A BILL
To amend section 4507.23 of the Revised Code to allow 1
any active-duty member of the United States armed 2
forces to obtain a free duplicate driver's license 3
following a service-related injury.4


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 4507.23 of the Revised Code be 5
amended to read as follows:6

       Sec. 4507.23.  (A) Except as provided in division (I) of this 7
section, each application for a temporary instruction permit and 8
examination shall be accompanied by a fee of five dollars.9

       (B) Except as provided in division (I) of this section, each10
application for a driver's license made by a person who previously11
held such a license and whose license has expired not more than12
two years prior to the date of application, and who is required13
under this chapter to give an actual demonstration of the person's14
ability to drive, shall be accompanied by a fee of three dollars15
in addition to any other fees.16

       (C) Except as provided in divisions (E) and (I) of this17
section, each application for a driver's license, or motorcycle18
operator's endorsement, or renewal of a driver's license shall be19
accompanied by a fee of six dollars. Except as provided in20
division (I) of this section, each application for a duplicate21
driver's license shall be accompanied by a fee of two dollars and22
fifty cents. The duplicate driver's licenses issued under this23
section shall be distributed by the deputy registrar in accordance24
with rules adopted by the registrar of motor vehicles.25

       (D) Except as provided in division (I) of this section, each26
application for a motorized bicycle license or duplicate thereof27
shall be accompanied by a fee of two dollars and fifty cents.28

       (E) Except as provided in division (I) of this section, each29
application for a driver's license or renewal of a driver's30
license that will be issued to a person who is less than31
twenty-one years of age shall be accompanied by whichever of the32
following fees is applicable:33

       (1) If the person is sixteen years of age or older, but less34
than seventeen years of age, a fee of seven dollars and35
twenty-five cents;36

       (2) If the person is seventeen years of age or older, but37
less than eighteen years of age, a fee of six dollars;38

       (3) If the person is eighteen years of age or older, but less 39
than nineteen years of age, a fee of four dollars and seventy-five 40
cents;41

       (4) If the person is nineteen years of age or older, but less 42
than twenty years of age, a fee of three dollars and fifty cents;43

       (5) If the person is twenty years of age or older, but less44
than twenty-one years of age, a fee of two dollars and twenty-five45
cents.46

       (F) Neither the registrar nor any deputy registrar shall47
charge a fee in excess of one dollar and fifty cents for48
laminating a driver's license, motorized bicycle license, or49
temporary instruction permit identification cards as required by50
sections 4507.13 and 4511.521 of the Revised Code. A deputy51
registrar laminating a driver's license, motorized bicycle52
license, or temporary instruction permit identification cards53
shall retain the entire amount of the fee charged for lamination,54
less the actual cost to the registrar of the laminating materials55
used for that lamination, as specified in the contract executed by56
the bureau for the laminating materials and laminating equipment.57
The deputy registrar shall forward the amount of the cost of the58
laminating materials to the registrar for deposit as provided in59
this section.60

       (G) Except as provided in division (I) of this section and 61
except for the renewal of a driver's license, commencing on 62
October 1, 2003, each transaction described in divisions (A), (B), 63
(C), (D), and (E) of this section shall be accompanied by an 64
additional fee of twelve dollars. A transaction involving the 65
renewal of a driver's license with an expiration date on or after 66
that date shall be accompanied by an additional fee of twelve 67
dollars. The additional fee is for the purpose of defraying the 68
department of public safety's costs associated with the 69
administration and enforcement of the motor vehicle and traffic 70
laws of Ohio.71

       (H) At the time and in the manner provided by section 4503.10 72
of the Revised Code, the deputy registrar shall transmit the fees 73
collected under divisions (A), (B), (C), (D), and (E), those 74
portions of the fees specified in and collected under division 75
(F), and the additional fee under division (G) of this section to 76
the registrar. The registrar shall pay two dollars and fifty cents 77
of each fee collected under divisions (A), (B), (C), (D), and 78
(E)(1) to (4) of this section, and the entire fee collected under 79
division (E)(5) of this section, into the state highway safety 80
fund established in section 4501.06 of the Revised Code, and such 81
fees shall be used for the sole purpose of supporting driver 82
licensing activities. The registrar also shall pay the entire fee 83
collected under division (G) of this section into the state 84
highway safety fund created in section 4501.06 of the Revised 85
Code. The remaining fees collected by the registrar under this 86
section shall be paid into the state bureau of motor vehicles fund 87
established in section 4501.25 of the Revised Code.88

       (I)(1)(a) A disabled veteran who has a service-connected89
disability rated at one hundred per cent by the veterans'90
administration may apply to the registrar or a deputy registrar91
for the issuance to that veteran, without the payment of any fee92
prescribed in this section, of any of the following items:93

       (1)(i) A temporary instruction permit and examination;94

       (2)(ii) A new, renewal, or duplicate driver's or commercial95
driver's license;96

       (3)(iii) A motorcycle operator's endorsement;97

       (4)(iv) A motorized bicycle license or duplicate thereof;98

       (5)(v) Lamination of a driver's license, motorized bicycle99
license, or temporary instruction permit identification card as100
provided in division (F) of this section, if the circumstances101
specified in division (I)(5) of this section are met.102

       (b) If the driver's license, motorized bicycle license, or103
temporary instruction permit identification card of a disabled104
veteran described in division (I) of this section is laminated by105
a deputy registrar who is acting as a deputy registrar pursuant to106
a contract with the registrar that is in effect on October 14,107
1997, the disabled veteran shall be required to pay the deputy108
registrar the lamination fee provided in division (F) of this109
section. If the driver's license, motorized bicycle license, or110
temporary instruction permit identification card of such a111
disabled veteran is laminated by a deputy registrar who is acting112
as a deputy registrar pursuant to a contract with the registrar113
that is executed after October 14, 1997, the disabled veteran is114
not required to pay the deputy registrar the lamination fee115
provided in division (F) of this section.116

       A disabled veteran whose driver's license, motorized bicycle117
license, or temporary instruction permit identification card is118
laminated by the registrar is not required to pay the registrar119
any lamination fee.120

       (2) Following a service-related injury, any active-duty 121
member of the armed forces of the United States, including the 122
reserve components of the armed forces and the national guard, may 123
apply to the registrar or a deputy registrar for a duplicate 124
driver's or commercial driver's license without payment of any fee 125
prescribed in this section.126

        (3) An application made under division (I) of this section 127
shall be accompanied by such documentary evidence of disability, 128
injury, or active-duty status as the registrar may require by 129
rule, provided that evidence of a service-related injury for an 130
active-duty member of the armed forces may be established by any 131
relevant document from department of defense medical personnel.132

       Section 2. That existing section 4507.23 of the Revised Code 133
is hereby repealed.134
