of the highway or bridge within the county, 29
provided that any marker so erected shall conform to the law of 30
this state and to federal law and shall be in accordance with the 31
directives for the signing of named memorial highways included in 32
the manual adopted by the department of transportation under 33
section 4511.09 of the Revised Code.34

       Only one name per county shall be assigned to a highway or a 35
bridge under this section, and the name shall apply to the entire36
extension of the highway or the entire portion of the bridge37
within the county. A name assigned to a state highway or part 38
thereof or a bridge under this section may be altered or 39
abolished, pursuant to approval of the director, in the same40
manner as provided for assignment of the original name.41

       This section shall not in any way modify, limit, or restrict 42
the authority of a municipal corporation to designate within the 43
municipal corporation, the name of a highway or a bridge that is44
part of the state highway system. If a municipal corporation has45
acted pursuant to its authority and designated the name of a46
highway or bridge within the municipal corporation, no other name 47
may be assigned to that highway or bridge under this section.48

       Sec. 5589.081.  (A) For purposes of this section, "studded49
tire" means any tire designed for use on a vehicle and equipped50
with metal studs or studs of wear-resisting material that project51
beyond the tread of the traction surface of the tire; and "motor52
vehicle," "street or highway," "public safety vehicle," and53
"school bus" have the same meaningmeanings as given those terms 54
in section 4511.01 of the Revised Code.55

       (B) No(1) Except as provided in division (B)(2) of this 56
section, no person shall operate any motor vehicle, other than a 57
public safety vehicle or school bus, that is equipped with studded 58
tires on any street or highway in this state, except during the 59
period extending from the first day of November of each year 60
through the fifteenth day of April of the succeeding year.61

       (2) A person may operate a motor vehicle that is equipped 62
with retractable studded tires with the studs retracted at any 63
time of the year, but shall operate the motor vehicle with the 64
studs extended only as provided in division (B)(1) of this 65
section.66

       (C) This section does not apply to the use of tire chains67
when there is snow or ice on the streets or highways where such68
chains are being used, or the immediate vicinity thereof.69

       Section 2. That existing sections 5511.09 and 5589.081 of the 70
Revised Code are hereby repealed.71
