A BILL
To enact sections 1751.69, 3923.90, and 5111.026 of 1
the Revised Code to require certain health care 2
insurers and plans, including the state's 3
Medicaid program, to offer to provide benefits 4
for prostate, colorectal, cervical, and ovarian 5
cancer screening examinations.6


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1.  That sections 1751.69, 3923.90, and 5111.026 of 7
the Revised Code be enacted to read as follows:8

       Sec. 1751.69.  (A) Notwithstanding section 3901.71 of the 9
Revised Code, each health insuring corporation providing insurance 10
for basic health care services in this state shall offer to 11
provide as a supplemental health care service benefits to its 12
subscribers for the expenses of examinations and laboratory tests 13
for the following:14

       (1) Prostate cancer;15

       (2) Colorectal cancer;16

       (3) Ovarian cancer;17

       (4) Cervical cancer.18

       (B) If a health insuring corporation provides benefits under 19
division (A) of this section, the benefits shall be provided:20

       (1) To any nonsymptomatic individual for whom the most 21
recently published American cancer society guidelines recommend 22
screening based on age, health, and other risk factors; 23

       (2) For examinations and laboratory tests that are 24
recommended by, and performed in accordance with, the most 25
recently published American cancer society guidelines;26

       (3) Subject to the same terms and conditions, including 27
copayment charges, that apply to similar benefits provided under 28
the policy, contract, or agreement. 29

       Sec. 3923.90. (A) Notwithstanding section 3901.71 of the 30
Revised Code, each insurance company authorized to do the business 31
of sickness and accident insurance in this state and each public 32
employee benefit plan that is established or modified in this 33
state shall offer to provide benefits for the expenses of 34
examinations and laboratory tests for the following:35

       (1) Prostate cancer;36

       (2) Colorectal cancer;37

       (3) Ovarian cancer;38

       (4) Cervical cancer.39

       (B) If an insurance company authorized to do the business of 40
sickness and accident insurance in this state or public employee 41
benefit plan provides benefits under division (A) of this 42
section, the benefits shall be provided:43

       (1) To any nonsymptomatic individual for whom the most 44
recently published American cancer society guidelines recommend 45
screening based on age, health, and other risk factors; 46

       (2) For examinations and laboratory tests that are 47
recommended by, and performed in accordance with, the most 48
recently published American cancer society guidelines;49

       (3) Subject to the same terms and conditions, including 50
copayment charges, that apply to similar benefits provided under 51
the policy or plan.52

       (C) This section does not apply to any policy that provides 53
coverage for specific diseases or accidents only, or to any 54
hospital indemnity, medicare supplement, or other policy that 55
offers supplemental benefits.56

       Sec. 5111.026.  (A) The provision of medical assistance under 57
this chapter shall include an offer of coverage of expenses for 58
examinations and laboratory tests for the following:59

       (1) Prostate cancer;60

       (2) Colorectal cancer;61

       (3) Ovarian cancer;62

       (4) Cervical cancer.63

       (B) If the medical assistance program provides benefits under 64
division (A) of this section, the benefits shall be provided:65

       (1) To any nonsymptomatic individual for whom the most 66
recently published American cancer society guidelines recommend 67
screening based on age, health, and other risk factors; 68

       (2) For examinations and laboratory tests that are 69
recommended by, and performed in accordance with, the most 70
recently published American cancer society guidelines;71

       (3) Subject to the same terms and conditions, including 72
copayment charges, that apply to similar benefits provided under 73
the policy, contract, or agreement.74

       Section 2. Section 1751.69 of the Revised Code, as enacted by 75
this act, shall apply only to policies, contracts, and agreements 76
that are delivered, issued for delivery, or renewed in this state 77
on or after the effective date of this act. Section 3923.90 of the 78
Revised Code, as enacted by this act, shall apply to policies of 79
sickness and accident insurance on or after the effective date of 80
this act in accordance with section 3923.01 of the Revised Code 81
and to public employee benefit plans that are established or 82
modified in this state on or after the effective date of this act.83
